1.pants. 1995.gada 26.jūlija Konvencija par informācijas tehnoloģiju izmantošanu muitas vajadzībām, kas izstrādāta, pamatojoties uz Līguma par Eiropas Savienību K 3.pantu (turpmāk — Konvencija), 1995.gada 26.jūlija Līgums par Konvencijas pagaidu piemērošanu starp noteiktām Eiropas Savienības dalībvalstīm (turpmāk — Līgums), 1996.gada 29.novembra Protokols par Eiropas Kopienu Tiesas sniegto Konvencijas iztulkošanu, pieņemot prejudiciālus nolēmumus, kas izstrādāts, pamatojoties uz Līguma par Eiropas Savienību K 3.pantu (turpmāk — Protokols), Deklarācija par vienlaicīgu minētās Konvencijas un Protokola pieņemšanu un Deklarācija, kas sniegta saskaņā ar Protokola 2.pantu, ar šo likumu tiek pieņemta un apstiprināta.
2.pants. Finanšu ministrija koordinē Konvencijā, Līgumā un Protokolā paredzēto saistību izpildi.
3.pants. Saskaņā ar Konvencijas 17.pantu Datu valsts inspekcija ir valsts pārraudzības iestāde.
4.pants. Latvija atzīst Eiropas Kopienu Tiesas kompetenci pieņemt prejudiciālus nolēmumus attiecībā uz Konvencijas iztulkošanu saskaņā ar Protokola 2.panta otrās daļas "a" punktu.
5.pants. Konvencija stājas spēkā tās 25.pantā noteiktajā laikā un kārtībā, bet Protokols — tā 5.pantā noteiktajā laikā un kārtībā, un Ārlietu ministrija par to paziņo laikrakstā "Latvijas Vēstnesis".
6.pants. Likums stājas spēkā 2004.gada 1.maijā. Līdz ar likumu izsludināma Konvencija, Līgums un Protokols angļu valodā un to tulkojums latviešu valodā.
Likums Saeimā pieņemts 2004.gada 29.aprīlī.

DRAWN UP ON THE BASIS OF ARTICLE K.3 OF THE TREATY ON EUROPEAN UNION, ON THE USE OF INFORMATION TECHNOLOGY FOR CUSTOMS PURPOSES

CONVENTION Drawn up on the basis of Article K.3 of the Treaty on European Union, on the use of information technology for customs purposes

THE HIGH CONTRACTING PARTIES to this Convention, Member States of the European Union;

REFERRING to the Act of the Council of the European Union of 23 July 1995;

RECALLING the commitments contained in the Convention on Mutual Assistance between Customs Administrations, signed in Rome on 7 September 1967;

CONSIDERING that customs administrations are responsible, together with other competent authorities, at the external frontiers of the Community and within the territorial limit thereof, for the prevention, investigation and suppression of offences against not only Community rules, but also against national laws, in particular those laws covered by Articles 36 and 223 of the Treaty establishing the European Community;

CONSIDERING that a serious threat to public health, morality and security is constituted by the developing trend towards illicit trafficking of all kinds;

CONVINCED that it is necessary to reinforce cooperation between customs administrations, by laying down procedures under which customs administrations may act jointly and exchange personal and other data concerned with illicit trafficking activities, using new technology for the management and transmission of such information, subject to the provisions of the Council of Europe Convention on the Protection of Individuals with Regard to Automatic Processing of Personal Data, done at Strasbourg on 28 January 1981;

BEARING IN MIND that the customs administrations in their day-to-day work have to implement both Community and non-Community provisions, and that there is consequently an obvious need to ensure that the provisions of mutual assistance and administrative cooperation in both sectors evolve as far as possible in parallel,

HAVE AGREED ON THE FOLLOWING PROVISIONS:

Chapter I. DEFINITIONS

Article 1

For the purposes of this Convention,

1. The term 'national laws' means laws or regulations of a Member State, in the application of which the customs administration of that Member State has total or partial competence, concerning:

— the movement of goods subject to measures of prohibition, restriction or control, in particular those measures covered by Articles 36 and 223 of the Treaty establishing the European Community,

— the transfer, conversion, concealment, or disguise of property or proceeds derived from, obtained directly or indirectly through or used in, illicit international drug trafficking.

2. The term 'personal data' means any information relating to an identified or identifiable individual.

3. The term 'supplying Member State' means a State which includes an item of data in the Customs Information System.

Chapter II. ESTABLISHMENT OF A CUSTOMS INFORMATION SYSTEM

Article 2

1. The customs administrations of the Member States shall set up and maintain a joint automated information system for customs purposes, hereinafter referred to as the 'Customs Information System'.

2. The aim of the Customs Information System, in accordance with the provisions of this Convention, shall be to assist in preventing, investigating and prosecuting serious contraventions of national laws by increasing, through the rapid dissemination of information, the effectiveness of the cooperation and control procedures of the customs administrations of the Member States.

