1.pants. 1994.gada 12.decembrī Rīgā parakstītais Latvijas Republikas valdības un Beļģijas Karalistes valdības līgums par gaisa satiksmi (turpmāk — Līgums) un tā pielikums ar šo likumu tiek pieņemti un apstiprināti.
2.pants. Likums stājas spēkā tā izsludināšanas dienā. Līdz ar likumu ir izsludināms Līgums un tā pielikums angļu valodā un tulkojums latviešu valodā.
3.pants. Latvijas Republikas Ārlietu ministrija uz šā likuma pamata un saskaņā ar Līguma 22.pantu sagatavo ratifikācijas rakstu nosūtīšanai Beļģijas Karalistes valdībai.
4.pants. Latvijas Republikas Ārlietu ministrija saskaņā ar Līguma 21.pantu reģistrē Līgumu Starptautiskajā civilās aviācijas organizācijā.
5.pants. Līgums stājas spēkā tā 22.pantā noteiktajā laikā un kārtībā.

Agreement between The Government of The Republic of Latvia and The Government of The Kingdom of Belgium on Air Transport

The Government of the Republic of Latvia and the Government of the Kingdom of Belgium, hereinafter referred to as "the Contracting Parties";

Being parties to the Convention on International Civil Aviation opened for signature at Chicago, on the 7th day of December, 1944;

Desiring to conclude an agreement, supplementary to the said Convention, for the purpose of establishing air services between and beyond their respective territories;

Desiring to ensure the highest degree of safety and security in international air transport;

Have agreed as follows:

Article 1

Definitions

For the purpose of this Agreement, unless the context otherwise requires:

a) the term "Convention" means the Convention on International Civil Aviation opened for signature at Chicago on the seventh day of December 1944 and includes any Annex adopted under Article 90 of that Convention and any amendment of the annexes or of the Convention under Articles 90 and 94 thereof so far as those Annexes and amendments have been adopted or ratified by both Contracting parties;

b) the term "Agreement" means this Agreement, the Annex attached thereto, and any modifications to the Agreement or to the Annex;

c) the term "aeronautical authorities" means: in the case of Latvia, The Ministry of Transport, and, in the case of Belgium, Ministry of Communications, or in both cases, any other authority or person empowered to perform the functions now exercised by the said authorities;

d) the terms "territory", "air service", "international air service", "airline" and "stop for non-traffic purposes" have the meaning respectively assigned to them in Articles 2 and 96 of the Convention;

e) the term "designated airline" means an airline which has been designated and authorized in accordance with Articles 3 and 4 of this Agreement;

f) the term "agreed services" means scheduled air services on the routes specified in the Annex to this Agreement for the transport of passengers, cargo and mail, separately or in combination;

g) the term "tariffs" means the prices to be paid for the carriage of passengers, baggage and cargo and the conditions under which those prices apply, including prices and conditions for agency and other ancillary services, but excluding remuneration and conditions for the carriage of mail;

h) the term "change of gauge" means the operation of one of the agreed services by a designated airline in such a way that one section of the route is flown by aircraft different in capacity from those used on another section;

i) The terms "aircraft equipment", "ground equipment", "aircraft stores", "spare parts" have the meanings respectively assigned to them in Annex 9 of the Convention.

Article 2

Grant of rights

1. Each Contracting Party grants to the other Contracting Party except as otherwise specified in the Annex the following rights for the conduct of international air services by the airline designated by the other Contracting Party:

a) to fly without landing across the territory of the other Contracting Party;

b) to make stops in the said territory for non-traffic purposes;

and

c) to make stops in the said territory for the purpose of taking up and discharging, while operating the routes specified in the Annex, international traffic in passengers, cargo and mail, separately or in combination.

2. Nothing in paragraph 1 of this article shall be deemed to confer on a designated airline of one Contracting Party the privilege of taking up, in the territory of the other Contracting Party, passengers, cargo and mail carried for remuneration or hire and destined for another point in the territory of that other Contracting Party.

Article 3

Designation to operate services

1. Each Contracting Party shall have the right to designate, by diplomatic note, to the other Contracting Party, an airline to operate the agreed services on the routes specified in the Annex for such a Contracting Party.

2. Each Contracting Party shall have the right to withdraw, by diplomatic note to the other Contracting Party, the designation of any airline and to designate another one.

Article 4

Authorization to operate services

1. Following receipt of a notice of designation by one Contracting Party pursuant to Article 3 of this Agreement, the aeronautical authorities of the other Contracting Party shall, consistent with its laws and regulations, grant without delay to the airline so designated the appropriate authorizations to operate the agreed services for which that airline has been designated.

2. Upon receipt of such authorizations the airline may begin at any time to operate the agreed services, in whole or in part, provided that the airline complies with the applicable provisions of this Agreement and that tariffs are established in accordance with the provisions of Article 13 of this Agreement.

Article 5

Revocation or suspension of operating authorization

1. The aeronautical authorities of each Contracting Party shall have the right to withhold the authorizations referred to in Article 4 with respect to an airline designated by the other Contracting Party, to revoke or suspend such authorization or impose conditions, temporarily or permanently:

a) in the event of failure by such airline to satisfy them that it is qualified to fulfill the conditions prescribed under the laws and regulations normally and reasonably applied to the operation of international air services by these authorities in conformity with the Convention;

b) in the event of failure by such airline to operate in accordance with the conditions prescribed under this Agreement;

c) in the event of failure by such airline to comply with the laws and regulations of that Contracting Party;

d) in the event that they are not satisfied that substantial ownership and effective control of the airline are vested in the Contracting Party designating the airline or in its nationals.

2. Unless immediate action is essential to prevent infringement of the laws and regulations referred to above, the rights enumerated in paragraph 1 of this article shall be exercised only after consultations with the aeronautical authorities of the other Contracting Party in conformity with Article 17 of this Agreement.

Article 6

Application of laws and regulations

1. The laws and regulations of one Contracting Party relating to the admission to, remaining in, or departure from its territory of aircraft engaged in international air navigation or to the operation and navigation of such aircraft shall be complied with by the designated airline of the other Contracting Party upon entrance into, departure from and while within the said territory.

2. The laws and regulations of one Contracting Party respecting entry, clearance, transit, immigration, passports, customs, currency, sanitary requirements and quarantine shall be complied with by the designated airline of the other Contracting Party and by or on behalf of its crews, passengers, cargo and mail upon transit of, admission to, departure from and while within the territory of such Contracting Party;

Passengers in transit across the territory of either Contracting Party shall be subject to no more than a simplified control.

3. Neither of the Contracting Parties shall give preference to its own or any other airline over an airline engaged in similar international air services of the other Contracting Party in the application of its regulations specified in paragraphs 1 and 2 of this article or in the use of airports, airways, air traffic services and associated facilities under its control.

Article 7

Certificates and licences

1. Certificates of air worthiness, certificates of competency and licences issued or rendered valid by one Contracting Party and still in force, shall be recognized as valid by the other Contracting Party for the purpose of operating the agreed services on the routes specified in the Annex, provided that such certificates or licences were issued or rendered valid pursuant to, and in conformity with, the standards established under the Convention.

Each Contracting Party reserves the right, however, to refuse to recognize, for the purpose of flights above its own territory, certificates of competency and licences granted to its own nationals by the other Contracting Party.

2. If the certificates or licences referred to in paragraph 1 of this article were issued or rendered valid according to requirements different from the standards established under the Convention, and if such difference has been filed with the International Civil Aviation Organization, the aeronautical authorities of the other Contracting Party may request consultations in accordance with Article 17 of this Agreement with a view to satisfying themselves that the requirements in question are acceptable to them.

