Par līgumu stāšanos spēkā

Ārlietu ministrija informē, ka:

1) 2016.gada 31.oktobrī stājās spēkā Latvijas Republikas valdības un Eiropas Kodolpētījumu organizācijas (CERN) līgums par zinātnisko un tehnisko sadarbību augstas enerģijas daļiņu fizikā (parakstīts Ženēvā 2016.gada 31.oktobrī, apstiprināts ar 2016.gada 27.septembra Ministru kabineta noteikumiem Nr.639);

2) 2017.gada 1.martā stāsies spēkā Latvijas Republikas valdības un Kipras Republikas valdības līgums par savstarpēju klasificētās informācijas aizsardzību (parakstīts Luksemburgā 2015.gada 22.jūnijā, apstiprināts ar 2014.gada 9.jūnija Ministru kabineta noteikumiem Nr.284).

par zinātnisko un tehnisko sadarbību augstas enerģijas daļiņu fizikā

Latvijas Republikas valdība (turpmāk tekstā – "LRV"),

no vienas puses,

un

Eiropas Kodolpētījumu organizācija (turpmāk tekstā – "CERN"), starpvaldību organizācija ar sēdekli Ženēvā, Šveicē,

no otras puses,

turpmāk kopā saukti "Puses"

ŅEMOT VĒRĀ:

zinātnisko pētījumu augstas enerģijas daļiņu fizikā lielo nozīmi turpmākajā fundamentālās zinātnes un tehnoloģiskā progresa attīstībā;

CERN nolūku stiprināt sadarbību ar valstīm, kuras nav CERN dalībvalstis, bet ar kurām ir izveidota sadarbība;

LRV interesi piedalīties CERN zinātniskajā programmā;

nodibinātos kontaktus starp CERN un LRV;

abpusējos ieguvumus, kurus Puses sagaida no sadarbības;

Pušu vēlmi radīt ietvaru, kas nodrošinātu Latvijas Republikas pētniekiem, zinātniekiem, inženieriem un zinātnes tehniskajam personālam iespējas ilgtermiņā piedalīties CERN pētniecības projektos, kā arī attiektos uz cita veida ieguldījumu, par kuru Puses vienojušās;

IR VIENOJUŠĀS PAR TURPMĀKO.

1. PANTS
Apjoms

1.1. Šis sadarbības līgums (turpmāk tekstā – "Līgums") izveido ietvaru, kurā Puses turpmāk uz savstarpīguma principa pamata attīsta savu zinātnisko sadarbību (šis tekstā lietotais jēdziens ietver arī jebkuru tehnisko sadarbību).

1.2. Puses savas sadarbības rezultātus izmanto tikai nemilitāriem mērķiem.

2. PANTS
Sadarbības veidi

Saskaņā ar Līguma 4.pantu LRV atbalsta tādus CERN pētniecības projektus, kuros Latvijas Republikas zinātniskajiem institūtiem un augstākās izglītības institūcijām ir īpaša kompetence, tostarp eksperimentālās un teorētiskās fizikas jomā, elementārdaļiņu paātrinājuma un sadursmju detekcijas inženierijā un skaitļošanā. Sadarbība īstenojas kā atbalsts tādos veidos kā cilvēkspēja, zinātība, iekārtas, materiāli, finansējums vai šo atbalsta veidu kombinācija.

3. PANTS
Atbalsts cilvēkspējai

3.1. Ja ir paredzēts atbalsts cilvēkspējai, CERN izskata Latvijas Republikas pētnieku, zinātnieku, inženieru un pētniecības tehniskā personāla iesniegumus, lai veiktu atlasi un norīkotu darbā par CERN personālā sastāva asociēto darbinieku. CERN var lemt par šo darbinieku uzturēšanās izmaksu segšanu CERN organizācijā.

3.2. Latvijas Republikas pētnieki, zinātnieki, inženieri un izglītojamie, kuri atbilst pieteikšanās kritērijiem, var pieteikties apmeklēt CERN skolas, tostarp Paātrinātāja skolu, Skaitļošanas skolu, Eiropas Fizikas skolu un CERN Vasaras programmu izglītojamajiem.

3.3. CERN izskata visus pieteikumus, ņemot vērā kandidātu nopelnus.

4. PANTS
Izpilde

4.1. Līguma izpilde ir atkarīga no Protokolu parakstīšanas starp CERN un LVR un/vai Latvijas Republikas zinātniskajiem institūtiem un augstākās izglītības iestādēm, katram pētniecības projektam sīki norādot sadarbību starp pusēm, kuras paraksta Protokolu, nosaucot mērķus, programmu, resursus, personālu, kā arī intelektuālā īpašuma, atbildības un citus jautājumus. Katram Protokolam var tikt pievienoti detalizēti papildinājumi.

4.2. Protokolos tiek ievēroti Līguma noteikumi

5. PANTS
Strīdi

5.1. Jebkuru strīdu par šī līguma interpretāciju vai piemērošanu Puses risina konsultāciju ceļā.

5.2. Strīdi, kurus nevar atrisināt konsultāciju veidā, nododami, pēc vienas Puses pieteikuma, šķīrējtiesā. Ja Puses nav vienojušās par citu strīdu izskatīšanas kārtību, šķīrējtiesā piedalās trīs tiesneši, proti, šķīrējtiesnesis, kuru izvēlas CERN ģenerāldirektors vai persona, kura rīkojas viņa vai viņas vietā, šķīrējtiesnesis, kuru izvēlas LRV, un trešais šķīrējtiesnesis, kuru kopīgi izvēlas abi Pušu izvēlētie šķīrējtiesneši un kurš nedrīkst būt ne CERN amatpersona, ne Latvijas Republikas pilsonis un kurš ir šķīrētiesas priekšsēdētājs.