Chapter III. OPERATION AND USE OF THE CUSTOMS INFORMATION

Article 3

1. The Customs Information System shall consist of a central data-base facility and it shall be accessible via terminals in each Member State. It shall comprise exclusively data necessary to achieve its aim as stated in Article 2 (2), including personal data, in the following categories:

(i) commodities;

(ii) means of transport;

(iii) businesses;

(iv) persons;

(v) fraud trends;

(vi) availability of expertise.

2. The Commission shall ensure the technical management of the infrastructure of the Customs Information System in accordance with the rules provided for by the implementing measures adopted within the Council. The Commission shall report on the management to the committee referred to in Article 16.

3. The Commission shall communicate to that committee the practical arrangements adopted for the technical management.

Article 4

The Member States shall determine the items to be included in the Customs Information System relating to each of the categories (i) to (vi) in Article 3 to the extent that this is necessary to achieve the aim of the system. No items of personal data shall be included in any event within categories (v) and (vi) of Article 3. The items of information included in respect of persons shall comprise no more than:

(i) name, maiden name, forenames and aliases;

(ii) date and place of birth;

(iii) nationality;

(iv) sex;

(v) any particular objective and permanent physical characteristics;

(vi) reason for inclusion of data;

(vii) suggested action;

(viii) a warning code indicating any history of being armed, violent or escaping.

In any case personal data listed in Article 6, first sentence of the Council of Europe Convention for the Protection of Individuals with Regard to Automatic Processing of Personal Data, done at Strasbourg on 28 January 1981, hereinafter referred to as the '1981 Strasbourg Convention', shall not be included.

Article 5

1. Data in categories (i) to (iv) of Article 3 shall be included in the Customs Information System only for the purpose of sighting and reporting, discreet surveillance or specific checks.

2. For the purpose of the suggested actions referred to in paragraph 1, personal data within any of the categories (i) to (iv) of Article 3 may be included in the Customs Information System only if, especially on the basis of prior illegal activities, there are real indications to suggest that the person concerned has committed, is in the act of committing, or will commit serious contraventions of national laws.

Article 6

1. If the suggested actions referred to in Article 5 (1) are carried out, the following information may in whole, or in part, be collected and transmitted to the supplying Member State:

(i) the fact that the commodity, means of transport, business or person reported has been found;

(ii) the place, time and reason for the check;

(iii) the route and destination of the journey;

(iv) persons accompanying the person concerned or occupants of the means of transport;

(v) the means of transport used;

(vi) objects carried;

(vii) the circumstances under which the commodity, means of transport, business or person was found.

When such information is collected in the course of discreet surveillance steps must be taken to ensure that the discreet nature of the surveillance is not jeopardized.

2. In the context of a specific check referred to in Article 5 (1) persons, means of transport and objects may be searched to the extent permissible and in accordance with the laws, regulations, and procedures of the Member State in which the search takes place. If the specific check is not permitted by the law of a Member State, it shall automatically be converted by that Member State into sighting and reporting.

Article 7

1. Direct access to data included in the Customs Information System shall be reserved exclusively for the national authorities designated by each Member State. These national authorities shall be customs administrations, but may also include other authorities competent, according to the laws, regulations and procedures of the Member State in question, to act in order to achieve the aim stated in Article 2 (2).

2. Each Member State shall send the other Member States and the committee referred to in Article 16 a list of its competent authorities which have been designated in accordance with paragraph 1 to have direct access to the Customs Information system stating, for each authority which data it may have access to and for what purposes.

3. Notwithstanding the provisions of paragraphs 1 and 2, Member State may, by unanimous agreement, permit access to the Customs Information System by international or regional organizations. Such agreement shall take the form of a protocol to this Convention. In reaching their decision the Member States shall take account of any reciprocal arrangements and any opinion of the Joint Supervisory Authority referred to in Article 18 on the adequacy of data protection measures.

Article 8

1. The Member States may only use data obtained from the Customs Information System in order to achieve the aim stated in Article 2 (2); however they may use it for administrative or other purposes with the prior authorization of and subject to any conditions imposed by the Member State which included it in the system. Such other use shall be in accordance with the laws, regulations and procedures of the Member State which seeks to use it and should take into account Principle 5.5 of the Recommendation R (87) 15 of 17 September 1987 of the Committee of Ministers of the Council of Europe.

2. Without prejudice to paragraphs 1 and 4 of this Article and Article 7 (3), data obtained from the Customs Information System shall only be used by national authorities in each Member State designated by the Member State in question, which are competent, in accordance with the laws, regulations and procedures of that Member State, to act in order to achieve the aim stated in Article 2 (2).

3. Each Member State shall send the other Member States and the committee referred to in Article 16 a list of the competent authorities it has designated in accordance with paragraph 2.

