Par Latvijas Republikas un Slovēnijas Republikas brīvās tirdzniecības līguma Apvienotās komitejas lēmumu nr.1/2002 attiecībā uz Latvijas Republikas un Slovēnijas Republikas brīvās tirdzniecības līguma B protokolu

1.pants. 2002.gada 29.oktobrī Rīgā parakstītais Latvijas Republikas un Slovēnijas Republikas brīvās tirdzniecības līguma Apvienotās komitejas lēmums nr.1/2002 attiecībā uz Latvijas Republikas un Slovēnijas Republikas brīvās tirdzniecības līguma B protokolu (turpmāk — Lēmums) ar šo likumu tiek pieņemts un apstiprināts.

2.pants. Likums stājas spēkā nākamajā dienā pēc tā izsludināšanas. Līdz ar likumu izsludināms Lēmums angļu valodā un tā tulkojums latviešu valodā.

3.pants. Lēmums stājas spēkā tā 2.pantā noteiktajā laikā un kārtībā, un Ārlietu ministrija par to paziņo laikrakstā "Latvijas Vēstnesis".

Likums Saeimā pieņemts 2003.gada 23.janvārī.

DECISION
No 1/2002 of the Joint Committee of the Free Trade Agreement between the Republic of Latvia and the Republic of Slovenia concerning Protocol B to the Free Trade Agreement between the Republic of Latvia and the Republic of Slovenia

THE JOINT COMMITTEE,

Having regard to the Free Trade Agreement between the Republic of Latvia, of the one part, and the Republic of Slovenia, of the other part, hereinafter referred to as 'the Agreement', signed in Riga on 22 April 1996, and in particular Article 38 of Protocol B thereof;

Whereas:

(1) Protocol B of the Agreement, concerning the definition of the concept of 'originating products' and methods of administrative co-operation, hereinafter referred to as 'the Protocol' has been amended several times since its entry into force. A consolidation of those amendments to the text of the Protocol therefore appears necessary for the sake of clarity and legal certainty of the rules of origin to be applied;

(2) Technical modifications of the processing rules are also required to take account of modifications to the Harmonized Commodity Description and Coding System ("Harmonized System"), which take effect from 1 January 2002;

(3) Certain processing requirements for non-originating materials to obtain originating status need to be amended to take account of the lack of production of a certain material within the contracting parties and of the specific conditions in which some products ("monolithic integrated circuits") are to be obtained, implying limited processing operations outside the Contracting parties;

(4) Some technical amendments are required in order to correct anomalies in and between the different language versions of the text;

(5) It is therefore appropriate, for the proper functioning of the Agreement and with a view to facilitate the work of users and customs administrations, to incorporate in a new text of the Protocol all the provisions in question.

HAS DECIDED AS FOLLOWS:

Article 1

Protocol B of the Agreement, concerning the definition of the concept of 'originating products' and methods of administrative co-operation, shall be replaced by the text attached hereto, together with the relevant Joint Declaration.

Article 2

1. This Decision shall enter into force on the first day of the month following a receipt of the latter diplomatic note confirming its approval in accordance with the internal legal requirements of the Contracting parties.

2. If this Decision can not enter into force before January 1, 2003 it shall be applied provisionally by Slovenia from that date.

Title I
GENERAL PROVISIONS

Article 1
Definitions

For the purposes of this Protocol:

a) “manufacture” means any kind of working or processing including assembly or specific operations;

b) “material” means any ingredient, raw material, component or part, etc., used in the manufacture of the product;

c) “product” means the product being manufactured, even if it is intended for later use in another manufacturing operation;

d) “goods” means both materials and products;

e) “customs value” means the value as determined in accordance with the 1994 Agreement on implementation of Article VII of the General Agreement on Tariffs and Trade (WTO Agreement on customs valuation);

f) “ex-works price” means the price paid for the product ex works to the manufacturer in Slovenia or in Latvia in whose undertaking the last working or processing is carried out, provided the price includes the value of all the materials used, minus any internal taxes which are, or may be, repaid when the product obtained is exported;

g) “value of materials” means the customs value at the time of importation of the non-originating materials used, or, if this is not known and cannot be ascertained, the first ascertainable price paid for the materials in Slovenia or in Latvia;

h) “value of originating materials” means the value of such materials as defined in (g) applied mutatis mutandis;

i) “value added” shall be taken to be the ex - works price minus the customs value of each of the materials incorporated which originate in the other countries referred to in Articles 3 and 4 or, where the customs value is not known or can not be ascertained, the first ascertainable price paid for the materials in Slovenia or in Latvia;

j) “chapters” and “headings” mean the chapters and the headings (four-digit codes) used in the nomenclature which makes up the Harmonized Commodity Description and Coding System, referred to in this Protocol as “the Harmonized System” or “HS”;

k) “classified” refers to the classification of a product or material under a particular heading;

l) “consignment” means products which are either sent simultaneously from one exporter to one consignee or covered by a single transport document covering their shipment from the exporter to the consignee or, in the absence of such a document, by a single invoice;

m) “territories” includes territorial waters.

 

Title II
DEFINITION OF THE CONCEPT OF “ORIGINATING PRODUCTS”

Article 2
General requirements

1. For the purpose of implementing this Agreement, the following products shall be considered as originating in Slovenia:

a) products wholly obtained in Slovenia within the meaning of Article 5;

b) products obtained in Slovenia incorporating materials which have not been wholly obtained there, provided that such materials have undergone sufficient working or processing in Slovenia within the meaning of Article 6.

2. For the purpose of implementing this Agreement, the following products shall be considered as originating in Latvia:

c) products wholly obtained in Latvia within the meaning of Article 5;

d) products obtained in Latvia incorporating materials which have not been wholly obtained there, provided that such materials have undergone sufficient working or processing in Latvia within the meaning of Article 6.

Article 3
Cumulation in Slovenia

1. Without prejudice to the provisions of Article 2 (1), products shall be considered as originating in Slovenia if such products are obtained there, incorporating materials originating in Bulgaria, Switzerland (incl. Liechtenstein)1, the Czech Republic, Estonia, Hungary, Iceland, Lithuania, Latvia, Norway, Poland, Romania, Slovenia, the Slovak Republic, Turkey or in the Community in accordance with the provisions of the Protocol on rules of origin annexed to the Agreements between Slovenia and each of these countries, provided that the working or processing carried out in Slovenia goes beyond the operations referred to in Article 7. It shall not be necessary that such materials have undergone sufficient working or processing.

2. Where the working or processing carried out in Slovenia does not go beyond the operations referred to in Article 7, the product obtained shall be considered as originating in Slovenia only where the value added there is greater than the value of the materials used originating in any one of the other countries referred to in paragraph 1. If this is not so, the product obtained shall be considered as originating in the country which accounts for the highest value of originating materials used in the manufacture in Slovenia.

3. Products, originating in one of the countries referred to in paragraph 1, which do not undergo any working or processing in Slovenia, retain their origin if exported into one of these countries.

4. The cumulation provided for in this Article may only be applied to materials and products which have acquired originating status by the application of rules of origin identical to those given in this Protocol.

Article 4
Cumulation in Latvia

1. Without prejudice to the provisions of Article 2(2), products shall be considered as originating in Latvia if such products are obtained there, incorporating materials originating in Bulgaria, the European Communities, Poland, Hungary, the Czech Republic, the Slovak Republic, Romania, Lithuania, Latvia, Estonia, Slovenia, Iceland, Norway, Switzerland (including Liechtenstein)1 or Turkey in accordance with the provisions of the Protocol on rules of origin annexed to the Agreements between Latvia and each of these countries, provided that the working or processing carried out in Latvia goes beyond the operations referred to in Article 7. It shall not be necessary that such materials have undergone sufficient working or processing.

2. Where the working or processing carried out in Latvia does not go beyond the operations referred to in Article 7, the product obtained shall be considered as originating in Latvia only where the value added there is greater than the value of the materials used originating in any one of the other countries referred to in paragraph 1. If this is not so, the product obtained shall be considered as originating in the country which accounts for the highest value of originating materials used in the manufacture in Latvia.

3. Products, originating in one of the countries referred to in paragraph 1, which do not undergo any working or processing in Latvia, retain their origin if exported into one of these countries.

4. The cumulation provided for in this Article may only be applied to materials and products which have acquired originating status by the application of rules of origin identical to those given in this Protocol.

Article 5
Wholly obtained products

1. The following shall be considered as wholly obtained in Slovenia or in Latvia:

a) mineral products extracted from their its soil or from their its seabed;

b) vegetable products harvested there;

c) live animals born and raised there;

d) products from live animals raised there;

e) products obtained by hunting or fishing conducted there;

f) products of sea fishing and other products taken from the sea outside the territorial waters of Slovenia or of Latvia by their vessels;

g) products made aboard its factory ships exclusively from products referred to in (f);

h) used articles collected there fit only for the recovery of raw materials, including used tyres fit only for retreading or for use as waste;

i) waste and scrap resulting from manufacturing operations conducted there;

j) products extracted from marine soil or subsoil outside its territorial waters provided that they have sole rights to work that soil or subsoil;

k) goods produced there exclusively from the products specified in (a) to (j).

2. The terms “their vessels” and “their factory ships” in paragraph 1(f) and (g) shall apply only to vessels and factory ships:

a) which are registered or recorded in Slovenia or in Latvia;

b) which sail under the flag of Slovenia or of Latvia;

c) which are owned to an extent of at least 50 per cent by nationals of Slovenia or of Latvia, or by a company with its head office in one of these States, of which the manager or managers, Chairman of the Board of Directors or the Supervisory Board, and the majority of the members of such boards are nationals of Slovenia or of Latvia and of which, in addition, in the case of partnerships or limited companies, at least half the capital belongs to those States or to public bodies or nationals of the said States;

d) of which the master and officers are nationals of Slovenia or of Latvia; and

e) of which at least 75 per cent of the crew are nationals of Slovenia or of Latvia.

Article 6
Sufficiently worked or processed products

1. For the purposes of Article 2, products which are not wholly obtained are considered to be sufficiently worked or processed when the conditions set out in the list in Annex II are fulfilled.

The conditions referred to above indicate, for all products covered by the Agreement, the working or processing which must be carried out on non-originating materials used in manufacturing and apply only in relation to such materials. It follows that if a product, which has acquired originating status by fulfilling the conditions set out in the list is used in the manufacture of another product, the conditions applicable to the product in which it is incorporated do not apply to it, and no account shall be taken of the non-originating materials which may have been used in its manufacture.

2. Notwithstanding paragraph 1, non-originating materials which, according to the conditions set out in the list, should not be used in the manufacture of a product may nevertheless be used, provided that:

a) their total value does not exceed 10 per cent of the ex-works price of the product;

b) any of the percentages given in the list for the maximum value of non-originating materials are not exceeded through the application of this paragraph.

This paragraph shall not apply to products falling within Chapters 50 to 63 of the Harmonized System.

3. Paragraphs 1 and 2 shall apply subject to the provisions of Article 7.

Article 7
Insufficient working or processing

1. Without prejudice to paragraph 2, the following operations shall be considered as insufficient working or processing to confer the status of originating products, whether or not the requirements of Article 6 are satisfied:

(a) preserving operations to ensure that the products remain in good condition during transport and storage;

(b) breaking-up and assembly of packages;

(c) washing, cleaning; removal of dust, oxide, oil, paint or other coverings;

(d) ironing or pressing of textiles;

(e) simple painting and polishing operations;

(f) husking, partial or total bleaching, polishing, and glazing of cereals and rice;

(g) operations to colour sugar or form sugar lumps;

(h) peeling, stoning and shelling, of fruits, nuts and vegetables;

(i) sharpening, simple grinding or simple cutting;

(j) sifting, screening, sorting, classifying, grading, matching; (including the making-up of sets of articles);

(k) simple placing in bottles, cans, flasks, bags, cases, boxes, fixing on cards or boards and all other simple packaging operations;

(l) affixing or printing marks, labels, logos and other like distinguishing signs on products or their packaging;

(m) simple mixing of products, whether or not of different kinds,

(n) simple assembly of parts of articles to constitute a complete article or disassembly of products into parts;

(o) a combination of two or more operations specified in (a) to (n);

(p) slaughter of animals.

2. All operations carried out in Slovenia or in Latvia on a given product shall be considered together when determining whether the working or processing undergone by that product is to be regarded as insufficient within the meaning of paragraph 1.

Article 8
Unit of qualification

1. The unit of qualification for the application of the provisions of this Protocol shall be the particular product which is considered as the basic unit when determining classification using the nomenclature of the Harmonized System.

It follows that:

a) when a product composed of a group or assembly of articles is classified under the terms of the Harmonized System in a single heading, the whole constitutes the unit of qualification;

b) when a consignment consists of a number of identical products classified under the same heading of the Harmonized System, each product must be taken individually when applying the provisions of this Protocol.

2. Where, under General Rule 5 of the Harmonized System, packaging is included with the product for classification purposes, it shall be included for the purposes of determining origin.

Article 9
Accessories, spare parts and tools

Accessories, spare parts and tools dispatched with a piece of equipment, machine, apparatus or vehicle, which are part of the normal equipment and included in the price thereof or which are not separately invoiced, shall be regarded as one with the piece of equipment, machine, apparatus or vehicle in question.

Article 10
Sets

Sets, as defined in general rule 3 of the Harmonized System, shall be regarded as originating when all component products are originating. Nevertheless, when a set is composed of originating and non-originating products, the set as a whole shall be regarded as originating, provided that the value of the non-originating products does not exceed 15 per cent of the ex-works price of the set.

Article 11
Neutral elements

In order to determine whether a product originates, it shall not be necessary to determine the origin of the following which might be used in its manufacture:

a) energy and fuel;

b) plant and equipment;

c) machines and tools;

d) goods which do not enter and which are not intended to enter into the final composition of the product.

Title III
TERRITORIAL REQUIREMENTS

Article 12
Principle of territoriality

1. Except as provided for in Articles 3 and 4 and paragraph 3 of this Article, the conditions for acquiring originating status set out in Title II must be fulfilled without interruption in Slovenia or in Latvia.

2. Except as provided for in Articles 3 and 4, where originating goods exported from Slovenia or from Latvia to another country return, they must be considered as non-originating, unless it can be demonstrated to the satisfaction of the customs authorities that:

a) the returning goods are the same as those exported; and

b) they have not undergone any operation beyond that necessary to preserve them in good condition while in that country or while being exported.

3. The acquisition of originating status in accordance with the conditions set out in Title II shall not be affected by working or processing done outside Slovenia or Latvia on materials exported from Slovenia or from Latvia and subsequently re- imported there, provided:

a) the said materials are wholly obtained in one of the Contracting Parties or have undergone working or processing beyond the operations referred to in Article 7 prior to being exported; and

b) it can be demonstrated to the satisfaction of the customs authorities that:

i) the re-imported goods have been obtained by working or processing the exported materials; and

ii) the total added value acquired outside Slovenia or Latvia by applying the provisions of this Article does not exceed 10 per cent of the ex-works price of the end product for which originating status is claimed.

4. For the purposes of paragraph 3, the conditions for acquiring originating status set out in Title II shall not apply to working or processing done outside the Slovenia or Latvia. But where, in the list in Annex II, a rule setting a maximum value for all the non-originating materials incorporated is applied in determining the originating status of the end product, the total value of the non-originating materials incorporated in the territory of the Party concerned, taken together with the total added value acquired outside Slovenia or Latvia by applying the provisions of this Article, shall not exceed the stated percentage.

5. For the purposes of applying the provisions of paragraphs 3 and 4, “total added value” shall be taken to mean all costs arising outside Slovenia or Latvia, including the value of the materials incorporated there.

6. The provisions of paragraphs 3 and 4 shall not apply to products which do not fulfill the conditions set out in the list in Annex II or which can be considered sufficiently worked or processed only if the general tolerance fixed in Article 6(2) is applied.

7. The provisions of paragraphs 3 and 4 shall not apply to products of Chapters 50 to 63 of the Harmonized System.

8. Any working or processing of the kind covered by the provisions of this Article and done outside Slovenia or Latvia shall be done under the outward processing arrangements, or similar arrangements.

Article 13
Direct transport

1. The preferential treatment provided for under the Agreement applies only to products, satisfying the requirements of this Protocol, which are transported directly between Slovenia and Latvia or through the territories of the other countries referred to in Articles 3 and 4. However, products constituting one single consignment may be transported through other territories with, should the occasion arise, trans-shipment or temporary warehousing in such territories, provided that they remain under the surveillance of the customs authorities in the country of transit or warehousing and do not undergo operations other than unloading, reloading or any operation designed to preserve them in good condition.

