Par Latvijas Republikas un Austrālijas līgumu par izdošanu
1.pants. 2000.gada 14.jūlijā Rīgā parakstītais Latvijas Republikas un Austrālijas līgums par izdošanu (turpmāk — Līgums) ar šo likumu tiek pieņemts un apstiprināts.
2.pants. Likums stājas spēkā tā izsludināšanas dienā. Līdz ar likumu izsludināms Līgums angļu valodā un tā tulkojums latviešu valodā.
3.pants. Līgums stājas spēkā tā 16.pantā noteiktajā laikā un kārtībā, un Ārlietu ministrija par to paziņo laikrakstā "Latvijas Vēstnesis".
Likums Saeimā pieņemts 2003.gada 20.februārī.

TREATY ON EXTRADITION BETWEEN THE REPUBLIC OF LATVIA AND AUSTRALIA

THE REPUBLIC OF LATVIA AND AUSTRALIA, hereinafter referred to as "Contracting States",

DESIRING to make more effective the co-operation of the two countries in the suppression of crime by concluding a treaty on extradition,

HAVE AGREED as follows:

Article 1

Obligation to extradite

Each Contracting State agrees to extradite to the other, in accordance with the provisions of this Treaty, any persons who are wanted for prosecution or the imposition or enforcement of a sentence in the Requesting State for an extraditable offence.

Article 2

Extraditable offences

1. For the purposes of this Treaty, extraditable offences are offences, however described, which at the time of the request for extradition are punishable under the laws of both Contracting States by imprisonment for a maximum period of at least one year or by a more severe penalty. Where the request for extradition relates to a person convicted of such an offence who is wanted for the enforcement of a sentence of imprisonment, extradition shall be granted only if a period of at least six months of such penalty remains to be served.

2. For the purpose of this Article in determining whether an offence is an offence against the law of both Contracting States:

(a) it shall not matter whether the laws of the Contracting States place the acts or omissions constituting the offence within the same category of offence or denominate the offence by the same terminology;

(b) the totality of the acts or omissions alleged against the person whose extradition is sought shall be taken into account and it shall not matter whether, under the laws of the Contracting States, the constituent elements of the offence differ.

3. Where extradition of a person is sought for an offence against a law relating to taxation, customs duties, foreign exchange control or other revenue matter extradition may not be refused on the ground that the law of the Requested State does not impose the same kind of tax or duty or does not contain a tax, duty, customs, or exchange regulation of the same kind as the law of the Requesting State.

4. Where the offence has been committed outside the territory of the Requesting State extradition shall be granted where the law of the Requested State provides for the punishment of an offence committed outside its territory in similar circumstances. Where the law of the Requested State does not so provide the Requested State may, in its discretion, grant extradition.

Article 3

Exceptions to extradition

1. Extradition shall not be granted in any of the following circumstances:

(a) if the offence for which extradition is sought is a political offence. Reference to a political offence shall not include the taking or attempting taking of the life of a Head of State or a member of that person's family nor an offence against the law relating to genocide;

(b) if there are substantial grounds for believing that a request for extradition for an ordinary criminal offence has been made for the purpose of prosecuting or punishing a person on account of that person's race, religion, nationality or political opinion or that that person's position may be prejudiced for any of those reasons;

(c) if the offence for which extradition is sought is an offence under military law, which is not an offence under the ordinary criminal law of the Contracting States;

(d) if final judgement has been passed in the Requested State or in a third state in respect of the offence for which the person's extradition is sought;

(e) if the person whose extradition is sought has, according to the law of either Contracting State, become immune from prosecution or punishment by reason of lapse of time; or

(f) if the person, on being extradited to the Requesting State, would be liable to be tried or sentenced in that State by a court or tribunal;

(i) that has been specially established for the purpose of trying the person's case; or

(ii) that is only occasionally, or under exceptional circumstances, authorised to try persons accused of the offence for which extradition is sought.

2. Extradition may be refused in any of the following circumstances:

(a) if the person whose extradition is sought is a national of the Requested State. Nationals of the Republic of Latvia shall be taken to include citizens of the Republic of Latvia and persons who are subjects of the Law on the Status of former USSR Citizens who are not citizens of Latvia or of any other State. Where the Requested State refuses to extradite a national of that State it shall, if the other State so requests and the laws of the Requested State allow, submit the case to the competent authorities in order that proceedings for the prosecution of the person in respect of all or any of the offences for which extradition has been sought may be taken;

(b) if the competent authorities of the Requested State have decided to refrain from prosecuting the person for the offence in respect of which extradition is sought;

(c) if the offence with which the person sought is accused or convicted, or any other offence for which that person may be detained or tried in accordance with this Treaty, carries the death penalty under the law of the Requesting State unless that State undertakes that the death penalty will not be imposed or, if imposed, will not be carried out;

(d) if the offence for which extradition is sought is regarded under the law of the Requested State as having been committed in whole or in part within that State;

(e) if a prosecution in respect of the offence for which extradition is sought is pending in the Requested State against the person whose extradition is sought;

(f) if the offence for which extradition is sought is an offence which carries a punishment of the kind referred to in Article 7 of the International Covenant on Civil and Political Rights, adopted by the United Nations General Assembly on 16 December 1966; or

(g) if the Requested State, while also taking into account the nature of the offence and the interests of the Requesting State, considers that, in the circumstances of the case, including the age, health or other personal circumstances of the person whose extradition is sought, the extradition of that person would be unjust, oppressive, incompatible with humanitarian considerations or too severe a punishment.