4. Data obtained from the Customs Information System may, with the prior authorization of, and subject to any conditions imposed by, the Member State which included it in the System, be communicated for use by national authorities other than those designated under paragraph 2, non-Member States, and international or regional organizations wishing to make use of them. Each Member State shall take special measures to ensure the security of such data when it is being transmitted or supplied to services located outside its territory. Details of such measures must be communicated to the Joint Supervisory Authority referred to in Article 18.

Article 9

1. The inclusion of data in the Customs Information System shall be governed by the laws, regulations and procedures of the supplying Member State unless this Convention lays down more stringent provisions.

2. The use of data obtained from the Customs Information System, including performance of any action under Article 5 suggested by the supplying Member State, shall be governed by the laws, regulations and procedures of the Member State using such data, unless this Convention lays down more stringent provisions.

Article 10

1. Each of the Member States shall designate a competent customs administration which shall have national responsibility for the Customs Information System.

2. This administration shall be responsible for the correct operation of the Customs Information System within the Member State and shall take the measures necessary to ensure compliance with the provisions of this Convention.

3. The Member States shall inform one another of the competent administration referred to in paragraph 1.

Chapter IV. AMENDMENT OF DATA

Article 11

1. Only the supplying Member State shall have the right to amend, supplement, correct, or delete data which it has included in the Customs Information System.

2. Should a supplying Member State note, or have drawn to its attention, that the data it included are factually inaccurate or were included, or are stored contrary to this Convention, it shall amend, supplement, correct or delete the data, as appropriate, and shall advise the other Member States accordingly.

3. If one of the Member States has evidence to suggest that an item of data is factually inaccurate, or was included or is stored on the Customs Information System, contrary to this Convention, it shall advise the supplying Member State as soon as possible. The latter shall check the data concerned and, if necessary, correct or delete the item without delay. The supplying Member State shall advise the other Member States of any correction or deletion effected.

4. If, when including data in the Customs Information System, a Member State notes that its report conflicts with a previous report as to content or suggested action, it shall immediately advise the Member State which made the previous report. The two Member States shall then attempt to resolve the matter. In the event of disagreement, the first report shall stand, but those parts of the new report which do not conflict shall be included in the System.

5. Subject to the provisions of this Convention, where in any Member State a court, or other competent authority within that Member State, makes a final decision as to amendment, supplementation, correction, or deletion, of data in the Customs Information System, the Member States undertake mutually to enforce such a decision. In the event of conflict between such decisions of courts or other competent authorities in different Member States, including those referred to in Article 15 (4) concerning correction or deletion, the Member State which included the data in question shall delete it from the System.

Chapter V. RETENTION OF DATA

Article 12

1. Data included in the Customs Information System shall be kept only for the time necessary to achieve the purpose for which it was included. The need for its retention shall be reviewed at least annually by the supplying Member State.

2. The supplying Member State may, within the review period, decide to retain data until the next review if its retention is necessary for the purposes for which it was included. Without prejudice to Article 15, if there is no decision to retain data it shall automatically be transferred to that part of the Customs Information System to which access shall be limited in accordance with paragraph 4.

3. The Customs Information System shall automatically inform the supplying Member State of a scheduled transfer of data from the Customs Information System under paragraph 2, giving one month's notice.

4. Data transferred under paragraph 2 shall continue to be retained for one year within the Customs Information System, but, without prejudice to Article 15, shall be accessible only to a representative of the committee referred to in Article 16 or to the supervisory authorities referred to in Articles 17 (1) and 18 (1). During that period they may consult the data only for the purposes of checking its accuracy and lawfulness, after which it must be deleted.

Chapter VI. PERSONAL DATA PROTECTION

Article 13

1. Each Member State intending to receive personal data from, or include it in, the Customs Information System shall, no later than the time of entry into force of this Convention, adopt the national legislation sufficient to achieve a level of protection of personal data at least equal to that resulting from the principles of the 1981 Strasbourg Convention.

2. A Member State shall receive personal data from, or include it in, the Customs Information System only where the arrangements for the protection of such data provided for in paragraph 1 have entered into force in the territory of that Member State. The Member State shall also have previously designated a national supervisory authority or authorities in accordance with Article 17.

3. In order to ensure the proper application of the data protection provisions in this Convention, the Customs Information System shall be regarded in every Member State as a national data file subject to the national provisions referred to in paragraph 1 and any more stringent provisions contained in this Convention.

Article 14

1. Subject to Article 8 (1), each Member State shall ensure that it shall be unlawful under its laws, regulations and procedures for personal data from the Customs Information System to be used other than for the purpose of the aim stated in Article 2 (2).

2. Data may be duplicated only for technical purposes, provided that such duplication is necessary for direct searching by the authorities referred to in Article 7. Subject to Article 8 (1), personal data included by other Member States may not be copied from the Customs Information System into other national data files.

Article 15

1. The rights of persons with regard to personal data in the Customs Information System, in particular their right of access, shall be put into effect in accordance with the laws, regulations and procedures of the Member State in which such rights are invoked.