Failure to reach a satisfactory agreement in matters regarding flight safety will constitute grounds for the application of Article 5 of this Agreement.

Article 8

Aviation security

1. The Contracting Parties reaffirm that their obligation to protect, in their mutual relationship, the security of civil aviation against acts of unlawful interference forms an integral part of this Agreement.

2. The Contracting Parties shall provide upon request all necessary assistance to each other to prevent acts of unlawful seizure of aircraft and other unlawful acts against the safety of passengers, crew, aircraft and airports and air navigation facilities and any other threat to aviation security.

3. The Contracting Parties shall act in conformity with the provisions of the Convention on Offences and Certain Other Acts Committed on Board Aircraft, signed at Tokyo on 14 September 1963, the Convention for the Suppression of Unlawful Seizure of Aircraft, signed at The Hague on 16 December 1970 and the Convention for the Suppression of Acts against the Safety of Civil Aviation, signed at Montreal on 23 September 1971.

4. The Contracting Parties shall, in their mutual relations, act in conformity with the aviation security provisions established by the International Civil Aviation Organization and designated as annexes to the Convention on International Civil Aviation to the extent that such security provisions are applicable to the Parties; they shall require that operators of aircraft of their registry or operators who have their principal place of business or permanent residence in their territory and the operators of airports in their territory act in conformity with such aviation security provisions.

5. Each Contracting Party agrees to observe the security provisions required by the other Contracting Party for entry into the territory of that other Contracting Party and to take adequate measures to inspect passengers, crew, their carry-on items as well as cargo prior to boarding or loading. Each Contracting Party shall also give positive consideration to any request from the other Contracting Party for special security measures for its aircraft or passengers to meet a particular threat.

6. When an incident or threat of an incident of unlawful seizure of aircraft or other unlawful acts against the safety of passengers, crew, aircraft, airports and air navigation facilities occurs, the Contracting Parties shall assist each other by facilitating communications and other appropriate measures intended to terminate rapidly and safely such incident or threat thereof.

7. Should a Contracting Party depart from the aviation security provisions of this article, the aeronautical authorities of the other Contracting Party may request immediate consultations with the aeronautical authorities of that Party. Failure to reach a satisfactory agreement within thirty (30) days will constitute grounds for application of Article 5 of this Agreement.

Article 9

User charges

1. The charges imposed in the territory of one Contracting Party on the designated airline of the other Contracting Party for the use of airports and other aviation facilities by the aircraft of the designated airline of the other Contracting Party shall not be higher than those imposed on the designated airline of the first Contracting Party.

2. Each Contracting Party shall encourage consultations between its competent charging authorities and the designated airline using the facilities and services, where practicable, through the airlines" representative organizations. Reasonable notice should be given of any proposal for changes in user charges to enable them to express their views before changes are made.

Article 10

Customs and excise

1. Each Contracting Party shall exempt the designated airline of the other Contracting Party from import restrictions, customs duties, excise taxes, inspection fees and other national, regional or local duties and charges on aircraft, fuel, lubricating oils, consumable technical supplies, spare parts including engines, regular aircraft equipment, ground equipment, aircraft stores and other items intended for use or used solely in connection with the operation or servicing of aircraft of the designated airline of such other Contracting Party operating the agreed services, as well as printed ticket stock, airway bills, any printed material which bears the insignia of the company printed thereon and usual publicity material distributed without charge by that designated airline.

2. The exemptions granted by this article shall apply to the items referred to in paragraph 1 of this article, whether or not such items are used or consumed wholly within the territory of the Contracting Party granting the exemption, provided such items are:

a) introduced into the territory of one Contracting Party by or on behalf of the designated airline of the other Contracting Party, but not alienated in the territory of the said Contracting Party;

b) retained on board aircraft of the designated airline of one Contracting Party upon arriving in or leaving the territory of the other Contracting Party;

c) taken on board aircraft of the designated airline of one Contracting Party in the territory of the other Contracting Party and intended for use in operating the agreed services.

3. The regular airborne equipment, the ground equipment, as well as the materials and supplies normally retained on board the aircraft of the designated airline of either Contracting Party, may be unloaded in the territory of the other Contracting Party only with the approval of the Customs authorities of that territory. In such case, they may be placed under the supervision of the said authorities up to such time as they are re-exported or otherwise disposed of in accordance with Customs regulations.

4. Baggage and cargo in direct transit shall be exempt from customs duties and other taxes.

5. The exemptions provided for by this article shall also be available where the designated airline of one Contracting Party has contracted with another airline, which similarly enjoys such exemptions from the other Contracting Party, for the loan or transfer in the territory of the other Contracting Party of the items specified in paragraph 1 of this article.

Article 11

Capacity

1. There shall be fair and equal opportunity for the designated airline of each Contracting Party to operate the agreed services between and beyond their respective territories on the routes specified in the Annex to this Agreement.

2. In operating the agreed services, the designated airline of each Contracting Party shall take into account the interest of the designated airline of the other Contracting Party so as not to affect unduly the services which the latter provides on the whole or part of the same route.

3. The agreed services provided by the designated airlines of the Contracting Parties shall bear reasonable relationship to the requirements of the public for transportation on the specified routes and shall have as their primary objective the provision, at a reasonable load factor, of capacity adequate to meet the current and reasonably anticipated requirements for the carriage of passengers, cargo and mail between the territories of the Contracting Parties.

4. The designated airlines shall, not later than 30 days prior to the date of operation of any agreed service, submit for approval their proposed flight programs to the aeronautical authorities of both Contracting Parties. Said flight programs shall include i.a. the type of service, the aircraft to be used, the frequencies and the flight schedules.

This shall likewise apply to later changes.

In special cases this time limit may be reduced, subject to the consent of the said authorities.

Article 12

Change of gauge

The designated airline of one Contracting Party may make a change of gauge in the territory of the other Contracting Party on the following conditions:

a) that the substitution is justified by reasons of economy of operation;

b) that the aircraft operating on the sector more distant from the territory of the Contracting Party designating the airline shall operate only in connection with the aircraft on the nearer sector and shall be scheduled so to do; the former shall arrive at the point of change for the purpose of carrying traffic transferred from or to be transferred into the latter, and the capacity shall be determined with primary reference to this purpose;

c) that the airline shall not hold itself out to the public by advertisement or otherwise as providing a service which originates at the point where the change of aircraft is made, unless otherwise permitted by the Annex to this Agreement;

d) that in connection with any one aircraft flight into the territory of the other Contracting Party in which the change of aircraft is made, only one flight may be made out of that territory unless authorized by the aeronautical authorities of the other Contracting Party to operate more than one flight.

Article 13

Tariffs

1. The Contracting Parties shall allow that a tariff on one of the routes as specified in the annex shall be established by each of the designated airlines, if possible after consultation between those airlines.

2. The tariffs for carriage on agreed services to and from the territory of the other Contracting Party shall be established at reasonable levels, due regard being paid to all relevant factors including cost of operation, reasonable profit, characteristics of service, the tariffs of other airlines over all or part of the same route.

3. The tariffs shall be submitted to and received by the aeronautical authorities of the Contracting Parties at least forty-five (45) days before the proposed date of their introduction; in special cases, a shorter period may be accepted by the aeronautical authorities.

If within thirty (30) days from the date of receipt, the aeronautical authorities of one Contracting Party have not notified the aeronautical authorities of the other Contracting Party that they are dissatisfied with the tariff submitted to them, such tariff shall be considered to be acceptable and shall come into effect on the date started in the proposed tariff.

