Your Excellency

I have the honour to propose, with reference to the recent discussions between the British Embassy and the Ministry of Foreign Affairs that, members of the family of career members of the United Kingdom diplomatic missions and consular posts in Latvia be enabled to engage in gainful employment in the receiving State, and on the same basis as members of the family of career members of Latvian diplomatic missions and consular posts in the United Kingdom are enabled to engage in gainful employment.

In particular I propose that the granting in each case of the appropriate authorisation be facilitated in accordance with the provisions of the relevant national legislation and following the procedure set out in the attached Annex.

If the above text is acceptable to the Ministry, I propose that this Note and its Annex, together with your reply, should place on record the understanding between the Government of Latvia and the Government of the United Kingdom of Great Britain and Northern Ireland which will serve as a framework to enable members of the family of members of diplomatic missions or consular posts to engage in gainful employment, and will come into operation of the date of your reply.

I avail myself of this opportunity to renew to Your Excellency the assurances of my highest consideration.

Jūsu Ekselence,

Man ir tas gods apstiprināt Jūsu 1997. gada 12. jūnija notas Nr.021/97 saņemšanu attiecībā uz abu valstu diplomātiskajām misijām, kuras nozīmētas otrā valstī, personāla ģimenes locekļu tiesībām strādāt algotu darbu. Atbildot uz to apliecinu, ka Jūsu notas saturs ir pieņemams Latvijas Republikas valdībai un ka Jūsu Nota kopā ar šo atbildi oficiāli apstiprina mūsu abu valdību saprašanos šajā jautājumā.

Šī kārtība stājas spēkā ar šo dienu un būs zināma kā Latvijas Republikas valdības un Lielbritānijas un Ziemeļīrijas Apvienotās Karalistes valdības līgums par Diplomātisko misiju personāla ģimenes locekļu tiesībām strādat algotu darbu.

Es izmantoju šo izdevību, lai vēlreiz apliecinātu savu cieņu Lielbritānijas un Ziemeļīrijas Apvienotās Karalistes vēstniecībai.

Divpusējā līguma teksts

1. Atļauja algota darba veikšanai

(a) Nosūtošās valsts diplomātisko vai konsulāro pārstāvniecību darbinieku ģimenes locekļiem tiek atļauts pēc reciprocitātes principa, veikt atalgojamu nodarbošanos rezidences valstī saskaņā ar rezidences valsts likumu un citu normatīvo aktu noteikumiem .

(b) Šā Līguma izpratnē:

(i) “diplomātiskās vai konsulārās pārstāvniecības darbinieks” nozīmē jebkuru nosūtošās valsts diplomātiskās misijas, konsulārās pārstāvniecības vai starptautiskas organizācijas misijas darbinieku, kas nav rezidences valsts pilsonis;

(ii) “ģimenes loceklis” nozīmē diplomātiskās misijas vai konsulārās pārstāvniecības darbinieka laulāto vai nepilngadīgu bērnu, kas ir diplomātiskās vai konsulārās pārstāvniecības darbinieka ģimenes loceklis;

(c) Jebkuras atļaujas algota darba veikšanai rezidences valstī, termiņš tiek ierobežots līdz ar attiecīgā diplomātiskās vai konsulārās pārstāvniecības darbinieka pilnvaru beigšanos.

2. Kārtība darba atļauju saņemšanai:

(a) Lūgumu par atļauju algota darba veikšanai attiecīgā ģimenes locekļa vārdā nosūtošās valsts vēstniecība nosūta rezidences valsts Ārlietu ministrijai.

(b) Sekojošā kārtība tiek pielietota veidā, kas dod iespēju attiecīgajam ģimenes loceklim iesaistīties algotā darbā, cik vien ātri iespējams, kā arī jebkuras prasības, kas attiecas uz darba atļaujām un analoģiskām formalitātēm, tiek pielietotas labvēlīgā veidā.

3. Civilās un administratīvās privilēģijas un neaizskaramība

Attiecībā uz ģimenes locekļiem, kuriem ir piešķirta neaizskaramība no rezidences valsts civilās un administratīvās jurisdikcijas viedokļa saskaņā ar Vīnes Konvenciju par diplomātiskajiem sakariem vai saskaņā ar jebkuru citu piemērojamu starptautisku dokumentu, šāda neaizskaramība netiek piemērota attiecībā uz jebkādu darbību, kas veikta algota darba ietvaros un kas pakļauta rezidences valsts civilajām un administratīvajām tiesībām.

