prezidents izsludina šādu likumu:
Par Latvijas Republikas valdības un Zviedrijas Karalistes valdības līgumu par savstarpējo palīdzību muitas jautājumos
1.pants. 1995.gada 17.novembrī Stokholmā parakstītais Latvijas Republikas valdības un Zviedrijas Karalistes valdības līgums par savstarpējo palīdzību muitas jautājumos (turpmāk — Līgums) ar šo likumu tiek pieņemts un apstiprināts.
2.pants. Likums stājas spēkā tā izsludināšanas dienā. Līdz ar likumu izsludināms Līgums latviešu un angļu valodā.
3.pants. Latvijas Republikas Ārlietu ministrija uz šā likuma pamata un saskaņā ar Līguma 20.pantu sagatavo ratifikācijas rakstu nosūtīšanai Zviedrijas Karalistes valdībai.
4.pants. Līgums stājas spēkā tā 20.pantā noteiktajā laikā un kārtībā.
Likums Saeimā pieņemts 1996.gada 1.februārī.

Latvijas Republikas valdības un Zviedrijas Karalistes valdības līgums par savstarpējo palīdzību muitas jautājumos

 Latvijas Republikas Valdība un Zviedrijas Karalistes Valdība, turpmāk — Līgumslēdzējas Puses,

atzīstot, ka muitas likumdošanas pārkāpumi ir kaitīgi abu valstu ekonomiskām, finansiālām, sociālām un komerciālām, kā arī likumīgām tirdzniecības interesēm,

ievērojot precīzu aplikšanu ar nodokļiem; muitas nodokļu, citu nodokļu, nodevu un maksu, par importētām un eksportētām precēm, iekasēšanas svarīgumu, kā arī aizliegumu, ierobežojumu un kontroles nolikumu pienācīgu ieviešanu,

pārliecinoties, ka pasākumus muitas likumdošanas pārkāpumu aizkavēšanai un precīzas ievedmuitas un izvedmuitas un citu nodokļu iekasēšanas nodrošināšanai, var padarīt vēl efektīvākus sadarbībā starp abu valstu muitas iestādēm,

atsaucoties uz Muitas Sadarbības Padomes 1953. gada 5. decembra Rekomendāciju par savstarpējo administratīvo palīdzību,

ir vienojušās par sekojošo:

DEFINĪCIJAS

1.pants

Šai Līgumā paredzēto mērķu sasniegšanas veicināšanai:

1. "Muitas likumdošana" ir noteikumi, kurus noteicis likums vai likumpamatotu aktu normas attiecībā uz preču importu, eksportu, tranzītu vai citām muitas procedūrām, vai attiecībā uz muitas nodokļiem, citiem nodokļiem, nodevām vai maksām, ko iekasē muitas iestādes; vai aizlieguma, ierobežojuma vai kontroles pasākumiem.

2. "Pārkāpums" ir jebkurš muitas likumdošanas pārkāpums, kā arī jebkurš šādas likumdošanas pārkāpšanas mēģinājums.

3. "Muitas iestāde" ir Latvijas Republikas, Valsts ieņēmumu dienesta Muitas departaments un Zviedrijas Karalistē, Muitas padome (Generaltullstyrelsen).

4. "Pieprasošā muitas iestāde" ir tās Līgumslēdzējas Puses kompetenta muitas iestāde, kas pieprasa palīdzību muitas jautājumos.

5. "Pieprasītā muitas iestāde" ir tās Līgumslēdzējas Puses kompetenta muitas iestāde, kas saņem palīdzības pieprasījumu muitas jautājumos

6. "Kontrolētā piegāde" ir paņēmiens, kas atļauj aizliegto vai aizdomās turēto narkotisko un psihotropo vielu, kā arī to aizstājēju, kravu piegādes apturēšanu, pārvietošanu caur vai ievešanu Līgumslēdzēju Pušu teritorijā savu kompetento iestāžu uzraudzībā, vēršot uzmanību uz to personu identificēšanu, kuras iesaistītas šo narkotisko un psihotropo vielu nelikumīgā pārvietošanā.

LĪGUMA DARBĪBAS SFĒRA

2.pants

1. Ar savu muitas iestāžu starpniecību un saskaņā ar noteikumiem, kurus noteicis šis Līgums, Līgumslēdzējas Puses sniegs viena otrai savstarpējo palīdzību, lai:

a) nodrošinātu pareizu muitas likumdošanas ievērošanu;

b) aizkavētu, izmeklētu un cīnītos ar muitas likumdošanas pārkāpumiem;

c) nosūtītu/izziņotu tādus dokumentus, kas attiecas uz muitas likumdošanas piemērošanu;

d) izpildītu tādas prasības, kas saistītas ar muitas likumdošanu.