In the event that a shorter period for the submission of a tariff is accepted by the aeronautical authorities, they may also agree that the period for giving notice of dissatisfaction be less than thirty (30) days.

4. If a notice of dissatisfaction has been filed in accordance with paragraph 3 of this article, the aeronautical authorities of the Contracting Parties shall hold consultations in accordance with Article 17 of this Agreement and endeavour to determine the tariff by agreement between themselves.

5. If the aeronautical authorities cannot agree on any tariff submitted to them under paragraph 3 of this article or on the determination of any tariff under paragraph 4 of this article, the dispute shall be settled in accordance with the provisions of article 18 of this Agreement.

6. If the aeronautical authorities of one of the Contracting Parties become dissatisfied with an established tariff, they shall so notify the aeronautical authorities of the other Contracting Party and the designated airlines shall attempt, where required, to reach an agreement.

If within the period of ninety (90) days from the date of receipt of a notice of dissatisfaction, a new tariff cannot be established, the procedures as set out in paragraphs 4 and 5 of this article shall apply.

7. When tariffs have been established in accordance with the provisions of this article, those tariffs shall remain in force until new tariffs have been established in accordance with the provisions of this article or article 18 of this Agreement.

8. No tariff shall come into force if the aeronautical authorities of either Contracting Party are dissatisfied with it except under the provision of paragraph 4 of article 18 of this Agreement.

9. The aeronautical authorities of both Contracting Parties shall endeavour to ensure that the tariffs charged and collected conform to the tariffs approved by them and are not subject to rebates.

Article 14

Staff requirements

1. The designated airline of one Contracting Party shall be allowed on the basis of reciprocity, to maintain in the territory of the other Contracting Party its representatives and commercial, operational and technical staff as required in connection with the operation of the agreed services.

2. These staff requirements may, at the option of the designated airline, be satisfied by its own personnel of any nationality or by using the services of any other organization, company or airline operating in the territory of the other Contracting Party and authorized to perform such services in the territory of that Contracting Party.

3. The representatives and staff shall be subject to the laws and regulations in force of the other Contracting Party. Consistent with such law and regulations, each Contracting Party shall, on the basis of reciprocity and with the minimum of delay, grant the necessary work permits, employment visas or other similar documents to the representatives and staff referred to in paragraph 1 of this article.

4. To the extent permitted under national law, both Contracting Parties shall dispense with the requirement of work permits or employment visas or other similar documents for personnel performing certain temporary services and duties.

Article 15

Sales and revenues

1. Each designated airline shall be granted the right to engage in the sale of air transportation in the territory of the other Contracting Party directly and, at its discretion, through its agents.

Each designated airline shall have the right to sell transportation in the currency of that territory or, at its discretion, in freely convertible currencies of other countries.

Any person shall be free to purchase such transportation in currencies accepted for sale by that airline.

2. Each Contracting Party grants to the designated airline of the other Contracting Party the right of free transfer of the excess of receipts over expenditures earned by the designated airline in its territory. Such transfers shall be effected on the basis of the official exchange rates for current payments, or where there are no official exchange rates, at the prevailing foreign exchange market rates for current payments, applicable on the day of the introduction of the request for transfer by the airline designated by the other Contracting Party and shall not be subject to any charges except normal service charges collected by banks for such transactions.

3. Each Contracting Party shall, on the basis of reciprocity, exempt the designated airline of the other Contracting Party from any form of taxation on income or profits derived by that airline in the territory of the first Contracting Party from the operation of international air services, as well as from any tax on turnover or capital.

This provision shall not have effect if a Convention for the avoidance of double taxation providing for a similar exemption shall be in force between the two Contracting Parties.

Article 16

Exchange of information

1. The aeronautical authorities of both Contracting Parties shall exchange information, as promptly as possible, concerning the current authorizations extended to their respective designated airline to render service to, through, and from the territory of the other Contracting Party. This will include copies of current certificates and authorizations for services on specified routes, together with amendments, exemption orders and authorized service patterns.

2. Each Contracting Party shall cause its designated airline to provide to the aeronautical authorities of the other Contracting Party, as long in advance as practicable, copies of tariffs, schedules, including any modification thereof, and all other relevant information concerning the operation of the agreed services, including information about the capacity provided on each of the specified routes and any further information as may be required to satisfy the aeronautical authorities of the other Contracting Party that the requirements of this Agreement are being duly observed.

3. Each Contracting Party shall cause its designated airline to provide to the aeronautical authorities of the other Contracting Party statistics relating to the traffic carried on the agreed services showing the points of embarkation and disembarkation.

Article 17

Consultations

1. The aeronautical authorities of the Contracting Parties shall consult each other from time to time with a view to ensuring close cooperation in all matters affecting the implementation of, and satisfactory compliance with, the provisions of this Agreement and of its Annex.

2. Such consultations shall begin within a period of sixty (60) days of the date of receipt of such a request, unless otherwise agreed by the Contracting Parties.

Article 18

Settlement of disputes

1. If any dispute arises between the Contracting Parties relating to the interpretation or application of this Agreement, the Contracting Parties shall in the first place endeavour to settle it by negotiation.

2. If the Contracting Parties fail to reach a settlement by negotiation, they may agree to refer the dispute for decision to some person or body, or either Contracting Party may submit the dispute for decision to a Tribunal of three arbitrators.

3. The arbitral tribunal shall be constituted as follows:

Each of the Contracting Parties shall nominate an arbitrator within a period of sixty (60) days from the date of receipt, by one Contracting Party, through diplomatic channels, of a request for arbitration from the other Contracting Party. These two arbitrators shall by agreement appoint a third arbitrator within a further period of sixty (6O) days.

The third arbitrator shall be a national of a third State, shall act as President of the Tribunal and shall determine the place where arbitration will be held.

If either of the Contracting Parties fails to nominate an arbitrator within the period specified, or if the third arbitrator is not appointed within the period specified, the President of the Council of the International Civil Aviation Organization may be requested by either Contracting Party to appoint an arbitrator or arbitrators as the case requires.

4. The Contracting Parties undertake to comply with any decision or award given under paragraphs 2 and 3 of this article.

If either Contracting Party fails to comply with such decision, the other Contracting Party shall have grounds for the application of article 5 of this Agreement.

5. The expenses of the arbitral tribunal shall be shared equally between the Contracting Parties.

Article 19

Modifications

1. If either of the Contracting Parties considers it desirable to modify any provision of this Agreement, it may request consultations with the other Contracting Party. Such consultations, which may be between aeronautical authorities and which may be through discussion or by correspondence, shall begin within a period of sixty (60) days from the date of the request.

2. If a general multilateral air convention comes into force in respect of both Contracting Parties, the provisions of such convention shall prevail. Consultations in accordance with paragraph 1 of this article may be held with a view to determining the extent to which this Agreement is affected by the provisions of the multilateral convention.

3. Any modification agreed pursuant to such consultations shall come into force when it has been confirmed by an exchange of diplomatic notes.

Article 20

Termination

1. Either Contracting Party may at any time give notice in writing through diplomatic channels to the other Contracting Party of its decision to terminate this Agreement.

Such notice shall be communicated simultaneously to the International Civil Aviation Organization.

2. The Agreement shall terminate one (1) year after the date of receipt of the notice by the other Contracting Party, unless the notice to terminate is withdrawn by mutual consent before the expiry of this period.