4. Kriminālā neaizskaramība

Attiecībā uz ģimenes locekļiem, kuriem ir piešķirta neaizskaramība no rezidences valsts kriminālās jurisdikcijas viedokļa saskaņā ar Vīnes Konvenciju par diplomātiskajiem sakariem vai saskaņā ar jebkuru citu piemērojamu starptautisku dokumentu:

(a) Rezidences valsts kriminālās jurisdikcijas noteikumi, kas attiecas uz neaizskaramību, tiek piemēroti attiecībā uz jebkuru darbību, kas veikta algota darba ietvaros. Tomēr nosūtošā valsts nopietni apsver iespēju atsaukt attiecīgā ģimenes locekļa, par kuru ir interese no rezidences valsts kriminālās jurisdikcijas viedokļa, neaizskaramību.

(b) Šādos apstākļos nosūtošā valsts nopietni apsver iespēju atsaukt attiecīgā ģimenes locekļa neaizskaramību tiesas sprieduma izpildei.

5. Fiskālās garantijas

Saskaņā ar Vīnes Konvenciju par diplomātiskajiem sakariem vai saskaņā ar jebkuru citu piemērojamu starptautisku dokumentu, ģimenes locekļi ir pakļauti rezidences valsts finansiālajām un sociālajām garantijām visos jautājumos, kas attiecas uz viņu algoto darbu šajā valstī.

6. Darbības termiņš un izbeigšanās

Līgums noslēgts uz neierobežotu laika periodu. Jebkura no valstīm ir tiesīga to pārtraukt, 6 (sešus) mēnešus iepriekš iesniedzot par to rakstisku paziņojumu otrai valstij.

Your Excellency

I have the honour to acknowledge receipt of your Note 021/97 dated June 12, 1997 concerning the employment of dependants of members of either governments' diplomatic missions appointed to the other country. In reply, I confirm that the contents of your Note are acceptable to the Government of Republic of Latvia and that your Note, together with this reply, place on record the understanding of our two Governments in this matter. These arrangements will come into operation today and will be known as the Agreement between the Government of the Republic of Latvia and the Government of the United Kingdom and Northern Ireland concerning the employment of dependants of members of either governments' diplomatic missions appointed to the other country.

I avail myself of this opportunity to renew to the Embassy of United Kingdom and Northern Ireland the assurance of my highest consideration.

Text for a bilateral work agreement

1. Authorization to engage in a gainful occupation

(a) The members of the family forming part of the household of a member of a diplomatic mission or consular post of the sending State will be authorised, on a reciprocal basis, to engage in a gainful occupation in the receiving State in accordance with the provisions of the law of the receiving State.

(b) For the purposes of this agreement:

(i) “a member of a diplomatic mission or consular post” means any employee of the sending State who is not a national of the receiving State in diplomatic mission, consular post or mission to an international organisation;

(ii) “a member of the family” means the spouse of a member of a diplomatic mission or consular post and any minor child who forms part of the household of a member of a diplomatic mission or consular post;

(c) Any authorisation to engage in a gainful occupation in the receiving State will, in principle, be terminated at the end of the assignment of the member of a diplomatic mission or consular post.

2. Procedures

(a) A request for authorisation to engage in a gainful occupation will be sent on behalf of the member of the family by the Embassy of the sending State to the Ministry of Foreign Affairs of the receiving State.

(b) The procedures followed will be applied in a way which enables the member of the family to engage in a gainful occupation as soon as possible and any requirements relating to work permits and similar formalities will be favourably applied.

3. Civil and administrative privileges

In the case of members of the family who enjoy immunity from the civil and administrative jurisdiction of the receiving State in accordance with the Vienna Convention of Diplomatic Relations or under any other applicable international instrument such immunity will not apply in respect to any act carried out in the course of the gainful occupation and falling within the civil or administrative law of the receiving State.

4. Criminal Immunity

In the case of members of the family who enjoy immunity from the criminal jurisdiction of the receiving State in accordance with the Vienna Convention on Diplomatic Relations or under any other applicable international instrument:

(a) the provisions concerning immunity from the criminal jurisdiction of the receiving State will continue to apply in respect of any act carried out in the course of the gainful occupation. However, the sending State will give serious consideration to waiving the immunity of the member of the family concerned from the criminal jurisdiction of the receiving State.

(b) In such circumstances, the sending State will give serious consideration to waiving the immunity of the member of the family from the execution of a sentence.

5. Fiscal and social security regimes

In accordance with the Vienna Convention on Diplomatic Relations or under any other applicable international instrument members of the family will be subject to the fiscal and social security regimes of the receiving State for all matters connected with their gainful occupation in that State.

6. Duration and Termination

This arrangement will remain in operation for an indefinite period. Either State may terminate it at any time by giving 6 (six) months' notice in writing to the other State.