Originating products may be transported by pipeline across territory other than that of Slovenia or Latvia.

2. Evidence that the conditions set out in paragraph 1 have been fulfilled shall be supplied to the customs authorities of the importing country by the production of:

a) a single transport document covering the passage from the exporting country through the country of transit; or

b) a certificate issued by the customs authorities of the country of transit:

(i) giving an exact description of the products;

(ii) stating the dates of unloading and reloading of the products and, where applicable, the names of the ships, or the other means of transport used; and

(iii) certifying the conditions under which the products remained in the transit country; or

c) failing these, any substantiating documents.

Article 14
Exhibitions

1. Originating products, sent for exhibition in a country other than those referred to in Articles 3 and 4 and sold after the exhibition for importation in Slovenia or in Latvia shall benefit on importation from the provisions of the Agreement provided it is shown to the satisfaction of the customs authorities that:

a) an exporter has consigned these products from Slovenia or from Latvia to the country in which the exhibition is held and has exhibited them there;

b) the products have been sold or otherwise disposed of by that exporter to a person in Slovenia or in Latvia;

c) the products have been consigned during the exhibition or immediately thereafter in the state in which they were sent for exhibition; and

d) the products have not, since they were consigned for exhibition, been used for any purpose other than demonstration at the exhibition.

2. A proof of origin must be issued or made out in accordance with the provisions of Title V and submitted to the customs authorities of the importing country in the normal manner. The name and address of the exhibition must be indicated thereon. Where necessary, additional documentary evidence of the conditions under which they have been exhibited may be required.

3. Paragraph 1 shall apply to any trade, industrial, agricultural or crafts exhibition, fair or similar public show or display which is not organized for private purposes in shops or business premises with a view to the sale of foreign products, and during which the products remain under customs control.

 

Title IV
DRAWBACK OR EXEMPTION

Article 15
Prohibition of drawback of, or exemption from, customs duties

1. Non-originating materials used in the manufacture of products originating in Slovenia, in Latvia or in one of the other countries referred to in Articles 3 and 4 for which a proof of origin is issued or made out in accordance with the provisions of Title V shall not be subject in Slovenia or in Latvia to drawback of, or exemption from, customs duties of whatever kind.

2. The prohibition in paragraph 1 shall apply to any arrangement for refund, remission or non-payment, partial or complete, of customs duties or charges having an equivalent effect, applicable in Slovenia or in Latvia to materials used in the manufacture, where such refund, remission or non-payment applies, expressly or in effect, when products obtained from the said materials are exported and not when they are retained for home use there.

3. The exporter of products covered by a proof of origin shall be prepared to submit at any time, upon request from the customs authorities, all appropriate documents proving that no drawback has been obtained in respect of the non-originating materials used in the manufacture of the products concerned and that all customs duties or charges having equivalent effect applicable to such materials have actually been paid.

4. The provisions of paragraphs 1 to 3 shall also apply in respect of packaging within the meaning of Article 8 (2), accessories, spare parts and tools within the meaning of Article 9 and products in a set within the meaning of Article 10 when such items are non-originating.

5. The provisions of paragraphs 1 to 4 shall apply only in respect of materials which are of the kind to which the Agreement applies. Furthermore, they shall not preclude the application of an export refund system for agricultural products, applicable upon export in accordance with the provisions of the Agreement.

 

Title V
PROOF OF ORIGIN

Article 16
General requirements

1. Products originating in Slovenia shall, on importation into Latvia and products originating in Latvia shall, on importation into Slovenia benefit from the Agreement upon submission of either:

a) a movement certificate EUR.1, a specimen of which appears in Annex III; or

b) in the cases specified in Article 21(1), a declaration, subsequently referred to as the “invoice declaration”, given by the exporter on an invoice, a delivery note or any other commercial document which describes the products concerned in sufficient detail to enable them to be identified. The text of the invoice declaration appears in Annex IV.

2. Notwithstanding paragraph 1, originating products within the meaning of this Protocol shall, in the cases specified in Article 26, benefit from the Agreement without it being necessary to submit any of the documents referred to above.

Article 17
Procedure for the issue of a movement certificate EUR.1

1. A movement certificate EUR.1 shall be issued by the customs authorities of the exporting country on application having been made in writing by the exporter or, under the exporter’s responsibility, by his authorized representative.

2. For this purpose, the exporter or his authorized representative shall fill out both the movement certificate EUR.1 and the application form, specimens of which appear in Annex III. These forms shall be completed one of the languages in which this Agreement is drawn up and in accordance with the provisions of the domestic law of the exporting country. If they are hand- written, they shall be completed in ink in printed characters. The description of the products must be given in the box reserved for this purpose without leaving any blank lines. Where the box is not completely filled, a horizontal line must be drawn below the last line of the description, the empty space being crossed through.

3. The exporter applying for the issue of a movement certificate EUR.1 shall be prepared to submit at any time, at the request of the customs authorities of the exporting country where the movement certificate EUR.1 is issued, all appropriate documents proving the originating status of the products concerned as well as the fulfilment of the other requirements of this Protocol.

4. A movement certificate EUR.1 shall be issued by the customs authorities of a Contracting Party if the products concerned can be considered as products originating in a Contracting Party or in one of the other countries referred to in Articles 3 and 4 and fulfill the other requirements of this Protocol.

5. The customs authorities issuing movement certificate EUR.1 shall take any steps necessary to verify the originating status of the products and the fulfilment of the other requirements of this Protocol. For this purpose, they shall have the right to call for any evidence and to carry out any inspection of the exporter’s accounts or any other check considered appropriate. They shall also ensure that the forms referred to in paragraph 2 are duly completed. In particular, they shall check whether the space reserved for the description of the products has been completed in such a manner as to exclude all possibility of fraudulent additions.

6. The date of issue of the movement certificate EUR.1 shall be indicated in Box 11 of the certificate.

7. A movement certificate EUR.1 shall be issued by the customs authorities and made available to the exporter as soon as actual exportation has been effected or ensured.

Article 18
Movement certificates EUR.1 issued retrospectively

1. Notwithstanding Article 17(7), a movement certificate EUR.1 may exceptionally be issued after exportation of the products to which it relates if:

a) it was not issued at the time of exportation because of errors or involuntary omissions or special circumstances; or

b) it is demonstrated to the satisfaction of the customs authorities that a movement certificate EUR.1 was issued but was not accepted at importation for technical reasons.

2. For the implementation of paragraph 1, the exporter must indicate in his application the place and date of exportation of the products to which the movement certificate EUR.1 relates, and state the reasons for his request.

3. The customs authorities may issue a movement certificate EUR.1 retrospectively only after verifying that the information supplied in the exporter’s application agrees with that in the corresponding file.

4. Movement certificates EUR.1 issued retrospectively must be endorsed with one of the following phrases:

EN “ISSUED RETROSPECTIVELY”

LV “IZDOTS PĒC PREČU EKSPORTA “

SL “IZDANO NAKNADNO”.

5. The endorsement referred to in paragraph 4 shall be inserted in the “Remarks” box of the movement certificate EUR.1.

Article 19
Issue of a duplicate movement certificate EUR.1

1. In the event of theft, loss or destruction of a movement certificate EUR.1, the exporter may apply to the customs authorities which issued it for a duplicate made out on the basis of the export documents in their possession.

2. The duplicate issued in this way must be endorsed with one of the following words:

EN “DUPLICATE”

LV “DUBLIKĀTS”

SL “DVOJNIK”.

3. The endorsement referred to in paragraph 2 shall be inserted in the “Remarks” box of the duplicate movement certificate EUR.1.

4. The duplicate, which must bear the date of issue of the original movement certificate EUR.1, shall take effect as from that date.

Article 20
Issue of movement certificates EUR.1 on the basis of a proof of origin issued or made out previously

When originating products are placed under the control of a customs office in Slovenia or in Latvia, it shall be possible to replace the original proof of origin by one or more movement certificates EUR.1 for the purpose of sending all or some of these products elsewhere within Slovenia or Latvia. The replacement movement certificate(s) EUR.1 shall be issued by the customs office under whose control the products are placed.

Article 20a
Accounting segregation

1. Where considerable cost or material difficulties arise in keeping separate stocks of originating and non-originating materials which are identical and interchangeable, the customs authorities may, at the written request of those concerned, authorise the so-called “accounting segregation” method to be used for managing such stocks.

2. This method must be able to ensure that, for a specific reference-period, the number of products obtained which could be considered as “originating” is the same as that which would have been obtained if there had been physical segregation of the stocks.

3. The customs authorities may grant such authorisation, subject to any conditions deemed appropriate.

4. This method is recorded and applied on the basis of the general accounting principles applicable in the country where the product was manufactured.

5. The beneficiary of this facilitation may issue or apply for proofs of origin, as the case may be, for the quantity of products which may be considered as originating. At the request of the customs authorities, the beneficiary shall provide a statement of how the quantities have been managed.

6. The customs authorities shall monitor the use made of the authorisation and may withdraw it at any time whenever the beneficiary makes improper use of the authorisation in any manner whatsoever or fails to fulfil any of the other conditions laid down in this Protocol.

Article 21
Conditions for making out an invoice declaration

1. An invoice declaration as referred to in Article 16(1)(b) may be made out:

a) by an approved exporter within the meaning of Article 22, or

b) by any exporter for any consignment consisting of one or more packages containing originating products whose total value does not exceed EUR 6, 000.

2. An invoice declaration may be made out if the products concerned can be considered as products originating in Slovenia, in Latvia or in one of the other countries referred to in Articles 3 and 4 and fulfill the other requirements of this Protocol.

3. The exporter making out an invoice declaration shall be prepared to submit at any time, at the request of the customs authorities of the exporting country, all appropriate documents proving the originating status of the products concerned as well as the fulfilment of the other requirements of this Protocol.

4. An invoice declaration shall be made out by the exporter by typing, stamping or printing on the invoice, the delivery note or another commercial document, the declaration, the text of which appears in Annex IV, using one of the linguistic versions set out in that Annex and in accordance with the provisions of the domestic law of the exporting country. If the declaration is hand-written, it shall be written in ink in printed characters.

5. Invoice declarations shall bear the original signature of the exporter in manuscript. However, an approved exporter within the meaning of Article 22 shall not be required to sign such declarations provided that he gives the customs authorities of the exporting country a written undertaking that he accepts full responsibility for any invoice declaration which identifies him as if it had been signed in manuscript by him.

6. An invoice declaration may be made out by the exporter when the products to which it relates are exported, or after exportation on condition that it is presented in the importing country no longer than two years after the importation of the products to which it relates.

Article 22
Approved exporter

1. The customs authorities of the exporting country may authorise any exporter, hereinafter referred to as “approved exporter”, who makes frequent shipments of products under this Agreement to make out invoice declarations irrespective of the value of the products concerned. An exporter seeking such authorisation must offer to the satisfaction of the customs authorities all guarantees necessary to verify the originating status of the products as well as the fulfilment of the other requirements of this Protocol.

2. The customs authorities may grant the status of approved exporter subject to any conditions which they consider appropriate.

3. The customs authorities shall grant to the approved exporter a customs authorisation number which shall appear on the invoice declaration.

4. The customs authorities shall monitor the use of the authorisation by the approved exporter.

5. The customs authorities may withdraw the authorisation at any time. They shall do so where the approved exporter no longer offers the guarantees referred to in paragraph 1, no longer fulfils the conditions referred to in paragraph 2 or otherwise makes an incorrect use of the authorisation.

Article 23
Validity of proof of origin

1. A proof of origin shall be valid for four months from the date of issue in the exporting country, and must be submitted within the said period to the customs authorities of the importing country.

2. Proofs of origin which are submitted to the customs authorities of the importing country after the final date for presentation specified in paragraph 1 may be accepted for the purpose of applying preferential treatment, where the failure to submit these documents by the final date set is due to exceptional circumstances.

3. In other cases of belated presentation, the customs authorities of the importing country may accept the proofs of origin where the products have been submitted before the said final date.

Article 24
Submission of proof of origin

Proofs of origin shall be submitted to the customs authorities of the importing country in accordance with the procedures applicable in that country. The said authorities may require a translation of a proof of origin and may also require the import declaration to be accompanied by a statement from the importer to the effect that the products meet the conditions required for the implementation of the Agreement.

Article 25
Importation by instalments

Where, at the request of the importer and on the conditions laid down by the customs authorities of the importing country, dismantled or non-assembled products within the meaning of General Rule 2(a) of the Harmonized System falling within Sections XVI and XVII or headings 7308 and 9406 of the Harmonized System are imported by instalments, a single proof of origin for such products shall be submitted to the customs authorities upon importation of the first instalment.

Article 26
Exemptions from proof of origin

1. Products sent as small packages from private persons to private persons or forming part of travellers’ personal luggage shall be admitted as originating products without requiring the submission of a proof of origin, provided that such products are not imported by way of trade and have been declared as meeting the requirements of this Protocol and where there is no doubt as to the veracity of such a declaration. In the case of products sent by post, this declaration can be made on the customs declaration CN22/CN23 or on a sheet of paper annexed to that document.

2. Imports which are occasional and consist solely of products for the personal use of the recipients or travellers or their families shall not be considered as imports by way of trade if it is evident from the nature and quantity of the products that no commercial purpose is in view.

3. Furthermore, the total value of these products shall not exceed EUR 500 in the case of small packages or EUR 1,200 in the case of products forming part of travellers’ personal luggage.

Article 27
Supporting documents

The documents referred to in Articles 17(3) and 21(3) used for the purpose of proving that products covered by a movement certificate EUR.1 or an invoice declaration can be considered as products originating in Slovenia, in Latvia or in one of the other countries referred to in Articles 3 and 4 and fulfil the other requirements of this Protocol may consist inter alia of the following:

a) direct evidence of the processes carried out by the exporter or supplier to obtain the goods concerned, contained for example in his accounts or internal book-keeping;

b) documents proving the originating status of materials used, issued or made out in Slovenia or in Latvia where these documents are used in accordance with domestic law;

c) documents proving the working or processing of materials in Slovenia or in Latvia, issued or made out in Slovenia or in Latvia, where these documents are used in accordance with domestic law;

d) movement certificates EUR.1 or invoice declarations proving the originating status of materials used, issued or made out in Slovenia or in Latvia in accordance with this Protocol, or in one of the other countries referred to in Articles 3 or 4, in accordance with rules of origin which are identical to the rules in this Protocol.

Article 28
Preservation of proof of origin and supporting documents

1. The exporter applying for the issue of a movement certificate EUR.1 shall keep for at least three years the documents referred to in Article 17(3).

2. The exporter making out an invoice declaration shall keep for at least three years a copy of this invoice declaration as well as the documents referred to in Article 21(3).

3. The customs authorities of the exporting country issuing a movement certificate EUR.1 shall keep for at least three years the application form referred to in Article 17(2).

4. The customs authorities of the importing country shall keep for at least three years the movement certificates EUR.1 and the invoice declarations submitted to them.

Article 29
Discrepancies and formal errors

1. The discovery of slight discrepancies between the statements made in the proof of origin and those made in the documents submitted to the customs office for the purpose of carrying out the formalities for importing the products shall not ipso facto render the proof of origin null and void if it is duly established that this document does correspond to the products submitted.

2. Obvious formal errors such as typing errors on a proof of origin should not cause this document to be rejected if these errors are not such as to create doubts concerning the correctness of the statements made in this document.

Article 30
Amounts expressed in euro

1. For the application of the provisions of Article 21(1)(b) and Article 26(3) in cases where products are invoiced in a currency other than euro, amounts in the national currencies of Slovenia, of Latvia of the countries referred to in Articles 3 and 4 equivalent to the amounts expressed in euro shall be fixed annually by each of the countries concerned.

2. A consignment shall benefit from the provisions of Article 21(1)(b) or Article 26(3) by reference to the currency in which the invoice is drawn up, according to the amount fixed by the country concerned.

3. The amounts to be used in any given national currency shall be the equivalent in that currency of the amounts expressed in euro as at the first working day of October and shall apply from 1 January the following year. Slovenia and Latvia shall be notified of the relevant amounts.

4. A country may round up or down the amount resulting from the conversion into its national currency of an amount expressed in euro. The rounded-off amount may not differ from the amount resulting from the conversion by more than 5 per cent. A country may retain unchanged its national currency equivalent of an amount expressed in euro if, at the time of the annual adjustment provided for in paragraph 3, the conversion of that amount, prior to any rounding-off, results in an increase of less than 15 per cent in the national currency equivalent. The national currency equivalent may be retained unchanged if the conversion would result in a decrease in that equivalent value.