2. Palīdzība šī Līguma ietvaros tiks sniegta saskaņā ar spēkā esošo likumdošanu pieprasītās Līgumslēdzējas Puses teritorijā un pieprasītās muitas iestādes kompetences un iespēju robežās. Ja nepieciešams, muitas iestāde var vienoties, ka palīdzību sniegs cita kompetenta iestāde, saskaņā ar spēkā esošo likumdošanu pieprasītās Līgumslēdzējas Puses teritorijā. Šis Līgums neradīs noteikumus attiecībā uz savstarpējo palīdzību noziedzības jautājumos.

INFORMĀCIJAS APMAIŅA

3.pants

1. Pēc pieprasījuma, muitas iestādes piegādās viena otrai visu informāciju, kas varētu nodrošināt precizitāti:

a) muitas nodokļu, citu nodokļu, nodevu un maksu iekasēšanā, ko veic muitas iestādes; un īpaši informāciju, kas varētu palīdzēt noteikt preču vērtību un to tarifa klasifikāciju;

b) importēšanas un eksportēšanas aizliegumu un ierobežojumu ieviešanā;

c) to preču izcelsmes nacionālo noteikumu piemērošanā, ko neietver citas vienošanās, kuras būtu noslēgusi viena vai abas Līgumslēdzējas Puses.

2. Ja pieprasītai muitas iestādei nav pieprasītās informācijas, šī iestāde to meklēs saskaņā ar spēkā esošo likumdošanu pieprasītās Līgumslēdzējas Puses teritorijā.

3. Pieprasītā muitas iestāde iegūs informāciju tāpat, kā tā rīkotos savās interesēs.

4.pants

Pēc pieprasījuma, muitas iestādes sniegs viena otrai jebkuru informāciju par to, vai:

a) preces, kas ievestas vienas Līgumslēdzējas Puses teritorijā ir likumīgi izvestas no otras Līgumslēdzējas Puses teritorijas;

b) preces, kas izvestas no vienas Līgumslēdzējas Puses teritorijas ir likumīgi ievestas otras Līgumslēdzējas Puses teritorijā;

c) preces, kurām nodrošināts labvēlības režīms pie izvešanas no vienas Līgumslēdzējas Puses teritorijas, ir laikā ievestas otras Līgumslēdzējas Puses teritorijā, turklāt tiek sniegta arī informācija par jebkuriem muitas kontroles pasākumiem, kas piemēroti šīm precēm.

5.pants

Vienas Līgumslēdzējas Puses muitas iestāde, pēc savas iniciatīvas vai pieprasījuma, sniegs otras Līgumslēdzējas Puses muitas iestādei visu informāciju, ko varētu izmantot attiecībā uz muitas likumdošanas pārkāpumiem, īpaši attiecībā par:

a) zināmām vai aizdomīgām personām, kuras iesaistītas otras Līgumslēdzējas Puses teritorijā spēkā esošās muitas likumdošanas pārkāpumos;

b) precēm, kas ir nelikumīgas pārvietošanas objekti;

c) zināmiem vai aizdomīgiem transportlīdzekļiem, kas izmantoti otras Līgumslēdzējas Puses teritorijā spēkā esošās muitas likumdošanas pārkāpumos;

d) jauniem veidiem un līdzekļiem, kas iesaistīti muitas likumdošanas pārkāpumos;

e) vietām, kur ir izvietoti preču krājumi, uzrādot iespējamo pieņēmumu, ka tie tiks izmantoti nelegālai pārvietošanai.

6.pants

Pēc savas iniciatīvas vai pieprasījuma, vienas Līgumslēdzējas Puses muitas iestāde piegādās otras Līgumslēdzējas Puses muitas iestādei ziņojumus, liecību protokolus vai apstiprinātas dokumentu kopijas, kas sniedz visu noderīgo informācijas par veiktiem vai plānotiem pasākumiem, kuri izraisa vai varētu izraisīt pārkāpumus pret šīs Līgumslēdzējas Puses teritorijā spēkā esošo muitas likumdošanu.

Liecību protokolu un dokumentu oriģināli tiks pieprasīti gadījumos, kad apstiprinātās kopijas būs nepietiekamas. Saņemtās lietas un dokumenti tiks atdoti pēc iespējas ātrākā laikā.

7.pants

Dokumenti, saskaņā ar šo Līgumu, var tikt aizvietoti ar datorinformāciju, kas sastādīta jebkurā formā un paredzēta tiem pašiem mērķiem. Visa materiāla interpretācijai vai piemērošanai noderīgā informācija tiks piegādāta vienlaicīgi.