3. This Article shall not affect any obligations which have been or shall in the future be assumed by the Contracting States under any multilateral Convention.

Article 4

Postponement of extradition

The Requested State may postpone the extradition of a person in order to proceed against that person, or so that that person may serve a sentence, for an offence other than an offence constituted by an act or omission for which extradition is sought. In such case the Requested State shall advise the Requesting State accordingly.

Article 5

Extradition procedure and required documents

1. A request for extradition shall be made in writing and shall be communicated through the diplomatic channel to the General Prosecutor's Office of the Republic of Latvia or the Attorney-General's Department of Australia, as the case may be. All documents submitted in support of a request for extradition shall be authenticated in accordance with Article 6.

2. The request for extradition shall be accompanied:

(a) if the person is accused of an offence — by a warrant for the arrest or a copy of the warrant for arrest of the person, a statement of each offence for which extradition is sought and a statement of the acts or omissions which are alleged against the person in respect of each offence;

(b) if a person has been convicted in his absence of an offence — by a judicial or other document, or a copy thereof, authorising the apprehension of the person, a statement of each offence for which extradition is sought and a statement of the acts or omissions which are alleged against the person in respect of each offence;

(c) if the person has been convicted of an offence otherwise than in that person's absence — by such documents as provide evidence of the conviction and the sentence imposed, the fact that the sentence is immediately enforceable, and the extent to which the sentence has not been carried out;

(d) if the person has been convicted of an offence otherwise than in that person's absence but no sentence has been imposed — by such documents as provide evidence of the conviction and a statement affirming that it is intended to impose a sentence;

(e) in all cases by the text of the relevant provision of the law, if any, creating the offence or a statement of the relevant law as to the offence including any law relating to the limitation of proceedings, as the case may be, and in either case, a statement of the punishment that can be imposed for the offence; and

(f) in all cases by as accurate a description as possible of the person claimed together with any other information which may help to establish that person's identity and nationality.

3. To the extent permitted by the law of the Requested State, extradition may be granted of a person pursuant to the provisions of this Treaty notwithstanding that the requirements of Paragraph 1 and Paragraph 2 of this Article have not been complied with provided that the person claimed consents to an order for extradition being made.

4. A Contracting State which sends to the other Contracting State a document in accordance with this Treaty that is not in the language of the other Contracting State shall, if requested, provide a translation of the document into the language of the other Contracting State.

Article 6

Authentication of supporting documents

1. A document that, in accordance with Article 5, accompanies a request for extradition shall be admitted in evidence, if authenticated, in any extradition proceedings in the territory of the Requested State.

2. A document is authenticated for the purposes of this Treaty if:

(a) it purports to be signed or certified by a Judge, Magistrate or other officer, including a prosecutor, in or of the Requesting State; and

(b) it purports to be authenticated by the oath or affirmation of a witness or to be sealed with:

(i) an official or public seal of the Requesting State or of a minister of state, or of a Department or officer of the Government, of the Requesting State; or

(ii) in the case of a document emanating from the Republic of Latvia, the seal of the General Prosecutor's Office of the Republic of Latvia.

Article 7

Additional information

1. If the Requested State considers that the information furnished in support of a request for extradition is not sufficient in accordance with this Treaty to enable extradition to be granted that State may request that additional information be furnished within such time as it specifies.

2. If the person whose extradition is sought is under arrest and the additional information furnished is not sufficient in accordance with this Treaty or is not received within the time specified, the person may be released from custody. Such release shall not preclude the Requesting State from making a fresh request for the extradition of the person.

3. Where the person is released from custody in accordance with paragraph 2 of this Article, the Requested State shall notify the Requesting State as soon as practicable.

Article 8

Provisional arrest

1. In case of urgency a Contracting State may apply by means of the facilities of the International Criminal Police Organisation (INTERPOL) or otherwise for the provisional arrest of the person sought pending the presentation of the request for extradition through the diplomatic channel. The application may be transmitted by post or telegraph or by any other means affording a record in writing.

2. The application shall contain a description of the person sought, a statement that extradition is to be requested through the diplomatic channel, a statement of the existence of one of the documents mentioned in paragraph 2 of Article 5 authorising the apprehension of the person, a statement of the punishment that can be, or has been imposed for the offence and, if requested by the Requested State, a concise statement of the acts or omissions alleged to constitute the offence.

3. On receipt of such an application the Requested State shall take the necessary steps to secure the arrest of the person claimed and the Requesting State shall be promptly notified of the result of its request.

4. A person arrested upon such an application may be set at liberty upon the expiration of 45 days from the date of that person's arrest if a request for extradition, supported by the documents specified in Article 5, has not been received.

5. The release of a person pursuant to paragraph 4 of this Article shall not prevent the institution of proceedings with a view to extraditing the person sought if the request is subsequently received.