5.The amounts expressed in euro shall be reviewed by the Joint Committee at the request of any of Slovenia or of Latvia. When carrying out this review, the Joint Committee shall consider the desirability of preserving the effects of the limits concerned in real terms. For this purpose, it may decide to modify the amounts expressed in euro.

Title VI
ARRANGEMENTS FOR ADMINISTRATIVE CO-OPERATION

Article 31
Mutual assistance

1. The customs authorities of Slovenia and of Latvia shall provide each other with specimen impressions of stamps used in their customs offices for the issue of movement certificates EUR.1 and with the addresses of the customs authorities responsible for verifying those certificates and invoice declarations.

2. In order to ensure the proper application of this Protocol, Slovenia and Latvia shall assist each other, through the competent customs administrations, in checking the authenticity of the movement certificates EUR.1 or the invoice declarations and the correctness of the information given in these documents.

Article 32
Verification of proofs of origin

1. Subsequent verifications of proofs of origin shall be carried out at random or whenever the customs authorities of the importing country have reasonable doubts as to the authenticity of such documents, the originating status of the products concerned or the fulfilment of the other requirements of this Protocol.

2. For the purposes of implementing the provisions of paragraph 1, the customs authorities of the importing country shall return the movement certificate EUR.1 and the invoice, if it has been submitted, the invoice declaration, or a copy of these documents, to the customs authorities of the exporting country giving, where appropriate, the reasons for the enquiry. Any documents and information obtained suggesting that the information given on the proof of origin is incorrect shall be forwarded in support of the request for verification.

3. The verification shall be carried out by the customs authorities of the exporting country. For this purpose, they shall have the right to call for any evidence and to carry out any inspection of the exporter’s accounts or any other check considered appropriate.

4. If the customs authorities of the importing country decide to suspend the granting of preferential treatment to the products concerned while awaiting the results of the verification, release of the products shall be offered to the importer subject to any precautionary measures judged necessary.

5. The customs authorities requesting the verification shall be informed of the results of this verification as soon as possible. These results must indicate clearly whether the documents are authentic and whether the products concerned can be considered as products originating in Slovenia, in Latvia or in one of the other countries referred to in Articles 3 and 4 and fulfill the other requirements of this Protocol.

6. If in cases of reasonable doubt there is no reply within ten months of the date of the verification request or if the reply does not contain sufficient information to determine the authenticity of the document in question or the real origin of the products, the requesting customs authorities shall, except in exceptional circumstances, refuse entitlement to the preferences.

Article 33
Dispute settlement

Where disputes arise in relation to the verification procedures of Article 32 which cannot be settled between the customs authorities requesting a verification and the customs authorities responsible for carrying out this verification or where they raise a question as to the interpretation of this Protocol, they shall be submitted to the Joint Committee.

In all cases the settlement of disputes between the importer and the customs authorities of the importing country shall be under the legislation of the said country.

Article 34
Penalties

Penalties shall be imposed on any person who draws up, or causes to be drawn up, a document which contains incorrect information for the purpose of obtaining a preferential treatment for products.

Article 35
Free zones

1. Slovenia and Latvia shall take all necessary steps to ensure that products traded under cover of a proof of origin which in the course of transport use a free zone situated in their territory, are not substituted by other goods and do not undergo handling other than normal operations designed to prevent their deterioration.

2. By means of an exemption to the provisions contained in paragraph 1, when products originating in Slovenia or in Latvia are imported into a free zone under cover of a proof of origin and undergo treatment or processing, the authorities concerned shall issue a new movement certificate EUR.1 at the exporter’s request, if the treatment or processing undergone is in conformity with the provisions of this Protocol.

 

Title VII
FINAL PROVISIONS

Article 36
Sub-Committee on customs and origin matters

1. A Sub-Committee on customs and origin matters shall be set up under the Joint Committee to assist it in carrying out its duties and to ensure a continuous information and consultation processed between experts.

2. It shall be composed of experts from Slovenia and Latvia responsible for questions related to customs and origin matters.

Article 37
Amendments to the Protocol

The Joint Committee may decide to amend the provisions of this Protocol.

Annex I

INTRODUCTORY NOTES TO THE LIST IN ANNEX II

Note 1:

The list sets out the conditions required for all products to be considered as sufficiently worked or processed within the meaning of Article 6 of the Protocol.

Note 2:

2.1. The first two columns in the list describe the product obtained. The first column gives the heading number or chapter number used in the Harmonized System and the second column gives the description of goods used in that system for that heading or chapter. For each entry in the first two columns, a rule is specified in column 3 or 4. Where, in some cases, the entry in the first column is preceded by an “ex”, this signifies that the rules in column 3 or 4 apply only to the part of that heading as described in column 2.

2.2.Where several heading numbers are grouped together in column 1 or a chapter number is given and the description of products in column 2 is therefore given in general terms, the adjacent rules in column 3 or 4 apply to all products which, under the Harmonized System, are classified in headings of the chapter or in any of the headings grouped together in column 1.

2.3. Where there are different rules in the list applying to different products within a heading, each indent contains the description of that part of the heading covered by the adjacent rules in column 3 or 4.

2.4. Where, for an entry in the first two columns, a rule is specified in both columns 3 and 4, the exporter may opt, as an alternative, to apply either the rule set out in column 3 or that set out in column 4. If no origin rule is given in column 4, the rule set out in column 3 is to be applied.

Note 3:

3.1.The provisions of Article 6 of the Protocol, concerning products having acquired originating status which are used in the manufacture of other products, shall apply, regardless of whether this status has been acquired inside the factory where these products are used or in another factory in Slovenia or in Latvia. 

Example:

An engine of heading 8407, for which the rule states that the value of the non-originating materials which may be incorporated may not exceed 40 % of the ex-works price, is made from “other alloy steel roughly shaped by forging” of heading ex 7224.

If this forging has been forged in Slovenia or in Latvia from a non-originating ingot, it has already acquired originating status by virtue of the rule for heading ex 7224 in the list. The forging can then count as originating in the value-calculation for the engine, regardless of whether it was produced in the same factory or in another factory in Slovenia or in Latvia. The value of the non-originating ingot is thus not taken into account when adding up the value of the non-originating materials used.

3.2. The rule in the list represents the minimum amount of working or processing required, and the carrying-out of more working or processing also confers originating status; conversely, the carrying-out of less working or processing cannot confer originating status. Thus, if a rule provides that non-originating material, at a certain level of manufacture, may be used, the use of such material at an earlier stage of manufacture is allowed, and the use of such material at a later stage is not.

3.3. Without prejudice to Note 3.2, where a rule uses the expression “Manufacture from materials of any heading”, then materials of any heading(s) (even materials of the same description and heading as the product) may be used, subject, however, to any specific limitations which may also be contained in the rule.

However, the expression “Manufacture from materials of any heading, including other materials of heading ...” or “Manufacture from materials of any heading, including other materials of the same heading as the product” means that materials of any heading(s) may be used, except those of the same description as the product as given in column 2 of the list.

3.4. When a rule in the list specifies that a product may be manufactured from more than one material, this means that one or more materials may be used. It does not require that all be used. 

Example:

The rule for fabrics of headings 5208 to 5212 provides that natural fibres may be used and that chemical materials, among other materials, may also be used. This does not mean that both have to be used; it is possible to use one or the other, or both.

3.5. Where a rule in the list specifies that a product must be manufactured from a particular material, the condition obviously does not prevent the use of other materials which, because of their inherent nature, cannot satisfy the rule. (See also Note 6.2 below in relation to textiles). 

Example:

The rule for prepared foods of heading 1904, which specifically excludes the use of cereals and their derivatives, does not prevent the use of mineral salts, chemicals and other additives which are not products from cereals.

However, this does not apply to products which, although they cannot be manufactured from the particular materials specified in the list, can be produced from a material of the same nature at an earlier stage of manufacture. 

Example:

In the case of an article of apparel of ex Chapter 62 made from non-woven materials, if the use of only non-originating yarn is allowed for this class of article, it is not possible to start from non-woven cloth — even if non-woven cloths cannot normally be made from yarn. In such cases, the starting material would normally be at the stage before yarn — that is, the fibre stage.

3.6.Where, in a rule in the list, two percentages are given for the maximum value of non-originating materials that can be used, then these percentages may not be added together. In other words, the maximum value of all the non-originating materials used may never exceed the higher of the percentages given. Furthermore, the individual percentages must not be exceeded, in relation to the particular materials to which they apply.

Note 4:

4.1.The term “natural fibres” is used in the list to refer to fibres other than artificial or synthetic fibres. It is restricted to the stages before spinning takes place, including waste, and, unless otherwise specified, includes fibres which have been carded, combed or otherwise processed, but not spun.

4.2. The term “natural fibres” includes horsehair of heading 0503, silk of headings 5002 and 5003, as well as wool-fibres and fine or coarse animal hair of headings 5101 to 5105, cotton fibres of headings 5201 to 5203, and other vegetable fibres of headings 5301 to 5305.

4.3. The terms “textile pulp”, “chemical materials” and “paper-making materials” are used in the list to describe the materials, not classified in Chapters 50 to 63, which can be used to manufacture artificial, synthetic or paper fibres or yarns.

4.4. The term “man-made staple fibres” is used in the list to refer to synthetic or artificial filament tow, staple fibres or waste, of headings 5501 to 5507.

Note 5:

5.1. Where, for a given product in the list, reference is made to this Note, the conditions set out in column 3 shall not be applied to any basic textile materials used in the manufacture of this product and which, taken together, represent 10 % or less of the total weight of all the basic textile materials used. (See also Notes 5.3 and 5.4 below.)

5.2.However, the tolerance mentioned in Note 5.1 may be applied only to mixed products which have been made from two or more basic textile materials.

The following are the basic textile materials:

— silk,

— wool,

— coarse animal hair,

— fine animal hair,

— horsehair,

— cotton,

— paper-making materials and paper,

— flax,

— true hemp,

— jute and other textile bast fibres,

— sisal and other textile fibres of the genus Agave,

— coconut, abaca , ramie and other vegetable textile fibres,

— synthetic man-made filaments,

— artificial man-made filaments,

— current-conducting filaments,

— synthetic man-made staple fibres of polypropylene,

— synthetic man-made staple fibres of polyester,

— synthetic man-made staple fibres of polyamide,

— synthetic man-made staple fibres of polyacrylonitrile,

— synthetic man-made staple fibres of polyimide,

— synthetic man-made staple fibres of polytetrafluoroethylene,

— synthetic man-made staple fibres of poly(phenylene sulphide),

— synthetic man-made staple fibres of poly(vinyl chloride),

— other synthetic man-made staple fibres,

— artificial man-made staple fibres of viscose,

— other artificial man-made staple fibres,

— yarn made of polyurethane segmented with flexible segments of polyether, whether or not gimped,

— yarn made of polyurethane segmented with flexible segments of polyester, whether or not gimped,

— products of heading 5605 (metallised yarn) incorporating strip consisting of a core of aluminium foil or of a core of plastic film whether or not coated with aluminium powder, of a width not exceeding 5 mm, sandwiched by means of a transparent or coloured adhesive between two layers of plastic film,

— other products of heading 5605. 

Example:

A yarn, of heading 5205, made from cotton fibres of heading 5203 and synthetic staple fibres of heading 5506, is a mixed yarn. Therefore, non-originating synthetic staple fibres which do not satisfy the origin-rules (which require manufacture from chemical materials or textile pulp) may be used, provided that their total weight does not exceed 10 % of the weight of the yarn. 

Example:

A woollen fabric, of heading 5112, made from woollen yarn of heading 5107 and synthetic yarn of staple fibres of heading 5509, is a mixed fabric. Therefore, synthetic yarn which does not satisfy the origin-rules (which require manufacture from chemical materials or textile pulp), or woollen yarn which does not satisfy the origin-rules (which require manufacture from natural fibres, not carded or combed or otherwise prepared for spinning), or a combination of the two, may be used, provided that their total weight does not exceed 10 % of the weight of the fabric. 

Example:

Tufted textile fabric, of heading 5802, made from cotton yarn of heading 5205 and cotton fabric of heading 5210, is a only mixed product if the cotton fabric is itself a mixed fabric made from yarns classified in two separate headings, or if the cotton yarns used are themselves mixtures. 

Example:

If the tufted textile fabric concerned had been made from cotton yarn of heading 5205 and synthetic fabric of heading 5407, then, obviously, the yarns used are two separate basic textile materials and the tufted textile fabric is, accordingly, a mixed product.

5.3. In the case of products incorporating “yarn made of polyurethane segmented with flexible segments of polyether, whether or not gimped”, this tolerance is 20 % in respect of this yarn.

5.4. In the case of products incorporating “strip consisting of a core of aluminium foil or of a core of plastic film whether or not coated with aluminium powder, of a width not exceeding 5 mm, sandwiched by means of a transparent or coloured adhesive between two layers of plastic film”, this tolerance is 30 % in respect of this strip.

Note 6:

6.1.Where, in the list, reference is made to this Note, textile materials (with the exception of linings and interlinings), which do not satisfy the rule set out in the list in column 3 for the made-up product concerned, may be used, provided that they are classified in a heading other than that of the product and that their value does not exceed 8 % of the ex-works price of the product.

6.2.Without prejudice to Note 6.3, materials, which are not classified within Chapters 50 to 63, may be used freely in the manufacture of textile products, whether or not they contain textiles. 

Example:

If a rule in the list provides that, for a particular textile item (such as trousers), yarn must be used, this does not prevent the use of metal items, such as buttons, because buttons are not classified within Chapters 50 to 63. For the same reason, it does not prevent the use of slide-fasteners, even though slide-fasteners normally contain textiles.

6.3.Where a percentage-rule applies, the value of materials which are not classified within Chapters 50 to 63 must be taken into account when calculating the value of the non-originating materials incorporated.

Note 7:

7.1.For the purposes of headings ex 2707, 2713 to 2715, ex 2901, ex 2902 and ex 3403, the “specific processes” are the following:

(a) vacuum-distillation;

(b) redistillation by a very thorough fractionation-process;

(c) cracking;

(d) reforming;

(e) extraction by means of selective solvents;

(f) the process comprising all of the following operations: processing with concentrated sulphuric acid, oleum or sulphuric anhydride; neutralisation with alkaline agents; decolourisation and purification with naturally-active earth, activated earth, activated charcoal or bauxite;

(g) polymerisation;

(h) alkylation;

(i) isomerisation.

7.2. For the purposes of headings 2710, 2711 and 2712, the “specific processes” are the following:

(a) vacuum-distillation;

(b) redistillation by a very thorough fractionation-process;

(c) cracking;

(d) reforming;

(e) extraction by means of selective solvents;

(f) the process comprising all of the following operations: processing with concentrated sulphuric acid, oleum or sulphuric anhydride; neutralisation with alkaline agents; decolourisation and purification with naturally-active earth, activated earth, activated charcoal or bauxite;

(g) polymerisation;

(h) alkylation;

(ij) isomerisation;

(k) in respect of heavy oils of heading ex 2710 only, desulphurisation with hydrogen, resulting in a reduction of at least 85 % of the sulphur-content of the products processed (ASTM D 1266-59 T method);

(l) in respect of products of heading 2710 only, deparaffining by a process other than filtering;

(m) in respect of heavy oils of heading ex 2710 only, treatment with hydrogen, at a pressure of more than 20 bar and a temperature of more than 250 °C, with the use of a catalyst, other than to effect desulphurisation, when the hydrogen constitutes an active element in a chemical reaction. The further treatment, with hydrogen, of lubricating oils of heading ex 2710 (e.g. hydrofinishing or decolourisation), in order, more especially, to improve colour or stability shall not, however, be deemed to be a specific process;

(n) in respect of fuel oils of heading ex 2710 only, atmospheric distillation, on condition that less than 30 % of these products distils, by volume, including losses, at 300 °C, by the ASTM D 86 method;

(o) in respect of heavy oils other than gas oils and fuel oils of heading ex 2710 only, treatment by means of a high-frequency electrical brush-discharge;

(p) in respect of crude products (other than petroleum jelly, ozokerite, lignite wax or peat wax, paraffin wax containing by weight less than 0.75 % of oil) of heading ex 2712 only, de-oiling by fractional crystallisation.