PERSONU, PREČU UN TRANSPORTLĪDZEKĻU UZRAUDZĪBA

8.pants

Savas kompetences un iespēju robežās, pēc savas iniciatīvas vai pēc otras Līgumslēdzējas Puses muitas iestādes pieprasījuma, vienas Līgumslēdzējas Puses muitas iestāde veiks speciālu uzraudzību pār:

a) zināmu vai aizdomās turētu personu pārvietošanos, īpaši iebraukšanu un izbraukšanu no tās teritorijas, kuras iesaistītas otras Līgumslēdzējas Puses teritorijā spēkā esošās muitas likumdošanas pārkāpumos;

b) zināmiem vai aizdomīgiem transporta līdzekļiem, kas izmantoti otras Līgumslēdzējas Puses teritorijā spēkā esošās muitas likumdošanas pārkāpumos;

c) tādu preču pārvietošanu, kuru ievešanu vai izvešanu no savas teritorijas otras Līgumslēdzējas Puses valdība vai muitas iestāde ir ierobežojusi vai aizliegusi.

KONTROLĒTĀ PIEGĀDE

9.pants

1. Ja to atļauj nacionālās likumdošanas sistēmas pamatprincipi, Līgumslēdzējas Puses savu iespēju robežās un pamatojoties uz līgumiem vai savstarpēji noteikto kārtību veiks visus nepieciešamos pasākumus, lai izmantotu kontrolēto piegādi starptautiskā līmenī, vēršot uzmanību uz to personu identificēšanu, kuras iesaistītas narkotisko un psihotropo vielu nelikumīgā pārvietošanā un veiks visus likumīgos pasākumus, kas vērsti pret šīm personām.

2. Lēmumus par kontrolētās piegādes piemērošanu pieņems katrā atsevišķā gadījumā. Ja nepieciešams un saskaņā ar nacionālo likumdošanu, tajos var ņemt vērā finansiālas vienošanās un noteikto kārtību.

3. Aizliegto kravu pārvietošanu, par kuru kontrolēto piegādi ir notikusi vienošanās, ar abu muitas iestāžu piekrišanu var apturēt vai atļaut pārvietot tālāk ar narkotiku vai psihotropo vielu neizņemšanu, pārvietošanu vai aizvietošanu kopumā vai pa daļām.

IZMEKLĒŠANA

10.pants

1. Saskaņā ar iesniegumu, pieprasītā muitas iestāde veiks visu apstākļu noskaidrošanu par darbību, kas ir vai var tikt uzskatīta par pretrunīgu attiecībā uz pieprasošās Līgumslēdzējas Puses teritorijā spēkā esošo muitas likumdošanu. Par šādas izmeklēšanas rezultātiem tā paziņos pieprasošai muitas iestādei.

2. Šīs izmeklēšanas notiks saskaņā ar likumdošanu, kas ir spēkā pieprasītās Līgumslēdzējas Puses teritorijā. Pieprasītā muitas iestāde rīkosies tāpat, kā tā rīkotos savās interesēs.

3. Šādās izmeklēšanās, pieprasītā muitas iestāde var atļaut piedalīties pieprasošās Līgumslēdzējas Puses amatpersonām.

EKSPERTI UN LIECINIEKI

11.pants

Ja sakarā ar izdarītiem muitas likumdošanas pārkāpumiem vienas Līgumslēdzējas Puses tiesa vai citas iestādes pieprasa, otras Līgumslēdzējas Puses muitas iestāde var pilnvarot savas amatpersonas sniegt liecības vai uzstāties kā ekspertiem tiesā vai pirms tās. Savu pienākumu ietvaros šādas amatpersonas sniegs liecības par to rīcībā esošajiem faktiem. Ierašanās pieprasījumā ir skaidri jānorāda, kāds ir attiecīgais gadījums un kādām pilnvarām amatpersonai jābūt.

INFORMĀCIJAS UN DOKUMENTU LIETOŠANA

12.pants

1. Informācija, dokumenti un citi paziņojumu, kas saņemti saskaņā ar šo Līgumu, nevar tikt izmantoti citos mērķos kā noteikts šajā Līgumā, bez rakstiskas tās muitas iestādes piekrišanas, kura tos nosūtījusi. Šie noteikumi neattiecas uz informāciju, dokumentiem un paziņojumiem par pārkāpumiem, kas saistīti ar narkotiskām un psihotropām vielām.

2. Jebkura informācija, kas atbilstoši šim Līgumam ir iesniegta jebkurā tās formā, būs konfidenciāla. Uz to ir jāattiecina dienesta noslēpuma statuss un tāda paša veida informācijas un dokumentu aizsardzība, kas ir paredzēta saskaņā ar to Līgumslēdzējas Puses teritorijā spēkā esošo likumdošanu, kura to ir saņēmusi.