5.3. Pieteikumā ir jānorāda pieteicēja izvēlētais šķīrējtiesnesis; atbildētājs ieceļ otru šķīrētiesnesi un informē otru Pusi par viņa vārdu un uzvārdu divu mēnešu laikā no pieteikuma saņemšanas. Ja atbildētājs neinformē par otrā šķīrējtiesneša vārdu un uzvārdu divu mēnešu periodā vai ja divi izvēlētie šķīrējtiesneši nevienojas par trešo šķīrējtiesnesi divu mēnešu laikā pēc otrā šķīrējtiesneša iecelšanas, otro vai trešo šķīrējtiesnesi, atkarībā no situācijas, izvēlas Starptautiskā Justīcijas tiesa pēc tās Puses pieprasījuma, kura pirmā vēršas tiesā.

5.4. Šķīrējtiesa nosaka savu lietas izskatīšanas procedūru. Tās lēmumi ir Pusēm saistoši un nav pārsūdzami.

6. PANTS
Spēkā stāšanās un darbības ilgums

6.1. Līgums stājas spēkā, kad to parakstījušas abas Puses, ar noteikumu, ka, ja Līgums kādai no Pusēm pēc tam vēl ir jāapstiprina vai jāratificē, tad tas stājas spēkā dienā, kad Puse, kurai nepieciešams Līguma apstiprinājums vai ratifikācija, ir iesniegusi otrai pusei rakstisku paziņojumu pa diplomātiskajiem kanāliem, ka līgums ir apstiprināts un ratificēts.

6.2. Līgums ir spēkā piecus (5) gadus, un pēc tam tā darbība katru reizi automātiski tiek pagarināta uz nākamo piecu (5) gadu periodu, ja vien kāda no Pusēm nav nosūtījusi otrai Pusei rakstisku paziņojumu pa diplomātiskajiem kanāliem par Līguma darbības izbeigšanu, vai Puses nav vienojušās par Līguma darbības pagarināšanu uz citu laika periodu vismaz sešus (6) mēnešus pirms Līguma darbības pagarināšanas datuma."

Parakstīts Ženēvā 2016.gada 31.oktobrī divos oriģināleksemplāros, katrs – angļu un latviešu valodā. Teksti abās valodās ir vienlīdz autentiski. Līguma noteikumu atšķirīgas interpretācijas gadījumā noteicošais ir teksts angļu valodā.

COOPERATION AGREEMENT
between
THE GOVERNMENT OF THE REPUBLIC OF LATVIA
and
THE EUROPEAN ORGANIZATION FOR NUCLEAR RESEARCH (CERN) concerning
Scientific and Technical Cooperation in High-Energy Physics

The Government of the Republic of Latvia (hereinafter referred to as "GRL"),

on the one hand,

and

The European Organization for Nuclear Research (hereinafter referred to as "CERN"), an Intergovernmental Organization having its seat at Geneva, Switzerland,

on the other hand,

hereafter collectively referred to as "the Parties"

CONSIDERING:

That research in high-energy physics is important for the further development of fundamental science and technological progress;

CERN’s intention to strengthen co-operation with States which are not Members of CERN but with whom co-operation has been established;

GRL’s interest in participating in the scientific programme of CERN;

The established contacts between CERN and GRL;

The Parties’ desire to create a framework to ensure, on a long-term basis, opportunities for participation by researchers, scientists, engineers and research technical staff from the Republic of Latvia in research projects of CERN, and for the provision of such other contributions as the Parties may agree;

The mutual benefit that the Parties expect to result from their cooperation;

HAVE AGREED AS FOLLOWS:

ARTICLE 1
Scope

1.1 This Cooperation Agreement (hereinafter referred to as "the Agreement") constitutes the framework within which the Parties shall, on a basis of reciprocity, further develop their scientific cooperation (such notion as used hereinafter to include any technical cooperation as well).

1.2 The Parties shall use the results of their cooperation for non-military purposes only.

ARTICLE 2
Forms of Cooperation

Subject to Article 4 hereunder, GRL shall support such research projects of CERN for which Scientific Institutes and Higher Education Institutions from the Republic of Latvia have particular expertise, including in the field of experimental and theoretical physics, accelerator and detector engineering, and computing. The support may be in the form of manpower, know-how, equipment, materials, funds or any combination thereof.

ARTICLE 3
Manpower support

3.1 Where the support is in the form of manpower, CERN shall consider applications by researchers, scientists, engineers and research technical staff from the Republic of Latvia for selection and appointment as Associated Member of the Personnel of CERN. CERN may on a case-by-case basis decide to contribute towards meeting their cost of living expenses in the CERN region.

3.2 Researchers, scientists, engineers and students from the Republic of Latvia meeting the eligibility criteria for application may apply to attend the CERN Schools, including the Accelerator School, the Computing School, the European School of Physics and the Summer Student Programme at CERN.