If laid down in the laws, regulations and procedures of the Member State concerned, the national supervisory authority provided for in Article 17 shall decide whether information is to be communicated and the procedures for so doing.

A Member State which has not supplied the data concerned may only communicate data if it has first given the supplying Member State an opportunity to adopt its position.

2. A Member State, to which an application for access to personal data is made, shall refuse access if access may undermine the performance of the legal task specified in the report pursuant to Article 5 (1), or in order to protect the rights and freedoms of others. Access shall be refused in any event during the period of discreet surveillance or sighting and reporting.

3. In each Member State, a person may, according to the laws, regulations and procedures of the Member State concerned, have personal data relating to himself corrected or deleted if that data is factually inaccurate, or was included or is stored in the Customs Information System contrary to the aim stated in Article 2 (2) of this Convention or to the provisions of Article 5 of the 1981 Strasbourg Convention.

4. In the territory of each Member State, any person may, in accordance with the laws, regulations and procedures of the Member State in question, bring an action or, if appropriate, a complaint before the courts or the authority competent under the laws, regulations and procedures of that Member State concerning personal data relating to himself on the Customs Information System, in order to:

(i) correct or delete factually inaccurate personal data;

(ii) correct or delete personal data included or stored in the Customs Information System contrary to this Convention;

(iii) obtain access to personal data;

(iv) obtain compensation pursuant to Article 21 (2).

The Member States concerned undertake mutually to enforce the final decisions taken by a court, or other competent authority, pursuant to (i), (ii) and (iii).

5. The references in this Article and in Article 11 (5) to a 'final decision' do not imply any obligation on the part of any Member State to appeal against a decision taken by a court or other competent authority.

Chapter VII. INSTITUTIONAL FRAMEWORK

Article 16

1. A Committee consisting of representatives from the Customs Administrations of the Member States shall be set up. The Committee shall take its decisions unanimously where the provisions of the first indent of paragraph 2 are concerned and by a two-thirds majority where the provisions of the second indent of paragraph 2 are concerned. It shall adopt its rules of procedure unanimously.

2. The Committee shall be responsible:

— for the implementation and correct application of the provisions of this Convention, without prejudice to the powers of the authorities referred to in Articles 17 (1) and 18 (1);

— for the proper functioning of the Customs Information System with regard to technical and operational aspects. The Committee shall take all necessary steps to ensure that the measures set out in Articles 12 and 19 are properly implemented with regard to the Customs Information System. For the purpose of applying this paragraph, the Committee may have direct access to, and use of, data from the Customs Information System.

3. The Committee shall report annually to the Council, in accordance with Title VI of the Treaty on European Union, regarding the efficiency and effectiveness of the Customs Information System, making recommendations as necessary.

4. The Commission shall be party to the Committee's proceedings.

Chapter VIII. PERSONAL DATA PROTECTION SUPERVISION

Article 17

1. Each Member State shall designate a national supervisory authority or authorities responsible for personal data protection to carry out independent supervision of such data included in the Customs Information System.

The supervisory authorities, in accordance with their respective national laws shall carry out independent supervision and checks, to ensure that the processing and use of data held in the Customs Information System do not violate the rights of the person concerned. For this purpose the supervisory authorities shall have access to the Customs Information System.

2. Any person may ask any national supervisory authority to check personal data relating to himself on the Customs Information System and the use which has been or is being made of that data. That right shall be governed by the laws, regulations and procedures of the Member State in which the request is made. If the data has been included by another Member State, the check shall be carried out in close coordination with that Member State's national supervisory authority.

Article 18

1. A Joint Supervisory Authority shall be set up, consisting of two representatives from each Member State drawn from the respective independent national supervisory authority or authorities.

2. The Joint Supervisory Authority shall perform its task in accordance with the provisions of this Convention and of the 1981 Strasbourg Convention taking into account Recommendation R (87) 15 of 17 September 1987 of the Committee of Ministers of the Council of Europe.

3. The Joint Supervisory Authority shall be competent to supervise operation of the Customs Information System, to examine any difficulties of application or interpretation which may arise during its operation, to study problems which may arise with regard to the exercise of independent supervision by the national supervisory authorities of the Member States, or in the exercise of rights of access by individuals to the System, and to draw up proposals for the purpose of finding joint solutions to problems.

4. For the purpose of fulfilling its responsibilities, the Joint Supervisory Authority shall have access to the Customs Information System.

5. Reports drawn up by the Joint Supervisory Authority shall be forwarded to the authorities to which the national supervisory authorities submit their reports.

Chapter IX. SECURITY OF THE CUSTOMS INFORMATION SYSTEM

Article 19

1. All necessary administrative measures to maintain security shall be taken:

(i) by the competent authorities of the Member States in respect of the terminals of the Customs Information System in their respective States;

(ii) by the Committee referred to in Article 16 in respect of the Customs Information System and the terminals located on the same premises as the System and used for technical purposes and the checks required by paragraph 3.

