AGREEMENT BETWEEN THE NATIONAL ARMED FORCES OF LATVIA AND GERMAN AIR RESCUE CONCERNING SUPPORT OF GERMAN – AIR RESCUE ON THE AEROMEDICAL EVACUATION FOR THE NATIONAL ARMED FORCES OF LATVIA PARTICIPATING IN THE INTERNATIONAL OPERATIONS
The National Armed Forces of Latvia and the German Air- Rescue hereinafter referred to as “the German Party and the Latvian Party ”,
guided by the wish to strengthen mutual relations and co-operation in the operational level between the both Parties and
wishing to set forth the legal and practical framework for the implementation of co-operation in the aeromedical evacuation,
have reached the following understanding:
Article I
Purpose
The purpose of this Agreement is to provide the implementing measures for the assistance provided by the German Party to the Latvian Party in performing aeromedical evacuation for the National Armed Forces of Latvia from the territory of Germany or other NATO countries in Europe to the Republic of Latvia in cases of emergency.
Article II
Responsibilities of the Parties
2.1. The German Party:
a) prepares the scheme of navigation (tentatively within 5 (five) working days;
b) requests of corridor for the accordant flights (from the territory of Germany or other point of departure, respectively, to Riga);
c) picks up the medical personnel from Latvia on the ambulance airplane on the appointed day;
d) manages the flight from Germany or other point of departure to Riga;
e) picks up the wounded.
2.2. The Latvian Party:
a) provides the German Party with precise information about dates and the number of wounded troops of National Armed Forces of Latvia planned to be evacuated from Germany or other NATO countries in Europe;
b) provides the German Party with the information about the date of arrival of the mobile medical personnel of Military Medical Centre of National Armed Forces Logistic Centre;
c) provides the military medical personnel with necessary portative medical equipment and medicine;
d) covers the following expences (reimbursement of costs):
costs of services and flights i.e. total costs of operation of the German Party (third party fees, pro rata maintenance costs, fuel and other direct expenses, pro rata depreciation, wages and usual profit margin) insurance expenses for pilots; travelling allowance.
The request for a flight is carried out in compliance with the provisions of STANAG 3204.

Article IV
Amendments and disputes
4.1. This Agreement is not intended to conflict with the national law of the Parties. In case of conflict, law of the Republic of Latvia will apply. Both Parties notify each other in the event of any conflict arising.
4.2. Any dispute regarding the interpretation or application of this Agreement will be resolved through negotiations between the disputing Parties at the lowest possible level and will not be referred to any national or international tribunal or other third party for settlement.
4.3 Any dispute arising out of or in connection with this agreement, including any question regarding its existence, validity or termination, that cannot be solved as stated above, shall be referred to and ultimately resolved by arbitration in Paris under the Rules of Arbitration of ICC (International Chamber of Commerce). The language of the arbitration should be English.
Article V
Entry into effect, amendments and termination
5.1. This Agreement is concluded for unlimited period of time and shall become effective on the date of signature of the Parties.
5.2. Amendments to this Agreement shall be done in writing by the mutual consent of both Parties.
5.3. The Parties may terminate this Agreement at any time by mutual written agreement.
5.4. If the Agreement is terminated, the Parties will initiate negotiations to settle all outstanding mutual financial obligations, claims, disputes and security issues arising from this Agreement.
