Grozījums Latvijas Republikas valdības un Somijas Republikas valdības līgumā par vīzu atcelšanu

Somijas vēstniecība izsaka savu cieņu Latvijas Republikas Ārlietu ministrijai un tai ir gods iesniegt sekojošo:

No 2001.gada 25.marta Somija piemēro Šengenas līgumu, ar kuru līguma dalībvalstis ir uzņēmušās saistības ievērot kopīgus vīzas noteikumus. Latvija ir viena no valstīm, kurām nav nepieciešama vīza. Tiesiskais pamats tam ir paredzēts 2001.gada 15.marta Padomes regulā (EK) Nr.539/2001, kas nosaka trešās valstis, kuru pilsoņiem, šķērsojot arējās robežas, ir jābūt vīzai un valstis, kuru pilsoņiem nav nepieciešama vīza.

Somijas pievienošanās Šengenas līgumam rezultātā, līguma par vīzu atcelšanu noteikumos, kas attiecas uz bezvīzu uzturēšanās perioda aprēķināšanu, ir izdarāmi grozījumi, lai tos saskaņotu ar Konvencijas, kas īsteno 1985.gada 14.jūnija Šengenas līgumu par pakāpenisku kontroles atcelšanu uz kopējām robežām, kas noslēgts starp Beniluksa Ekonomiskās Savienības valstu, Vācijas Federatīvās Republikas un Francijas Republikas valdībām, 20.panta prasībām.

Balstoties uz augstāk minēto, Somijas Republikas valdība piedāvā izdarīt grozījumus līguma 1.pantā, kuru 1997.gada 28.jūlijā parakstīja Somijas Republika un Latvijas Republika.

Līguma par vīzu atcelšanu, 1.panta pašreizējā redakcija ir izteikta sekojoši:

“Latvijas Republikas pilsoņi, kuriem ir derīgas Latvijas Republikas pases, bez vīzas var ieceļot Somijas Republikā, šķērsojot jebkuru robežpunktu, kur tas atļauts, un uzturēties Somijas Republikā laika periodu, kas nepārsniedz trīs mēnešus. Šis trīs mēnešu periods tiek skaitīts no dienas, kurā persona ieceļo kādā no Ziemeļvalstīm, kas ir 1957.gada 12.jūlija Konvencijas par atteikšanos no pasu kontroles uz Ziemeļvalstu iekšējām robežām dalībvalsts. Jebkura uzturēšanās jebkurā no šīm valstīm sešu mēnešu laikā pirms ierašanās kādā no šīm valstīm no valsts, kura nav Ziemeļvalsts, tiek iekļauta minētajā trīs mēnešu periodā.”

Somijas Republikas valdība piedāvā grozīt līguma 1.pantu, izsakot to sekojošā redakcijā:

“Latvijas Republikas pilsoņi, kuriem ir derīgas Latvijas Republikas pases, var bez vīzas ieceļot Somijas Republikas teritorijā, šķērsojot jebkuru robežpunktu, kur tas atļauts, un uzturēties Somijas Republikas teritorijā laika periodu, kas nepārsniedz trīs mēnešus sešu mēnešu laikā, skaitot no pirmās ieceļošanas dienas. Šo trīs mēnešu periodu aprēķina, skaitot no pirmās ieceļošanas dienas jebkurā Šengenas valstī. Iepriekšminēto trīs mēnešu un sešu mēnešu periodu aprēķināšanā ņem vērā uzturēšanos jebkurā Šengenas valstī.”

Somijas Republikas valdība izsaka cerību, ka Latvijas Republikas valdībai augstāk minētais priekšlikums būs pieņemams. Pieņemšanas gadījumā šī nota un Latvijas Republikas valdības atbilde uzskatāma par apliecinājumu līguma noslēgšanai starp divām valstīm, kas stāsies spēkā atbildes notas saņemšanas dienā.

Somijas vēstniecība izmanto šo izdevību, lai vēlreiz apliecinātu savu cieņu Latvijas Republikas Ārlietu ministrijai.

VERBAL NOTE

The Embassy of Finland presents its compliments to the Ministry of Foreign Affairs of the Republic of Latvia and has the honour to present the following.

As of 25 March 2001 Finland has applied the Schengen Agreement, in which the parties to the Agreement committed themselves to observe common visa regulations. Latvia is one of the countries exempt from the visa requirement. The legal basis for this is provided by the Council Regulation (EC) no 539/2001 of 15 March 2001 listing the third countries whose nationals must be in possession of visas when crossing the external borders and those whose nationals are exempt from that requirement.

Due to the accession of Finland to the Schengen Agreement, the provisions of the Agreement concerning the Abolition of Visas, relating to the calculation of the period of time for the visa-free stay, need to be amended so as to bring them in conformity with the provisions of Article 20 of the Convention Applying the Schengen Agreement of 14 June 1985 between the Governments of the States of the Benelux Economic Union, the Federal Republic of Germany and the French Republic, on the Gradual Abolition of Checks at Their Common Borders.