2. In particular the competent authorities and the committee referred to in Article 16 shall take measures:

(i) to prevent any unauthorized person from having access to installations used for the processing of data;

(ii) to prevent data and data media from being read, copied, modified or removed by unauthorized persons;

(iii) to prevent the unauthorized entry of data and any unauthorized consultation, modification, or deletion of data;

(iv) to prevent data in the Customs Information System from being accessed by unauthorized persons by means of data transmission equipment;

(v) to guarantee that, with respect to the use of the Customs Information System, authorized persons have right of access only to data for which they have competence;

(vi) to guarantee that it is possible to check and establish to which authorities data may be transmitted by data transmission equipment;

(vii) to guarantee that it is possible to check and establish a posteriori what data has been introduced into the Customs Information System, when and by whom, and to monitor interrogation;

(viii) to prevent the unauthorized reading, copying, modification or deletion of data during the transmission of data and the transport of data media.

3. The committee referred to in Article 16 shall monitor interrogation of the Customs Information System for the purpose of checking that searches made were admissible and were made by authorized users. At least 1 % of all searches made shall be checked. A record of such searches and checks shall be maintained in the System, shall be used only for the abovementioned purpose by the said committee and the supervisory authorities referred to in Articles 17 and 18, and shall be deleted after six months.

Article 20

The competent customs administration referred to in Article 10 (1) of this Convention shall be responsible for the security measures set out in Article 19, in relation to the terminals located in the territory of the Member State concerned, the review functions set out in Article 12 (1) and (2), and otherwise for the proper implementation of this Convention so far as is necessary under the laws, regulations and procedures of that Member State.

Chapter X. RESPONSIBILITIES AND LIABILITIES

Article 21

1. Each Member State shall be responsible for the accuracy, currency and lawfulness of data it has included in the Customs Information System. Each Member State shall also be responsible for complying with the provisions of Article 5 of the 1981 Strasbourg Convention.

2. Each Member State shall be liable, in accordance with its own laws, regulations and procedures for injury caused to a person through the use of the Customs Information System in the Member State concerned.

This shall also be the case where the injury was caused by the supplying Member State entering inaccurate data or entering data contrary to this Convention.

3. If the Member State against which an action in respect of inaccurate data is brought is not the Member State which supplied it, the Member States concerned shall seek agreement as to what proportion, if any, of the sums paid out in compensation shall be reimbursed by the supplying Member State to the other Member State. Any such sums agreed shall be reimbursed on request.

Article 22

1. The costs incurred in connection with the operation and use of the Customs Information System by the Member States on their territories shall be borne by each of them.

2. Other expenditure incurred in the implementation of this Convention, except for that which cannot be kept separate from the operation of the Customs Information System for the purpose of applying the customs and agricultural rules of the Community, shall be borne by the Member States. Each Member State's share shall be determined according to the proportion of its gross national product to the sum total of the gross national products of the Member States for the year preceding the year in which the costs are incurred.

For the purpose of applying this paragraph, the expression 'gross national product' means the gross national product determined in accordance with Council Directive 89/130/EEC, Euratom of 13 February 1989 on the harmonization of the compilation of gross national product at market prices (1) or any amending or replacing Community instrument.

Chapter XI. IMPLEMENTATION AND FINAL PROVISIONS

Article 23

The information provided for under this Convention shall be exchanged directly between the authorities of the Member States.

Article 24

1. This Convention shall be subject to adoption by the Member States in accordance with their respective constitutional requirements.

2. Member States shall notify the Secretary-General of the Council of the European Union of the completion of their constitutional requirements for adopting this Convention.

3. This Convention shall enter into force 90 days after the notification, referred to in paragraph 2, by the last Member State to fulfil that formality.

Article 25

1. This Convention shall be open to accession by any State that becomes a member of the European Union.

2. The text of this Convention in the language of the acceding State, drawn up by the Council of the European Union, shall be authentic.

3. Instruments of accession shall be deposited with the depositary.

4. This Convention shall enter into force with respect to any State that accedes to it ninety days after the deposit of its instrument of accession or on the date of entry into force of the Convention if it has not already entered into force at the time of expiry of the said period of ninety days.

Article 26

1. The Secretary-General of the Council of the European Union shall act as depositary of this Convention.

2. The depositary shall publish in the Official Journal of the European Communities information on the progress of adoptions and accessions, declarations and reservations, and also any other notification concerning this Convention.

Article 27

1. Any dispute between Member States on the interpretation or application of this Convention must in an initial stage be examined by the Council in accordance with the procedure set out in Title VI of the Treaty on European Union with a view to reaching a solution.

If no solution is found within six months, the matter may be referred to the Court of Justice of the European Communities by a party to the dispute.

2. Any dispute between one or more Member States and the Commission of the European Communities concerning the application of this Convention which it has proved impossible to settle through negotiation may be submitted to the Court of Justice.