3. Paragrāfs Nr. 1 neaizliedz izmantot informāciju jebkuros tiesas vai administratīvajos pasākumos, kurus pēc tam uzsāk sakarā ar muitas likumdošanas neievērošanu.

4. Tomēr saskaņā ar šī Līguma mērķiem un tā ietvaros, Līgumslēdzējas Puses muitas iestāde var savos, pirms tiesas fiksētajos pierādījumos, sastādītajos ziņojumos un raksturojumos, kā arī veiktajā rīcībā un iesniegtajā apsūdzībā, lietot kā pierādījumu, informāciju un dokumentus, kas iegūti saskaņā ar šo Līgumu.

Šādas informācijas un dokumentu izmantošana kā liecība tiesā ir jānosaka saskaņā ar nacionālo likumdošanu.

NOSŪTĪŠANA/IZZIŅOŠANA

13.pants

Uz iesnieguma pamata, pieprasītā muitas iestāde, saskaņā ar likumdošanu, kas ir spēkā pieprasītās Līgumslēdzējas Puses teritorijā, nosūtīs/izziņos iesaistītām fiziskām vai juridiskām personām, kas dzīvo vai atrodas tās teritorijā, visus dokumentus un lēmumus, uz kuriem ir attiecināms šis Līgums un kas iegūti no pieprasošās muitas iestādes.

PALĪDZĪBA PIE ZAUDĒTĀ ATGŪŠANAS

14.pants

1. Uz iesnieguma pamata, pieprasītā muitas iestāde veiks visu nepieciešamo darbību, lai izpildītu prasības, kas attiecās uz muitas nodokli. Šādas prasības ietver arī pārējos nodokļus, maksas, nodevas un procentus, kurus ir piemērojušas un iekasējušas muitas iestādes saskaņā ar muitas likumdošanu.

2. Pirmā punkta noteikumi attieksies tikai uz prasībām par muitas nodokli, kura lielums pārsniedz, saskaņā ar 18. panta 1. punktu, noteikto minimālo lielumu un veido pieprasījuma objektu ar kura palīdzību ir iespējama prasības realizēšana pieprasošās Līgumslēdzējas Puses teritorijā.

3. Pieprasījumam par zaudētā atgūšanu ir jāpievieno oficiāls dokuments vai apstiprināta kopija un tulkojums, kas saskaņā ar 15. panta 3. punkta noteikumiem, ļauj veikt tā izpildīšanu.

4. Dokuments, kas pieļauj prasības realizēšanu, kur tas iespējams un saskaņā ar likumdošanu, kas ir spēkā pieprasītās Līgumslēdzējas Puses teritorijā, tiks akceptēts, atzīts, papildināts vai aizvietots ar dokumentu, kas pilnvaro realizēt šādu prasību šīs Līgumslēdzējas Puses teritorijā

5. Jautājumi par jebkuru laika periodu, pēc kura prasības nevar tikt izpildītas, ir jārisina saskaņā ar likumdošanu, kas ir spēkā pieprasītās Līgumslēdzējas Puses teritorijā.

6. Pieprasītās Līgumslēdzējas Puses teritorijā izpildāmās prasības nesaņem nekādas priekšrocības.

7. Bankrota prasība pret parādnieku, kas bankrotējis uz muitas nodokļa pamata, var tikt reģistrēta tikai tad, ja tās pieteicējs un pieprasītā muitas iestāde tam piekrīt. Izdevumus, kas rodas bankrota prasību izpildīšanas rezultātā, segs pieprasošā muitas iestāde.

8. Pieprasītā muitas iestāde var atļaut maksas atlikšanu vai maksāt pa daļām, bet lai to varētu darīt, pirmkārt tai ir jāinformē pieprasošā muitas iestāde.

9. Protokoli par muitas nodokļa prasības esamību vai lielumu, vai dokumentu, kas pieļauj šīs prasības īstenošanu, var tikt sastādīti tikai pēc tam, kad ir saņemts attiecīgs dokuments no pieprasošās Līgumslēdzējas Puses iesaistītās iestādes.

10. Prasības par zaudētā atgūšanu tiks izpildītas pieprasītās Līgumslēdzējas Puses valūtas vienībās, saskaņā ar oficiālo valūtas maiņas kursu, kas ir spēkā pieprasījuma saņemšanas dienā.

11. Pēc nodevu un izdevumu atlīdzināšanas, kas piemēroti saskaņā ar pieprasītās Līgumslēdzējas Puses teritorijā spēkā esošo likumdošanu, atgūtais daudzums tiks nosūtīts pieprasošai muitas iestādei.