Article 9

Conflicting requests

1. Where requests are received from two or more States for the extradition of the same person, the Requested State shall determine to which of those States the person is to be extradited and shall notify the Requesting States of its decision.

2. In determining to which State a person is to be extradited, the Requested State shall have regard to all relevant circumstances and, in particular, to:

(a) if the requests relate to different offences - the relative seriousness of the offences;

(b) the time and place of commission of each offence;

(c) the respective dates of the requests;

(d) the nationality of the person; and

(e) the ordinary place of residence of the person.

Article 10

Surrender

1. The Requested State shall, as soon as a decision on the request for extradition has been made, communicate that decision to the Requesting State through the diplomatic channel.

2. Where extradition is granted, the Requested State shall surrender the person from a point of departure in its territory convenient to the Requesting State.

3. The Requesting State shall remove the person from the territory of the Requested State within such reasonable period as the Requested State specifies and, if the person is not removed within that period, the Requested State may refuse to extradite that person for the same offence.

4. If circumstances beyond its control prevent a Contracting State from surrendering or removing the person to be extradited it shall notify the other Contracting State. The two Contracting States shall mutually decide upon a new date of surrender, and the provisions of paragraph 3 of this Article shall apply.

Article 11

Surrender of property

1. To the extent permitted under the law of the Requested State and subject to the rights of third parties, which shall be duly respected, all property found in the Requested State that has been acquired as a result of the offence or may be required as evidence shall, if the Requesting State so requests, be surrendered if extradition is granted.

2. Subject to paragraph 1 of this Article, the abovementioned property shall, if the Requesting State so requests, be surrendered to the Requesting State even if the extradition cannot be carried out.

3. Where the law of the Requested State or the rights of third parties so require, any articles so surrendered shall be returned to the Requested State free of charge if that State so requests.

Article 12

Rule of speciality

1. Subject to paragraph 3 of this Article, a person extradited under this Treaty shall not be detained or tried, or be subjected to any other restriction of his personal liberty, in the territory of the Requesting State for any offence committed before his extradition other than:

(a) an offence for which extradition was granted or any other extraditable offence of which the person could be convicted upon proof of the facts upon which the request for extradition was based, provided that that offence does not carry a penalty which is more severe than that which could be imposed for the offence for which extradition was sought; or

(b) any other extraditable offence in respect of which the Requested State consents.

2. A request for the consent of the Requested State under this Article shall be accompanied by the documents mentioned in Article 5.

3. Paragraph 1 of this Article does not apply if the person has had an opportunity to leave the Requesting State and has not done so within 45 days of final discharge in respect of the offence for which that person was extradited or if the person has returned to the territory of the Requesting State after leaving it.

Article 13

Surrender to a third State

1. Where a person has been surrendered to the Requesting State by the Requested State, the first-mentioned State shall not surrender that person to any third State for an offence committed before that person's surrender unless:

(a) the Requested State consents to that surrender; or

(b) the person has had an opportunity to leave the Requesting State and has not done so within 45 days of final discharge in respect of the offence for which that person was surrendered by the Requested State or has returned to the territory of the Requesting State after leaving it.

2. Before acceding to a request pursuant to sub-paragraph (1)(a) of this Article, the Requested State may request the production of the documents mentioned in Article 5.

Article 14

Transit

1. Where a person is to be extradited to a Contracting State from a third State through the territory of the other Contracting State, the Contracting State to which the person is to be extradited shall request the other Contracting State to permit the transit of that person through its territory.

2. Upon receipt of such a request the Requested Contracting State shall grant the request unless it is satisfied that there are reasonable grounds for refusing to do so.

3. Permission for the transit of a person shall, subject to the law of the Requested Contracting State, include permission for the person to be held in custody during transit.

4. Where a person is being held in custody pursuant to paragraph 3 of this Article, the Contracting State in whose territory the person is being held may direct that the person be released if transportation is not continued within a reasonable time.

5. The Contracting State to which the person is being extradited shall reimburse the other Contracting State for any expense incurred by that other Contracting State in connection with the transit.

Article 15

Expenses

1. The Requested State shall make all necessary arrangements for and meet the cost of any proceedings arising out of a request for extradition and shall otherwise represent the interest of the Requesting State.

2. The Requested State shall bear the expenses incurred in its territory in the arrest and detention of the person whose extradition is sought until that person is surrendered to a person nominated by the Requesting State.

3. The Requesting State shall bear the expenses incurred in conveying the person from the territory of the Requested State.

Article 16

Entry into force and termination

1. This Treaty shall enter into force on the thirtieth day after the receipt of the last notification by which the Contracting States have notified each other in writing that their respective requirements for the entry into force of this Treaty have been complied with.

2. On the entry into force of this Treaty, the Treaty between the Latvian Republic and the United Kingdom of Great Britain and Ireland for the mutual extradition of fugitive criminals, done at Riga on 16 July 1924, shall cease to be in force between the Republic of Latvia and Australia.

3. Requests for extradition made after this Treaty has entered into force may be granted pursuant to the provisions of this Treaty irrespective of whether the offence in relation to which extradition is sought was committed before or after the entry into force of this Treaty.