In the absence of acknowledgement of receipt by the other Contracting Party, the notice shall be deemed to have been received fourteen (14) days after the receipt of the notice by the International Civil Aviation Organization.

Article 21

Registration

This Agreement and any amendment thereto shall be registered with the International Civil Aviation Organization.

Article 22

Entry into force

Each of the Contracting Parties shall notify the other Contracting Party through the diplomatic channel of the completion of its constitutional formalities required to bring this Agreement into effect.

The Agreement shall come into force on the first day of the month from the date of the last notification.

In witness whereof the undersigned, being duly authorized thereto by their respective Governments, have signed the present Agreement.

Done in Riga, on the 12th of December, 1994 in two originals each in the English language which will be the authentic text.

Any point or points on the agreed routes may be omitted by the designated airlines of both Contracting Parties or may be operated in a different order on any or all flights, provided that the point of departure or arrival is in the country of their nationality.

Latvijas Republikas valdības un Beļģijas Karalistes valdības līgums par gaisa satiksmi

Latvijas Republikas valdība un Beļģijas Karalistes valdība (turpmāk — Līgumslēdzējas Puses),

būdamas Konvencijas par starptautisko civilo aviāciju, kas atklāta parakstīšanai 1944.gada 7.decembrī Čikāgā, dalībnieces;

vēloties noslēgt līgumu, kas papildina minēto Konvenciju, lai nodibinātu regulāru gaisa satiksmi starp to attiecīgajām teritorijām un aiz tām;

vēloties garantēt augstāku starptautiskās aviācijas drošības pakāpi;

ir vienojušās par sekojošo:

1. pants

Definīcijas

Šajā Līgumā, ja kontekstā nav paredzēts citādi,

a) termins "Konvencija" nozīmē Konvenciju par starptautisko civilo aviāciju, kas atklāta parakstīšanai 1944.gada 7.decembrī Čikāgā un ietver pielikumus, kas pieņemti saskaņā ar šīs Konvencijas 90. pantu un jebkurus tās pielikumu grozījumus, kas izdarīti saskaņā ar Konvencijas 90. un 94.pantu, ciktāl šos pielikumus un grozījumus ir pieņēmušas vai ratificējušas abas Līgumslēdzējas Puses;

b) termins "Līgums" nozīmē šo Līgumu, tā pielikumu un jebkurus šī Līguma vai tā pielikuma grozījumus;

c) termins "aviācijas institūcijas" Latvijas Republikas gadījumā nozīmē Satiksmes ministriju, Beļģijas Karalistes gadījumā — Sakaru ministriju vai abos gadījumos — jebkuru citu personu vai institūciju, kas ir pilnvarota veikt minēto institūciju funkcijas;

d) terminiem "teritorija", "gaisa satiksme", "starptautiskā gaisa satiksme", "aviokompānija" un "nosēšanās nekomerciālos nolūkos" ir attiecīgi Konvencijas 2. un 96.pantos paredzētā nozīme;

e) ar terminu "nozīmētā aviokompānija" jāsaprot aviokompānija, kas nozīmēta un pilnvarota saskaņā ar šā Līguma 3. un 4.pantu;

f) termins "Līgumā noteiktā satiksme" nozīmē regulāru gaisa satiksmi, kas tiek veikta šā Līguma pielikumā noteiktajos maršrutos, lai kopīgi vai atsevišķi pārvadātu pasažierus, kravu un pastu;

g) termins "tarifi" nozīmē cenas, kuras jāmaksā par pasažieru, bagāžas un kravas pārvadāšanu un nosacījumus, kādos šīs cenas tiek piemērotas, ieskaitot aģentūras un citus pakalpojumus, bet izņemot atlīdzību un nosacījumus par pasta pārvadāšanu;

h) termins "kapacitātes maiņa" nozīmē, ka, veicot Līgumā noteikto satiksmi, nozīmētā aviokompānija vienā maršruta posmā izmanto citas ietilpības gaisa kuģi nekā pārējā tā daļā;

i) terminiem "gaisa kuģa iekārtas", "galvenās iekārtas", "gaisa kuģa krājumi", "rezerves daļas" ir attiecīgi Konvencijas 9.pielikumā noteiktā nozīme.

2. pants

Tiesības veikt satiksmi

1. Lai otras Līgumslēdzējas Puses nozīmētā aviokompānija varētu veikt starptautisko gaisa satiksmi, katra Līgumslēdzēja Puse, ja pielikumā nav paredzēts citādi, piešķir otrai Līgumslēdzējai Pusei šādas tiesības:

a) bez nosēšanās lidot pāri otras Līgumslēdzējas Puses teritorijai;

b) apstāties minētajā teritorijā nekomerciālos nolūkos; un

c) apstāties minētajā teritorijā, lai, veicot starptautisko gaisa satiksmi, pielikumā noteiktajos punktos atsevišķi vai kopīgi uzņemtu vai izsēdinātu pasažierus, iekrautu vai izkrautu kravu un pastu.

2. Nekādi šī panta 1.punkta nosacījumi nepiešķir vienas Līgumslēdzējas Puses nozīmētajai aviokompānijai tiesības otras Līgumslēdzējas Puses teritorijā uzņemt gaisa kuģī pasažierus, kravu un pastu, lai par atlīdzību vai uz nomas līguma pamata nogādātu uz citu punktu šīs otras Līgumslēdzējas Puses teritorijā.

3. pants

Aviokompānijas nozīmēšana

1. Katrai Līgumslēdzējai Pusei ir tiesības ar diplomātisku notu, kuru nosūta otrai Līgumslēdzējai Pusei, nozīmēt aviokompāniju satiksmes veikšanai Līguma pielikumā noteiktajos maršrutos.

2. Katrai Līgumslēdzējai Pusei ir tiesības ar diplomātisku notu, kuru nosūta otrai Līgumslēdzējai Pusei, atsaukt jebkuras aviokompānijas nozīmējumu un nozīmēt tās vietā citu.

4. pants

Atļauja veikt satiksmi

1. Pēc paziņojuma par aviokompānijas nozīmēšanu, kuru vienas Līgumslēdzējas Puses aviācijas institūcijas sniedz saskaņā ar šā Līguma 3.pantu, saņemšanas otras Līgumslēdzējas Puses aviācijas institūcijas atbilstoši to likumiem un noteikumiem bez kavēšanās izsniedz nozīmētajai aviokompānijai attiecīgas atļaujas veikt Līgumā noteikto satiksmi, kuras veikšanai šī aviokompānija nozīmēta.

2. Pēc šo atļauju saņemšanas aviokompānija jebkurā laikā pilnīgi vai daļēji drīkst uzsākt Līgumā noteikto satiksmi, ja tā ir izpildījusi šā Līguma noteikumus un ja tarifi ir noteikti saskaņā ar šā Līguma 13.panta noteikumiem.

5. pants

Pārvadājumu atļaujas atsaukšana vai pārtraukšana

1. Katras Līgumslēdzējas Puses aviācijas institūcijām ir tiesības apturēt šā Līguma 4.pantā noteiktās atļaujas attiecībā uz otras Līgumslēdzējas Puses nozīmēto aviokompāniju, atsaukt vai apturēt šīs atļaujas vai uzlikt pagaidu vai pastāvīgu nosacījumu izpildi šādos gadījumos:

a) ja aviokompānija nevar pierādīt, ka tā spēj izpildīt likumu un noteikumu prasības, kurus šīs aviācijas institūcijas saskaņā ar Konvenciju parasti un saprātīgi piemēro starptautiskajai gaisa satiksmei;

b) ja aviokompānija nespēj darboties saskaņā ar šā Līguma noteikumiem;

c) ja aviokompānija nespēj izpildīt šīs Līgumslēdzējas Puses likumus un noteikumus;

d) ja tām nav pierādījumu, ka reālā īpašuma tiesības uz aviokompāniju un efektīvā kontrole pār to ir Līgumslēdzējai Pusei, kas nozīmējusi aviokompāniju, vai tās pilsoņiem.