7.3. For the purposes of headings ex 2707, 2713 to 2715, ex 2901, ex 2902 and ex 3403, simple operations, such as cleaning, decanting, desalting, water-separation, filtering, colouring, marking, obtaining a sulphur-content as a result of mixing products with different sulphur-contents, or any combination of these operations or like operations, do not confer origin.

Printing instructions

1. Each form shall measure 210 x 297 mm; a tolerance of up to minus 5 mm or plus 8 mm in the length may be allowed. The paper used must be white, sized for writing, not containing mechanical pulp and weighing not less than 25 g/m2. It shall have a printed green guilloche pattern background making any falsification by mechanical or chemical means apparent to the eye.

2. The competent authorities of Slovenia and Latvia may reserve the right to print the forms themselves or may have them printed by approved printers. In the latter case, each form must include a reference to such approval. Each form must bear the name and address of the printer or a mark by which the printer can be identified. It shall also bear a serial number, either printed or not, by which it can be identified.

JOINT DECLARATION
concerning the review of the changes to the origin rules as a result of the amendments to the Harmonized System

Where, following the amendments made to the nomenclature, the changes to the origin rules as introduced by Decision No 1/2002 alter the substance of any rule existing prior to Decision 1/2002, and it appears that such alteration results in a situation prejudicial to the interest of the sectors concerned, then, if one of the Contracting Parties so requests in the period up to and including 31 December 2004, an examination shall be made as a matter of urgency by the Joint Committee, of the need to restore the substance of the rule concerned as it was before Decision 1/2002.

In any case the Joint Committee shall decide to restore, or not to restore, the substance of the rule concerned within a period of three months of the request being made to it by either of the parties to the Agreement.

If the substance of the rule concerned is restored, then the parties to the Agreement shall also provide the legal framework necessary to ensure that any customs duties paid on the products concerned imported after 1 January 2002 can be reimbursed.

 

Latvijas Republikas un Slovēnijas Republikas brīvās tirdzniecības līguma Apvienotās komitejas lēmums Nr. 1/2002 attiecībā uz Latvijas Republikas un Slovēnijas Republikas brīvās tirdzniecības līguma B Protokolu

APVIENOTĀ KOMITEJA,

Atsaucoties uz 1996.gada 22.aprīlī Rīgā parakstīto brīvās tirdzniecības līgumu starp Latvijas Republiku, no vienas puses un Slovēnijas Republiku, no otras puses, turpmāk sauktu kā "Līgums", un sevišķi B Protokola 38.pantu;

Ievērojot, ka:

(1) Līguma B Protokolā par izcelsmes produkcijas jēdziena definējumu un administratīvās sadarbības metodēm, turpmāk sauktu kā "Protokols", pēc tā stāšanās spēkā vairākas reizes ir veikti grozījumi. Tādējādi ir nepieciešams Protokola tekstā veikto izmaiņu apkopojums, skaidrības un juridiskas noteiktības nepieciešamības dēļ, lai preču izcelsmes noteikumi varētu tikt pielietoti;

(2) Ir nepieciešams veikt tehniskus grozījumus pārstrādes noteikumos, lai ievērotu izmaiņas Preču aprakstīšanas un kodēšanas harmonizētajā sistēmā ("Harmonizētā Sistēma"), kas stājās spēkā no 2002.gada 1.janvāra;

(3) Ir nepieciešams mainīt dažas pārstrādes prasības neizcelsmes materiāliem izcelsmes statusa saņemšanai, ņemot vērā atsevišķu izejmateriālu trūkumu Līgumslēdzēju pusēs, un specifiskos nosacījumus dažu produktu ("monolītās integrālās shēmas") iegūšanai, norādot ierobežotas pārstrādes iespējas ārpus Līgumslēdzējām pusēm;

(4) Ir nepieciešami tehniski labojumi, lai novērstu kļūdas tekstā un neatbilstību starp tekstiem dažādās valodās;

(5) Pilnīgai līguma funkcionēšanai un lietotāju un muitas administratoru darba veicināšanai jaunajā Protokola tekstā atbilstoši ir jāiestrādā visi iepriekšminētie nosacījumi.

IR NOLĒMUSI SEKOJOŠO:

1.pants

Līguma B protokols par "izcelsmes produkcijas" jēdziena definējumu un administratīvās sadarbības metodēm tiek aizstāts ar pievienoto tekstu kopā ar Apvienoto Deklarāciju.

2.pants

1. Šis Lēmums stājas spēkā nākamā mēneša pirmajā datumā, pēc pēdējās diplomātiskās notas saņemšanas, kas apliecina tā apstiprināšanu saskaņā ar katras puses juridiskajām prasībām.

2. Ja šis Lēmums nestājas spēkā līdz 2003.gada janvārim, Slovēnijā tas tiek piemērots pagaidu kārtībā.

I nodaļa
VISPĀRĒJIE NOSACĪJUMI

1.pants
Definīcijas

Šī Protokola izpratnē:

(a) “ražošana” nozīmē jebkāda veida apstrādi vai pārstrādi, tajā skaitā salikšanu vai specifiskas operācijas;

(b) “materiāls” nozīmē jebkādu sastāvdaļu, izejvielu, komponentu vai daļu u.tml., kura tiek izmantota produkcijas ražošanai;

(c) “produkcija” nozīmē produkciju, kas tiek ražota, pat ja tā ir paredzēta vēlākai izmantošanai citās ražošanas operācijās;

(d) “preces” nozīmē gan materiālus, gan produkciju;

(e) “muitas vērtība” nozīmē vērtību, kas noteikta saskaņā ar Līguma par 1994.gada Vispārējās Vienošanās par Tarifiem un Tirdzniecību VII. panta ieviešanu (PTO Līgums par Muitas Novērtējumu);

(f) “ex-works cena” nozīmē produkcijas rūpnīcas cenu, kas samaksāta ražotājam Slovēnijā vai Latvijā, kura uzņēmumā ir veikta pēdējā apstrāde vai pārstrāde; ar noteikumu, ka dotajā cenā ietilpst visu izmantoto materiālu vērtība, atņemot visus iekšējos nodokļus, kuri ir vai var tikt atmaksāti, kad iegūtā produkcija tiek eksportēta;

(g) “materiālu vērtība” nozīmē izmantoto neizcelsmes materiālu muitas vērtību importēšanas brīdī vai, ja tā nav zināma vai nevar tikt noskaidrota, tad pirmā noskaidrotā tirgus cena, kas samaksāta par materiāliem Slovēnijā vai Latvijā;

(h) “izcelsmes materiālu vērtība” nozīmē (g) punktā minētu materiālu vērtību, kas piemērojama mutatis mutandis;

(i) “pievienotā vērtība” ir ex-works cena mīnus katra iestrādātā materiāla muitas vērtība, kura izcelsmes vieta ir citas valstis, kas minētas 3. un 4. pantos, vai gadījumā, ja muitas vērtība nav zināma vai nav nosakāma — pirmā pārbaudāmā cena, kas samaksāta par materiāliem Slovēnijā vai Latvijā;

(j) “grupas” un “preču pozīcijas” nozīmē grupas un preču pozīcijas (četru ciparu kodus), kurus lieto nomenklatūrā, kas veido Preču Aprakstīšanas un Kodēšanas Harmonizēto Sistēmu, kas šajā Protokolā ir minēta kā “Harmonizētā sistēma” vai “HS”;

(k) “klasificēts” attiecas uz produkcijas vai materiāla klasifikāciju attiecīgajā pozīcijā;

(l) “sūtījums” nozīmē produkciju, kas visa tiek vienlaicīgi sūtīta no viena eksportētāja vienam kravas saņēmējam, vai kuras pārvadājumu no eksportētāja pie kravas saņēmēja noformē ar vienu un to pašu transporta dokumentu vai, ja tāda nav, tad ar vienu un to pašu rēķinu;

(m) “teritorijas’’ ietver teritoriālos ūdeņus.

 

II nodaļa
“IZCELSMES PRODUKCIJAS” JĒDZIENA DEFINĒJUMS

2. pants
Vispārējās prasības

1. Šī Līguma izpildes nolūkā sekojoša produkcija tiks uzskatīta par Slovēnijas izcelsmes produkciju:

a) produkcija, kas pilnībā iegūta Slovēnijā, kā noteikts šī Protokola 5. pantā;

b) produkcija, kas iegūta Slovēnijā un satur materiālus, kuri nav pilnībā tur iegūti, nodrošinot, ka minētie materiāli ir izgājuši pietiekamu apstrādi vai pārstrādi Slovēnijā, kā tas ir noteikts šī Protokola 6. pantā.

2. Šī Līguma izpildes nolūkā sekojoša produkcija tiks uzskatīta par Latvijas izcelsmes produkciju:

a) produkcija, kas pilnībā iegūta Latvijā, kā noteikts šī Protokola 5. pantā;

b) produkcija, kas iegūta Latvijā un satur materiālus, kuri nav pilnībā tur iegūti, nodrošinot, ka minētie materiāli ir izgājuši pietiekamu apstrādi vai pārstrādi Latvijā, kā tas ir noteikts šī Protokola 6. pantā.

3. pants
Kumulācija Slovēnijā

1. Produkcija, neietekmējot 2.pantā (1) minēto, tiek uzskatīta par Slovēnijas izcelsmes produkciju, ja tā tur tiek arī iegūta un satur materiālus, kuru izcelsmes valstis ir Bulgārija, Šveice (ieskaitot Lihtenšteinu1), Čehijas Republika, Igaunija, Ungārija, Islande, Lietuva, Latvija, Norvēģija, Polija, Rumānija, Slovēnija, Slovākijas Republika, Turcija vai Eiropas Kopiena saskaņā ar Protokola noteikumiem par preču izcelsmi, kas pievienoti attiecīgajiem Līgumiem starp Slovēniju un katru no minētajām valstīm, nodrošinot, ka tās apstrāde vai pārstrāde Slovēnijā pārsniedz šī Protokola 7. pantā minēto. Nav nepieciešams, lai šie materiāli būtu izgājuši pietiekamu apstrādi vai pārstrādi.

2. Tur, kur Slovēnijā veiktā apstrāde vai pārstrāde nepārsniedz 7.pantā minētās operācijas, iegūtā produkcija tiek uzskatīta par Slovēnijas izcelsmes produkciju tikai, kad pievienotā vērtība ir lielāka par izmantoto materiālu vērtību, kuru izcelsmes valsts ir jebkura no 1.pantā minētām valstīm. Pretējā gadījumā iegūtā produkcija tiek uzskatīta par radītu tajā valstī, kur ir visaugstākā to izcelsmes materiālu vērtība, kas izmantoti ražošanā Slovēnijā.

3. Produkcija, kuras izcelsmes valsts ir kāda no 1.pantā minētajām valstīm, kas netiek nekādā veidā apstrādāta vai pārstrādāta Slovēnijā, saglabā savu izcelsmi, ja tiek eksportēta uz kādu no šīm valstīm.

4. Šajā pantā minētā kumulācija tiek attiecināta tikai uz tiem materiāliem un produkciju, kas ieguvuši izcelsmes statusu tikai šim Protokolam identisku izcelsmes noteikumu piemērošanas ceļā.

4. pants
Kumulācija Latvijā

1. Produkcija, neietekmējot 2.pantā (2) minēto, tiek uzskatīta par Latvijas izcelsmes produkciju, ja tā tur tiek arī iegūta un satur materiālus, kuru izcelsmes valstis ir Bulgārija, Šveice (ieskaitot Lihtenšteinu1), Čehijas Republika, Igaunija, Ungārija, Islande, Lietuva, Latvija, Norvēģija, Polija, Rumānija, Slovēnija, Slovākijas Republika, Turcija vai Eiropas Kopiena saskaņā ar Protokola noteikumiem par preču izcelsmi, kas pievienoti attiecīgajiem Līgumiem starp Latviju un katru no minētajām valstīm, nodrošinot, ka tās apstrāde vai pārstrāde Latvijā pārsniedz šī Protokola 7. pantā minēto. Nav nepieciešams, lai šie materiāli būtu izgājuši pietiekamu apstrādi vai pārstrādi.

2. Tur, kur Latvijā veiktā apstrāde vai pārstrāde nepārsniedz 7.pantā minētās operācijas, iegūtā produkcija tiek uzskatīta par Latvijas izcelsmes produkciju, taču tikai tur, kur pievienotā vērtība ir lielāka par izmantoto materiālu vērtību, kuru izcelsmes valsts ir jebkura no 1.pantā minētām valstīm. Pretējā gadījumā iegūtā produkcija tiek uzskatīta par radītu tajā valstī, kur ir visaugstākā to izcelsmes materiālu vērtība, kas izmantoti ražošanā Latvijā.

3. Produkcija, kuras izcelsmes valsts ir kāda no 1.pantā minētām valstīm, kas netiek nekādā veidā apstrādāta vai pārstrādāta Latvijā, saglabā savu izcelsmi, ja tiek eksportēta uz kādu no šīm valstīm.

4. Šajā pantā minētā kumulācija tiek attiecināta tikai uz tiem materiāliem un produkciju, kas ieguvuši izcelsmes statusu tikai šim Protokolam identisku izcelsmes noteikumu piemērošanas ceļā.

5. pants
Pilnībā iegūtā produkcija

1. Sekojošais tiek uzskatīts par pilnībā iegūtu Slovēnijā vai Latvijā:

(a) minerāli, kas iegūti no to augsnes vai jūras dzīlēm;

(b) tur novākta dārzeņu produkcija;

(c) dzīvi dzīvnieki, tur dzimuši un auguši;

(d) produkcija, kas iegūta no tur audzētiem dzīviem dzīvniekiem;

(e) tur medībās vai makšķerējot iegūtā produkcija;

(f) jūras zvejas produkcija, vai cita produkcija, ko jūrā ārpus Slovēnijas vai Latvijas ūdeņiem, iegūst to kuģi;

(g) produkcija, kas ražota uz to pārstrādes kuģiem tikai no produkcijas, kas minēta (f) punktā; tur savākti lietoti izstrādājumi, kas der tikai izejmateriālu iegūšanai, tai skaitā lietotas riepas, kuras der tikai atjaunošanai vai kā atkritumi;

(h) atkritumi un lūžņi, kas radušies ražošanas procesā, kas tur veikts;

(i) produkcija, kas iegūta no jūras dzīlēm vai dzīlēm ārpus to teritoriālajiem ūdeņiem, ar noteikumu, ka tām vienīgajām ir tiesības izstrādāt šo jūras dibenu un dzīles zem tā;

(j) preces, kas ražotas no produkcijas, kas minēta punktos no (a) līdz (j).

2. Jēdzieni “to kuģi” un “to pārstrādes kuģi” 1.(f) un (g) punktos tiek attiecināti tikai uz kuģiem un pārstrādes kuģiem:

(a) kuri ir reģistrēti vai uzskaitīti Slovēnijā vai Latvijā;

(b) kuri kuģo zem Slovēnijas vai Latvijas karoga;

(c) kuri vismaz 50% apmērā pieder Slovēnijas vai Latvijas pilsoņiem, vai uzņēmumam, kura galvenā mītne ir vienā no šīm valstīm, vai kura vadītājs/a vai vadītāji, direktoru padomes vai uzraudzības padome un šādu padomju locekļu vairākums ir Slovēnijas vai Latvijas pilsoņi, un kurā, turklāt, līgumsabiedrību vai sabiedrību ar ierobežotu atbildību gadījumā, vismaz puse kapitāla pieder šīm valstīm, to valdības iestādēm vai pilsoņiem;

(d) kuru kapteinis un virsnieki ir Slovēnijas vai Latvijas pilsoņi;

(e) uz kuriem vismaz 75% apkalpes ir Slovēnijas vai Latvijas pilsoņi.

6.pants
Pietiekami apstrādāta vai pārstrādāta produkcija

1. 2. panta nolūkos, produkcija, kas nav pilnībā iegūta, tiek uzskatīta par tur pietiekami apstrādātu vai pārstrādātu, ja tā atbilst II Pielikuma nosacījumiem.

Augšminētie nosacījumi nosaka visu šī Līguma produkcijas grupu apstrādi vai pārstrādi, kas jāveic ar neizcelsmes materiāliem, kuri tiek izmantoti produkcijas ražošanā un tikai attiecībā uz šādiem materiāliem. Tādēļ, ja produkcija, kas ieguvusi izcelsmes statusu izpildot visus šai produkcijai piemērojamos nosacījumus, tiek izmantota citas produkcijas ražošanā, uz produkciju, kurā ietverta iepriekšminētā produkcija, šie nosacījumi neattiecas un netiek ņemti vērā tie neizcelsmes materiāli, kas var tikt lietoti tās ražošanā.

