prezidents izsludina šādu likumu:
Par Ziemeļatlantijas līguma organizācijas dalībvalstu un valstu, kas piedalās programmā "Partnerattiecības — mieram", līgumu par to bruņoto spēku statusu un šā līguma protokolu
1.pants. 1995.gada 19.jūnijā Briselē parakstītais Ziemeļatlantijas līguma organizācijas dalībvalstu un valstu, kas piedalās programmā "Partnerattiecības — mieram", līgums par to bruņoto spēku statusu (turpmāk — Līgums) un Līguma protokols (turpmāk — Protokols) ar šo likumu tiek pieņemti un apstiprināti.
2.pants. Likums stājas spēkā tā izsludināšanas dienā. Līdz ar likumu izsludināms Līgums un Protokols angļu valodā un to tulkojums latviešu valodā.
3.pants. Latvijas Republikas Ārlietu ministrija uz šā likuma pamata un saskaņā ar Līguma 5.pantu un Protokola 2.pantu sagatavo ratifikācijas dokumentu un deponē to Amerikas Savienoto Valstu valdībai.
4.pants. Līgums stājas spēkā tā 5.pantā noteiktajā laikā un kārtībā, Protokols stājas spēkā tā 2.pantā noteiktajā laikā un kārtībā.

AGREEMENT
among the States Parties to the North Atlantic Treaty and the other States Participating in the Partnership for Peace regarding the Status of their Forces

The states Parties to the North Atlantic Treaty done in Washington on 4 April 1949 and the States which accept the invitation to Partnership for Peace issued and signed by the Heads of State and Government of the member States of the North Atlantic Treaty Organisation in Brussels on 10 January 1994 and which subscribe to the Partnership for Peace Framework Document;

Constituting together the States participating in the Partnership for Peace;

Considering that the Forces of one State Party to the present Agreement may be sent and received, by agreement, into the territory of another State Party;

Bearing in mind that the decisions to send and to receive Forces will continue to be the subject of separate arrangements between the States Parties concerned;

Desiring, however, to define the status of such Forces while in the territory of another State Party;

Recalling the Agreement between the States Parties to the North Atlantic Treaty regarding the status of their Forces done at London on 19 June 1951;

Have agreed as follows:

Article 1

Except as otherwise provided for in the present Agreement and any additional protocol in respect to its own parties, all States Parties to the present Agreement shall apply the provisions of the Agreement between Parties to the North Atlantic Treaty regarding the status of their Forces, done at London on 19 June 1951, hereinafter referred to as the NATO SOFA, as if all State Parties to the present Agreement were Parties to NATO SOFA.

Article 2

1) In addition to the area to which the NATO SOFA applies the present Agreement shall apply to the territory of all States Parties to the present Agreement which are not Parties to the NATO SOFA.

2) For the purposes of the present Agreement, references in the NATO SOFA to the North Atlantic Treaty area shall be deemed also to include the territories referred to in paragraph 1 of the present Article, and references to the North Atlantic Treaty shall be deemed to include the Partnership for Peace.

Article 3

For purposes of implementing the present Agreement with respect to matters involving Parties that are not Parties to the NATO SOFA, provisions of the NATO SOFA that provide for requests to be submitted, or differences to be referred to the North Atlantic Council, the Chairman of the North Atlantic Council Deputies or an arbitrator shall be construed to require the Parties concerned to negotiate between or among themselves without resource to any outside jurisdiction.

Article 4

The present Agreement may be supplement or otherwise modified in accordance with International Law.

Article 5

1) The present Agreement shall be open for signature by any State that is either a contracting Party to the NATO SOFA, or that accepts the invitation to the Partnership for Peace and subscribes to the Partnership for Peace Framework Document.

2) The present Agreement shall be subject to ratification, acceptance or approval. Instruments of ratification, acceptance or approval shall be deposited with the Government of the United of America, which shall notify all signatory States of each such deposit.

3) Thirty days after three signatory States, at least one which is a Party to the NATO SOFA and one of which has accepted the invitation to the Partnership for Peace and subscribed to the Partnership for Peace Framework Document, have deposited their instruments of ratification, acceptance or approval, the present Agreement shall enter into force in respect of those States. It shall enter into force in respect of each other signatory State thirty days after the date of deposit of its instrument.

Article 6

The present Agreement may be denounced by any Party to this Agreement by giving written notification of denunciation to the Government of the United States of America, which will notify all signatory States of each such notification. The denunciation shall take effect one year after receipt of the notification by the Government of the United States of America. After the expiration of this period of one year, the present Agreement shall cease to be in force as regards the Party that denounces it, except for the settlement of outstanding claims that arose before the day on which the denunciation takes effect, but shall continue to be in force for the remaining Parties.

In witness whereof, the undersigned, being duly authorised by their respective Governments, have signed this Agreement.