PALĪDZĪBAS PIEPRASĪJUMA FORMA UN BŪTĪBA

15.pants

1. Atbilstoši šim Līgumam, pieprasījumam ir jābūt sastādītam rakstiski. Lai izpildītu šādus pieprasījumus, tiem jāpievieno visi nepieciešamie dokumenti.

Situācijas neatliekamības dēļ var tikt pieņemts arī mutisks pieprasījums, bet pēc tam nekavējoties tas ir jāapstiprina rakstiski.

2. Pieprasījumiem, atbilstoši šī panta pirmajam punktam, ir jāsatur sekojoša informācija:

a) muitas iestāde, kas izdara pieprasījumu;

b) pieprasītie pasākumi;

c) pieprasījuma iemesls un mērķis;

d) saistošie likumi, noteikumi un citi juridiski akti;

e) pēc iespējas precīzi un aptveroši norādījumi par tām fiziskām vai juridiskām personām, kuras ir izmeklēšanas mērķis;

f) noderīgo faktu kopsavilkums, izņemot gadījumos, kas paredzēti 13. pantā.

3. Pieprasījums ir jāiesniedz pieprasītās Līgumslēdzējas Puses valsts, angļu vai citā valodā, kas pieņemama pieprasītai muitas iestādei.

4. Ja pieprasījums neatbilst formālām prasībām, tad var tikt pieprasītas tā korekcijas vai pārstrāde, neietekmējot tā izpildi.

IZŅĒMUMI NO SAISTĪBAS SNIEGT PALĪDZĪBU

16.pants

1. Ja saskaņā ar pieprasījumu pēc palīdzības, ir paredzēts pārkāpt pieprasītās Līgumslēdzējas Puses suverenitāti, valstisko kārtību, drošību vai citas intereses, vai notiktu rūpniecisko, komerciālo vai profesionālo noslēpumu pārkāpšana, šāds pieprasījums var tikt noraidīts, realizēts daļēji vai īstenots saskaņā ar noteiktiem apstākļiem vai prasībām.

2. Ja pieprasījums pēc palīdzības nevar tikt izpildīts, tad pieprasošai muitas iestādei tas tiks paziņots nekavējoties, kā arī tā tiks informēta par atteikuma iemesliem.

3. Ja muitas iestāde pati nav spējīga sniegt prasīto palīdzību, kuru tā pieprasa, tā vērsīs uzmanību uz šo faktu savā pieprasījumā otrai Līgumslēdzējas Puses muitas iestādei.

IZDEVUMI

17.pants

Katra muitas iestāde atteiksies no visu, ar šī Līguma izpildi saistīto, izdevumu piedzīšanas, izņemot izdevumus par ekspertiem, lieciniekiem, tulkiem, kā arī izdevumiem, kas noteikti 14. pantā.

LĪGUMA IEVIEŠANA

18.pants

1. Šī Līguma ieviešana tiks nodota Līgumslēdzēju Pušu muitas iestādēm. Muitas iestādes savstarpēji vienosies par detalizētiem pasākumiem, kas jāveic šī mērķa īstenošanai.

2. Saviem izmeklēšanas dienestiem, Līgumslēdzēju Pušu muitas iestādes var radīt tādu kārtību, kas paredz tiešos kontaktus starp tiem.

LĪGUMA SPĒKS TELPĀ

19.pants

Šis Līgums būs piemērojams abu Līgumslēdzēju Pušu teritorijās.

LĪGUMA STĀŠANĀS SPĒKĀ UN APTURĒŠANA

20.pants

1. Pa diplomātiskiem kanāliem katra valdība paziņos viena otrai, ka visas nepieciešamās juridiskās prasības, lai Līgums stātos spēkā, ir izpildītas. Līgums stāsies spēkā sešdesmit dienu laikā, pēc pēdējā paziņojuma saņemšanas.

2. Šī Līguma darbība tiek apturēta pēc rakstiska paziņojuma saņemšanas pa diplomātiskiem kanāliem un tas zaudē spēku sešus mēnešus pēc tam, kad šādu paziņojumu ir saņēmusi otra Līgumslēdzējas Puse.

To apliecinot, šo Līgumu ir parakstījušas pilnvarotas personas.

Parakstīts Stokholmā, 1995. gada 17.novembrī, divos eksemplāros, latviešu, zviedru un angļu valodās, turklāt visi teksti ir pilnīgi autentiski. Jebkuru domstarpību gadījumā, interpretējot šo Līgumu, par pamatu tiks ņemts teksts angļu valodā.