2. Neraugoties uz 1.daļas nosacījumiem, neizcelsmes materiāli, kas, saskaņā ar šai produkcijai piemērojamo nosacījumu sarakstu nedrīkst tikt lietoti produkcijas ražošanā, tomēr var tikt izmantoti, ar noteikumu, ka:

(a) to kopējā vērtība nepārsniedz 10 % no produkcijas ex-works cenas;

(b) ja sarakstā dotās neizcelsmes materiālu maksimālās procentuālās vērtības netiek pārsniegtas, piemērojot šīs daļas nosacījumus.

Šis punkts neattiecas un produktiem, kas minēti Harmonizētās Sistēmas 50. līdz 63. grupās.

3. 1. un 2. daļa tiek piemērota saskaņā ar 7.panta nosacījumiem.

7. pants
Nepietiekama apstrāde vai pārstrāde

1. Neietekmējot 2.daļu, sekojošās operācijas tiks uzskatītas par nepietiekamu apstrādi vai pārstrādi, lai noteiktu izcelsmes preču statusu, neņemot vērā to, vai tiek izpildītas 6.panta prasības:

a) operācijas, kas nodrošina preču saglabāšanu labā stāvoklī, transportēšanas un uzglabāšanas laikā;

b) iepakojuma izjaukšana un salikšana;

c) mazgāšana, tīrīšana; putekļu, oksīdu, eļļas, krāsas vai citu pārklājumu noņemšana;

d) tekstilpreču gludināšana vai presēšana;

e) vienkāršas krāsošanas un pulēšanas operācijas;

f) graudu un rīsu lobīšana, daļēja vai kopēja balināšana, pulēšana un glazēšana;

g) cukura krāsošanas vai cukura graudu veidošanas operācijas;

h) augļu, riekstu un dārzeņu lobīšana, kauliņu izņemšana un mizošana;

i) beršana, vienkārša malšana vai vienkārša sagriešana;

j) sijāšana, kārtošana, klasificēšana, šķirošana, salikšana (ieskaitot preču komplektēšanu);

k) vienkārša iepildīšana pudelēs, metāla kārbās, kolbās, ielikšana maisos, kārbās, kastēs, piestiprināšana kartēm vai kartonam un visas pārējās vienkāršās iepakošanas darbības;

l) preču zīmju, etiķešu, logo un citu atšķirības zīmju piestiprināšana vai uzdrukāšana uz precēm vai to iepakojumiem;

m) vienkārša, atšķirīgu vai neatšķirīgu veidu, produktu sajaukšana;

n) preču daļu vienkārša salikšana gatavas preces izgatavošanai vai preču izjaukšana pa daļām;

o) divu vai vairāku no (a) līdz (n) punktos minēto operāciju apvienojums;

p) dzīvnieku kaušana.

2. Visas operācijas, kas tika veiktas ar konkrēto preci Slovēnijā vai Latvijā, tiek uzskatītas par kopumu, nosakot vai šīs preces veiktā apstrāde vai pārstrāde ir jāuzskata par nepietiekamu 1.daļas izpratnē.

8. pants
Kvalifikācijas vienība

1. Par kvalifikācijas vienību šī Protokola noteikumu lietošanas aspektā, tiek uzskatīta attiecīgā produkcija, kura tiek atzīta par pamata vienību, nosakot klasifikāciju ar Harmonizētās Sistēmas nomenklatūras palīdzību.

Tādējādi:

a) kad produkcija, kas sastāv no izstrādājumu grupas vai komplekta, tiek klasificēta Harmonizētā Sistēmā kā viena grupa, tad viss kopums veido vienu kvalifikācijas vienību;

b) kad sūtījums sastāv no vairākiem identiskiem produktiem, kurus klasificē vienā un tajā pašā Harmonizētās Sistēmas grupā, katrs šāds produkts ir jāuztver atsevišķi, lietojot šī Protokola nosacījumus.

2. Tur, kur saskaņā ar Harmonizētās Sistēmas 5. vispārīgo noteikumu, iepakojums klasifikācijas nolūkos tiek iekļauts produkcijā, tam jābūt tāpat iekļautam arī izcelsmes noteikšanas nolūkos.

9. pants
Piederumi, rezerves daļas un instrumenti

Piederumi, rezerves daļas un instrumenti, kurus nosūta ar iekārtu, mašīnu, aparātu vai transporta līdzekli, un kuri ir to parastās komplektācijas daļa un ir iekļauti to cenā, vai kuri netiek pieprasīti apmaksai ar atsevišķu rēķinu, šajā gadījumā tiek uzskatīti par vienu veselumu ar atbilstošo iekārtu, mašīnu, aparātu vai transporta līdzekli.

10. pants
Komplekti

Komplekti, pēc Harmonizētās sistēmas 3. vispārīgā noteikuma definīcijas, tiek uzskatīti par izcelsmes komplektiem, ja katra tos veidojošā sastāvdaļa ir izcelsmes produkcija. Tomēr, ja komplekts sastāv no izcelsmes un neizcelsmes produkcijas, tas kopumā tiek atzīts par izcelsmes produkciju, nodrošinot, ka neizcelsmes produkcijas vērtība nepārsniedz 15 procentus no komplekta ex-works cenas.

11. pants
Neitrālie elementi

Lai noteiktu, vai produkcijai ir izcelsme, nav nepieciešams noteikt sekojošo elementu izcelsmi, kas var būt izmantoti šīs produkcijas ražošanā:

(a) enerģija un degviela;

(b) aprīkojums un iekārtas;

(c) mašīnas un instrumenti;

(d) preces, kas neietilpst un nav paredzētas iekļaušanai produkcijas galīgajā komplektā.

III nodaļa
TERITORIĀLĀS PRASĪBAS

12. pants
Teritoriālais princips

1. II Nodaļā minētos nosacījumus attiecībā uz izcelsmes statusa iegūšanu Slovēnijas un Latvijas teritorijās ir jāpilda nepārtraukti, izņemot gadījumus, kas atrunāti 3.un 4. pantā, kā arī šī panta 3.daļā.

2. Izņemot 3.un 4.pantā minētos gadījumus, ja izcelsmes preces, kas ir eksportētas no Slovēnijas vai Latvijas, tiek atsūtītas atpakaļ, tās uzskata par neizcelsmes precēm, ja vien muitas iestādēm nevar pierādīt, ka:

a) atpakaļ atsūtītās preces ir tās pašas preces, kuras tika eksportētas; un

b) tās nav apstrādātas ne ar kādām operācijām, izņemot tām, kas nepieciešamas to saglabāšanai labā stāvoklī tajā valstī vai eksporta laikā.

3. Apstrāde vai pārstrāde, kas veikta ārpus Slovēnijas vai Latvijas ar materiāliem, kas eksportēti no Slovēnijas vai Latvijas un pēcāk atkārtoti

importēti šajās valstīs, neietekmē izcelsmes statusa ieguvi saskaņā ar II Nodaļā minētiem nosacījumiem, ar nosacījumu, ka:

(a) minētie materiāli ir pilnībā iegūti Slovēnijā vai Latvijā vai ir izgājuši apstrādi vai pārstrādi, kas ir plašāka par 7.pantā minētajām operācijām pirms to eksporta; un

(b) ir iespējams pārliecinoši nodemonstrēt muitas iestādēm, ka

(i) re-importētās preces ir iegūtas, apstrādājot vai pārstrādājot eksportētos materiālus; un

(ii) kopējā pievienotā vērtība, kas iegūta ārpus Slovēnijas vai Latvijas, piemērojot šī panta nosacījumus, nepārsniedz 10% no gala produkta ex-works cenas, kuram tiek pieprasīts izcelsmes statuss.

4. 3.daļas nolūkos, II nodaļas noteikumi izcelsmes statusa iegūšanai netiek attiecināti uz apstrādi vai pārstrādi, kas notiek ārpus Slovēnijas vai Latvijas. Tomēr, tur, kur tiek attiecināts II Pielikuma sarakstā minētais noteikums par maksimālās vērtības noteikšanu visiem izmantotajiem ne-izcelsmes materiāliem, lai identificētu izcelsmes statusu beigu produktam, kopējā ne-izcelsmes materiālu vērtība, kas izmatoti attiecīgās Puses teritorijā, ņemta kopā ar kopējo pievienoto vērtību, kas iegūta ārpus Slovēnijas vai Latvijas, saskaņā ar šī panta nosacījumiem, nepārsniedz tur minētos procentus.

5. 3.un 4.daļas lietošanas nolūkā, ar “kopējo pievienoto vērtību” saprot visas izmaksas, kas rodas ārpus Slovēnijas vai Latvijas, ieskaitot tur iestrādāto materiālu vērtību.

6. 3. un 4.daļas noteikumi netiek attiecināti uz produkciju, kas neapmierina II Pielikuma sarakstā minētos nosacījumus vai arī, kuru var uzskatīt par pietiekami apstrādātu vai pārstrādātu tikai, ja tiek piemērotas 6. (2) pantā minētās vispārējās vērtības.

7. 3.un 4.daļas noteikumi neattiecas uz produktiem, kas pieder pie Harmonizētās Sistēmas 50-63 grupām.

8. Jebkura tāda veida apstrāde vai pārstrāde, kas minēta šī panta noteikumos un notiek ārpus Slovēnijas vai Latvijas, tiek veikta saskaņā ar vienošanos par ārējo apstrādi vai līdzīgiem principiem.

13. pants
Tiešie pārvadājumi

1. Priekšrocības, kuras sniedz šis Līgums, tiek attiecinātas tikai uz produkciju, kas atbilst šī Protokola noteikumiem, un kura tiek pārvadāta starp Slovēniju un Latviju tieši vai caur citu valstu teritorijām, kuras ir minētas 3.un 4. pantā. Tomēr, produkcija, kas veido vienotu, nedalītu sūtījumu, var tikt pārvadāta caur citu teritoriju, ar, ja tas nepieciešams, pārkraušanu vai pagaidu uzglabāšanu šajā teritorijā, nodrošinot, ka preces paliek tranzīta valsts muitas iestāžu uzraudzībā vai uzglabāšanā un ka ar tām netiks veiktas citas operācijas, kā tikai izkraušana, pārkraušana, vai jebkura cita operācija, kas preces saglabā labā stāvoklī.

Izcelsmes produkcija var tikt transportēta pa cauruļvadiem cauri teritorijai, kura nav Slovēnijas vai Latvijas teritorija.

2. Kā pierādījums tam, ka 1. daļas nosacījumi ir izpildīti, importējošās valsts muitas iestādēm jāuzrāda:

a) vienotu kravas pavadzīmi, kurā uzrādīts ceļš no eksportējošās valsts caur tranzīta valsti; vai

b) tranzīta valsts muitas iestāžu izsniegts sertifikāts:

(i) dodot produkcijas precīzu aprakstu;

(ii) norādot produkcijas izkraušanas un pārkraušanas datumus un, ja iespējams, izmantoto kuģu vai citu transporta līdzekļu nosaukumus; un

(iii) apliecinājums par apstākļiem, kādos produkcija atradās tranzīta valstī; vai

(c) augšminētajam iztrūkstot, jebkādus citus pamatojošus dokumentus.

14. pants
Izstādes

1. Izcelsmes produkcija, kura sūtīta izstādei trešajā valstī, citā kā norādīts 3.un 4. pantos un kas pēc izstādes ir pārdota importēšanai Slovēnijā un Latvijā, importējot iegūst priekšrocības no šī Līguma noteikumiem ar nosacījumu, ka muitas iestāžu prasību apmierināšanai tiek uzrādīts, ka:

(a) eksportētājs ir nosūtījis šo produkciju no Slovēnijas vai Latvijas, kurā ir notikusi izstāde un ir to tur izstādījis;

(b) produkcija ir tikusi pārdota vai citādi nodota no eksportētāja personai Slovēnijā vai Latvijā;

(c) produkcija ir tikusi nosūtīta izstādes laikā vai tūlīt pēc izstādes no valsts, kurā tā tika sūtīta uz izstādi; un

(d) produkcija, kopš tā nosūtīta uz izstādi, nav lietota nekādiem nolūkiem, izņemot demonstrēšanu izstādē.

2. Izcelsmes apliecinājumam jābūt izsniegtam un izrakstītam saskaņā ar V Nodaļas nosacījumiem un iesniegtam importējošās valsts muitas iestādēm parastajā veidā. Tajā jābūt minētam izstādes nosaukumam un adresei. Kur nepieciešams, var tikt pieprasīti papildus pierādījumu dokumenti par apstākļiem, kādos produkcija tika izstādīta.

3. 1.daļas noteikumi jāattiecina uz jebkurām tirdzniecības, rūpniecības, lauksaimniecības vai amatniecības izstādēm, gadatirgiem vai līdzīgām sabiedriskām izrādēm vai demonstrējumiem, kuri netiek organizēti privātiem mērķiem veikalos vai darījumu telpās ar nolūku pārdot ārzemju produkciju, un, kuru laikā produkcija paliek muitas kontrolē.

 

IV nodaļa
MUITAS NODEVU ATMAKSĀŠANA VAI ATBRĪVOŠANA NO TĀM

15. pants
Aizliegums atmaksāt muitas nodokli vai atbrīvot no tā

1. Par neizcelsmes materiāliem, kuri tiek izmantoti Slovēnijas vai Latvijas vai kādas no 3.un 4. pantā minētās valsts izcelsmes produkcijas ražošanā un kurai ir izdots vai izrakstīts izcelsmes apstiprinājums saskaņā ar V Nodaļas nosacījumiem, nav atļauts atmaksāt muitas nodokli vai atbrīvot no tā Slovēnijā vai Latvijā.

2. 1.daļas aizliegums attiecas uz jebkuru atlīdzināšanas, atlaišanas vai nemaksāšanas kārtību, daļēju vai pilnīgu, muitas nodokļiem un maksājumiem ar līdzvērtīgu efektu, kas tiek pielietoti Slovēnijā vai Latvijā attiecībā uz materiāliem, kas tiek izmantoti ražošanā, ja šāda atlīdzināšanas, atlaišanas vai nemaksāšanas kārtība tiek attiecināta, teorētiski vai faktiski, tad, kad produkcija, kas iegūta no iepriekšminētajiem materiāliem, tiek eksportēta un netiek attiecināta, kad tā tiek atgriezta iekšējai lietošanai šajā valstī.

3. Produkcijas, kurai izdots izcelsmes apstiprinājums, eksportētājam ir jābūt gatavam jebkurā brīdī, pēc muitas iestāžu pieprasījuma, iesniegt visus nepieciešamos dokumentus, kas apstiprina, ka nav saņemts atlīdzinājums attiecībā uz neizcelsmes materiāliem, kas izmantoti attiecīgās produkcijas ražošanā un ka visi muitas nodokļi vai maksājumi ar līdzvērtīgu efektu, kas attiecināmi uz šādiem materiāliem ir faktiski nomaksāti.

4. 1. līdz 3. daļas nosacījumi attiecas arī uz iepakojumu 8. (2) panta skaidrojumā, piederumiem, rezerves daļām un instrumentiem 9. panta skaidrojumā un komplektiem 10. panta skaidrojumā, ja tiem nav izcelsmes.

5. 1.līdz 4. daļas nosacījumi attiecas tikai uz tāda veida materiāliem, uz kuriem šis Līgums attiecas. Turklāt, tas nenoliedz eksporta kompensācijas sistēmas pielietojumu lauksaimniecības produkcijai, kas tiek attiecināta uz eksportu saskaņā ar šī Līguma nosacījumiem.

 

V nodaļa
IZCELSMES APLIECINĀJUMS

16. pants
Vispārējās prasības

1. Slovēnijas izcelsmes produkcija, importējot to uz Latviju, un Latvijas izcelsmes produkcija, importējot to uz Slovēniju, gūst labumu no šī Līguma, iesniedzot:

(a) kustības sertifikātu EUR.1, kura paraugs dots III Pielikumā; vai

(b) 21.(1) pantā konkretizētajos gadījumos, deklarāciju, (turpmāk tekstā “deklarācija uz rēķina–faktūras”), ko iesniedz eksportētājs uz rēķina-faktūras, preču piegādes pavadzīmes vai jebkura cita komerciāla dokumenta un kas pietiekami detalizēti apraksta attiecīgo produkciju, lai to varētu identificēt. Rēķina -faktūras deklarācijas teksts atspoguļots IV pielikumā

2. Neievērojot 1.daļas nosacījumus, izcelsmes produkcija šī Protokola izpratnē, 26. pantā konkretizētajos gadījumos, gūst labumu no šī Līguma bez nepieciešamības iesniegt kādu no augstākminētajiem dokumentiem.