Based on the above, the Government of the Republic of Finland proposes that Article 1 of the Agreement signed between the Governments of the Republic of Finland and the Republic of Latvia on 28 July 1997 be amended.

Article 1 of the Agreement Concerning the Abolition of Visas, in its present form, read as follows:

“Citizens of the Republic of Latvia, holding valid passports of the Republic of Latvia shall be free to enter the Republic of Finland at any authorized border-crossing point and to stay in the Republic of Finland for a period not exceeding three months without being required to obtain a visa. This period of three months shall be calculated from the date of entry into any Nordic State being a Party to the Convention of 12 July 1957 on the Waiver of Passport Control at the Intra-Nordic Borders. Any sojourn in any of those States during six months preceding the entry into one of those States from the non-Nordic State shall be included in the above period of three months.”

The Government of the Republic of Finland proposes that Article 1 of the Agreement be amended to read as follows:

“Citizens of the Republic of Latvia, holding valid passports of the Republic of Latvia, shall be free to enter the territory of the Republic of Finland at any authorized border-crossing point and to stay in the territory of the Republic of Finland for a maximum period of three months during the six months following the date of first entry without being required to obtain a visa. This period of three months shall be calculated from the date of first entry into any Schengen State. Any stay in any Schengen State shall be taken into account in the calculation of the above periods of three months and six months. ”

The Government of the Republic of Finland hopes that the Government of the Republic of Latvia will find the above proposal acceptable. In case of acceptance, this Note and the Reply of the Government of the Republic of Latvia may be considered to constitute an Agreement between the two States which shall enter into force on the date of receipt of the Reply Note.

The Embassy avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Republic of Latvia the assurances of its highest consideration.

Latvijas Republikas Ārlietu ministrija izsaka savu cieņu Somijas Republikas vēstniecībai un tai ir tas gods apliecināt Somijas Republikas vēstniecības 2002.gada 9. janvāra vērbālnotas Nr.… saņemšanu, kas paziņo, ka Somijas Republikas valdība izsaka priekšlikumu grozīt Latvijas Republikas valdības un Somijas Republikas valdības līguma par vīzu atcelšanu 1.pantu, izsakot to sekojošā redakcijā:

“Latvijas Republikas pilsoņi, kuriem ir derīgas Latvijas Republikas pases, var bez vīzas ieceļot Somijas Republikas teritorijā, šķērsojot jebkuru robežpunktu, kur tas atļauts, un uzturēties Somijas Republikas teritorijā laika periodu, kas nepārsniedz trīs mēnešus sešu mēnešu laikā, skaitot no pirmās ieceļošanas dienas. Šo trīs mēnešu periodu aprēķina, skaitot no pirmās ieceļošanas dienas jebkurā Šengenas valstī. Iepriekšminēto trīs mēnešu un sešu mēnešu periodu aprēķināšanā ņem vērā uzturēšanos jebkurā Šengenas valstī.”

Atbildot, Ministrijai ir tas gods paziņot, ka Latvijas Republikas valdība pieņem Somijas Republikas valdības priekšlikumu un piekrīt, ka Somijas Republikas vēstniecības verbālnota un šī atbilde būs apliecinājums līguma noslēgšanai starp divām valstīm, kas stāsies spēkā šīs atbildes saņemšanas dienā.

Latvijas Republikas ārlietu ministrija izmanto izdevību, lai vēlreiz apliecinātu savu cieņu Somijas Republikas vēstniecībai.

The Ministry of Foreign Affairs of the Republic of Latvia presents its compliments to the Embassy of Finland and has the honour to acknowledge receipt of Verbal Note No. … of the Embassy of Finland, dated January 9, 2002, which states that the Government of the Republic of Finland proposes that Article 1 of the Agreement between the Government of the Republic of Latvia and the Government of the Republic of Finland concerning the Abolition of Visas be amended to read as follows:

“Citizens of the Republic of Latvia, holding valid passports of the Republic of Latvia, shall be free to enter the territory of the Republic of Finland at any authorized border-crossing point and to stay in the territory of the Republic of Finland for a maximum period of three months during the six months following the date of first entry without being required to obtain a visa. This period of three months shall be calculated from the date of first entry into any Schengen State. Any stay in any Schengen State shall be taken into account in the calculation of the above periods of three months and six months. ”

In the Reply the Ministry has the honour to state that the Government of the Republic of Latvia accepts the proposal of the Government of the Republic of Finland and agrees that Verbal Note of the Embassy of Finland and the present Reply shall constitute an Agreement between the two States which shall enter into force on the date of receipt of the present Reply.

The Ministry of Foreign Affairs of the Republic of Latvia avails itself of this opportunity to renew to the Embassy of Finland the assurances of its highest consideration.