HAVING REGARD to the importance of early application of the Convention;

WHEREAS, pursuant to Article K.7 of the Treaty on European Union, the provision of Title VI of that Treaty do not prevent the establishment or development of closer cooperation between two or more Member States in so far as such cooperation does not conflict with, or impede, that provided for in Title VI of the said Treaty;

WHEREAS provisional application between certain Member States of the European Union of the Convention would not conflict with, or impede, the cooperation provided for in Title VI of the Treaty on European Union,

HAVE AGREED AS FOLLOWS:

Article 1

For the purposes of this Agreement:

— 'Convention' means the Convention drawn up on the basis of Article K.3 of the Treaty on European Union on the use of information technology for customs purposes,

— 'High Contracting Parties' means the Member States of the European Union, parties to the Convention,

— 'Parties' means the Member States of the European Union, parties to this Agreement.

Article 2

The Convention shall apply provisionally between the High Contracting Parties parties to this Agreement as of from the first day of the third month following the deposit of the instrument of approval, acceptance or ratification of this Agreement by the eighth High Contracting Party to do so.

Article 3

The transitional provisions necessary for provisional application of the Convention shall be adopted by common accord amongst the High Contracting Parties between which the Convention is to apply provisionally and in consultation with the other High Contracting Parties. During this period of provisional application, the functions of the Committee provided for in Article 16 of the Convention shall be exercised by the High Contracting Parties acting by common accord in close association with the Commission of the European Communities. Article 7 (3) and Article 16 of the Convention shall not be implemented during that period.

Article 4

1. This Agreement shall be open for signing by the Member States signatories of the Convention. It shall be subject to approval, acceptance or ratification. It shall enter into force on the first day of the third month following the deposit of the instrument of approval, acceptance or ratification by the eighth High Contracting Party to do so.

2. For any High Contracting Party depositing its instrument of approval, acceptance or ratification at a later date, this Agreement shall enter into force on the first day of the third month following such deposit.

3. Instruments of approval, acceptance or ratification shall be deposited with the Secretary-General of the Council of the European Union, who shall act as depositary.

Article 5

This Agreement, drawn up in a single original in the Danish, Dutch, English, Finnish, French, German, Greek, Irish, Italian, Portuguese, Spanish and Swedish languages, each text being equally authentic, shall be deposited with the Secretary-General of the Council of the European Union, who shall transmit a certified copy to each of the parties.

Article 6

This Agreement shall expire upon entry into force of the Convention.

THE HIGH CONTRACTING PARTIES,

HAVE AGREED on the following provisions, which shall be annexed to the Convention:

Article 1

The Court of Justice of the European Communities shall have jurisdiction, pursuant to the conditions laid down in this Protocol, to give preliminary rulings on the interpretation of the Convention on the use of information technology for customs purposes.

Article 2

1. By a declaration made at the time of the signing of this Protocol or at any time thereafter, any Member State shall be able to accept the jurisdiction of the Court of Justice of the European Communities to give preliminary rulings on the interpretation of the Convention on the use of information technology for customs purposes pursuant to the conditions specified in either paragraph 2 (a) or paragraph 2 (b).

2. A Member State making a declaration pursuant to paragraph 1 may specify that either:

(a) any court or tribunal of that State against whose decisions there is no judicial remedy under national law may request the Court of Justice of the European Communities to give a preliminary ruling on a question raised in a case pending before it and concerning the interpretation of the Convention on the use of information technology for customs purposes if that court or tribunal considers that a decision on the question is necessary to enable it to give judgment, or

(b) any court or tribunal of that State may request the Court of Justice of the European Communities to give a preliminary ruling on a question raised in a case pending before it and concerning the interpretation of the Convention on the use of information technology for customs purposes if that court or tribunal considers that a decision on the question is necessary to enable it to give judgment.

Article 3

1. The Protocol on the Statute of the Court of Justice of the European Communities and the Rules of Procedure of that Court of Justice shall apply.

2. In accordance with the Statute of the Court of Justice of the European Communities, any Member State, whether or not it has made a declaration pursuant to Article 2, shall be entitled to submit statements of case or written observations to the Court of Justice of the European Communities in cases which arise pursuant to Article 1.

Article 4

1. This Protocol shall be subject to adoption by the Member States in accordance with their respective constitutional requirements.

2. Member States shall notify the depositary of the completion of their respective constitutional requirements for adopting this Protocol and communicate to him any declaration made pursuant to Article 2.

3. This Protocol shall enter into force 90 days after the notification, referred to in paragraph 2, by the Member State which, being a member of the European Union on the date of adoption by the Council of the Act drawing up this Protocol, is the last to fulfil that formality. However, it shall at the earliest enter into force at the same time as the Convention on the use of information technology for customs purposes.

Article 5

1. This Protocol shall be open to accession by any State that becomes a member of the European Union.

2. Instruments of accession shall be deposited with the depositary.

3. The text of this Protocol in the language of the acceding State, drawn up by the Council of the European Union, shall be authentic.