17. pants
EUR.1 kustības sertifikāta izsniegšanas kārtība

1. EUR.1 kustības sertifikātu izsniedz eksportētājas valsts muitas iestādes, pamatojoties uz eksportētāja vai eksportētāja atbildībā esošā pilnvarotā pārstāvja rakstisku iesniegumu.

2. Šim nolūkam eksportētājam vai tā pilnvarotajam pārstāvim jāaizpilda gan EUR.1 kustības sertifikāts, gan iesnieguma veidlapa, kuru paraugi doti III. Pielikumā. Šīm veidlapām jābūt aizpildītām vienā no valodām, kurā ir sastādīts līgums, un saskaņā ar eksportējošās valsts nacionālās likumdošanas nosacījumiem. Ja tās tiek aizpildītas ar roku, tās jāaizpilda ar tinti un drukātiem burtiem. Produkcijas apraksts jādod šim nolūkam paredzētajā rūtiņā, neatstājot nevienu brīvu līniju. Ja aile nav pilnībā aizpildīta, zem apraksta pēdējās rindas jānovelk horizontāla svītra, svītrojot tukšo laukumu.

3. Eksportētājam, kurš ir griezies pēc EUR.1 sertifikāta izsniegšanas, jebkurā laikā, pēc eksportētājas valsts muitas iestāžu pieprasījuma, kurās EUR.1 kustības sertifikāts tiek izsniegts, jābūt gatavam iesniegt visus atbilstošus dokumentus, kuri apliecinātu attiecīgās produkcijas izcelsmes statusu, kā arī šī Protokola citu prasību izpildi.

4. Līgumslēdzējas Puses muitas iestādes izsniedz kustības sertifikātu EUR.1, ja attiecīgā produkcija var tikt uzskatīta par Līgumslēdzējas Puses valsts vai kādas no 3.un 4. pantā minēto valstu izcelsmes produkciju un tā atbilst pārējām šī Protokola prasībām.

5. Kustības sertifikātu EUR.1 izsniedzošā muitas iestāde veic nepieciešamos pasākumus, lai pārbaudītu produkcijas izcelsmes statusu un šī Protokola pārējo prasību izpildi. Šim nolūkam tai ir tiesības pieprasīt jebkurus pierādījumus un veikt jebkuru eksportētāja uzskaites inspekciju vai jebkādu citu pārbaudi, kuru tā uzskata par derīgu. Tāpat tās pārliecinās, ka 2. daļā minētās anketas tiek pienācīgi aizpildītas. Jo sevišķi tās pārbauda, vai ailes, kas domātas produkcijas aprakstam, tiek aizpildītas tā, lai izslēgtu jebkuru iespēju tās papildināt viltošanas nolūkos.

6. Kustības sertifikāta EUR.1 izdošanas datums tiek uzrādīts sertifikāta 11. ailē.

7. EUR.1 kustības sertifikātu izsniedz muitas iestādes un tam jābūt pieejamam eksportētājam, tiklīdz notiek vai ir nodrošināta faktiskā eksportēšana.

18. pants
Retrospektīvi izsniegtie kustības sertifikāti EUR.1

1. Neievērojot 17.(7) panta nosacījumus, EUR.1 kustības sertifikāti var izņēmuma veidā tikt izsniegti pēc produkcijas eksporta, ja:

a) tie netika izsniegti eksportēšanas laikā, kļūdu vai netīšas nolaidības vai īpašu apstākļu dēļ; vai

b) muitas iestādēm tiek pierādīts, ka EUR.1 kustības sertifikāts ticis izsniegts, bet tehnisku iemeslu dēļ nav akceptēts importēšanai.

2. 1.daļas izpildes nodrošināšanai eksportētājam šajā iesniegumā ir jāuzrāda produkcijas, uz kuru attiecas EUR.1 kustības sertifikāts, eksportēšanas vieta un datums un jānorāda savas prasības iemesli.

3. Muitas iestādes var izsniegt EUR.1. kustības sertifikātu retrospektīvi tikai pēc pārbaudes, vai eksportētāja iesniegumā sniegtā informācija atbilst norādītajiem datiem.

4. Retrospektīvi izsniegtajiem EUR.1 kustības sertifikātiem jābūt apstiprinātiem ar vienu no sekojošām frāzēm:

LV “IZDOTS PĒC PREČU EKSPORTA’’

SL “IZDANO NAKNADNO”

5. 4.daļā minētajam apstiprinājumam jābūt ievietotam EUR.1 kustības sertifikāta ailē “Piezīme”.

19. pants
EUR.1 kustības sertifikātu dublikātu izsniegšana

1. EUR.1 kustības sertifikāta nozagšanas, nozaudēšanas vai iznīcināšanas gadījumā eksportētājs var griezties pie muitas iestādēm, kuras to izsniedza, pēc dublikāta, kuru sastāda uz to rīcībā esošo eksporta dokumentu pamata.

2. Šādā veidā izsniegtajam dublikātam jābūt apstiprinātam ar vienu no sekojošiem vārdiem:

EN “DUPLICATE”

LV “DUBLIKĀTS”

SL “DVOJNIK”.

3. 2.daļā minētajam apstiprinājumam jābūt iekļautam EUR.1 kustības sertifikāta dublikāta ailē “Piezīmes”.

4. Dublikāts, kuram jāsatur EUR.1 kustības sertifikāta oriģināla izsniegšanas datums, stājas spēkā no šī datuma.

20. pants
Kustības sertifikātu EUR.1 izdošana, pamatojoties uz izdotu vai iepriekš izrakstītu izcelsmes apstiprinājumu

Ja izcelsmes produkcija atrodas kādas Slovēnijas vai Latvijas muitas iestādes kontrolē, ir iespējams aizvietot oriģinālo izcelsmes apstiprinājumu ar vienu vai vairākiem kustības sertifikātiem EUR.1 ar mērķi nosūtīt visu vai daļu produkcijas citām muitas iestādēm Slovēnijā vai Latvijā. Aizvietojošais kustības sertifikāts(i) EUR.1 tiek izsniegts muitas iestādē, kuras kontrolē atrodas attiecīgā produkcija.

20.a pants
Uzskaites nodalīšana

1. Gadījumā, ja, uzglabājot atsevišķus izcelsmes un neizcelsmes materiālu krājumus, kas ir identiski un savstarpēji apmaināmi, rodas ievērojamas izmaksas vai būtiski sarežģījumi, muitas iestādes drīkst, pēc attiecīgo personu rakstiska pieprasījuma, atļaut izmantot tā saukto “uzskaites nodalīšanas” metodi šādu krājumu izmantošanā.

2. Ar šo metodi jānodrošina, ka konkrētā atskaites periodā saņemto preču, kuras var uzskatīt par “izcelsmes” precēm, skaits ir vienāds ar tādu preču skaitu, kuras varētu saņemt krājumu fiziskas nodalīšanas gadījumā.

3. Muitas iestādes drīkst dot šādu atļauju, izvirzot jebkuru nosacījumu, kuru tā uzskata par atbilstošu.

4. Šī metode tiek reģistrēta un izmantota, balstoties uz vispārējiem grāmatvedības standartiem, kas piemērojami preces ražošanas valstī.

5. Minētās atļaujas saņēmējs drīkst izdot vai iesniegt pieteikumu attiecībā uz izcelsmes pierādījuma dokumentiem — saskaņā ar konkrētu gadījumu — par preču, kuras var uzskatīt par izcelsmes precēm, skaitu. Pēc muitas iestāžu pieprasījuma, saņēmējs iesniedz apstiprinājumu par to, kādi daudzumi ir izmantoti.

6. Muitas iestādes kontrolē atļaujas izmantošanu un drīkst to atsaukt jebkurā brīdī, ja saņēmējs nepienācīgi izmanto doto atļauju vai nepilda jebkurus no nosacījumiem, kas noteikti šajā Protokolā.

21. pants
Deklarācijas uz rēķina–faktūras izrakstīšanas nosacījumi

1. Deklarāciju uz rēķina–faktūras, kā minēts 16. (1) (b) pantā, var izrakstīt:

a) atzīts eksportētājs 22. panta izpratnē;

b) jebkurš cita eksportētājs sūtījumam, kas sastāv no viena vai vairākiem iepakojumiem, kas satur izcelsmes produkciju, kuru kopējā vērtība nepārsniedz 6,000 eiro.

2. Deklarācija uz rēķina–faktūras var tikt izrakstīta, ja attiecīgā produkcija var tikt uzskatīta par Slovēnijas, Latvijas vai 3.un 4. pantā uzskaitīto valstu izcelsmes produkciju un izpilda citas šī Protokola prasības.

3. Eksportētājam, kas izraksta deklarāciju uz rēķina–faktūras, jābūt gatavam jebkurā brīdī pēc eksportētājas valsts muitas iestāžu pieprasījuma iesniegt visus atbilstošos dokumentus, kas apstiprina attiecīgās produkcijas izcelsmes statusu, kā arī garantēt citu šī Protokola prasību izpildi.

4. Eksportētājam deklarācija uz rēķina–faktūras, kuras teksta piemērs dots IV Pielikumā, ir jānoformē drukātā vai iespiestā uz rēķina–faktūras, kravas pavadzīmes, vai cita komerciāla dokumenta, lietojot vienu no lingvistiskajām versijām, kas minētas šajā Pielikumā, saskaņā ar eksportētājvalsts nacionālo likumdošanu. Ja deklarācija ir rakstīta ar roku, tad tai jābūt aizpildītai ar tinti drukātiem burtiem.

5. Deklarācijām uz rēķina–faktūras ir jābūt parakstītām ar eksportētāja paraksta oriģinālu. Tomēr, atzītam eksportētājam, 22. panta izpratnē, nav jāparaksta šādu deklarāciju, nodrošinot, ka tas iesniedz eksportējošās valsts muitas iestādēm rakstisku solījumu par to, ka uzņemas pilnu atbildību par katru rēķinu–faktūru, kas identificē to kā parakstītāju.

6. Deklarāciju uz rēķina–faktūras var sastādīt eksportētājs tad, kad produkcija, uz kuru tā attiecas, tiek eksportēta vai pēc arī tam ar nosacījumu, ka tā tiek iesniegta importējošās valsts muitas iestādēm ne vēlāk kā divus gadus pēc attiecīgo preču importa.

22. pants
Atzīts eksportētājs

1. Eksportētājvalsts muitas iestādes var pilnvarot jebkuru eksportētāju, turpmāk tekstā — “Atzīts eksportētājs”, kas veic regulārus šī produkcijas sūtījumus šī Līguma ietvaros, aizpildīt deklarācijas uz rēķina–faktūras, neatkarīgi no attiecīgās produkcijas vērtības. Eksportētājam, kas vēlas saņemt šādu pilnvarošanu, muitas iestādēs ir jāiesniedz produkcijas izcelsmes, kā arī citu dotā Protokola nosacījumu izpildes pierādījumus.

2. Muitas iestādes var garantēt atzīta eksportētāja statusu, izvirzot jebkuru nosacījumu, kuru tā uzskata par atbilstošu.

3. Muitas iestādes piešķir Atzītam eksportētājam muitas pilnvaras numuru, kas jāuzrāda deklarācijā uz rēķina–faktūras.

4. Muitas iestādes uzrauga Atzītā eksportētāja pilnvarojuma izmantošanu.

5. Muitas iestādes var pārtraukt pilnvarojumu jebkurā brīdī. Tās to dara, ja Atzītais eksportētājs vairs nenodrošina garantijas, kas minētas 1.daļā, vairs nepilda nosacījumus, kas uzskaitīti 2. daļā vai pilnvarojumu nepareizi izmanto savādāk.

23. pants
Izcelsmes apliecinājuma derīgums

1. Izcelsmes apliecinājums ir derīgs četru mēnešu laikā no izsniegšanas datuma eksportējošā valstī un tas norādītajā periodā jāiesniedz importējošās valsts muitas iestādēm.

2. Izcelsmes apliecinājumi, kas ir iesniegti importētājas valsts muitas iestādēm pēc pēdējās 1. daļā noteiktās dienas, var tikt akceptēti labvēlīga tirdzniecības režīma nodrošināšanas nolūkos, ja šo dokumentu iesniegšanas kavējums ir radies ārkārtēju iemeslu dēļ.

3. Citos nokavētas iesniegšanas gadījumos importējošās valsts muitas iestādes var akceptēt izcelsmes apliecinājumu, ja produkcija tiek uzrādīta pirms norādītā beigu datuma.

24. pants
Izcelsmes apliecinājuma iesniegšana

Izcelsmes apliecinājums jāiesniedz importējošās valsts muitas iestādēm saskaņā ar kārtību, kas ir spēkā šajā valstī. Norādītās iestādes var pieprasīt izcelsmes apliecinājuma tulkojumu. Tās var arī prasīt pievienot importa deklarācijai importētāja paziņojumu par to, ka produkcija atbilst šī Līguma izpildei nepieciešamajiem nosacījumiem.

25. pants
Importēšana pa daļām

Ja pēc importētāja pieprasījuma un importējošās valsts muitas iestāžu noteikumiem izjaukta vai nesalikta produkcija, Harmonizētās Sistēmas 2.(a) vispārējo noteikumu, kas ietilpst nodaļās XVI un XVII vai HS preču pozīcijās 7308 un 9406 izpratnē, tiek importēta pa daļām, tad šādas produkcijas vienots izcelsmes apliecinājums jāiesniedz muitas iestādēm, importējot pirmo daļu.

26. pants
Izņēmumi formālajam izcelsmes apliecinājumam

1. Produkcija, ko privātpersona sūta nelielā iepakojumā citai privātpersonai vai kas veido daļu no ceļotāju personiskās bagāžas, tiek atzīta par izcelsmes produkciju bez formāla izcelsmes apliecinājuma, nodrošinot, ka šāda produkcija netiek importēta tirdzniecības nolūkos un ir deklarēta kā šī Protokola nosacījumus izpildoša, ja nav šaubu par šādas deklarācijas ticamību. Gadījumā, ja produkcija ir nosūtīta pa pastu, šī deklarācija var tikt aizpildīta uz muitas deklarācijas CN22/CN23 vai uz papīra lapas, kas pievienota šim dokumentam.

2. Gadījuma rakstura imports, kas sastāv pamatā no saņēmēja vai ceļotāja, vai to ģimenes locekļu personiskās lietošanas priekšmetiem netiek uzskatīts kā imports tirdzniecības veidā, ja no produkcijas dabas un daudzuma ir acīmredzams, ka tur nav komerciāla rakstura nodomu.

3. Turklāt, kopējā šādas produkcijas vērtība nedrīkst pārsniegt 500 EUR nelielu iepakojumu gadījumā vai 1 200 EUR gadījumā, ja šī produkcija veido daļu no ceļotāja personiskās bagāžas.

27. pants
Papildus dokumenti

Dokumenti, kas minēti 17. (3) un 21. (3) pantos un lietoti EUR.1 kustības sertifikātā vai deklarācijā uz rēķina–faktūras minētās produkcijas izcelsmes apstiprināšanai Slovēnijā, Latvijā vai arī kādā no 3.un 4. pantā uzskaitītām valstīm, kā arī kas izpilda šī Protokola citas prasības, var sastāvēt inter alia no sekojošiem komponentiem:

(a) tieša liecība par eksportētāja vai piegādātāja veiktām operācijām nolūkā iegūt attiecīgo produkciju, kas ietverta, piemēram, tā rēķinos vai iekšējā grāmatvedībā;

(b) dokumenti, kas apstiprina izmantoto materiālu izcelsmi, kurus izdevusi vai kuri ir izrakstīti Slovēnijā vai Latvijā, kur šie dokumenti tiek lietoti saskaņā ar šīs valsts nacionālo likumdošanu;

(c) dokumenti, kas apstiprina attiecīgās produkcijas apstrādi vai pārstrādi Slovēnijā vai Latvijā, kurus izdevusi vai izrakstījusi Slovēnija vai Latvijā un, kur šie dokumenti tiek lietoti saskaņā ar šīs valsts nacionālo likumdošanu;

(d) EUR.1 kustības sertifikāti vai deklarācijas uz rēķina–faktūras, kas apstiprina izmantoto materiālu izcelsmi, kurus izdevusi vai izrakstījusi Slovēnijā vai Latvijā saskaņā ar šo Protokolu vai kāda no 3.un 4.pantā minētajām valstīm, saskaņā ar izcelsmes noteikumiem, kas ir identiski šajā Protokolā atrunātajiem noteikumiem.