2. Ja nav nepieciešama nekavējoša rīcība, lai novērstu minēto likumu un noteikumu pārkāpšanu, šī panta 1.punktā noteiktās tiesības saskaņā ar šā Līguma 17.pantu tiks izmantotas tikai pēc konsultācijām ar otras Līgumslēdzējas Puses aviācijas institūcijām.

6. pants

Likumu un noteikumu piemērošana

1. Vienas Līgumslēdzējas Puses likumi un noteikumi, kas attiecas uz starptautiskajā gaisa satiksmē iesaistīta gaisa kuģa ierašanos tās teritorijā, uzturēšanos tajā vai tās atstāšanu vai uz šī gaisa kuģa veiktajiem pārvadājumiem un navigāciju tiek piemēroti arī otras Līgumslēdzējas Puses nozīmētajai aviokompānijai ierodoties minētajā teritorijā, to atstājot vai uzturoties tajā.

2. Vienas Līgumslēdzējas Puses nozīmētā aviokompānija ievēros otras Līgumslēdzējas Puses likumus un noteikumus, kas attiecas uz muitas deklarācijām, atbrīvojumiem, tranzītu, imigrāciju, pasēm, muitu, valūtu, sanitārajiem noteikumiem un karantīnu, gaisa kuģu apkalpēm, pasažieriem, kravai un pastam šķērsojot tranzītā šīs otras Līgumslēdzējas Puses teritoriju, ierodoties tajā, to atstājot vai uzturoties tajā.

Pasažieri, kuri tranzītā šķērso vienas vai otras Līgumslēdzējas Puses teritoriju, tiks pakļauti ne vairāk kā vienai vienkāršotai kontrolei.

3. Neviena Līgumslēdzēja Puse, piemērojot šī panta 1. un 2.punktā minētos noteikumus un atļaujot izmantot tās kontrolē esošās lidostas, gaisa trases, gaisa satiksmes pakalpojumus un ar tiem saistītas ierīces, nepiešķirs priekšrocības savai vai jebkurai citai aviokompānijai salīdzinājumā ar otras Līgumslēdzējas Puses aviokompāniju, kas iesaistīta līdzīgā starptautiskajā gaisa satiksmē.

7. pants

Apliecības un licences

1. Lidojumu derīguma apliecības, kvalifikācijas apliecības un licences, kuras ir izsniegusi vai apstiprinājusi viena Līgumslēdzēja Puse un kuras vēl ir spēkā, otrai Līgumslēdzējai Pusei ir jāatzīst par spēkā esošām, lai veiktu Līgumā paredzēto satiksmi tā pielikumā noteiktajos maršrutos, ja šīs apliecības vai licences ir izdotas vai atzītas par spēkā esošām saskaņā ar standartiem, kas noteikti Konvencijā.

Katrai Līgumslēdzējai Pusei ir tiesības atteikties atzīt kvalifikācijas apliecības un licences, kuras tās pilsoņiem lidojumiem pāri tās teritorijai izdevusi otra Līgumslēdzēja Puse.

2. Ja šī panta 1.punktā minētās apliecības vai licences ir izdotas vai stājušās spēkā saskaņā ar prasībām, kuras atšķiras no Konvencijas standartiem un ja šīs atšķirības ir reģistrētas Starptautiskajā civilās aviācijas organizācijā, otras Līgumslēdzējas Puses aviācijas institūcijas ir tiesīgas pieprasīt konsultācijas saskaņā ar šā Līguma 17.pantu, lai pārliecinātos, ka šīs apspriežamās prasības tām ir pieņemamas.

Ja nav iespējams vienoties par jautājumiem, kas attiecas uz lidojumu drošību, jānosaka, kad tiks piemēroti šā Līguma 5.panta noteikumi.

8. pants

Aviācijas drošība

1. Līgumslēdzējas Puses apliecina, ka to pienākums vienai pret otru aizsargāt civilās aviācijas drošību pret nelikumīgas iejaukšanās aktiem veido šā Līguma neatņemamu sastāvdaļu.

2. Katra Līgumslēdzēja Puse pēc otras Līgumslēdzējas Puses pieprasījuma sniedz tai visu nepieciešamo palīdzību, lai novērstu nelikumīgu gaisa kuģa sagrābšanu, citus nelikumīgus aktus, kas vērsti pret pasažieru, apkalpes, gaisa kuģa, lidostu un aeronavigācijas iekārtu drošību un jebkurus citus draudus civilās aviācijas drošībai.

3. Līgumslēdzējas Puses rīkojas saskaņā ar noteikumiem, kuri paredzēti Konvencijā par noziegumiem un dažiem citiem aktiem, kas izdarīti gaisa kuģos, kura parakstīta 1963.gada 14.septembrī Tokijā, Konvencijā par cīņu pret nelikumīgu gaisa kuģu sagrābšanu, kura parakstīta 1970.gada 16.decembrī Hāgā, un Konvencijā par nelikumīgiem aktiem, kas apdraud civilās aviācijas drošību, kura parakstīta 1971.gada 23.septembrī Monreālā.

4. Līgumslēdzējas Puses savstarpējās attiecībās rīkosies saskaņā ar aviācijas drošības noteikumiem, kurus pieņēmusi Starptautiskā civilās aviācijas organizācija un kuri kā pielikumi ir pievienoti Konvencijai par starptautisko civilo aviāciju, ciktāl šie drošības noteikumi ir piemērojami Pusēm; tās pieprasīs, lai to reģistrā reģistrēto gaisa kuģu ekspluatanti vai ekspluatanti, kuru pamata darbības vieta vai pastāvīgā uzturēšanās vieta ir to teritorijā, un to teritorijā esošo lidostu ekspluatanti rīkotos saskaņā ar šiem aviācijas drošības noteikumiem.

5. Katra Līgumslēdzēja Puse piekrīt ievērot aviācijas drošības noteikumus, kurus otra Līgumslēdzēja Puse piemēro tiem, kas ierodas tās teritorijā, kā arī pakļauties attiecīgiem pasažieru, apkalpes, tiem klātesošās bagāžas un kravas pārbaudes pasākumiem pirms iekāpšanas vai iekraušanas. Katra Līgumslēdzēja Puse ar sapratni izvērtēs jebkuru otras Līgumslēdzējas Puses lūgumu pēc īpašiem drošības pasākumiem, lai novērstu īpašus draudus tās gaisa kuģiem vai pasažieriem.

6. Nelikumīga gaisa kuģa sagrābšanas incidenta vai tā draudu gadījumā vai citu pret pasažieru, apkalpes, gaisa kuģa, lidostu un aeronavigācijas iekārtu drošību vērstu nelikumīgu aktu gadījumā Līgumslēdzējas Puses palīdzēs viena otrai, atvieglojot sakarus un veicot citus attiecīgus pasākumus, lai ātri un droši novērstu šādu incidentu vai tā draudus.