4. This Treaty may be amended by agreement in writing between the Contracting States. Any such agreement shall enter into force in accordance with the procedure set out in paragraph 1 of this Article.

5. Either Contracting State may terminate this Treaty by notice in writing at any time and it shall cease to be in force on the one hundred and eightieth day after the day on which notice is given.

IN WITNESS WHEREOF the undersigned, being duly authorised thereto by their respective Governments, have signed this Treaty.

LATVIJAS REPUBLIKAS UN AUSTRĀLIJAS LĪGUMS PAR IZDOŠANU

Latvijas Republika un Austrālija (turpmāk tekstā — Līgumslēdzējas valstis),

VĒLOTIES padarīt efektīvāku sadarbību starp abām valstīm noziedzības apkarošanā, noslēdzot līgumu par izdošanu,

IR VIENOJUŠĀS par turpmāko:

1. pants

Pienākums veikt izdošanu

Līgumslēdzējas valstis vienojas par to, ka saskaņā ar šī Līguma noteikumiem izdos otrai Līgumslēdzējai valstij visas personas, kas lūguma iesniedzējā valstī tiek meklētas kriminālvajāšanai, tiesāšanai vai soda izpildei sakarā ar tādu noziedzīgu nodarījumu, par ko ir paredzēta izdošana.

2. pants

Noziedzīgi nodarījumi, par ko ir paredzēta izdošana

1. Šajā Līgumā noziedzīgi nodarījumi, par ko ir paredzēta izdošana, ir noziedzīgi nodarījumi, par kuriem laikā, kad lūdz izdošanu, saskaņā ar abu Līgumslēdzēju valstu likumiem sods ir brīvības atņemšana uz vismaz vienu gadu vai smagāks sods. Ja izdošanas lūgums attiecas uz personu, kas ir notiesāta par šādu noziedzīgu nodarījumu un kas tiek meklēta brīvības atņemšanas soda izpildei, izdošanu veic vienīgi tad, ja atlikušais šā soda izciešanas laiks ir vismaz seši mēneši.

2. Šajā pantā, nosakot to, vai kāds nodarījums ir noziedzīgs nodarījums saskaņā ar abu Līgumslēdzēju valstu likumiem:

a) nav nozīmes tam, vai Līgumslēdzēju valstu likumos attiecīgā darbība vai bezdarbība, kas ir noziedzīgs nodarījums, pieder pie tādas pašas noziedzīgu nodarījumu kategorijas, kā arī tam, vai noziedzīgais nodarījums ir definēts, lietojot tādu pašu terminoloģiju;

b) ņem vērā to darbību vai bezdarbību kopumu, par ko apsūdz personu, kuru lūdz izdot, un nav nozīmes tam, vai saskaņā ar Līgumslēdzēju valstu likumiem attiecīgā noziedzīgā nodarījuma sastāva elementi atšķiras.

3. Ja personu lūdz izdot par noziedzīgu nodarījumu nodokļu, muitas nodevu, ārvalstu valūtas tirgus kontroles vai citā ar ieņēmumiem saistītā jomā, tad nedrīkst attiekties veikt izdošanu, pamatojoties uz to, ka lūguma saņēmējas valsts likumi neparedz tādus pašus nodokļus vai nodevas vai ka tās likumos nav normu, kas regulē nodokļu, nodevu, muitas vai ārvalstu valūtas tirgus jomu, vai tās nav analogas lūguma iesniedzējas valsts likumos paredzētajām normām.

4. Ja noziedzīgs nodarījums ir izdarīts ārpus lūguma iesniedzējas valsts teritorijas, izdošanu veic tad, ja lūguma saņēmējas valsts likumi paredz sodu par noziedzīgu nodarījumu, kas ir izdarīts ārpus tās teritorijas līdzīgos apstākļos. Ja lūguma saņēmējas valsts likumi to neparedz, lūguma saņēmēja valsts var veikt izdošanu pēc saviem ieskatiem.

3. pants

Izņēmumi

1. Izdošanu nedrīkst veikt, ja pastāv kāds no turpmāk norādītajiem apstākļiem:

a) noziedzīgais nodarījums, par ko ir lūgta izdošana, ir politisks. Par politisku nodarījumu nav uzskatāma ne valsts vadītāja vai šās personas ģimenes locekļa nonāvēšana vai nonāvēšanas mēģinājums, ne arī genocīds;

b) ir pietiekams pamats uzskatīt, ka izdošanu lūdz par parastu noziedzīgu nodarījumu, lai vajātu vai sodītu personu tās rases, reliģijas, tautības vai politisko uzskatu dēļ, vai ka šās personas stāvoklim varētu kaitēt kāds no minētajiem iemesliem;

c) nodarījums, par ko ir lūgta izdošana, ir noziedzīgs nodarījums vienīgi militārajā jomā, bet nav noziedzīgs nodarījums saskaņā ar Līgumslēdzēju valstu vispārējām krimināltiesību normām;

d) lūguma saņēmējā valstī vai kādā trešajā valstī ir taisīts galīgais spriedums lietā par noziedzīgo nodarījumu, par ko personu lūdz izdot;

e) tās personas, kuru lūdz izdot, kriminālvajāšana vai sodīšana atbilstīgi jebkuras Līgumslēdzējas valsts likumiem nav iespējama sakarā ar noilgumu; vai

f) attiecīgo personu pēc izdošanas lūguma iesniedzējai valstij varētu tiesāt vai piespriest viņai sodu šās valsts tiesā vai tribunālā:

    i) kas ir īpaši izveidots šās personas lietas iztiesāšanai; vai

    ii) kas ir pilnvarots tikai īpašos gadījumos vai apstākļos tiesāt personas, kas apsūdzētas noziedzīgajā nodarījumā, par ko ir lūgta izdošana.