3.3 CERN shall treat all applications in accordance with their merit.

ARTICLE 4
Execution

4.1 The execution of the Agreement is subject to the conclusion of Protocols between CERN and GRL and/or Scientific Institutes and Higher Education Institutions from the Republic of Latvia, detailing, for each research project, the cooperation between the parties to the Protocol in terms of objectives, programme, resources, status of staff, intellectual property, liability and other issues. Each Protocol may be complemented by detailed Addenda.

4.2 The Protocols shall be subject to the terms of the Agreement.

ARTICLE 5
Disputes

5.1 Any dispute concerning the interpretation or application of the Agreement shall be settled by consultation between the Parties.

5.2 Disputes which cannot be settled by consultation shall, unless the Parties agree to another method of settlement, be submitted at the request of any one of them to an arbitration tribunal composed of three members, namely to an arbitrator chosen by the Director-General of CERN or the person acting in his or her stead, an arbitrator chosen by GRL, and a third arbitrator chosen jointly by the two others, who shall be neither an official of CERN nor a national of the Republic of Latvia and who shall be Chairman of the Tribunal.

5.3 The application shall include the name of the arbitrator chosen by the applicant; the respondent shall appoint the second arbitrator and inform the other Party of the latter’s name within two months of receiving the application. If the respondent fails to notify the name of the second arbitrator within the said period of two months or if the two arbitrators fail to agree on the choice of a third arbitrator within two months after the second arbitrator having been appointed, the second arbitrator or the third arbitrator, as the case may be, shall be chosen by the President of the International Court of Justice, at the request of whichever Party is the first to apply to the Court.

5.4 The Tribunal shall establish its own rules of procedure. Its decisions shall be binding on the Parties who shall have no right of appeal.

ARTICLE 6
Entry into force and duration

6.1 The Agreement shall enter into force on the date of its signature by the Parties, it being understood that where it is subject to subsequent approval or ratification, it shall enter into force on the date on which the Party concerned has given written notification through diplomatic channels to the other Party that approval or ratification has taken place.

6.2 The Agreement shall remain in force for an initial period of five (5) years and shall thereafter be renewed automatically, each time for a new period of five (5) years, unless a written notice of termination is given through diplomatic channels by one of the Parties to the other, or the Parties have agreed on its renewal by another period, at least six (6) months prior to the renewal date.

Done in Geneva on 31 October 2016 in two original copies, each in the English and the Latvian language, both texts being equally authentic. In the event of divergence regarding the interpretation of the provisions of the Agreement, the text done in English shall prevail.

PAR SAVSTARPĒJU KLASIFICĒTĀS INFORMĀCIJAS AIZSARDZĪBU

Latvijas Republikas valdība un Kipras Republikas valdība (turpmāk sauktas "Puses"),

atzīstot nepieciešamību izstrādāt noteikumus klasificētās informācijas, ar kuru notikusi savstarpēja apmaiņa politiskas, militāras, ekonomiskas, juridiskas, zinātniskas un tehnoloģiskas vai citas sadarbības ietvaros, kā arī klasificētās informācijas, kas izstrādāta šādas sadarbības procesā aizsardzībai

nodrošinot visas klasificētās informācijas, kuru klasificējusi viena Puse un nodevusi otrai Pusei vai kas ir kopēji izstrādāta Pušu sadarbības rezultātā, savstarpēju aizsardzību,

vēloties izstrādāt noteikumus par klasificētās informācijas, ar kuru ir notikusi apmaiņa starp Pusēm, savstarpēju aizsardzību,

ņemot vērā savstarpējo ieinteresētību klasificētās informācijas aizsardzībā saskaņā ar Pušu nacionālajiem normatīvajiem aktiem,

ir vienojušās par turpmāko.

1. pants
Mērķis

Šī līguma mērķis ir nodrošināt klasificētās informācijas aizsardzību, kas ir kopīgi izstrādāta vai ar kuru ir notikusi apmaiņa starp Pusēm.

2. pants
Definīcijas

Šī līguma mērķiem:

a) "Drošības prasību pārkāpums" nozīmē darbību vai bezdarbību, kas ir pretrunā ar šo līgumu vai Pušu nacionālajiem normatīvajiem aktiem, kā rezultātā var notikt klasificētās informācijas izpaušana, pazaudēšana, iznīcināšana, nepiemērota izmantošana vai cita veida kompromitēšana;

b) "Klasificēts līgums" nozīmē līgumu starp diviem vai vairākiem līgumslēdzējiem, kas satur vai kura īstenošanai nepieciešama pieeja klasificētai informācijai;

c) "Klasificētā informācija" nozīmē jebkādu informāciju neatkarīgi no tās formas vai veida, kam nepieciešama aizsardzība pret nepilnvarotu darbību un kas ir klasificēta saskaņā ar Pušu nacionālajiem normatīvajiem aktiem un kurai ir piešķirta atbilstoša klasifikācijas pakāpe;

d) "Kompetentā iestāde" nozīmē Nacionālo drošības iestādi un jebkuru citu kompetentu iestādi, kas saskaņā ar Pušu nacionālajiem normatīvajiem aktiem ir atbildīga par šī līguma īstenošanu;

e) "Līgumslēdzējs" nozīmē fizisku personu, juridisku personu vai valsts iestādi, kas ir tiesīga slēgt klasificētus līgumus;