7. Ja viena Līgumslēdzēja Puse neievēro šajā pantā paredzētos aviācijas drošības noteikumus, otras Līgumslēdzējas Puses aviācijas institūcijas ir tiesīgas pieprasīt nekavējošas konsultācijas ar minētās Līgumslēdzējas Puses aviācijas institūcijām. Ja nav iespējams panākt apmierinošu vienošanos trīsdesmit (30) dienu laikā, tad var tikt piemēroti šā Līguma 5.panta noteikumi.

9. pants

Lietotāju maksājumi

1. Maksājumi, kuri vienas Līgumslēdzējas Puses teritorijā tiek noteikti otras Līgumslēdzējas Puses nozīmētajai aviokompānijai par lidostu un citu aviācijas iekārtu pakalpojumiem, kurus izmantojis šīs otras Līgumslēdzējas Puses nozīmētās aviokompānijas gaisa kuģis, nedrīkst būt augstāki par maksājumiem, kuri noteikti pirmās Līgumslēdzējas Puses nozīmētajai aviokompānijai.

2. Katrai Līgumslēdzējai Pusei, ja iespējams — ar aviokompāniju pārstāvniecību starpniecību, jāveicina tās kompetento maksājumu iekasēšanas institūciju savstarpējas konsultācijas ar nozīmētajām aviokompānijām, kas izmanto iekārtas un pakalpojumus. Par jebkuru priekšlikumu izdarīt izmaiņas lietotāju maksājumos jāsniedz motivēts paziņojums, lai dotu tām iespēju izteikt savus uzskatus pirms izmaiņu izdarīšanas.

10. pants

Muita un akcīze

1. Katra Līgumslēdzēja Puse atbrīvos otras Līgumslēdzējas Puses nozīmēto aviokompāniju no importa ierobežojumiem, muitas nodokļiem, akcīzes nodokļiem, tehniskās apskates maksājumiem un citiem valsts, reģionālajiem un vietējiem nodokļiem un maksājumiem par gaisa kuģi, degvielu, smērvielām, patērējamiem tehniskajiem līdzekļiem, rezerves daļām, ieskaitot dzinējus, parasto gaisa kuģa aprīkojumu, uz zemes izmantojamo aprīkojumu, gaisa kuģa krājumus un citas pārvadājumu veikšanai vai gaisa kuģa apkalpei domātas lietas, kuras paredzētas izmantošanai vai kuras tiek izmantotas vienīgi otras Līgumslēdzējas Puses nozīmētās aviokompānijas gaisa kuģī, kas veic Līgumā paredzēto satiksmi, kā arī iespiestu aviobiļešu krājumus, pavadzīmes, jebkurus iespiestus materiālus ar kompānijas emblēmu un iespiestus materiālus, kurus nozīmētā aviokompānija izdala bez maksas.

2. Šajā pantā paredzētie atbrīvojumi tiek piemēroti šī panta 1.punktā minētajām lietām, neatkarīgi no tā, vai minētās lietas tiek izmantotas vai pilnīgi patērētas atbrīvojumus piešķīrušās Līgumslēdzējas Puses teritorijā, ja šīs lietas:

a) vienas Līgumslēdzējas Puses teritorijā ievedusi otras Līgumslēdzējas Puses nozīmētā aviokompānija, bet minētajā teritorijā tās netiek atsavinātas;

b) paliek vienas Līgumslēdzējas Puses nozīmētās aviokompānijas gaisa kuģī, tam ierodoties otras Līgumslēdzējas Puses teritorijā vai to atstājot;

c) uzņemtas vienas Līgumslēdzējas Puses nozīmētās aviokompānijas gaisa kuģī otras Līgumslēdzējas Puses teritorijā, un kuras paredzēts izmantot Līgumā paredzētās satiksmes veikšanas laikā.

3. Parastais gaisa kuģa aprīkojums, uz zemes izmantojamais aprīkojums, kā arī materiāli un krājumi, kuri parasti atrodas katras nozīmētās aviokompānijas gaisa kuģī, var tikt izkrauti otras Līgumslēdzējas Puses teritorijā tikai pēc šīs teritorijas muitas institūciju atļaujas. Šajā gadījumā tās jānovieto minēto institūciju uzraudzībā līdz brīdim, kad tās saskaņā ar muitas noteikumiem tiek izvestas vai citādi izvietotas.

4. Tiešā tranzīta bagāža un krava tiks atbrīvota no muitas nodokļiem un citām nodevām.

5. Atbrīvojumi, kuri noteikti šajā pantā, var tikt piemēroti, ja vienas Līgumslēdzējas Puses nozīmētā aviokompānija vienojas ar citu aviokompāniju, kas tāpat izmanto šos otras Līgumslēdzējas Puses piešķirtos atbrīvojumus, kuri attiecas uz tās teritorijā veikto šī panta 1. punktā minēto lietu aizdevumu vai pārsūtīšanu.

11. pants

Kapacitāte

1. Katras Līgumslēdzējas Puses nozīmētajai aviokompānijai ir taisnīgas un vienlīdzīgas iespējas veikt Līgumā paredzēto satiksmi starp Līgumslēdzēju Pušu teritorijām un aiz to robežām šā Līguma pielikumā noteiktajos maršrutos.

2. Veicot Līgumā paredzēto satiksmi, katras Līgumslēdzējas Puses nozīmētā aviokompānija ņem vērā otras Līgumslēdzējas Puses nozīmētās aviokompānijas intereses, lai nenodarītu kaitējumu satiksmei, kuru tā veiks tajā pašā maršrutā vai tā posmā.

3. Nozīmēto aviokompāniju sniegtajiem pakalpojumiem jābūt saprātīgā apjomā saistītiem ar sabiedrības pieprasījumu pēc pārvadājumiem noteiktos maršrutos un to galvenais mērķis ir nodrošināt pieņemamam noslodzes faktoram adekvātu kapacitāti, lai nodrošinātu esošo un saprātīgi paredzamo pieprasījumu pēc pasažieru, kravas un pasta pārvadājumiem starp Līgumslēdzēju Pušu teritorijām.

4. Nozīmētās aviokompānijas ne vēlāk kā trīsdesmit (30) dienas pirms Līgumā paredzētās satiksmes uzsākšanas abu Līgumslēdzēju Pušu aviācijas institūcijām iesniedz apstiprināšanai lidojumu programmas. Minētajām lidojumu programmām jāietver ziņas par apkalpošanas veidu, izmantojamo gaisa kuģi, lidojumu biežumu kā arī lidojumu saraksti. Tas pats attiecas arī uz vēlāk izdarāmajiem grozījumiem. Īpašos gadījumos pēc minēto institūciju piekrišanas šis termiņš var tikt saīsināts.

12. pants

Satiksmes kapacitātes maiņa

Vienas Līgumslēdzējas Puses nozīmētā aviokompānija otras Līgumslēdzējas Puses teritorijā ir tiesīga veikt satiksmes plūsmas kapacitātes maiņu sekojošos gadījumos:

a) ja šādu maiņu izraisa ekonomiski iemesli;

b) ja gaisa kuģis, kas veic pārvadājumus posmā, kurš atrodas vistālāk no Līgumslēdzējas Puses teritorijas, veic šos pārvadājumus tikai saistībā ar gaisa kuģi tuvākajā posmā un šāda saistība ir iepriekš plānota; pirmais gaisa kuģis ierodas kapacitātes maiņas punktā, lai nodotu pasažierus, kravu un pastu otrajam gaisa kuģim, un kapacitāte jānosaka, vadoties no šī mērķa;

c) ja aviokompānija publiski, ar reklāmas palīdzību vai citādi, nepiedāvā savus satiksmes pakalpojumus, kas sākas punktā, kur notiek gaisa kuģa maiņa, ja šā Līguma pielikumā nav paredzēta cita kārtība;

d) ja katrā lidojumā uz otras Līgumslēdzējas Puses teritoriju, kurā notiek gaisa kuģa maiņa, ir tikai viens lidojums aiz šīs teritorijas robežām, izņemot gadījumus, kad otras Līgumslēdzējas Puses aviācijas institūcijas ir atļāvušas veikt vairāk par vienu lidojumu.