28. pants
Izcelsmes apliecinājuma un papildus dokumentu uzglabāšana

1. Eksportētājs, kas iesniedz pieprasījumu EUR.1 kustības sertifikāta izsniegšanai, uzglabā 17. (3) pantā minētos dokumentus vismaz trīs gadus.

2. Eksportētājs, kas izraksta deklarāciju uz rēķina-faktūras, uzglabā šīs deklarācijas kopiju un 21. (3) pantā minētos dokumentus vismaz trīs gadus.

3. Eksportētājvalsts muitas iestādes, kuras izdod EUR.1 kustības sertifikātu, uzglabā vismaz trīs gadus 17. (2) pantā minētā pieteikuma veidlapa.

4. Importētājvalsts muitas iestādēs uzglabā vismaz trīs gadus tām iesniegtais EUR.1 kustības sertifikāts un deklarācija uz rēķina–faktūras.

29. pants
Nesakritības un formālas kļūdas

1. Nelielu nesakritību starp ziņām, kuras sniegtas izcelsmes apliecinājumā un tām, kuras sniegtas muitas iestādēm iesniegtajos dokumentos ar nolūku veikt produkcijas importēšanas formalitātes, atklāšana nevar ipso facto padarīt izcelsmes apliecinājumu par likumīgu spēku zaudējušu, ja ir pienācīgi pamatota šo dokumentu saistība ar piegādāto produkciju.

2. Acīmredzamas formālas kļūdas, tādas kā drukas kļūdas izcelsmes apliecinājuma dokumentos, nevar būt par iemeslu šī dokumenta noraidīšanai, ja šīs kļūdas nav tādas, kuras rada šaubas par šajā dokumentā sniegto ziņu precizitāti.

30. pants
Eiro izteiktās summas

1. Ar mērķi piemērot 21.(1)(b) panta un 26.(3) panta noteikumus gadījumos, kad rēķini par precēm ir izdoti citā valūtā nevis eiro, summas, kas izteiktas Slovēnijas, Latvijas un 3. un 4.pantos minēto valstu nacionālajās valūtās un kas ir vienādas ar summām, kas izteiktas eiro, tiek labotas reizi gadā katrā attiecīgajā valstī.

2. Preču nosūtītājs gūst labumu no 21.(1)(b) panta vai 26.(3) panta noteikumiem, atsaucoties uz valūtu, kurā ir sastādīts rēķins, saskaņā ar attiecīgās valsts laboto summu.

3. Summa, kas lietojama jebkurā dotajā nacionālajā valūtā, ir vienāda ar šīs valūtas summām, kas izteiktas eiro oktobra pirmajā darba dienā, un ir piemērojama no nākamā gada 1.janvāra. Slovēnija un Latvija tiek informētas par attiecīgajām summām.

4. Valsts drīkst noapaļot uz augšu vai uz leju summu, kas iegūta valsts nacionālajā valūtā, eiro konvertēšanas rezultātā. Noapaļotā summa nedrīkst atšķirties no konvertēšanas rezultātā iegūtās summas par vairāk kā 5 procentiem. Valsts drīkst saglabāt eiro izteiktās summas ekvivalentu tās nacionālajā valūtā bez izmaiņām, ja ikgadējās labošanas brīdī, kas noteikts 3.daļā, šīs summas konvertēšanas rezultātā iegūtā ekvivalentā summa nacionālajā valūtā palielinās ne mazāk kā par 15 procentiem pirms summas noapaļošanas. Summas ekvivalentu nacionālajā valūtā drīkst saglabāt nemainītu, ja ekvivalentās summas vērtība konvertēšanas rezultātā samazinātos.

5. Pēc Slovēnijas un Latvijas pieprasījuma Apvienotā komiteja pārskata summu, kas izteikta eiro. Veicot šādu pārskatīšanu, Apvienotā komiteja apsver nepieciešamību saglabāt ierobežojumu rezultātus reālajos noteikumos. Šim nolūkam komisija drīkst pieņemt lēmumu par eiro valūtā izteikto summu labošanu.

VI nodaļa
ADMINISTRATĪVĀS SADARBĪBAS NOSACĪJUMI

31. pants
Savstarpējā sadarbība

1. Slovēnijas un Latvijas muitas iestādes apmainās ar zīmogu paraugiem, kurus tās lieto EUR.1 sertifikātu izsniegšanai un muitas iestāžu adresēm, kuras atbildīgas par šo sertifikātu un deklarāciju uz rēķina–faktūras pārbaudi.

2. Nolūkā nodrošināt šī Protokola pareizu pielietošanu, Slovēnija un Latvija sniedz palīdzību viena otrai, caur kompetentām muitas administrācijām, EUR.1 kustības sertifikātu un deklarāciju uz rēķina–faktūras autentiskuma un tajos uzrādītās informācijas pareizības pārbaudē.

32. pants
Izcelsmes apliecinājuma pārbaude

1. Sekojoša EUR.1 kustības sertifikātu un deklarāciju uz rēķina–faktūras pārbaude jāveic izlases kārtībā vai jebkurā brīdī, kad importējošās valsts muitas iestādēm ir pamats apšaubīt šo dokumentu autentiskumu, attiecīgās produkcijas izcelsmes statusu vai šī Protokola citu prasību izpildi.

2.1.daļas nosacījumu izpildes nolūkā, importējošās valsts muitas iestādēm jāatdod EUR.1 kustības sertifikāts un rēķins–faktūra, ja tas ir iesniegts, deklarācija uz rēķina–faktūras vai šo dokumentu kopijas eksportējošās valsts muitas iestādēm, paziņojot, kur tas ir nepieciešams, izmeklēšanas iemeslus. Jebkurš iegūtais dokuments vai informācija, kas liek domāt, ka izcelsmes apliecinājumā ietvertā informācija ir nepareiza tiks attiecīgi nosūti, lai sniegtu papildus atbalstu lietas pārbaudīšanai.

3. Pārbaude jāveic eksportējošās valsts muitas iestādēm. Šim nolūkam tām ir jābūt tiesīgām pieprasīt jebkādas liecības un veikt jebkādu eksportētāja uzskaites inspekciju vai jebkādu citu pārbaudi, kuru tā uzskata par nepieciešamu.

4. Ja importējošās valsts muitas iestādes nolemj apturēt priekšrocību režīmu attiecīgajai produkcijai, kamēr tiek gaidīti pārbaudes rezultāti, tām jāpiedāvā izsniegt produkciju importētājam, pakļaujot to drošības pasākumiem, kuri tiek atzīti par nepieciešamiem.

5. Muitas iestādes, kuras pieprasa pārbaudi, tiek informētas par šīs pārbaudes rezultātiem cik ātri vien iespējams. Šiem rezultātiem skaidri jānorāda, vai dokumenti ir autentiski un vai attiecīgā produkcija var tikt uzskatīta par Slovēnijas, Latvijas vai kādas citas valsts, kas uzskaitītas 3.un 4.pantā izcelsmes produkciju un vai tā izpilda šī Protokola citas prasības.

6. Ja pamatotu šaubu gadījumos atbilde netiek saņemta desmit mēnešu laikā pēc pārbaudes pieprasīšanas vai ja šī atbilde nesatur pietiekošu informāciju, lai noteiktu apšaubāmā dokumenta autentiskumu vai reālo produkcijas izcelsmi, pieprasījumu izteikušās muitas iestādes atsakās sniegt muitas atvieglojumus, izņemot ārkārtējus apstākļus.

33. pants
Strīdu izšķiršana

Ja rodas strīdi attiecībā uz 32. panta pārbaudes procedūrām, kuri nevar tikt izšķirti starp muitas iestādēm, kuras pieprasa pārbaudi un muitas iestādēm, kuras ir atbildīgas par pārbaudes veikšanu, vai, ja tie izraisa jautājumu par šī Protokola interpretāciju, tiem jābūt iesniegtiem izskatīšanai Apvienotajā komitejā.

Visos gadījumos strīdu starp importētāju un importējošās valsts muitas iestādēm izšķiršana notiek pēc šīs iepriekšminētās valsts likumdošanas.

34. pants
Sodi

Jebkura persona, kuras izraksta vai liek izrakstīt dokumentu, kurš satur neprecīzu informāciju ar mērķi iegūt privileģētu attieksmi pret attiecīgo produkciju, ir sodāma.

35. pants
Brīvās zonas

1. Slovēnijai un Latvijai jāsper visi nepieciešamie soļi, lai nodrošinātu, ka produkcija, kuru tirgo saskaņā ar izcelsmes apliecinājuma noteikumiem, un kuru transportējot izmanto brīvo zonu, kas atrodas to teritorijā, netiek aizstāta ar citām precēm un, ka tā netiek pakļauta kaut kādai darbībai, izņemot normālas operācijas, lai pasargātu to no bojāšanās.

2. Kā izņēmumu 1. daļas nosacījumiem, kad Slovēnijas vai Latvijas izcelsmes produkcija tiek importēta brīvajā zonā kā izcelsmes produkcija un tur tiek pakļauta apstrādei vai pārstrādei, attiecīgajām iestādēm pēc eksportētāja pieprasījuma jāizsniedz jauns transportēšanas sertifikāts EUR.1, ja veiktā apstrāde vai pārstrāde ir atbilstoša šī Protokola nosacījumiem.

NOBEIGUMA NOSACĪJUMI

36. pants
Muitas un izcelsmes lietu apakškomiteja

1. Apvienotās Komitejas ietvaros tiek izveidota muitas un izcelsmes jautājumu apakškomisija, lai atvieglotu tās pienākumu veikšanu un pastāvīgi sniegtu informāciju un konsultācijas, kas notiek starp ekspertiem.

2. Apakškomitejas sastāvā darbojas Slovēnijas un Latvijas eksperti, kas atbild par izcelsmes un muitas jautājumiem.

37. pants
Protokola grozījumi

Apvienotā Komiteja ir tiesīga pieņemt lēmumu par šī Protokola grozījumiem.

1 Lihtenšteinas hercogistei ir muitas ūnija ar Šveici un tā ir Līguma par Eiropas Ekonomisko Zonu puse

 

 

I pielikums

IEVADPIEZĪMES TABULAI II PIELIKUMĀ

1. piezīme:

Tabulā doti nepieciešamie nosacījumi visai produkcijai, lai tā tiktu uzskatīta par pietiekami apstrādātu vai pārstrādātu šī Protokola 6. panta izpratnē.

2. piezīme:

2.1. Tabulas pirmās divas ailes ietver iegūtās produkcijas aprakstu. Pirmā ailē norādīts preču pozīcijas numurs vai grupas numurs, kurus izmanto harmonizētajā sistēmā un otrā ailē — preču apraksts, kuru izmanto šajā sistēmā atbilstošajai preču pozīcijai vai grupai. Katram ierakstam pirmajās divās ailēs atbilst 3. vai 4. ailē norādītie noteikumi. Dažos gadījumos, ierakstu pirmajā ailē ievada “ex”, tas norāda, ka 3. vai 4. ailes noteikumi attiecas tikai uz to preču pozīcijas daļu, kura aprakstīta 2. ailē.

2.2. Tur, kur vairāki preču pozīciju numuri tiek grupēti kopā 1.ailē, kā arī tiek dots grupas numurs un produkcijas apraksts 2.ailē, tādējādi, dots vispārīgos jēdzienos, kopīgie noteikumi 3. vai 4. ailēs attiecas uz visu produkciju, kura pēc harmonizētās sistēmas tiek klasificēta kā šīs grupas preču pozīcija, vai uz jebkuru preču pozīciju, kas sagrupēta kopā 1.ailē.

2.3. Ja sarakstā ir atšķirīgi noteikumi attiecībā uz dažādu produkciju vienā preču pozīcijā, katra atkāpe satur aprakstu tai preču pozīcijas daļai, kurai atbilst blakus esošie 3. vai 4.ailes noteikumi.

2.4. Ja ierakstam pirmajās divās ailēs atbilstošie noteikumi ir aprakstīti gan 3. gan 4.ailē, eksportētājs var izvēlēties, kā alternatīvu, pielietot vienu vai otru noteikumu. Ja 4.ailē nav doti izcelsmes noteikumi, jāvadās no 3.ailē minētajiem.

3. piezīme:

3.1. Šī Protokola 6. panta noteikumi attiecībā uz produkciju, kas ir ieguvusi izcelsmes statusu un kura tiek izmantota citas produkcijas iegūšanā, jāpiemēro neatkarīgi no tā vai šis statuss iegūts rūpnīcā, kurā šī produkcija tiek izmantota vai arī citā rūpnīcā Slovēnijā vai Latvijā. 

Piemērs:

8407. preču pozīcijas dzinējs, kuram noteikums nosaka, ka neizcelsmes materiālu, kuri var tikt iestrādāti, vērtība nedrīkst pārsniegt 40% no ex-works cenas, ir izgatavots no 7224. preču pozīcijas “citiem tērauda sakausējumiem, kuri rupji apstrādāti ar kalšanu”.

Ja šis kalums ir kalts Slovēnijā vai Latvijā no neizcelsmes stieņiem tad kalums jau ir ieguvis izcelsmi, saskaņā ar No ex 7224. preču pozīcijas noteikumu. Šis kalums var tikt ieskaitīts dzinēja vērtības aprēķinā kā izcelsmes materiāls neatkarīgi no tā, vai tas ir ražots tajā pašā vai citā Slovēnijas vai Latvijas rūpnīcā. Neizcelsmes stieņu vērtība tādējādi netiek ņemta vērtā, kad tiek saskaitīta izmantoto neizcelsmes materiālu vērtība.

3.2. Noteikumi sarakstā atspoguļo minimālo apstrādes vai pārstrādes apjomu, kas nepieciešams, jo lielāka apjoma apstrādes vai pārstrādes veikšana arī piešķir izcelsmes statusu; attiecīgi pretēji — mazāka apjoma apstrādes vai pārstrādes veikšana nevar nodrošināt izcelsmes statusu. Tādējādi, ja noteikumi nodrošina, ka neizcelsmes materiāli noteiktā ražošanas stadijā var tikt izmantoti, šādu materiālu izmantošana agrīnā ražošanas stadijā ir atļauta, bet vēlākā — nē.

3.3. Neietekmējot 3.2 piezīmes nosacījumus, kas saka, ka “ražošana no jebkuras preču pozīcijas materiāliem’’, tad jebkuras preču pozīcijas materiāli/s (pat materiāli ar to pašu aprakstu un preču pozīciju kā produkts) var tikt izmantoti, tomēr pakļaujot tos specifiskiem ierobežojumiem, kuri arī var būt ietverti noteikumos.

Tomēr izteiciens “ražošana no jebkuras preču pozīcijas materiāliem, ieskaitot citus materiālus no preču pozīcijas Nr. ...” vai “ražošana no jebkuras preču pozīcijas materiāliem, tai skaitā citiem materiāliem tajā pašā preču pozīcijā kā produkts” nozīmē, ka jebkuras preču pozīcijas materiāli var tikt izmantoti, izņemot tos, kam tāds pats apraksts kā produkcijai saraksta 2.ailē.

3.4. Kad noteikums tabulā nosaka, ka produkcija var tikt ražota no vairāk nekā viena materiāla, tas nozīmē, ka jebkurš viens vai vairāki materiāli var tikt izmantoti. Netiek prasīts, lai tiktu izmantoti visi. 

Piemērs:

Noteikums par audumu no HS 5208 līdz 5212 nosaka, ka var tikt izmantotas dabīgās šķiedras un var tikt izmantoti, citu materiālu starpā, ķīmiskie materiāli. Tas nenozīmē, ka abiem jābūt izmantotiem; var tikt izmantoti kā viens, tā otrs, vai abi kopā.

3.5. kad noteikums tabulā nosaka, ka produkcijai jābūt ražotai no noteikta materiāla, tas, acīmredzot, nenoliedz citu materiālu izmantošanu, kuri nevar izpildīt noteikumu tiem piemītošas dabas dēļ (skat. arī piezīmi 6.2. attiecībā uz tekstilu). 

Piemērs:

1904. preču pozīcijas noteikums par gataviem pārtikas produktiem, kurš īpaši izslēdz labības vai tās atvasinājumu izmantošanu, neliedz izmantot minerālos sāļus, ķimikālijas vai citus papildinājumus, kuri netiek iegūti no labības.