Done in Brussels, this nineteenth day of June, 1995 in the English and French languages, both texts being equally authoritative, in a single original which shall be deposited in the Archives of the Government of the United States of America. The Government of the United States of America shall transmit certified copies thereof of all the signatory States.

Additional Protocol to the Agreement among the States Parties to the North Atlantic Treaty and the other States participating in the Partnership for Peace regarding the status of their Forces

The State Parties to the present additional Protocol to the Agreement among the State Parties to the North Atlantic Treaty and other States participating in the Partnership for Peace regarding the status of their Forces, hereinafter referred to as Agreement;

Considering that the death penalty is not provided for under the domestic legislation of some Parties to the Agreement;

Have agreed as follows:

Article 1

Insofar as it has jurisdiction to the provisions of the Agreement, each State Party to the present additional Protocol shall not carry out a death sentence with regard to any member of a force and its civilian component, and their dependents from any other State Party to the present Additional Protocol.

Article 2

(1) The present Protocol shall be open for signature by any signatory of the Agreement.

(2) The present Protocol shall be subject to ratification, acceptance or approval. Instruments of ratification, acceptance or approval shall be deposited with the Government of the United States of America, which shall notify all signatory States or each such deposit.

(3) The present Protocol shall enter into force 30 days after the date of deposit of the instrument of ratification, acceptance or approval by three signatory States, at least one of which is a Party to the NATO SOFA and one of which is a State having accepted the invitation to join the Partnership for Peace and having subscribed to the Partnership for Peace Framework Document.

(4) The present Protocol shall come into force in respect of each other signatory State on the date of the deposit of its instrument of ratification, acceptance or approval with the Government of the United States of America.

Ziemeļatlantijas līguma organizācijas dalībvalstu un valstu, kas piedalās programmā "Partnerattiecības — mieram", līgums par to bruņoto spēku statusu

1949.gada 4.aprīlī Vašingtonā noslēgtā Ziemeļatlantijas līguma dalībvalstis un valstis, kas pieņem uzaicinājumu piedalīties programmā "Partnerattiecības — mieram", ko izstrādājuši un parakstījuši Ziemeļatlantijas līguma organizācijas dalībvalstu un valdību vadītāji 1994.gada 10.janvārī Briselē, un kas paraksta programmas "Partnerattiecības — mieram" Pamatdokumentu;

apvienojot valstis, kas piedalās programmā "Partnerattiecības — mieram";

apsverot, ka vienas šī Līguma dalībvalsts bruņotie spēki var tikt nosūtīti un uzņemti citas dalībvalsts teritorijā, pamatojoties uz savstarpēju vienošanos;

paturot prātā, ka lēmums nosūtīt un uzņemt bruņotos spēkus tiks pieņemts, attiecīgajām dalībvalstīm par to atsevišķi vienojoties;

vēloties tomēr noteikt šādu bruņoto spēku statusu citas dalībvalsts teritorijā;

atsaucoties uz 1951.gada 19.jūnijā Londonā parakstīto Ziemeļatlantijas līguma organizācijas dalībvalstu līgumu par to bruņotajiem spēkiem;

ir vienojušās par sekojošo:

1. pants

Ja šis Līgums vai jebkurš papildprotokols attiecībā uz tā dalībvalstīm neparedz ko citu, visas šī Līguma dalībvalstis piemēro 1951.gada 19.jūnijā Londonā parakstītā Ziemeļatlantijas līguma organizācijas dalībvalstu līguma par to bruņotajiem spēkiem (turpmāk tekstā — NATO SOFA) noteikumus tā, it kā visas šī Līguma dalībvalstis būtu NATO SOFA dalībvalstis.

2. pants

1. Papildus tai teritorijai, kurā darbojas NATO SOFA, šis Līgums darbojas visu šī Līguma dalībvalstu teritorijā, kuras nav NATO SOFA dalībvalstis.

2. Saskaņā ar šī Līguma mērķiem NATO SOFA ietvaros esošās atsauces uz Ziemeļatlantijas līguma teritoriju ietver arī šī panta 1.punktā minētās teritorijas, un atsauce uz Ziemeļatlantijas līgumu ietver arī programmu "Partnerattiecības — mieram".

3. pants

Saskaņā ar šī Līguma piemērošanas mērķiem tajos jautājumos, kas attiecas uz dalībvalstīm, kuras nav NATO SOFA dalībvalstis, NATO SOFA noteikumi, kas paredz lūgumu iesniegšanu vai paziņošanu par nesaskaņām Ziemeļatlantijas padomei, Ziemeļatlantijas padomes priekšsēdētājs, tā vietnieks vai arbitrs, uzliek par pienākumu attiecīgajām dalībvalstīm vest savstarpējās sarunas, neiesaistot nekādu ārēju jurisdikciju.

4. pants

Šis Līgums var tikt papildināts vai citādi pārveidots saskaņā ar starptautisko tiesību normām.