f) "Industriālās drošības sertifikāts" nozīmē Kompetentās iestādes lēmumu, kas apstiprina, ka juridiska vai fiziska persona fiziski un organizatoriski spēj apstrādāt un glabāt klasificēto informāciju saskaņā ar atbilstošajiem nacionālajiem normatīvajiem aktiem;

g) "Nacionālā drošības iestāde" nozīmē katras Puses valsts iestādi, kas saskaņā ar tās nacionālajiem normatīvajiem aktiem ir atbildīga par šī līguma vispārēju ieviešanu un pārraudzību, atbilstošās Pušu iestādes ir noteiktas šī līguma 4. panta 1. punktā;

h) "Nepieciešamība zināt" nozīmē nepieciešamību piekļūt konkrētai klasificētajai informācijai amata pienākumu un konkrēta uzdevuma izpildei;

i) "Izcelsmes Puse" nozīmē Pusi, kas ir izstrādājusi klasificēto informāciju;

j) "Speciālā atļauja" nozīmē Kompetentās iestādes lēmumu, kas apstiprina saskaņā ar nacionālajiem normatīvajiem aktiem, ka persona ir tiesīga piekļūt un apstrādāt klasificēto informāciju;

k) "Saņēmēja Puse" nozīmē Pusi, kurai tiek nodota Izcelsmes Puses klasificētā informācija;

l) "Trešā Puse" nozīmē jebkuru valsti, organizāciju, juridisku vai fizisku personu, kas nav šī līguma puse.

3. pants
Klasifikācijas pakāpes

Puses vienojas, ka šādas klasifikācijas pakāpes ir ekvivalentas un atbilst klasifikācijas pakāpēm, kas ir noteiktas to nacionālajos normatīvajos aktos:

Kompetentās iestādes

1. Pušu Nacionālās drošības iestādes ir:

2. Puses informē viena otru pa diplomātiskajiem kanāliem par jebkādām izmaiņām to Nacionālajās drošības iestādēs.

3. Nacionālās drošības iestādes nekavējoties informē viena otru par citām Kompetentajām iestādēm.

4. Nacionālās drošības iestādes informē viena otru par atbilstošajiem nacionālajiem normatīvajiem aktiem, kas attiecas uz klasificēto informāciju, un par jebkādām būtiskām to izmaiņām, apmainās ar informāciju par drošības standartiem, procedūrām un praksi klasificētās informācijas aizsardzībai.

5. pants
Aizsardzības pasākumi un pieeja klasificētai informācijai

1. Saskaņā ar to nacionālajiem normatīvajiem aktiem Puses veic visus nepieciešamos pasākumus klasificētās informācijas aizsardzībai, ar kuru ir notikusi apmaiņa vai kas ir izstrādāta šī līguma ietvaros. Šādai klasificētai informācijai tiek nodrošināts tāds pats aizsardzības līmenis, kāds tiek piemērots ekvivalentas klasifikācijas pakāpes nacionālajai klasificētajai informācijai saskaņā ar 3. pantu.

2. Izcelsmes Puse rakstiski informē Saņēmēju Pusi par jebkādām izmaiņām nosūtītās klasificētās informācijas klasifikācijas pakāpē.

3. Pieeja klasificētai informācijai tiek dota tikai personām, kurām ir "nepieciešamība zināt" un kuras ir pilnvarotas piekļuvei ekvivalentas klasifikācijas pakāpes klasificētai informācijai saskaņā ar Pušu nacionālajiem normatīvajiem aktiem.

4. Šī līguma ietvaros katra Puse atzīst speciālās atļaujas un industriālās drošības sertifikātus, kas ir izsniegti saskaņā ar otras Puses nacionālajiem normatīvajiem aktiem. Drošības pielaides ir ekvivalentas saskaņā ar šī līguma 3. pantu.

5. Saskaņā ar nacionālajiem normatīvajiem aktiem pēc pieprasījuma Kompetentās iestādes palīdz viena otrai pārbaudes procedūru veikšanā.

6. Šī līguma ietvaros Pušu Kompetentās iestādes nekavējoties informē viena otru par jebkādām izmaiņām speciālajās atļaujās un industriālās drošības sertifikātos, it īpaši par to anulēšanu vai pakāpes pazemināšanu.

7. Saņēmēja Puse:

a) nodod klasificēto informāciju Trešajai Pusei tikai pēc Izcelsmes puses iepriekšējas rakstiskas atļaujas saņemšanas;

b) apzīmē saņemto klasificēto informāciju saskaņā ar šī līguma 3. pantu;

c) izmanto klasificēto informāciju tikai tādiem mērķiem, kādiem tā paredzēta.

6. pants
Klasificētās informācijas nosūtīšana

1. Klasificētā informācija tiek nosūtīta pa diplomātiskajiem kanāliem, ja Nacionālās drošības iestādes nav vienojušās citādi. Saņēmēja Puse rakstiski apstiprina klasificētās informācijas saņemšanu.

2. Elektroniski klasificētā informācija tiek nosūtīta pa sertificētiem šifrētiem kanāliem, par kuriem ir vienojušās Nacionālās drošības iestādes.

3. Ja nepieciešams, Pušu izlūkošanas, drošības un policijas dienesti saskaņā ar nacionālajiem normatīvajiem aktiem var apmainīties ar operatīvo un izlūkošanas informāciju nepastarpināti.