13. pants

Tarifi

1. Līgumslēdzējas Puses piekritīs, ka tarifu katram pielikumā minētajam maršrutam noteiks katra nozīmētā aviokompānija, ja iespējams, pēc šo aviokompāniju savstarpējām konsultācijām.

2. Tarifi par pārvadājumiem, veicot Līgumā paredzēto satiksmi uz otras Līgumslēdzējas Puses teritoriju un no tās, jānosaka saprātīgā līmenī, pienācīgu uzmanību veltot visiem būtiskajiem faktoriem, ieskaitot pārvadājumu izmaksas, saprātīgu peļņu, pakalpojumu raksturojumu, citu aviokompāniju tarifi tajā pašā maršrutā vai tā posmā.

3. Tarifi jāiesniedz un Līgumslēdzēju Pušu aviācijas institūcijām tie jāsaņem vismaz četrdesmit piecas (45) dienas pirms paredzētās to ieviešanas dienas; īpašos gadījumos aviācijas institūcijas ir tiesīgas noteikt īsāku periodu.

Ja trīsdesmit (30) dienas pēc tarifa saņemšanas vienas Līgumslēdzējas Puses aviācijas institūcijas nepaziņo otras Līgumslēdzējas Puses aviācijas institūcijām, ka nepiekrīt iesniegtajam tarifam, šis tarifs tiek uzskatīts par pieņemamu un stājas spēkā dienā, kas noteikta iesniegtajā tarifa projektā.

Ja aviācijas institūcijas ir piekritušas īsākam tarifa iesniegšanas periodam, tās var vienoties, ka paziņojuma par noraidījumu iesniegšanas termiņš būs īsāks nekā trīsdesmit (30) dienas.

4. Ja paziņojums par noraidījumu ir sniegts saskaņā ar šī panta 3.punktu, Līgumslēdzēju Pušu aviācijas institūcijas saskaņā ar šā Līguma 17.pantu konsultēsies un centīsies noteikt tarifu pēc savstarpējas vienošanās.

5. Ja aviācijas institūcijas nespēs vienoties par tarifu, kas tām iesniegts saskaņā ar šī panta 3.punktu, vai par tarifa noteikšanu saskaņā ar šī panta 4.punktu, strīds tiks izšķirts saskaņā ar šā Līguma 18.panta noteikumiem.

6. Ja vienas Līgumslēdzējas Puses aviācijas institūcijas būs neapmierinātas ar noteikto tarifu, tās paziņos otras Līgumslēdzējas Puses aviācijas institūcijām, un nozīmētās aviokompānijas pēc to pieprasījuma centīsies panākt vienošanos.

Ja deviņdesmit (90) dienu laikā pēc paziņojuma par noraidījumu saņemšanas jauns tarifs netiks noteikts, tiks piemērotas šī panta 4. un 5.punktos paredzētās procedūras.

7. Ja tarifi ir noteikti saskaņā ar šī panta noteikumiem, minētie tarifi būs spēkā līdz jaunu tarifu noteikšanai saskaņā ar šī panta vai šā Līguma 18.panta noteikumiem.

8. Neviens tarifs nestāsies spēkā, ja Līgumslēdzēju Pušu aviācijas institūcijas tam nepiekrīt, izņemot šā Līguma 18.panta 4.punktā paredzētos noteikumus.

9. Abu Līgumslēdzēju Pušu aviācijas institūcijas centīsies nodrošināt, lai tarifi, kas tiek piemēroti un iekasēti, atbilstu to apstiprinātajiem tarifiem un tiem netiktu piemērotas atlaides.

14. pants

Nepieciešamais personāls

1. Vienas Līgumslēdzējas Puses nozīmētajai aviokompānijai uz savstarpējiem pamatiem tiks atļauts otras Līgumslēdzējas Puses teritorijā uzturēt savus pārstāvjus un komerciālo, pārvadājumu un tehnisko personālu, kas nepieciešams, lai veiktu Līgumā paredzēto satiksmi.

2. Nepieciešamo personālu pēc nozīmētās aviokompānijas izvēles drīkst komplektēt no jebkuras valsts pilsoņiem vai arī izmantot jebkuras citas organizācijas, kompānijas vai aviokompānijas pakalpojumus, kas darbojas otras Līgumslēdzējas Puses teritorijā un ir pilnvarota sniegt minētos pakalpojumus šīs Līgumslēdzējas Puses teritorijā.

3. Pārstāvji un personāls pakļausies otras Līgumslēdzējas Puses spēkā esošajiem likumiem un noteikumiem. Līdztekus minētajiem likumiem un noteikumiem katra Līgumslēdzēja Puse uz savstarpējiem pamatiem un pēc iespējas nekavējoties nodrošinās nepieciešamās darba atļaujas, darba vīzas vai citus līdzīgus dokumentus, kas nepieciešami šī panta 1.punktā minētajiem pārstāvjiem un personālam.

4. Valsts likumdošanā paredzētajā apjomā abas Līgumslēdzējas Puses piekritīs, ka personālam, kas veic pagaidu pakalpojumus un pienākumus, nebūs nepieciešamas darba atļaujas, darba vīzas vai citi līdzīgi dokumenti.

15. pants

Satiksmes pakalpojumu sniegšana un ienākumi

1. Katrai Līgumslēdzējai Pusei tiek nodrošinātas tiesības iesaistīties gaisa satiksmes pakalpojumu sniegšanā otras Līgumslēdzējas Puses teritorijā, pēc tās izvēles, tieši vai ar tās aģentu starpniecību.

Katrai nozīmētajai aviokompānijai ir tiesības sniegt satiksmes pakalpojumus, pēc tās izvēles, par minētajā teritorijā izmantojamo valūtu vai par citu valstu brīvi konvertējamu valūtu.

Jebkurai personai ir tiesības maksāt par šiem satiksmes pakalpojumiem tajā valūtā, kuru minētā aviokompānija ir atzinusi par pieņemamu tirdzniecībā.

2. Katra Līgumslēdzēja Puse nodrošina otras Līgumslēdzējas Puses nozīmētajai aviokompānijai tiesības brīvi pārsūtīt atlikumus, kas pakalpojumu sniegšanas teritorijā iegūti, saņemtajai naudas summai pārsniedzot izdoto. Šie pārsūtījumi jāveic, pamatojoties uz oficiālo valūtas maiņas kursu vai, ja nav noteikts oficiālais valūtas maiņas kurss, pēc dominējošā ārvalstu valūtas tirgus maiņas kursa dienā, kad otras Līgumslēdzējas Puses nozīmētā aviokompānija iesniegusi pieprasījumu par pārvedumu, neiekasējot nekādus maksājumus, izņemot parastos maksājumus bankai par šo pakalpojumu veikšanu.

3. Katra Līgumslēdzēja Puse savstarpēji atbrīvos otras Līgumslēdzējas Puses nozīmētās aviokompānijas ienākumus un peļņu, kurus šī aviokompānija ieguvusi pirmās Līgumslēdzējas Puses teritorijā starptautiskās gaisa satiksmes pakalpojumu sniegšanas rezultātā, no jebkuras aplikšanas ar nodokļiem, kā arī no apgrozījuma vai kapitāla nodokļiem.