5. pants

1. Šo Līgumu var parakstīt jebkura valsts, kas vai nu ir NATO SOFA dalībvalsts, vai kas pieņem uzaicinājumu "Partnerattiecībām — mieram" un paraksta "Partnerattiecību — mieram" pamatdokumentu.

2. Šis Līgums ir ratificējams, pieņemams vai apstiprināms. Ratifikācijas, pieņemšanas vai apstiprināšanas dokumenti tiek deponēti Amerikas Savienoto Valstu valdībā, kas informē visas šo Līgumu parakstījušās valstis par katru šādas deponēšanas gadījumu.

3. Trīsdesmit dienu laikā pēc tam, kad trīs šo Līgumu parakstījušās valstis, no kurām vismaz viena ir NATO SOFA dalībvalsts un viena ir pieņēmusi uzaicinājumu "Partnerattiecībām — mieram" un parakstījusi "Partnerattiecību — mieram" Pamatdokumentu, ir deponējušas savus ratifikācijas, pieņemšanas vai apstiprināšanas dokumentus, šis Līgums stājas spēkā attiecībā uz šīm valstīm. Attiecībā uz jebkuru citu valsti, kas parakstījusi šo Līgumu, tas stājas spēkā trīsdesmit dienas pēc tās dienas, kad šī valsts deponējusi savu dokumentu.

6. pants

Jebkura dalībvalsts var denonsēt šo Līgumu, par šādu denonsēšanu rakstiski paziņojot Amerikas Savienoto Valstu valdībai, kam par katru denonsēšanu jāinformē visas valstis, kas parakstījušas šo Līgumu. Denonsēšana stājas spēkā vienu gadu pēc tam, kad Amerikas Savienoto Valstu valdība ir saņēmusi paziņojumu par denonsēšanu. Pēc viena gada termiņa notecēšanas šī Līguma darbība izbeidzas attiecībā uz valsti, kas to denonsējusi, ja vien nav jāatrisina būtiskas prasības, kas radušās pirms denonsēšanas spēkā stāšanās dienas, starp pārējām Pusēm Līgums paliek spēkā.

To apliecinot, apakšā parakstījušies, būdami savu valdību atbilstoši pilnvaroti, ir parakstījuši šo Līgumu.

Parakstīts Briselē, 1995.gada 19.jūnijā, angļu un franču valodā, abi teksti ir autentiski. Oriģināls deponēts Amerikas Savienoto Valstu valdības arhīvos. Amerikas Savienoto Valstu valdība nosūta šī Līguma apliecinātas kopijas visām Līgumu parakstījušām valstīm.

Ziemeļatlantijas līguma organizācijas dalībvalstu un valstu, kas piedalās programmā "Partnerattiecības — mieram", līguma par to bruņoto spēku statusu Protokols

Ziemeļatlantijas līguma organizācijas dalībvalstu un valstu, kas piedalās programmā "Partnerattiecības — mieram", līguma par to bruņoto spēku statusu protokols, šeit minētas kā Līguma, dalībvalstis;

ņemot vērā, ka dažu Līguma dalībvalstu likumdošanā nāves sods nav paredzēts;

ir vienojušās par sekojošo:

1. pants

Saskaņā ar šī Līguma noteikumiem, ciktāl tas ir saskaņā ar katras valsts jurisdikciju, katra šī Protokola dalībvalsts neizpildīs nāves spriedumu jebkuram citas šīs Protokola dalībvalsts bruņoto spēku, to civilo sastāvdaļu un to padotajam loceklim.

2. pants

1) Šo Protokolu var parakstīt jebkura Līguma dalībvalsts.

2) Šis Protokols ir ratificējams, pieņemams vai apstiprināms. Ratifikācijas pieņemšanas vai apstiprināšanas dokumenti tiek deponēti Amerikas Savienoto Valstu valdībā, kas informē visas šo Protokolu parakstījušās valstis par katru šādas deponēšanas gadījumu.

3) Šis Protokols stājas spēkā trīsdesmit dienu laikā pēc tam, kad trīs šo Protokolu parakstījušās valstis, no kurām vismaz viena ir NATO SOFA dalībvalsts un viena ir pieņēmusi uzaicinājumu "Partnerattiecības — mieram" un parakstījusi "Partnerattiecības — mieram" Pamatdokumentu.

4) Attiecībā uz jebkuru citu valsti, kas parakstījusi Protokolu, tas stājas spēkā, sākot no tās dienas, kad ratifikācijas, pieņemšanas vai apstiprināšanas dokuments tiek deponēts Amerikas Savienoto Valstu valdībā.

Parakstīts Briselē, 1995.gada 19.jūnijā, angļu un franču valodā, abi teksti ir autentiski. Oriģināls deponēts Amerikas Savienoto Valstu valdības arhīvos. Amerikas Savienoto Valstu valdība nosūta šī Protokola apliecinātas kopijas visām Protokola dalībvalstīm.