2. Izdošanu var atteikties veikt, ja pastāv kāds no turpmāk norādītajiem apstākļiem:

a) persona, ko lūdz izdot, ir lūguma saņēmējas valsts pilsonis. Par Latvijas Republikas pilsoņiem uzskata Latvijas Republikas pilsoņus un personas, uz kurām attiecas likums "Par to bijušās PSRS pilsoņu statusu, kuriem nav Latvijas vai citas valsts pilsonības". Gadījumā, kad lūguma saņēmēja valsts atsakās izdot savu pilsoni, tad — ja to lūdz otra Līgumslēdzēja valsts un ja lūguma saņēmējas valsts likumi to ļauj — lūguma saņēmēja valsts nodod lietu kompetentajām iestādēm, lai varētu veikt attiecīgās personas kriminālvajāšanu sakarā ar visiem noziedzīgajiem nodarījumiem, par ko ir lūgta izdošana, vai kādu no tiem;

b) lūguma saņēmējas valsts kompetentās iestādes ir nolēmušas neuzsākt personas kriminālvajāšanu sakarā ar noziedzīgo nodarījumu, par ko ir lūgta izdošana;

c) par noziedzīgo nodarījumu, kurā ir apsūdzēta vai par ko ir notiesāta attiecīgā persona, kuru lūdz izdot, vai par kādu citu noziedzīgu nodarījumu, par ko šo personu var apcietināt vai tiesāt saskaņā ar šo Līgumu, lūguma iesniedzējas valsts likumos ir paredzēts nāves sods, izņemot gadījumu, kad šī valsts apņemas nepiespriest nāves sodu vai arī — ja nāves sodu piespriestu — neizpildīt to;

d) noziedzīgais nodarījums, par ko ir lūgta izdošana, saskaņā ar lūguma saņēmējas valsts likumiem ir uzskatāms par pilnībā vai daļēji veiktu šās valsts teritorijā;

e) lūguma saņēmējā valstī notiek personas kriminālvajāšana par noziedzīgo nodarījumu, par ko ir lūgta izdošana;

f) noziedzīgais nodarījums, par ko ir lūgta izdošana, ir nodarījums, par kuru paredzēts sods, kāds minēts Apvienoto Nāciju Organizācijas Ģenerālās asamblejas 1966.gada 16.decembrī pieņemtā Starptautiskā pakta par pilsoniskajām un politiskajām tiesībām 7.pantā; vai

g) lūguma saņēmēja valsts, ņemot vērā noziedzīga nodarījuma raksturu un lūguma iesniedzējas valsts intereses, uzskata, ka — ievērojot attiecīgās lietas apstākļus, tostarp personas, kuru lūdz izdot, vecumu, veselības stāvokli vai citus personīgas dabas apstākļus — šās personas izdošana būtu netaisna, cietsirdīga, neatbilstoša humānajiem apsvērumiem vai šai personai varētu tikt noteikts pārāk bargs sods.

3. Šis pants neietekmē jebkādus pienākumus, ko Līgumslēdzējas valstis ir uzņēmušās vai turpmāk uzņemsies saskaņā ar kādu daudzpusēju Konvenciju.

4. pants

Izdošanas atlikšana

Lūguma saņēmēja valsts var atlikt personas izdošanu, lai veiktu procesuālas darbības attiecībā uz šo personu vai arī lai šī persona varētu izciest sodu par kādu citu noziedzīgu nodarījumu, kas nav darbības vai bezdarbības izraisīts noziedzīgs nodarījums, par ko lūdz izdošanu. Šādā gadījumā lūguma saņēmēja valsts atbilstoši informē lūguma iesniedzēju valsti.

5. pants

Izdošanas procedūra un vajadzīgie dokumenti

1. Izdošanas lūgumu ir jāiesniedz rakstiski un ar diplomātiskā dienesta starpniecību jānodod Latvijas Republikas Ģenerālprokuratūrai vai Austrālijas Ģenerālprokuratūrai. Visiem dokumentiem, ko iesniedz papildus izdošanas lūgumam, ir jābūt autentiskiem 6.panta nozīmē.