4. This Protocol shall enter into force with respect to any State that accedes to it 90 days after the date of deposit of its instrument of accession, or on the date of the entry into force of this Protocol if the latter has not yet come into force when the said period of 90 days expires.

Article 6

Any State that becomes a member of the European Union and accedes to the Convention on the use of information technology for customs purposes in accordance with Article 25 thereof shall accept the provisions of this Protocol.

Article 7

1. Amendments to this Protocol may be proposed by any Member State, being a High Contracting Party. Any proposal for an amendment shall be sent to the depositary, who shall forward it to the Council.

2. Amendments shall be established by the Council, which shall recommend that they be adopted by the Member States in accordance with their respective constitutional requirements.

3. Amendments thus established shall enter into force in accordance with the provisions of Article 4.

Article 8

1. The Secretary-General of the Council of the European Union shall act as depositary of this Protocol.

2. The depositary shall publish in the Official Journal of the European Communities the notifications, instruments or communications concerning this Protocol.

Declaration concerning the simultaneous adoption of the Convention on the use of information technology for customs purposes and the Protocol on the interpretation by way of preliminary rulings, by the Court of Justice of the European Communities, of that Convention

The representatives of the Governments of the Member States of the European Union meeting within the Council,

At the time of the signing of the Council Act drawing up the Protocol on the interpretation, by way of preliminary rulings, by the Court of Justice of the European Communities of the Convention on the use of information technology for customs purposes,

Wishing to ensure that the said Convention is interpreted as effectively and uniformly as possible as from its entry into force,

Declare themselves willing to take appropriate steps to ensure that the national procedures for adopting the Convention on the use of information technology for customs purposes and the Protocol concerning its interpretation are completed simultaneously at the earliest opportunity.

Declaration made pursuant to Article 2

At the time of the signing of this Protocol, the following declared that they accepted the jurisdiction of the Court of Justice of the European Communities in accordance with the procedures laid down in Article 2:

Ireland and the Portuguese Republic in accordance with the procedures laid down in Article 2 (2) (a);

The Federal Republic of Germany, the Hellenic Republic, the French Republic, the Kingdom of the Netherlands, the Republic of Austria, the Republic of Finland and the Kingdom of Sweden, in accordance with the procedures laid down in Article 2 (2) (b).

Declaration

The Federal Republic of Germany, the Hellenic Republic, the Kingdom of the Netherlands and the Republic of Austria reserve the right to make provision in their national law to the effect that, where a question relating to the interpretation of the Convention on the use of information technology for customs purposes is raised in a case pending before a national court or tribunal against whose decision there is no judicial remedy under national law, that court or tribunal will be required to refer the matter to the Court of Justice.

For the Kingdom of Denmark and the Kingdom of Spain, the declaration(s) will be made at the time of adoption.

Šīs konvencijas AUGSTĀS LĪGUMSLĒDZĒJAS PUSES, Eiropas Savienības dalībvalstis,

ATSAUCOTIES uz Eiropas Savienības Padomes 1995. gada 23. jūlija aktu;

ATGĀDINOT saistības Konvencijā par savstarpēju palīdzību muitas pārvalžu starpā, kas parakstīta Romā 1967. gada 7. septembrī;

UZSKATOT, ka Kopienas teritorijā un pie Kopienas ārējām robežām muitas pārvaldes kopā ar citām kompetentām iestādēm atbild par to, lai tiktu novērsti, izmeklēti un pārvarēti ne tikai Kopienas noteikumu pārkāpumi, bet arī valstu noteikumu pārkāpumi, jo īpaši to likumu pārkāpumi, kas paredzēti Eiropas Kopienas dibināšanas līguma 36. un 223. pantā;

UZSKATOT, ka visu veidu nelikumīgas tirdzniecības attīstība nopietni apdraud cilvēku veselību, sabiedrības morāli un drošību;

PĀRLIECĪBĀ, ka ir jānostiprina sadarbība muitas pārvalžu starpā atbilstīgi noteikumiem Eiropas Padomes Konvencijā par personu aizsardzību attiecībā uz personas datu automātisko apstrādi, kura tika pieņemta Strasbūrā 1981. gada 28. janvārī, paredzot procedūras, kas ļaus muitas pārvaldēm darboties vienoti un apmainīties ar personas vai cita veida datiem par nelikumīgas tirdzniecības darbībām, izmantojot jaunu šāda tipa informācijas pārvaldības un pārraides tehnoloģiju;

PATUROT PRĀTĀ to, ka savā ikdienas darbā muitas pārvaldēm ir jāpiemēro gan Kopienas, gan valstu noteikumi un ka tāpēc noteikti jāgādā, lai Kopienas un valstu noteikumi par savstarpēju palīdzību un administratīvo sadarbību abos sektoros pēc iespējas tiktu izstrādāti paralēli,

IR VIENOJUŠĀS PAR ŠĀDIEM NOTEIKUMIEM.