Tomēr, tas neattiecas uz produkciju, kas, lai arī nevar tikt ražota no konkrētā materiāla, kas minēts tabulā, var tomēr tikt izgatavota no līdzīgas dabas materiāla agrākā ražošanas stadijā.  

Piemērs:

Gadījumā, kad ex 62.grupas apģērbs ir izgatavots no neaustajiem materiāliem, ja tiek pieļauta tikai neizcelsmes dzijas izmantošana šai izstrādājumu klasei, nav iespējams sākt ar neausto audumu - pat tad, ja neaustie audumi nevar normāli tikt izgatavoti no dzijas. Šādos gadījumos, sākuma materiāls varētu būt pirms dzijas, tas ir, šķiedras stadijā.

3.6. Ja tabulas noteikumā tiek noteiktas divas procentuālās vērtības neizcelsmes materiālu, kuri var tikt izmantoti, maksimālā satura apzīmēšanai, tad šie procentu rādītāji nevar tikt saskaitīti kopā. Visu izmantoto neizcelsmes materiālu maksimālā vērtība nekad nedrīkst pārsniegt augstāko no dotajiem procentu rādītājiem. Bez tam, individuālie procentu rādītāji nedrīkst tikt pārsniegti attiecībā uz noteiktajiem materiāliem, uz kuriem tie attiecas.

4. piezīme:

4.1. Jēdziens “dabīgās šķiedras” tabulā tiek lietots attiecībā uz šķiedrām, kas nav mākslīgās vai sintētiskās šķiedras. Tas attiecas uz ierobežotu stadiju pirms vērpšanas, ieskaitot atkritumus, un, ja nav noteikts citādi, iekļauj šķiedras, kuras ir kārstas, ķemmētas vai citādi pārstrādātas, bet nevērptas.

4.2. Jēdziens “dabīgās šķiedras” ietver 0503. preču pozīcijas zirgu astrus, 5002. un 5003. preču pozīciju zīdu, kā arī 5101. līdz 5105. preču pozīciju vilnas šķiedru, smalkus vai rupjus dzīvnieku matus, 5201. līdz 5203. preču pozīciju kokvilnas šķiedras un citas 5301. līdz 5305. preču pozīciju augu šķiedras.

4.3. Jēdzieni “tekstila pulpa”, “ķīmiskie materiāli” un “papīra ražošanas materiāli” tiek lietoti tabulā, attiecībā uz materiālus, kuri nav klasificēti 50. līdz 63. grupās, un kuri var tikt izmantoti mākslīgo, sintētisko vai papīra šķiedru, vai dziju ražošanai.

4.4. Jēdziens “mākslīgā štāpeļšķiedra” tiek lietots attiecībā uz 5501. līdz 5507. preču pozīciju sintētisko vai mākslīgo pavedienu auklu, štāpēļšķiedrām vai atkritumiem.

5. piezīme:

5.1. Gadījumā, ja produkcija tabulā ir nosaukta ar atsauci uz šo Piezīmi, tad tabulas 3.ailes nosacījumi netiek attiecināti uz nevienu tekstila pamatmateriālu, kurš izmantots tās ražošanā un kas, kopā ņemot, sastāda 10% vai mazāk no izmantoto tekstila pamatmateriālu svara (skat. zemāk arī 5.3. un 5.4. piezīmi).

5.2. Tomēr, 5.1.piezīmes pieļāvums var tikt attiecināts tikai uz jaukto produkciju, kura izgatavota no diviem vai vairākiem tekstila pamatmateriāliem.

Zemāk minētie materiāli ir tekstila pamatmateriāli:

— zīds,

— vilna

— rupjie dzīvnieku mati,

— smalkie dzīvnieku mati,

— zirgu astri,

— kokvilna,

— papīra ražošanas materiāli un papīrs,

— lini,

— kaņepāji,

— džuta un citu tekstila lūksnu šķiedras,

— sizāls un citas Agave dzimtas tekstila šķiedras,

— kokosriekstu, abakas, rāmijas un citu tekstilaugu šķiedras,

— sintētiskie pavedieni,

— mākslīgie pavedieni,

— strāvu vadošie pavedieni,

— sintētiskās štāpeļšķiedras no polipropilēna,

— sintētiskās štāpeļšķiedras no poliestera,

— sintētiskās štāpeļšķiedras no poliamīda,

— sintētiskās štāpeļšķiedras no poliakrilonitrila,

— sintētiskās štāpeļšķiedras no polimīda,

— sintētiskās štāpeļšķiedras no politetrafluoroetilēna,

— sintētiskās štāpeļšķiedras no poli(fenilēna sulfīda),

— sintētiskās štāpeļšķiedras no poli(vinilhlorīda),

— citas sintētiskās štāpeļšķiedras,

— mākslīgās štāpeļšķiedras no viskozas,

— pārējās ķīmiskās štāpeļškiedras,

— no poliuretāna izgatavota šķiedra (dzija), pārklāta ar elastīgu polietera kārtu, gluda vai reljefa,

— no poliuretāna izgatavota šķiedra, pārklāta ar elastīgu poliestera kārtu, gluda vai reljefa,

— Nr.5605 preču pozīcijas (metalizētā šķiedra) produkti, kurā ir alumīnija sloksnes, kas sastāv no alumīnija folijas serdes vai plastmasas plēves serdes, pārklātas ar alumīnija pulveri vai nepārklātas, platumā, kas nepārsniedz 5 mm, saspiestas ar caurspīdīgu vai krāsainu lipīgu materiālu starp plastmasas plēves divām kārtām,

— citi 5605 preču pozīcijas produkti. 

Piemērs:

5205. preču pozīcijas dzija, izgatavota no 5203. preču pozīcijas kokvilnas šķiedras un 5506. preču pozīcijas sintētiskās štāpeļšķiedras, ir jauktā dzija. Tādējādi, neizcelsmes sintētiskā štāpeļšķiedra, kura neizpilda izcelsmes noteikumus (kuri prasa ražošanu no ķīmiskajiem materiāliem vai tekstila pulpas), var tikt izmantota, ar nosacījumu, ka kopējais svars nepārsniedz līdz 10% no dzijas svara. 

Piemērs:

5112. preču pozīcijas vilnas audums, kurš izgatavots no 5107. preču pozīcijas vilnas dzijas un 5509. preču pozīcijas sintētiskās štāpeļšķiedras dzijas, ir jaukts audums. Tādējādi, sintētiskā dzija, kura neizpilda izcelsmes noteikumus (kuri prasa ražošanu no ķīmiskajiem materiāliem vai tekstila pulpas), vai vilnas dzija, kura neizpilda izcelsmes noteikumus (kuri prasa ražošanu no nekārstajām vai neķemmētajām un citādi vērpšanai nesagatavotām dabīgajām šķiedrām), vai šo divu kombinācija var tikt izmantota ar nosacījumu, ka to kopējais svars nepārsniedz 10%. 

Piemērs:

5802. preču pozīcijas cauršūtie tekstila audumi, kuri izgatavoti no 5205. preču pozīcijas kokvilnas dzijas un 5210. preču pozīcijas kokvilnas auduma, tikai tad uzskatāma par jauktu produkcija, ja pats kokvilnas audums ir jaukts audums, kurš ir izgatavots no dzijām, kuras klasificētas divās atsevišķās preču pozīcijās vai, ja izmantotās kokvilnas dzijas pašas ir jauktas. 

Piemērs:

Ja attiecīgais cauršūtais tekstila audums būtu izgatavots no 5205. preču pozīcijas kokvilnas dzijas un 5407. preču pozīcijas sintētiskā auduma, tad, izmantotās dzijas ir divi atsevišķi tekstila pamatmateriāli, un cauršūtais tekstila audums, attiecīgi, ir jaukta produkcija.

5.3. Gadījumā, ja audumā iestrādāta “grodota vai negrodota dzija, kura izgatavota no poliuretāna segmentiem ar poliestera lokaniem segmentiem”, šis pieļāvums ir 20% attiecībā pret tādu dziju.

5.4. Gadījumā, ja audumi, kuri satur lentu ar alumīnija folijas serdeni vai plastikāta plēves serdeni ar vai bez alumīnija pulvera seguma, kuru platums nepārsniedz 5 mm, kuras no abām pusēm kā sviestmaizē iespiestas ar caurspīdīga vai krāsaina līmmateriāla palīdzību starp diviem plastikāta plēves slāņiem, šis pieļāvums sastāda 30% attiecībā uz šo lentu.

6. piezīme

6.1. Ja tabulā ir atsauce uz šo Piezīmi, tad var tikt izmantoti arī tekstila materiāli (izņemot oderes un starplikas), kas neatbilst šīs tabulas 3.ailes noteikumiem attiecīgajai gatavajai produkcijai, ar nosacījumu, ka tie tiek klasificēti citā pozīcijā, nekā produkcija, un ka to vērtība nepārsniedz 8% no šīs produkcijas ex works cenas.

6.2. Neietekmējot 6.3. piezīmes nosacījumus, materiāli, kuri netiek klasificēti 50. līdz 63. grupās, var tikt brīvi izmantoti tekstilprodukcijas ražošanai, neatkarīgi no tā vai tie satur vai nesatur tekstilu. 

Piemērs:

Ja noteikums tabulā nosaka, ka noteiktam tekstila priekšmetam, piemēram, biksēm, jāizmanto dzija, tas neliedz izmantot metāla priekšmetus, piemēram, pogas, jo pogas netiek klasificētas 50. līdz 63. grupās. Tāda paša iemesla dēļ, tas neliedz izmantot rāvējslēdzējus pat tad, ja šie rāvējslēdzēji parasti satur tekstilu.

6.3. Tur, kur tiek piemēroti procentuālie noteikumi, materiālu, kuri netiek klasificēti 50.līdz 63.grupās, vērtībai ir jābūt ņemtai vērā, kad tiek saskaitīta iestrādāto neizcelsmes materiālu vērtība.

7. piezīme

7.1. Preču pozīciju ex 2707, 2713 līdz 2715, ex 2901, ex 2902 un ex 3403 nolūkos, ‘’specifiski procesi’’ ir sekojošie:

(a) vakuuma destilēšana;

(b) sekundārā destilēšana, precīza frakcionēšana;

(c) krekings;

(d) riformings;

(e) ekstrakcija ar selektīviem šķīdinātājiem;

(f) process, kas satur visas sekojošās operācijas: apstrāde ar koncentrētu sērskābi, oleumu vai sēra anhidrītu; neitralizācija ar sārmiem, atkrāsošana un attīrīšana ar dabīgajām aktīvajām zemēm, , aktivizētām zemēm, aktivizētu kokogli vai boksītu;

(g) polimerizācija;

(h) alkilēšana;

(i) izomerizācija.

7.2. 2710, 2711 un 2712 preču pozīciju mērķiem “specifiski procesi” ir:

(a) vakuuma destilēšana;

(b) pārdestilācija ar pārtvaicēšanu;

(c) krekings;

(d) riformings;

(e) selektīvā ekstrakcija;

(f) process, kas satur visas sekojošās operācijas: apstrāde ar koncentrētu sērskābi, oleumu vai sēra anhidrītu; neitralizācija ar sārmiem; atkrāsošana un attīrīšana ar dabīgajām aktīvajām zemēm, aktivizētām zemēm, aktivizētu kokogli vai boksītu;

(g) polimerizācija;

(h) alkilēšana;

(ij) izomerizācija;

(k) attiecībā uz smagajām eļļām, kas klasificētas ex 2710. preču pozīcijā, desulfurizācija ar ūdeņradi, kuras rezultātā apstrādātajos produktos sēra saturs samazinās par 85 procentiem (metode ASTM D 1266-59 T);

(l) attiecībā uz precēm, klasificētām 2710. preču pozīcijā — deparafinizēšana, filtrēšana;

(m) attiecībā uz smagajām eļļām, klasificētām ex 2710. preču pozīcijā, apstrāde ar ūdeņradi pie spiediena vairāk kā 20 bāri pie temperatūras lielākas kā 250° C, izmantojot katalizatorus atšķirīgus no tiem, kas izsauc desulfurizāciju, ja ūdeņradis veido aktīvu elementu ķīmiskajā reakcijā. Turpmākā ex 2710.preču pozīcijā klasificēto smēreļļu apstrāde ar ūdeņradi (piemēram hidrogenēšana vai atkrāsošana), lai uzlabotu krāsu vai stabilitāti, netiek uzskatīta par specifisku procesu;

(n) attiecībā uz degvieleļļām, klasificētām ex 2710. preču pozīcijā, destilēšana pie atmosfēras spiediena ar nosacījumu, ka atgūtais tilpums, ieskaitot zudumus, ir mazāks par 30 procentiem pie temperatūras ne lielākas kā 300 °C pēc ASTM D 86 metodes;

(o) attiecībā uz smagajām eļļām, izņemot gāzeļļas un degvieleļļas, kuras klasificētas ex 2710. preču pozīcijā, apstrāde ar augstfrekvences elektrisko lauku;

(p) attiecībā uz jēlproduktiem, klasificētiem 2712. preču pozīcijā, eļļas atdalīšana destilējot no produktiem (petrolejas želeja, ozekerīts, lignītvasks vai kūdras vasks, parafīna vasks, ar eļļas saturu mazāku kā 0,75 procenti).

7.3. 2707, 2713 līdz 2715, ex 2901, ex 2902 un ex 3403. preču pozīciju nolūkos, vienkāršas operācijas kā attīrīšana no mehāniskiem piemaisījumiem, atsāļošana, atūdeņošana, filtrēšana, iekrāsošana, iezīmēšana, naftas produkta ar noteiktu sēra saturu iegūšana, pievienojot dažādus sēra saturošus savienojumus. Jebkura šo operāciju kombinācija vai līdzīgas operācijas nepiešķir izcelsmi.

EUR. 1 KUSTĪBAS SERTIFIKĀTA PARAUGS UN PIETEIKUMA IESNIEGŠANA EUR.1 KUSTĪBAS SERTIFIKĀTA SAŅEMŠANAI

Iespiešana

1.Katrai veidlapai jābūt 210 x 297 mm lielai; pieļaujamā garuma nobīde ir līdz mīnus 5 mm vai plus 8 mm. Tās izgatavošanā jāizmanto balts, izmēriem atbilstošs rakstāmpapīrs, kas nesatur mehāniskos piemaisījumus un sver ne mazāk par 25 g/m2. Tam jāsatur iespiestu zaļu kopējošos aizmugures pamatni, kas padara acīmredzamu jebkādu viltošanu ar mehāniskiem vai ķīmiskiem līdzekļiem.

2. Šī Līguma Pušu muitas iestādes var paturēt tiesības pašām iespiest veidlapas vai var nodot to iespiešanu pilnvarotām spiestuvēm. Pēdējā gadījumā, katrai veidlapai ir jāsatur atsauce uz šādu pilnvarošanu. Uz katras veidlapas jābūt iespiedēja vārdam un adresei vai zīmei, pēc kuras iespiedēju var identificēt. Uz tās jābūt arī sērijas numuram, iespiestam vai neiespiestam, pēc kura veidlapu var identificēt.

Apvienotā Deklarācija par izmaiņu izcelsmes noteikumos pārskatīšanu Harmonizētās Sistēmas grozījumu rezultātā

Kur, sekojot atbilstoši grozījumiem nomenklatūrā, izmaiņas izcelsmes noteikumos, kas ieviesti ar Lēmumu Nr.1/2002 maina jebkura pirms Lēmuma Nr.1/2002 pastāvošā noteikuma būtību un izrādās, ka šādi grozījumi rada kaitējumu attiecīgo sektoru interesēm, tad, ja viena no Pusēm laikposmā līdz 2004.gada 31.decembrim ieskaitot pieprasa, Apvienotā Komiteja steidzamības kārtā izvērtē nepieciešamību atjaunot attiecīgā noteikuma būtību kāda tā bija pirms Lēmuma Nr.1/2002.

Jebkurā gadījumā Apvienotā Komiteja trīs mēnešu laikā no kādas Puses pieprasījuma iesniegšanas lemj atjaunot vai neatjaunot attiecīgā noteikuma būtību.

Ja attiecīgo noteikumu būtība ir atjaunota, Līgumslēdzējas puses paredz juridisko ietvaru struktūru, lai nodrošinātu, ka jebkuras muitas nodevas, kas samaksātas par attiecīgām precēm, kuras importētas pēc 2002. gada1.janvāra, var būt atmaksātas.