AGREEMENT
between the Government of the Republic of Latvia and the Government of the Kingdom of Sweden Regarding Mutual Assistance in Customs Matters
THE GOVERNMENTS OF REPUBLIC OF LATVIA AND THE KINGDOM OF SWEDEN, hereinafter referred to as the Contracting Parties,

CONSIDERING, that offences against customs legislation are prejudicial to the economic, fiscal, social and commercial interests of their respective countries as well as to the legitimate interests of trade;

CONSIDERING the importance of assuring the accurate assessment and collection of customs duties, other taxes, fees or charges on importation or exportation of goods, as well as the proper implementation of provisions of prohibition, restriction and control;

CONVINCED that efforts to prevent offences against customs legislation and efforts to ensure accurate collection of import and export duties and taxes can be rendered more effective through co-operation between their Customs Authorities;

HAVING REGARD TO the Recommendation of the Customs Co-operation Council on mutual administrative assistance of December 5, 1953;

HAVE AGREED AS FOLLOWS:

DEFINITIONS

Article 1

For the purposes of the present Agreement:

1. "Customs legislation" shall mean provisions laid down by law or regulation concerning the importation, exportation, transit of goods or any other customs procedure, whether relating to customs duties, other taxes, fees or charges levied by Customs Authorities, or to measures of prohibition, restriction or control.

2. "Offense" shall mean any violation of customs legislation as well as any attempted violation of such legislation.

3. "Customs Authority" shall mean in the Republic of Latvia, the Customs Department of the State Revenue Service (Valsts ieņēmumu dienesta Muitas departaments); and in the Kingdom of Sweden, the Board of Customs (Generaltullstyrelsen).

4. "Applicant Customs Authority" shall mean the competent Customs Authority of a Contracting Party which makes a request for assistance in customs matters.

5. "Requested Customs Authority" shall mean the competent Customs Authority of a Contracting Party which receives a request for assistance in customs matters.

6. "Controlled delivery" shall mean the technique of allowing illicit or suspect consignments of narcotic drugs, psychotropic substances or substances substituted for them, to pass out of, through or into the territories of the Contracting Parties, with the knowledge and under supervision of their competent authorities, with a view to identifying persons involved in the illicit trafficking of narcotic drugs and psychotropic substances.

SCOPE OF AGREEMENT

Article 2

1. The Contracting Parties shall, through their Customs Authorities and in accordance with the provisions set out in this Agreement, afford each other mutual assistance:

(a) in order to ensure that customs legislation is properly followed;

(b) in order to prevent, investigate and combat offences against customs legislation;

(c) in cases concerning delivery/notification of documents regarding application of customs legislation;

(d) in cases concerning recovery of claims related to customs legislation.

2. Assistance within the framework of this Agreement shall be rendered in accordance with the legislation in force in the territory of the requested Contracting Party and within the competence and resources of the requested Customs Authority. If necessary, a Customs Authority can arrange for assistance to be provided by another competent authority, in accordance with the legislation in force in the territory of the requested Contracting Party. This Agreement shall not prejudice the rules governing mutual assistance in criminal matters.

COMMUNICATION OF INFORMATION

Article 3

1. The Customs Authorities shall, upon request, supply to each other all information which may help to ensure accuracy in:

(a) the collection of customs duties, other taxes, fees and charges levied by Customs Authorities and, in particular, information which may help to assess the value of goods for customs purposes and to establish their tariff classification;

(b) the implementation of import and export prohibitions and restrictions;

(c) the application of national rules of origin not covered by other arrangements concluded by one or both Contracting Parties.

2. If the requested Customs Authority does not have the information asked for, it shall seek that information in accordance with the legislation in force in the territory of the requested Contracting Party.

3. The requested Customs Authority shall seek the information as if it was acting on its own account.

Article 4

The Customs Authorities shall, upon request, supply to each other any information showing that:

(a) goods imported into the territory of one Contracting Party have been lawfully exported from the territory of the other Contracting Party;

(b) goods exported from the territory of one Contracting Party have been lawfully imported into the territory of the other Contracting Party;

(c) goods which are granted favorable treatment upon exportation from the territory of one Contracting Party have been duly imported into the territory of the other Contracting Party, it being understood that information shall also be provided on any customs control measures to which the goods have been subjected.

Article 5

The Customs Authority of the one Contracting Party shall, on its own initiative or upon request, supply to the Customs Authority of the other Contracting Party all information likely to be of use to it relating to offences against customs legislation and, in particular, regarding:

(a) persons known or suspected of committing offences against the customs legislation in force in the territory of the other Contracting Party;

(b) goods known to be the subject of illicit traffic;

(c) means of transport known or suspected of being used in committing offences against customs legislation in force in the territory of the other Contracting Party;

(d) new ways and means employed in committing offences against customs legislation;

(e) places, where stocks of goods have been built up, giving reason to assume that they are to be used for illicit trafficking.