7. pants
Klasificētās informācijas tulkošana un pavairošana

1. Klasificētās informācijas tulkojumi un pavairošana tiek veikti saskaņā ar Saņēmējas Puses nacionālajiem normatīvajiem aktiem un šādām procedūrām:

a) tulkojumi un kopijas tiek apzīmētas un aizsargātas kā oriģinālā klasificētā informācija;

b) tulkojumu un kopiju skaits tiek veikts tādā apjomā, kādā nepieciešams oficiālajiem mērķiem;

c) uz tulkojumiem tiek veikta atbilstoša norāde tulkojuma valodā, ka tas satur Izcelsmes Puses klasificēto informāciju.

2. Klasificēto informāciju, kas apzīmēta kā SLEPENI /AΠOPPHTO/ SECRET un augstāk, tulko vai pavairo tikai pēc Izcelsmes Puses iepriekšējas rakstiskas atļaujas saņemšanas.

8. pants
Klasificētās informācijas iznīcināšana

1. Klasificētā informācija tiek iznīcināta tādā veidā, lai nepieļautu tās daļēju vai pilnīgu atjaunošanu.

2. Klasificēto informāciju, kas apzīmēta kā SLEPENI /AΠOPPHTO/ SECRET, iznīcina saskaņā ar nacionālajiem normatīvajiem aktiem.

3. Klasificēto informāciju, kas apzīmēta kā SEVIŠĶI SLEPENI/ AKPΩΣ AΠOPPHTO/ TOP SECRET, neiznīcina. To nodod atpakaļ Izcelsmes Puses Kompetentajai iestādei.

4. Par klasificētās informācijas iznīcināšanu sastāda aktu. Akta tulkojumu angļu valodā nosūta Izcelsmes Puses Kompetentajai iestādei.

5. Krīzes situācijā, kad klasificēto informāciju nav iespējams aizsargāt vai nodot atpakaļ, to nekavējoties iznīcina. Saņēmēja Puse iespējami ātri informē Izcelsmes Puses Kompetento iestādi par šo iznīcināšanu.

9. pants
Klasificēti līgumi

1. Tās Puses Nacionālā drošības iestāde, kas vēlas slēgt klasificētu līgumu ar otras Puses līgumslēdzēju, vai kas vēlas pilnvarot kādu no savas Puses līgumslēdzējiem slēgt klasificētu līgumu otras Puses teritorijā, saņem iepriekšēju rakstisku apstiprinājumu no otras Puses Nacionālās drošības iestādes, ka piedāvātajam līgumslēdzējam ir piešķirts atbilstošas klasifikācijas pakāpes industriālās drošības sertifikāts.

2. Līgumslēdzējs iesniedz apstiprināšanai informāciju par potenciālajiem apakšuzņēmējiem savai Kompetentajai iestādei.

3. Katrs klasificētais līgums, kas noslēgts saskaņā ar šo līgumu, satur:

a) līgumslēdzēja apņemšanos nodrošināt, ka tā telpas ir piemērotas atbilstošās klasifikācijas pakāpes klasificētās informācijas apstrādei un glabāšanai;

b) līgumslēdzēja apņemšanos nodrošināt, ka personas, kuras veic pienākumus, kam nepieciešama pieeja klasificētai informācijai, ir pilnvarotas saskaņā ar nacionālajiem normatīvajiem aktiem piekļūt ekvivalentās klasifikācijas pakāpes klasificētajai informācijai;

c) prasību, ka līgumslēdzējam jānodrošina, ka visas personas, kurām ir pieeja klasificētai informācijai, ir informētas par savu atbildību attiecībā uz klasificētās informācijas aizsardzību saskaņā ar nacionālajiem normatīvajiem aktiem;

d) klasificētās informācijas sarakstu un jomas, kur klasificētā informācija var tikt radīta;

e) procedūru, lai informētu par izmaiņām klasificētās informācijas klasifikācijas pakāpē;

f) informāciju par sakaru līdzekļiem un elektroniskās pārraides līdzekļiem;

g) klasificētās informācijas nosūtīšanas procedūru;

h) līgumslēdzēja apņemšanos informēt par jebkādiem notikušiem vai iespējamiem drošības prasību pārkāpumiem;

i) līgumslēdzēja apņemšanos nosūtīt vienu klasificētā līguma kopiju savai Kompetentajai iestādei;

j) apakšuzņēmēja apņemšanos izpildīt tādas pašas drošības prasības kā līgumslēdzējam.

4. Tiklīdz uzsāktas sarunas pirms līguma slēgšanas starp potenciālajiem līgumslēdzējiem, Izcelsmes Puses Nacionālā drošības iestāde informē otras Puses Nacionālo drošības iestādi par klasificētās informācijas klasifikācijas pakāpi, kas ir nepieciešama pirms līguma slēgšanas sarunām.

5. Katra klasificēta līguma kopija tiek nosūtīta arī tās Puses Nacionālajai drošības iestādei, kurā tiek plānots veikt darbu, lai nodrošinātu atbilstošu drošības uzraudzību un kontroli.

10. pants
Vizītes

1. Vizītes, kas ir saistītas ar klasificētiem līgumiem, iepriekš rakstiski jāsaskaņo ar uzņēmējas Puses Kompetento iestādi.