2. Izdošanas lūgumam ir jāpievieno:

a) ja persona ir apsūdzēta kādā noziedzīgā nodarījumā — attiecīgi lēmums par šās personas apcietināšanu vai arī šāda dokumenta noraksts, paziņojums par visiem noziedzīgajiem nodarījumiem, par ko lūdz izdošanu, un — katra noziedzīgā nodarījuma sakarā — izklāsts par darbībām vai bezdarbībām, kurās šo personu apsūdz;

b) ja persona tās prombūtnē ir notiesāta par kādu noziedzīgu nodarījumu — tiesas vai cits dokuments, vai šāda dokumenta noraksts, kas pilnvaro apcietināt šo personu, un — katra noziedzīgā nodarījuma sakarā — izklāsts par darbībām vai bezdarbībām, kurās šo personu apsūdz;

c) ja persona citādi, nevis tās prombūtnē, ir notiesāta par kādu noziedzīgu nodarījumu — tādi dokumenti, kas apliecina notiesāšanu, noteikto sodu, faktu, ka sods ir piemērojams nekavējoties, un to, kāda daļa no soda vēl nav izciesta;

d) ja persona citādi, nevis tās prombūtnē, ir notiesāta par kādu noziedzīgu nodarījumu, bet sods nav noteikts — tādi dokumenti, kas apliecina notiesāšanu, un paziņojums, kas apliecina nodomu noteikt sodu;

e) visos gadījumos — to likuma normu teksti, ja tādas normas ir, kas definē attiecīgo noziedzīgo nodarījumu, vai to likumu izklāsts, kuri attiecas uz noziedzīgo nodarījumu, tostarp to likumu normas par kriminālatbildības noilgumu, ja tāds pastāv, bet — abos gadījumos — paziņojums par sodu, ko var noteikt par attiecīgo noziedzīgo nodarījumu; un

f) visos gadījumos — iespējami precīzs tās personas apraksts, kuru lūdz izdot, kopā ar jebkuru citu informāciju, kas var palīdzēt noteikt šās personas identitāti un pilsonību.

3. Atbilstīgi lūguma saņēmējas valsts likumos atļautajam personas izdošanu saskaņā ar šā Līguma noteikumiem var veikt, atkāpjoties no šā panta 1. un 2.punktā paredzēto prasību izpildes, ar nosacījumu, ka persona, kuru lūdz izdot, piekrīt izdošanas rīkojuma piemērošanai.

4. Līgumslēdzēja valsts, kura saskaņā ar šo Līgumu nosūta otrai Līgumslēdzējai valstij dokumentu, kas nav šās otras Līgumslēdzējas valsts valodā, pēc attiecīga lūguma nodrošina dokumenta tulkojumu otras Līgumslēdzējas valsts valodā.

6. pants

Papildu dokumentu autentiskums

1. Dokumentus, ko saskaņā ar 5.pantu pievieno izdošanas lūgumam, ja tie ir autentiski, lūguma saņēmējas valsts teritorijā var izmantot par pierādījumiem jebkurā tiesvedībā, kas saistīta ar izdošanu.

2. Šā līguma nolūkā dokuments ir autentisks, ja:

a) to ir parakstījis vai apliecinājis tiesnesis, miertiesnesis vai cita lūguma iesniedzējas valsts amatpersona, tostarp prokurors; un

b) tas ir apliecināts ar zvērestu vai apliecinājuma uzrakstu, vai arī apzīmogots ar:

    i) lūguma iesniedzējas valsts oficiālo vai publisko zīmogu, vai lūguma iesniedzējas valsts valsts ministra vai valdības amatpersonas zīmogu; vai arī

    ii) ar Latvijas Republikas Ģenerālprokuratūras zīmogu, ja dokumentus iesniedz Latvijas Republika.

7. pants

Papildu informācija

1. Ja lūguma saņēmēja valsts uzskata, ka informācija, kas sniegta kopā ar izdošanas lūgumu, saskaņā ar šo Līgumu nav pietiekama, lai varētu veikt izdošanu, tad minētā valsts var lūgt sniegt attiecīgu papildu informāciju tādā termiņā, kādu tā nosaka.

2. Ja persona, kuru lūdz izdot, atrodas apcietinājumā, un sniegtā papildu informācija saskaņā ar šo Līgumu nav pietiekama vai arī tā nav saņemta noteiktajā termiņā, minēto personu var atbrīvot no apcietinājuma. Šāda atbrīvošana neliedz lūguma iesniedzējai valstij iesniegt jaunu lūgumu par šās personas izdošanu.

3. Ja persona ir atbrīvota no apcietinājuma saskaņā ar 2.punktu, lūguma saņēmēja valsts par to iespējami ātri informē lūguma iesniedzēju valsti.

8. pants

Pagaidu apcietinājums

1. Ārkārtas gadījumā Līgumslēdzēja valsts, izmantojot Starptautiskās Kriminālpolicijas organizācijas (INTERPOL) iespējas vai citus līdzekļus, var — līdz izdošanas lūguma iesniegšanai ar diplomātiskā dienesta starpniecību — lūgt uz laiku apcietināt personu, kuru lūdz izdot. Šādu lūgumu var izteikt, izmantojot pastu vai telegrāfu, vai jebkādus citus līdzekļus, kas nodrošina rakstisku formu.

2. Lūgumā par pagaidu apcietināšanu ietver meklējamās personas aprakstu, paziņojumu par to, ka izdošana tiks lūgta ar diplomātiskā dienesta starpniecību, paziņojumu par to, ka eksistē kāds no 5.panta 2.punktā minētajiem dokumentiem, kas pilnvaro apcietināt šo personu, paziņojumu par iespējamo sodu, ko var noteikt vai kas ir noteikts par attiecīgo noziedzīgo nodarījumu, un — ja to lūdz lūguma saņēmēja valsts — īss izklāsts par darbībām vai bezdarbībām, kas veido noziedzīgā nodarījuma sastāvu.