Article 6

The Customs Authority of one Contracting Party shall, on its own initiative or upon request, supply to the Customs Authority of the other Contracting Party reports, records of evidence or certified copies of documents giving all available information on activities, detected or planned, which constitute or appear to constitute an offence against the customs legislation in force in the territory of that Contracting Party.

Original files and documents shall be requested only in cases where certified copies would be insufficient. Files and documents which have been transmitted shall be returned at the earliest opportunity.

Article 7

The documents provided for in this Agreement may be replaced by computerised information produced in any form for the same purpose. All relevant information for the interpretation or utilization of the material should be supplied at the same time.

SURVEILLANCE OF PERSONS, GOODS AND MEANS OF TRANSPORT

Article 8

The Customs Authority of one Contracting Party shall, within its competence and resources, on its own initiative or upon request of the Customs Authority of the other Contracting Party, maintain surveillance over:

(a) the movements, particularly entry into and exit from its territory, of persons known or suspected of committing offences against customs legislation in force in the territory of the other Contracting Party;

(b) any means of transport known or suspected of being used for committing offences against the customs legislation in force in the territory of the other Contracting Party;

(c) movement of goods which are reported by the Customs Authority of the other Contracting Party as giving rise to substantial illicit traffic to or from its territory or suspicions thereof.

CONTROLLED DELIVERY

Article 9

1. If permitted by the basic principles of their respective domestic legal systems the Contracting Parties shall take the necessary measures, within their possibilities, to allow for the appropriate use of controlled delivery at the international level, on the basis of agreements or arrangements mutually consented to, with a view to identifying persons involved in the illicit trafficking of narcotic drugs and psychotropic substances and to taking legal action against them.

2. Decision to use controlled delivery shall be made on a case-by-case basis. They may, if necessary, and provided it is in conformity with the national legislation of the Contracting Parties, take into account financial arrangements and understandings reached.

3. Illicit consignment whose controlled delivery is agreed to may, by mutual consent of the competent authorities, be intercepted and allowed to continue with the narcotic drugs or psychotropic substances intact or removed or replaced in whole or in part.

INVESTIGATIONS

Article 10

1. Upon application, the requested Customs Authority shall initiate official inquiries concerning operations which are or appear to be contrary to the customs legislation in force in the territory of the applicant Contracting Party. It shall communicate the results of such inquiries to the applicant Customs Authority.

2. These inquiries shall be conducted under the legislation in force in the territory of the requested Contracting Party. The requested Customs Authority shall proceed as though it was acting on its own account.

3. The requested Customs Authority may allow officials of the applicant Contracting Party to be present at such investigations.

EXPERTS AND WITNESSES

Article 11

If the court or the authorities of one Contracting Party so request in connection with offences against customs legislation brought before them, the Customs Authority of the other Contracting Party may authorize its officials to appear as experts or witnesses before those courts or authorities. Such officials shall give evidence regarding facts established by them in the course of their duties. The request for appearance must clearly indicate in what case and in what capacity the official is to appear.

USE OF INFORMATION AND DOCUMENTS

Article 12

1. Information, documents and other communications received under this Agreement, shall not be used for purposes other than those specified in the Agreement, without the written consent of the Customs Authority which furnished them. These provisions are not applicable to information, documents and other communications concerning offences relevant to narcotic drugs and psychotropic substances.

2. Any information communicated in whatever form pursuant to this Agreement shall be of a confidential nature. It shall be covered by the obligation of official secrecy and shall enjoy the protection extended to the same kind of information and documents under the legislation in force in the territory of the Contracting Party which received it.

3. Paragraph 1 shall not impede the use of information in any judicial or administrative proceedings subsequently instituted for failure to comply with customs legislation.

4. The Customs Authorities of the Contracting Party may, however, in accordance with the purposes and within the scope of this Agreement, in their records of evidence, reports and testimonies and in proceeding and charges brought before courts, use as evidence information and documents obtained in accordance with this Agreement.

The use made of such information and documents as evidence in courts and the weight to be attached there to shall be determined in accordance with national legislation.

DELIVERY/NOTIFICATION

Article 13

Upon application, the requested Customs Authority shall, in accordance with the legislation in force in the territory of the requested Contracting Party, deliver/notify to the natural or legal persons concerned, residing or established in its territory, all documents and decisions falling within the scope of this Agreement, which emanate from the applicant Customs Authority.

ASSISTANCE IN RECOVERY

Article 14

1. Upon application, the requested Customs Authority shall take necessary steps to recover customs duty claims. Such claims also include other taxes, charges, fees as well as interests thereupon, levied and collected in accordance with customs legislation by Customs Authorities.