2. Vizītes pieprasījums tiek nosūtīts uzņēmējas Puses Kompetentai iestādei vismaz desmit darba dienas iepriekš.

3. Steidzamos gadījumos vizītes pieprasījums var tikt nosūtīts īsākā termiņā.

4. Vizītes pieprasījumā iekļauj:

a) apmeklētāja vārdu un uzvārdu, dzimšanas vietu un datumu, pilsonību, pases vai identifikācijas dokumenta numuru;

b) apmeklētāja pārstāvētā līgumslēdzēja nosaukumu un apmeklētāja amatu tajā;

c) apmeklējamā līgumslēdzēja nosaukumu, adresi un kontaktinformāciju;

d) apmeklētāja speciālās atļaujas apstiprinājumu, tās derīguma termiņu un pakāpi;

e) vizītes mērķi;

f) pieprasītās vizītes plānotos datumus un ilgumu. Atkārtotu vizīšu gadījumā norāda kopējo vizīšu ilguma periodu;

g) datumu, parakstu un pieprasījumu apliecina ar Kompetentās iestādes oficiālo zīmogu.

5. Kad vizīte tiek apstiprināta, uzņēmējas Puses Kompetentā iestāde nosūta vizītes pieprasījuma kopiju apmeklējamās juridiskās personas drošības personālam.

6. Vizītes apstiprinājuma derīguma termiņš nepārsniedz vienu gadu.

7. Pušu Kompetentās iestādes var sastādīt personu sarakstus, kuras ir pilnvarotas veikt atkārtotas vizītes. Šo sarakstu sākotnējais derīguma termiņš ir divpadsmit mēneši. Konkrēto vizīšu nosacījumus saskaņo šīs personas un apmeklējamo juridisko personu atbilstošās kontaktpersonas, ievērojot nosacījumiem, par kuriem iepriekš notikusi vienošanās.

11. pants
Drošības prasību pārkāpums

1. Drošības prasību pārkāpuma gadījumā Saņēmējas Puses Nacionālā drošības iestāde iespējami ātri informē Izcelsmes Puses Nacionālo drošības iestādi un uzsāk nepieciešamo izmeklēšanu.

2. Ja drošības prasību pārkāpums notiek Trešajā valstī, nosūtītājas Puses Nacionālā drošības iestāde veic visus nepieciešamos pasākumus, lai nodrošinātu, ka tiek uzsāktas 1. punktā norādītās darbības.

3. Pēc lūguma Izcelsmes Puse sadarbojas izmeklēšanas veikšanā saskaņā ar 1. punktu.

4. Izcelsmes Puse tiek informēta par izmeklēšanas rezultātiem un veiktajiem pasākumiem, lai mazinātu zaudējumus, un tai tiek nosūtīts gala ziņojums par zaudējumu iemesliem un apmēru.

12. pants
Izdevumi

Katra Puse sedz savus izdevumus, kas radušies šī līguma piemērošanas un pārraudzības gaitā.

13. pants
Strīdu izšķiršana

Jebkurš strīds, kas rodas šī līguma interpretācijas vai piemērošanas gaitā, tiek izšķirts pārrunu ceļā starp Pusēm.

14. pants
Noslēguma nosacījumi

1. Šis līgums tiek noslēgts uz nenoteiktu laika periodu un stājas spēkā otrā mēneša pirmajā dienā pēc dienas, kad pa diplomātiskiem kanāliem saņemts pēdējais rakstiskais paziņojums, kurā Puses informē viena otru, ka ir izpildītas to nacionālās juridiskās prasības, kas nepieciešamas, lai tas stātos spēkā.

2. Šis līgums var tikt grozīts jebkurā laikā, Pusēm savstarpēji rakstiski vienojoties. Grozījumi stājas spēkā saskaņā ar 1. punktu.

3. Katra Puse var jebkurā laikā izbeigt šo līgumu, pa diplomātiskiem kanāliem iesniedzot rakstisku paziņojumu otrai Pusei. Šajā gadījumā Līguma darbība tiek izbeigta sešus mēnešus pēc attiecīgā paziņojuma saņemšanas.

4. Neraugoties uz šī līguma izbeigšanu, Puses nodrošina, ka visa klasificētā informācija tiek aizsargāta saskaņā ar šo līgumu, kamēr Izcelsmes Puse atbrīvo Saņēmēju Pusi no šī pienākuma.

Līgums noslēgts Luksemburgā 2015.gada 22.jūnijā divos oriģinālos eksemplāros, katrs no tiem latviešu, grieķu un angļu valodā, kur visi teksti ir vienlīdz autentiski. Dažādu interpretāciju gadījumā noteicošais ir angļu valodas teksts.

Agreement
between
the Government of the Republic of LATVIA
and
the Government of the Republic of CYPRUS
on Mutual Protection of Classified Information

The Government of the Republic of Latvia and the Government of the Republic of Cyprus (hereinafter referred to as "the Parties"),

Recognizing the need to set rules on protection of Classified Information mutually exchanged within the scope of political, military, economical, legal, scientific and technological or any other cooperation, as well as Classified Information generated in the process of such cooperation,

Intending to ensure the mutual protection of all Classified Information, which has been classified by one Party and transferred to the other Party or commonly generated in the course of co-operation between the Parties,

Desiring to create a set of rules on the mutual protection of Classified Information exchanged between the Parties,

Considering the mutual interests in the protection of Classified Information, in accordance with the national laws and regulations of the Parties,

Have agreed as follows:

Article 1
Objective

The objective of this Agreement is to ensure the protection of Classified Information that is commonly generated or exchanged between the Parties.