3. Ja saņemts šāds lūgums, lūguma saņēmēja valsts veic vajadzīgos pasākumus, lai nodrošinātu meklētās personas pagaidu apcietināšanu, un tūlīt paziņo lūguma iesniedzējai valstij par tās lūguma rezultātu.

4. Personu, kas uz laiku apcietināta, pamatojoties uz šādu lūgumu, var atbrīvot, kad ir pagājušas 45 dienas no šās personas apcietināšanas dienas, ja nav saņemts izdošanas lūgums kopā ar 5.pantā minētajiem dokumentiem.

5. Personas atbrīvošana saskaņā ar šā panta 4.punktu neliedz sākt procesuālās darbības ar nolūku izdot šo personu, ja lūgums ir saņemts pēc šādas atbrīvošanas.

9. pants

Konkurējoši lūgumi

1. Ja no divām vai vairāk valstīm ir saņemti lūgumi par vienas un tās pašas personas izdošanu, lūguma saņēmēja valsts nosaka to, kurai no šīm valstīm persona ir jāizdod, un par savu lēmumu informē lūgumu iesniedzējas valstis.

2. Nosakot to, kurai valstij persona ir jāizdod, lūguma saņēmēja valsts ņem vērā visus attiecīgos apstākļus, jo īpaši:

a) ja lūgumi attiecas uz dažādiem noziedzīgiem nodarījumiem — noziedzīgo nodarījumu relatīvo smagumu;

b) katra noziedzīgā nodarījuma izdarīšanas laiku un vietu;

c) lūgumu datumus;

d) personas pilsonību; un

e) personas pastāvīgo dzīvesvietu.

10. pants

Nodošana

1. Tiklīdz par izdošanas lūgumu ir pieņemts lēmums, lūguma saņēmēja valsts ar diplomātiskā dienesta starpniecību šo lēmumu dara zināmu lūguma iesniedzējai valstij.

2. Ja lūguma saņēmēja valsts piekrīt veikt izdošanu, tā nodod attiecīgo personu vietā, kur iespējams atstāt lūguma saņēmējas valsts teritoriju un kas ir ērta lūguma iesniedzējai valstij.

3. Lūguma iesniedzēja valsts pārņem personu no lūguma saņēmējas valsts teritorijas pamatotā termiņā, ko nosaka lūguma saņēmēja valsts, un — ja persona šajā termiņā nav pārņemta — lūguma saņēmēja valsts var atteikties izdot šo personu par attiecīgo noziedzīgo nodarījumu.

4. Ja kāda Līgumslēdzēja valsts no tās neatkarīgu iemeslu dēļ nevar nodot vai pārņemt izdodamo personu, tā attiecīgi informē otru Līgumslēdzēju valsti. Abas Līgumslēdzējas valstis savstarpēji izlemj par jaunu nodošanas datumu, un uz šādu gadījumu attiecas šā panta 3.punkta noteikumi.

11. pants

Mantas nodošana

1. Pēc lūguma iesniedzējas valsts attiecīga lūguma, ja ir piekrišana izdošanai, visu mantu, kas atrasta lūguma saņēmējā valstī un kas iegūta noziedzīga nodarījuma rezultātā, vai kas var būt vajadzīga kā pierādījums, nodod lūguma iesniedzējai valstij, ja tas nav pretrunā ar šās valsts likumiem, un ņemot vērā trešo personu tiesības, kas ir pienācīgi jāievēro.

2. Pēc lūguma iesniedzējas valsts attiecīga lūguma iepriekš minēto mantu, ievērojot 1.punktu, nodod lūguma iesniedzējai valstij, pat ja izdošanu nevar veikt.

3. Pēc lūguma saņēmējas valsts lūguma, ja to nosaka minētās valsts likumi vai trešo personu tiesības, jebkurus nodotos priekšmetus bez maksas atdod lūguma saņēmējai valstij.

12. pants

Īpaši noteikumi

1. Ievērojot šā panta 3.punkta nosacījumus, personu, kas ir izdota saskaņā ar šo Līgumu, lūguma iesniedzējas valsts teritorijā nedrīkst apcietināt, tiesāt vai kā citādi ierobežot šās personas brīvību sakarā ar jebkuru noziedzīgu nodarījumu, kas ir izdarīts pirms izdošanas, izņemot:

a) noziedzīgu nodarījumu, sakarā ar kuru veica izdošanu, vai jebkuru citu noziedzīgu nodarījumu, par ko ir paredzēta izdošana un par ko personu varētu notiesāt, balstoties uz faktiem, ar kuriem pamatoja izdošanas lūgumu, ar nosacījumu, ka par šo noziedzīgo nodarījumu nav paredzēts smagāks sods kā tas, kuru var noteikt par noziedzīgu nodarījumu, par ko tika lūgta izdošana; vai

b) par jebkuru citu noziedzīgu nodarījumu, par ko ir paredzēta izdošana un kuram piekrīt lūguma saņēmēja valsts.