2. The provisions of paragraph 1 shall apply apply to customs duty claims which exceed a minimum amount, to be established in accordance with Article 18:1, and form the subject of an instrument permitting their enforcement in the territory of the applicant Contracting Party.

3. A request for recovery of a claim must be accompanied by an official or certified copy of the instrument permitting its enforcement and a translation in accordance with the provisions of Article 15:3.

4. The instrument permitting enforcement of the claim shall. where appropriate and in accordance with the legislation in force in the territory of the requested Contracting Party, be accepted, recognized, supplemented or replaced by an instrument authorizing enforcement in the territory of that Contracting Party.

5. Questions concerning any period beyond which a claim cannot be enforcement shall be governed by the legislation in force in the territory of the requested Contracting Party.

6. Claims to be recovered shall not given preferential treatment in the territory of the requested Contracting Party.

7. A bankruptcy petition against the debtor, on basis of a claim, can be filed only if the applicant and the requested Customs Authorities so agree. Costs resulting from bankruptcy proceedings shall be paid by the applicant Customs Authority.

8. The requested Customs Authority may allow deferral of payment or payment by instalments, but shall first inform the applicant Customs Authority.

9. Proceedings relating to the existence or the amount of the customs duty claim or the instrument permitting its enforcement may be brought only before the appropriate body of the applicant Contracting Party.

10. Claims shall be recovered in the currency of the requested Contracting Party in accordance with the official exchange rate on the day when the request was received.

11. Amounts which have been recovered shall be transmitted to the applicant Customs Authority, after deduction of fees and costs which are levied in accordance with the legislation in force in the territory of requested Contracting Party.

FORM AND SUBSTANCE OF REQUEST FOR ASSISTANCE

Article 15

1. Request pursuant to the present Agreement shall be made in writing. Documents necessary for the execution of such requests shall accompany the request. When required because of the urgency of the situation, oral requests may be accepted, but must be confirmed in writing immediately.

2. Requests pursuant to paragraph 1 of this Article shall include the following information:

(a) the Customs Authority making the request;

(b) the measure requested;

(c) the object of and the reason for the request;

(d) the laws, rules, regulations and other legal elements involved;

(e) indications as exact and comprehensive as possible on the natural or legal persons being the target of the investigations;

(f) a summary of the relevant facts, except in cases provided for in Article 13.

3. Request shall be submitted in an official language of the requested Contracting Party, in English or in any another language acceptable to the requested Customs Authority.

4. If a request does not meet the formal requirements, its correction or completion may be demanded, the ordering of precautionary measures shall not be affected thereby.

EXCEPTIONS FROM THE LIABILITY TO RENDER ASSISTANCE

Article 16

1. If the requested Customs Authority considers that assistance sought would infringe upon the sovereignty, public order, security or other essential interests of the requested Contracting Party or would involve violation of an industrial, commercial or professional secret in the territory of that Contracting Party, it may refuse such assistance, provide it partly or provide it subject to certain conditions or requirements.

2. If a request for assistance cannot be complied with the applicant Customs Authority shall be notified without delay and shall be informed of the reasons for the refusal to provide assistance.

3. If Customs Authority asks for assistance which it would itself be unable to give if asked to do so by the Customs Authority of the other Contracting Party, it shall draw attention to that fact in its request. Compliance with such a request shall be within the discretion of the requested Customs Authority.

COSTS

Article 17

Each Customs Authority shall waive all claims for reimbursement of costs incurred in the execution of this Agreement, with the exception of expenses for experts, witnesses, interpreters and translators as well as the exceptions stated in Article 14.

IMPLEMENTATION

Article 18

1. Implementation of this Agreement shall be entrusted to the Customs Authorities of the Contracting Parties. Those Authorities shall mutually agree on detailed arrangements for that purpose.

2. The Customs Authorities of the Contracting Parties may arrange for their investigation services to be in direct communication with each other.

TERRITORIAL APPLICABILITY

Article 19

This Agreement shall apply to the territories of both Contracting Parties.

ENTRY INTO FORCE AND TERMINATION

Article 20

1. Each Government shall notify one another through diplomatic channels when all necessary national legal requirements for entry into force have been fulfilled. The Agreement shall enter into force sixty days after the last notification has been received.

2. This Agreement may be terminated by written notice through diplomatic channels and shall cease to be in force six months after such notice has been received by the other Contracting Party.

In witness whereof the undersigned, duly authorized thereto, have signed this Agreement.

Done at Stockholm on 17 November 1995, in duplicate, in the Latvian, Swedish and English languages, all texts beeing equally authentic. In case of any divergence of interpretation of the provisions of this Agreement the English text shall prevail.