Article 2
Definitions

For the purposes of this Agreement:

a) "Breach of Security" means an act or an omission which is contrary to this Agreement or the national laws and regulations of the Parties, the result of which may lead to disclosure, loss, destruction, misappropriation or any other type of compromise of Classified Information;

b) "Classified Contract" means an agreement between two or more Contractors, which contains or the implementation of which requires access to Classified Information;

c) "Classified Information" means any information, irrespective of its form or nature, which requires protection against unauthorised manipulation and has been classified in accordance with the national laws and regulations of the Parties and has been so designated by a security classification level;

d) "Competent Authority" means National Security Authority and any other competent entity which, according to the national laws and regulations of the Parties, is responsible for the implementation of this Agreement;

e) "Contractor" means an individual, legal entity or state body possessing the legal capacity to conclude Classified Contracts;

f) "Facility Security Clearance" means the determination by the Competent Authority confirming, that the legal entity or an individual has the physical and organizational capability to handle and store Classified Information in accordance with the respective national laws and regulations;

g) "National Security Authority" means the state authority of each Party, which in accordance with its national laws and regulations is responsible for the general implementation and supervision of this Agreement; the respective authorities of the Parties are referred to in paragraph 1 of Article 4 of this Agreement;

h) "Need-to-know" means the necessity to have access to specific Classified Information in the scope of a given official position and for the performance of a specific task;

i) "Originating Party" means the Party which has created Classified Information;

j) "Personnel Security Clearance" means the determination by the Competent Authority confirming, in accordance with the respective national laws and regulations, that the individual is eligible to have access to and handle Classified Information;

k) "Receiving Party" means the Party to which Classified Information of the Originating Party is transmitted;

l) "Third Party" means any state, organization, legal entity or individual, which is not a party to this Agreement.

Article 3
Security Classification Levels

The Parties agree that the following security classification levels are equivalent and correspond to the security classification levels specified in their national laws and regulations:

Article 4
Competent Authorities

1. The National Security Authorities of the Parties are:

For the Government of the Republic of Latvia

Constitution Protection Bureau

For the Government of the Republic of Cyprus:

National Security Authority/ Ministry of Defence of the Republic of Cyprus

2. The Parties shall inform each other through diplomatic channels of any modification of the National Security Authorities.

3. The National Security Authorities shall immediately notify each other about other Competent Authorities.

4. The National Security Authorities shall inform each other of respective national laws and regulations on Classified Information and of any significant amendments thereto and shall exchange information about the security standards, procedures and practices for the protection of Classified Information.

Article 5
Protection Measures and Access to Classified Information

1. In accordance with their national laws and regulations, the Parties shall take all appropriate measures for the protection of Classified Information, which is exchanged or generated under this Agreement. At least the same level of protection shall be assigned to such Classified Information as is provided for the national Classified Information of the equivalent security classification level in accordance with Article 3.

2. The Originating Party shall inform the Receiving Party in writing about any change of the security classification level of the transmitted Classified Information.

3. Access to Classified Information shall be limited to persons on a Need-to-know basis who are authorised in accordance with the national laws and regulations of the Parties to have access to Classified Information of the equivalent security classification level.

4. Within the scope of this Agreement, each Party shall recognise the Personnel Security Clearances and Facility Security Clearances granted in accordance with the national laws and regulations of the other Party. The security clearances shall be equivalent in accordance with Article 3 of this Agreement.

5. The Competent Authorities shall, in accordance with the national laws and regulations, assist each other upon request at carrying out vetting procedures.

6. Within the scope of this Agreement, the Competent Authorities of the Parties shall inform each other without delay about any alteration with regard to Personnel and Facility Security Clearances, in particular about their withdrawal or downgrading.

7. The Receiving Party shall:

a) submit Classified Information to any Third Party only upon prior written consent of the Originating Party;

b) mark the received Classified Information in accordance with Article 3 of this Agreement;

c) use Classified Information solely for the purposes it has been provided for.

Article 6
Transmission of Classified Information

1. Classified Information shall be transmitted through diplomatic channels unless otherwise approved by the National Security Authorities. The Receiving Party shall confirm the receipt of Classified Information in writing.

2. Electronic transmission of Classified Information shall be carried out through certified cryptographic means agreed by the National Security Authorities.

3. If necessary, the intelligence, security and police services of the Parties may, in accordance with national laws and regulations, exchange operative and intelligence information directly with each other.

Article 7
Translation and Reproduction of Classified Information

1. Translations and reproductions of Classified Information shall be made in accordance with the national laws and regulations of the Receiving Party and the following procedures:

a) the translations and the reproductions shall be marked and protected as the original Classified Information;

b) the translations and the number of copies shall be limited to that required for official purposes;

c) the translations shall bear an appropriate note in the language of the translation indicating that it contains Classified Information received from the Originating Party.

2. Classified Information marked SLEPENI/ AΠOPPHTO/ SECRET or above shall be translated or reproduced only upon prior written consent of the Originating Party.

Article 8
Destruction of Classified Information

1. Classified Information shall be destroyed in a manner that prevents its partial or total reconstruction.

2. Classified Information marked up to SLEPENI/ AΠOPPHTO/ SECRET shall be destroyed in accordance with the national laws and regulations.