2. Lūgumam, kas piekrišanas saņemšanai atbilstīgi šim pantam ir adresēts lūguma saņēmējai valstij, pievieno 5.pantā minētos dokumentus.

3. Šā panta 1.punktu nepiemēro, ja personai ir bijusi iespēja atstāt lūguma iesniedzēju valsti un ja šī persona to nav izdarījusi 45 dienās pēc apsūdzības atcelšanas attiecībā uz noziedzīgo nodarījumu, par ko viņa tika izdota, vai ja persona ir atgriezusies lūguma iesniedzējas valsts teritorijā pēc tam, kad bija to atstājusi.

13. pants

Nodošana trešajai valstij

1. Ja lūguma saņēmēja valsts ir nodevusi personu lūguma iesniedzējai valstij, tad pēdējā minētā nedrīkst nodot šo personu kādai trešai valstij par noziedzīgu nodarījumu, kas izdarīts pirms nodošanas, izņemot gadījumus, kad:

a) lūguma saņēmēja valsts piekrīt šādai nodošanai; vai

b) personai ir bijusi iespēja atstāt lūguma iesniedzēju valsti, un šī persona to nav izdarījusi 45 dienās pēc apsūdzības atcelšanas attiecībā uz noziedzīgo nodarījumu, par ko viņa tika izdota, vai arī persona ir atgriezusies lūguma iesniedzējas valsts teritorijā pēc tam, kad bija to pametusi.

2. Pirms atbilstīgi šā panta 1.punkta a) apakšpunktam piekrist lūgumam par izdošanu, lūguma saņēmēja valsts var lūgt iesniegt 5.pantā minētos dokumentus.

14. pants

Tranzīts

1. Ja persona ir jāizdod no trešās valsts vienai no Līgumslēdzējām valstīm, šķērsojot otras Līgumslēdzējas valsts teritoriju, tā Līgumslēdzēja valsts, kurai persona ir jāizdod, lūdz atļauju otrai Līgumslēdzējai valstij pārvest šo personu, šķērsojot tās teritoriju.

2. Pēc šāda lūguma saņemšanas lūguma saņēmēja Līgumslēdzēja valsts piešķir atļauju, izņemot gadījumus, kad tai ir pamatoti iemesli atteikties to darīt.

3. Atļauja personas pārvešanai, ievērojot lūguma saņēmējas Līgumslēdzējas valsts likumus, ir arī atļauja pārvešanas laikā turēt personu apcietinājumā.

4. Gadījumos, kad personu tur apcietinājumā atbilstīgi šā panta 3.punktam, Līgumslēdzēja valsts, kuras teritorijā personu tur apcietinājumā, var norādīt, ka persona ir jāatbrīvo, ja pārvešanu neturpina pamatotā laikā.

5. Līgumslēdzēja valsts, kurai persona ir izdota, atlīdzina otrai Līgumslēdzējai valstij visus izdevumus, kas šai otrai Līgumslēdzējai valstij ir radušies saistībā ar pārvešanu.

15. pants

Izdevumi

1. Lūguma saņēmēja valsts veic visus pasākumus un sedz visus izdevumus, kas rodas, pamatojoties uz izdošanas lūgumu, un pārstāv lūguma iesniedzējas valsts intereses.

2. Lūguma saņēmēja valsts sedz izdevumus, kas rodas tās teritorijā saistībā ar personas, kuru lūdz izdot, apcietināšanu un turēšanu apcietinājumā līdz tam laikam, kad personu nodod lūguma iesniedzējas valsts norādītai personai.

3. Lūguma iesniedzēja valsts sedz izdevumus, kas rodas, konvojējot personu no lūguma saņēmējas valsts teritorijas.

16. pants

Līguma stāšanās spēkā un darbības izbeigšanās

1. Šis Līgums stājas spēkā trīsdesmitajā dienā pēc pēdējā paziņojuma saņemšanas, ar kuru Līgumslēdzējas valstis ir rakstiski paziņojušas viena otrai par attiecīgo prasību izpildi, lai Līgums stātos spēkā.

2. Stājoties spēkā šim līgumam, attiecībā uz Latvijas Republiku un Austrāliju zaudē spēku 1924.gada 16.jūlijā Rīgā parakstītais līgums starp Latviju un Lielbritāniju par noziedznieku izdošanu.

3. Lūgums par izdošanu, kas sastādīts pēc šī Līguma spēkā stāšanās, var tikt izpildīts saskaņā ar šī Līguma noteikumiem, neatkarīgi no tā, vai noziedzīgais nodarījums, par kuru lūdz izdošanu, ir izdarīts pirms vai pēc šī Līguma spēkā stāšanās.

4. Šis Līgums var tikt grozīts, noslēdzot rakstisku vienošanos starp Līgumslēdzējām valstīm. Jebkura vienošanās stājas spēkā saskaņā ar šī panta 1.punktā noteikto procedūru.

5. Katra Līgumslēdzēja valsts var jebkurā laikā izbeigt šo Līgumu, paziņojot to rakstiski, un Līguma darbība izbeidzas simts astoņdesmitajā dienā pēc šādas paziņošanas.