Šis noteikums pārstās būt spēkā, ja Līgumslēdzējas Puses parakstīs konvenciju par savstarpēju atbrīvošanu no divkāršas aplikšanas ar nodokļiem.

16. pants

Informācijas apmaiņa

1. Abu Līgumslēdzēju Pušu aviācijas institūcijas, cik ātri iespējams, apmainīsies ar informāciju par to nozīmētajām aviokompānijām izsniegtajām spēkā esošajām atļaujām veikt satiksmi uz otras Līgumslēdzējas Puses teritoriju, no tās vai pāri tai. Šajā informācijā jāiekļauj spēkā esošo sertifikātu un atļauju veikt satiksmi noteiktajos maršrutos noraksti un to grozījumi, pavēles par aizliegumu un atļautās satiksmes veids.

2. Katra Līgumslēdzēja Puse pieprasīs, lai tās nozīmētā aviokompānija reāli izpildāmā termiņā nodrošinātu otras Līgumslēdzējas Puses aviācijas institūcijas ar tarifu, sarakstu, ieskaitot to grozījumus, norakstiem un visu būtisko informāciju par Līgumā paredzēto satiksmi, ieskaitot informāciju par katra noteiktā maršruta kapacitāti, un jebkuru papildu informāciju, kuru var pieprasīt otras Līgumslēdzējas Puses aviācijas institūcijas, lai pārliecinātos, ka šī Līguma noteikumi tiek pilnībā ievēroti.

3. Katra Līgumslēdzēja Puse pieprasīs, lai tās nozīmētā aviokompānija nodrošinātu otras Līgumslēdzējas Puses aviācijas institūcijas ar statistikas datiem par pārvadājumiem Līgumā noteiktajos maršrutos, norādot punktus, kuros notiek iekāpšana gaisa kuģos un izkāpšana no tiem.

17. pants

Konsultācijas

1. Līgumslēdzēju Pušu aviācijas institūcijas laiku pa laikam konsultēs viena otru, lai ciešas sadarbības garā nodrošinātu šā Līguma un tā pielikuma nosacījumu ieviešanu un ievērošanu.

2. Šīm konsultācijām jāsākas sešdesmit (60) dienu laikā pēc pieprasījuma saņemšanas, ja Līgumslēdzējas Puses nav paredzējušas citu termiņu.

18. pants

Strīdu izšķiršana

1. Ja Līgumslēdzējām Pusēm radīsies domstarpības par šā Līguma tulkošanu vai piemērošanu, Līgumslēdzējas Puses vispirms centīsies to atrisināt sarunu ceļā.

2. Ja Līgumslēdzējas Puses nespēs izšķirt strīdu sarunu ceļā, tās var vienoties par strīda izšķiršanas uzticēšanu kādai personai vai institūcijai, vai arī viena no Līgumslēdzējām Pusēm, lai izšķirtu strīdu, var griezties triju tiesnešu šķīrējtiesā.

3. Šķīrējtiesa tiek izveidota šādi:

Katra Līgumslēdzēja Puse sešdesmit (60) dienu laikā pēc dienas, kad viena Līgumslēdzēja Puse ir saņēmusi diplomātiskā ceļā nosūtītu pieprasījumu par strīda izšķiršanu, ieceļ savu tiesnesi. Abi ieceltie tiesneši pēc savstarpējas vienošanās nākošo sešdesmit (60) dienu laikā ieceļ trešo tiesnesi. Trešajam tiesnesim jābūt trešās valsts pilsonim, viņam jāveic šķīrējtiesas priekšsēdētāja funkcijas un jānosaka vieta, kurā šķīrējtiesa darbosies.

Ja kāda Līgumslēdzēja Puse nenozīmē savu tiesnesi noteiktajā termiņā vai ja trešais tiesnesis nav nozīmēts noteiktajā periodā, jebkura Līgumslēdzēja Puse ir tiesīga lūgt, lai Starptautiskās civilās aviācijas organizācijas Padomes prezidents nozīmē nepieciešamo tiesnesi vai tiesnešus.

4. Līgumslēdzējas Puses apņemas pildīt jebkuru lēmumu, kas pieņemts saskaņā ar šī panta 2. un 3.punktu.

Ja viena Līgumslēdzēja Puse nepilda šādu lēmumu, otra Līgumslēdzēja Puse ir tiesīga piemērot šā Līguma 5.panta noteikumus.

5. Šķīrējtiesas izdevumus vienlīdzīgās daļās sedz abas Līgumslēdzējas Puses.

19. pants

Grozījumi

1. Ja viena Līgumslēdzēja Puse vēlas grozīt kādu no šā Līguma noteikumiem, tā var pieprasīt konsultācijas ar otru Līgumslēdzēju Pusi. Šādām konsultācijām, ko ir tiesīgas veikt aviācijas institūcijas un kas var notikt diskusiju ceļā vai apmainoties ar korespondenci, jāsākas sešdesmit (60) dienu laikā no pieprasījuma iesniegšanas dienas.

2. Ja attiecībā uz abām Līgumslēdzējām Pusēm ir stājusies spēkā daudzpusēja konvencija gaisa satiksmes jomā, priekšroka dodama šādas konvencijas noteikumiem. Saskaņā ar šī panta 1.punktu var tikt veiktas konsultācijas, lai noteiktu, kā šo Līgumu ietekmē daudzpusējās konvencijas noteikumi.

3. Jebkuri grozījumi, par kuriem šādās konsultācijās ir panākta vienošanās, stājas spēkā pēc to apstiprināšanas, kas tiek veikta, apmainoties ar diplomātiskajām notām.

20. pants

Līguma pārtraukšana

1. Katrai Līgumslēdzējai Pusei ir tiesības jebkurā laikā diplomātiskā ceļā nosūtīt otrai Līgumslēdzējai Pusei rakstisku paziņojumu par tās lēmumu pārtraukt šo Līgumu.

Šis paziņojums vienlaikus jānosūta arī Starptautiskajai civilās aviācijas organizācijai.

2. Līgums tiek pārtraukts vienu (1) gadu pēc dienas, kad paziņojumu saņēmusi otra Līgumslēdzēja Puse, ja paziņojums par Līguma pārtraukšanu pēc savstarpējas vienošanās netiek atsaukts līdz minētā termiņa beigām.

Ja otra Līgumslēdzēja Puse neapliecina, ka ir saņēmusi paziņojumu, paziņojums tiek uzskatīts par saņemtu četrpadsmit (14) dienas pēc tam, kad to saņēmusi Starptautiskā civilās aviācijas organizācija.

21. pants

Reģistrēšana

Šis Līgums un jebkurš tā grozījums jāreģistrē Starptautiskajā civilās aviācijas organizācijā.

22. pants

Stāšanās spēkā

Katra Līgumslēdzēja Puse diplomātiskā ceļā paziņo otrai Līgumslēdzējai Pusei, ka ir izpildītas tās konstitucionālās prasības, lai Līgums varētu stāties spēkā.

Šis Līgums stājas spēkā nākošā mēneša pirmajā dienā pēc dienas, kad saņemta pēdējā nota.

To apliecinot, savu valdību pienācīgi pilnvaroti pārstāvji paraksta šo Līgumu.

Parakstīts Rīgā 1994. gada 12. decembrī divos eksemplāros angļu valodā, un abi teksti ir autentiski.