3. Classified Information marked SEVIŠĶI SLEPENI/ AKPΩΣ AΠOPPHTO/ TOP SECRET shall not be destroyed. It shall be returned to Competent Authority of the Originating Party.

4. A report on destruction of Classified Information shall be made and its translation in English shall be delivered to the Competent Authority of the Originating Party.

5. In case of a crisis situation in which it is impossible to protect or return Classified Information it shall be destroyed immediately. The Receiving Party shall inform the Competent Authority of the Originating Party about this destruction as soon as possible.

Article 9
Classified Contracts

1. The National Security Authority of a Party, wishing to place a Classified Contract with a Contractor of other Party, or wishing to authorise one of its own Contractors to place a Classified Contract in the territory of the other Party shall obtain prior written assurance from the National Security Authority of the other Party that the proposed Contractor is granted Facility Security Clearance of the appropriate security classification level.

2. The Contractor shall submit information about potential sub-contractors for approval to its Competent Authority.

3. Each Classified Contract concluded in accordance with this Agreement shall include:

a) commitment of the Contractor to ensure that its premises have necessary conditions for handling and storing Classified Information of appropriate security classification level;

b) commitment of the Contractor to ensure that persons who perform duties requiring access to Classified Information are authorised in accordance with the national laws and regulations to have access to Classified Information of the equivalent security classification level;

c) requirement that the Contractor shall ensure that all persons with access to Classified Information are informed of their responsibility towards the protection of Classified Information in accordance with the national laws and regulations;

d) list of Classified Information and list of areas in which Classified Information can arise;

e) procedure for communication of changes in the security classification level of Classified Information;

f) communication means and electronic means for transmission;

g) procedure for the transmission of Classified Information;

h) commitment of the Contractor to notify of any actual or suspected Breach of Security;

i) commitment of the Contractor to forward a copy of the Classified Contract to its own Competent Authority;

j) commitment of the subcontractor to fulfil the same security obligations as the Contractor.

4. As soon as pre-contractual negotiations begin between potential Contractors, the National Security Authority of the Originating Party shall inform the National Security Authority of the other Party of the security classification level given to the Classified Information related to those pre-contractual negotiations.

5. Copy of each Classified Contract shall also be forwarded to the National Security Authority of the Party where the work is to be performed, to allow adequate security supervision and control.

Article 10
Visits

1. Visits related to Classified Contracts are subject to prior written approval given by the Competent Authority of the host Party.

2. The Competent Authority of the host Party shall receive a request for visit at least ten working days in advance.

3. In urgent cases, the request for visit can be transmitted in shorter time.

4. The request for visit shall include:

a) visitor’s name and surname, place and date of birth, citizenship, passport or identification document number;

b) name of the Contractor represented by the visitor and position of the visitor in the legal entity;

c) name, address and contact information of the legal entity to be visited;

d) confirmation of the visitor’s Personnel Security Clearance, its validity and level;

e) object and purpose of the visit;

f) expected date and duration of the requested visit. In case of recurring visits the total period covered by the visits shall be stated;

g) the date, signature and the official seal of the Competent Authority.

5. Once the visit has been approved the Competent Authority of the host Party shall provide a copy of the request for visit to the security officers of the legal entity to be visited.

6. The validity of visit approval shall not exceed one year.

7. The Competent Authorities of the Parties may draw up lists of individuals authorised to make recurring visits. The lists are valid for an initial period of twelve months. The terms of the respective visits shall be directly arranged with the appropriate points of contact in the legal entity to be visited by these individuals, in accordance with the terms and conditions agreed upon.

Article 11
Breach of Security

1. In case of Breach of Security the National Security Authority of the Receiving Party shall inform the National Security Authority of the Originating Party, as soon as possible, and initiate the appropriate investigation.

2. If a breach of security arises in a third state, the National Security Authority of the dispatching Party shall take all necessary measures in order to ensure that the actions prescribed in paragraph 1 are initiated.

3. The Originating Party shall, upon request, co-operate in the investigation in accordance with paragraph 1.

4.  Originating Party shall be informed of the results of the investigation and the measures taken to mitigate the damage and shall receive the final report on the reasons and extent of the damage.

Article 12
Expenses

Each Party shall bear its own expenses incurred in the course of application and supervision of this Agreement.

Article 13
Settlement of Disputes

Any dispute regarding the interpretation or application of this Agreement shall be settled by negotiations between the Parties.

Article 14
Final Provisions

1. This Agreement is concluded for an indefinite period of time and enters into force on the first day of the second month after the date of the receipt of the latest written notification by which the Parties have notified each other, through diplomatic channels, that their national legal requirements necessary for its entry into force have been fulfilled.

2. This Agreement may be amended any time on the basis of mutual written approval of the Parties. The amendments shall enter into force in accordance with paragraph 1.

3. Each Party may, at any time, terminate this Agreement by written notification to the other Party, through diplomatic channels. In this case, the termination takes effect six months after the date of the receipt of the respective notification.

4. Notwithstanding the termination of this Agreement, the Parties shall ensure that all Classified Information shall continue to be protected in accordance with this Agreement until the Originating Party dispenses the Receiving Party from this obligation.

Done at Luxembourg on 22 June 2015 in two originals, each in the Latvian, Greek and English languages, all texts being equally authentic. In case of any divergence of interpretation, the English text shall prevail.