I nodaļa

DEFINĪCIJAS

1. pants

Šajā konvencijā:

1) termins "valsts likumi" nozīmē kādas dalībvalsts normatīvos aktus, kuru piemērošana pilnīgi vai daļēji ir šīs dalībvalsts muitas pārvaldes kompetencē, par

— preču kustību, uz ko attiecas aizliegumi, ierobežojumi vai kontrole, jo īpaši saskaņā ar Eiropas Kopienas dibināšanas līguma 36. un 223. pantu,

— par darbībām nolūkā nodot, konvertēt, noklusēt vai slēpt īpašumu vai ieņēmumus, kas tieši vai netieši gūti vai izmantoti, piekopjot nelikumīgu tirdzniecību ar narkotikām starptautiskā līmenī;

2) termins "personas dati" nozīmē jebkuru informāciju par identificētu vai identificējamu indivīdu;

3) termins "datu piegādātājdalībvalsts" nozīmē valsti, kurā ievada datus muitu informācijas sistēmā.

II nodaļa

MUITU INFORMĀCIJAS SISTĒMAS IZVEIDE

2. pants

1. Dalībvalstu muitu pārvaldes izveido un uztur kopīgu automatizētu informācijas sistēmu atbilstoši muitu vajadzībām, kas še turpmāk saukta par "muitu informācijas sistēmu".

2. Muitu informācijas sistēmas mērķis saskaņā ar šīs konvencijas noteikumiem ir palīdzēt novērst, izmeklēt un saukt pie atbildības par smagiem valstu likumu pārkāpumiem, izmantojot ātru informācijas izplatīšanu, kas ļauj kāpināt dalībvalstu muitas pārvalžu sadarbības un kontroles procedūru efektivitāti.

III nodaļa

MUITU INFORMĀCIJAS SISTĒMAS DARBĪBA UN IZMANTOŠANA

3. pants

1. Muitu informācijas sistēmu veido centrālā datu bāze, kas ir pieejama, izmantojot termināļus katrā dalībvalstī. Tajā ietilpst vienīgi dati, tostarp arī personas dati, kas ir vajadzīgi, lai sasniegtu mērķi, kā paredzēts 2. panta otrajā daļā, kuri iedalīti šādās kategorijās:

i) preces,

ii) transportlīdzekļi,

iii) uzņēmumi,

iv) personas,

v) krāpšanas tendences,

vi) pieejamā ekspertīze.

2. Komisija nodrošina muitu informācijas sistēmas infrastruktūras tehnisko vadību saskaņā ar normām, ko paredz Padomē pieņemtie izpildes pasākumi.

Komisija sniedz pārskatu par vadību komitejai, kas minēta 16. pantā.

3. Komisija dara zināmu pieņemto tehniskās vadības īstenošanas kārtību iepriekš minētajai komitejai.

4. pants

Ciktāl tas ir vajadzīgs, lai sasniegtu sistēmas mērķi, dalībvalstis nosaka, kādi elementi iekļaujami muitu informācijas sistēmā atbilstoši katrai kategorijai 3. panta i) līdz vi) punktā. Personas datus nekādā gadījumā nedrīkst norādīt datu kategorijās, kas paredzētas 3. panta v) un vi) punktā. Sistēmā ievadītie dati nav plašāki par šādiem datiem:

i) uzvārds, pirmslaulību uzvārds, priekšvārds un aizgūtais vārds;

ii) dzimšanas datums un vieta;

iii) nacionālā piederība;

iv) dzimums;

v) visas īpašās faktiskās un pastāvīgās auguma īpatnības;

vi) datu iekļaušanas iemesls;

vii) ierosinātā darbība;

viii) brīdinājuma kods, kas norāda, ka persona jau bijusi bruņota, varmācīga vai bēguļojusi no iestādēm.

Nekādā gadījumā neiekļauj personas datus, kas paredzēti 6. panta pirmajā teikumā Konvencijā par personu aizsardzību attiecībā uz personas datu automātisko apstrādi, kuru Eiropas Padome pieņēma 1981. gada 28. janvārī Strasbūrā, kas še turpmāk saukta par "1981. gada Strasbūras konvenciju".

5. pants

1. Datus, kas attiecināmi uz kategorijām 3. panta i) līdz iv) punktā, iekļauj muitu informācijas sistēmā vienīgi novērošanas un ziņošanas, diskrētas novērošanas vai īpašas kontroles vajadzībām.

2. Ierosināto darbību vajadzībām, kuras minētas pirmajā daļā, personas datus, kas ietilpst 3. panta i) līdz iv) punkta kategorijās, var iekļaut muitu informācijas sistēmā vienīgi tad, ja īpaši ir pamatojums par iepriekš piekoptām nelikumīgām darbībām, ir faktiskas norādes, kas ļauj domāt, ka attiecīgā persona ir izdarījusi, izdara vai izdarīs smagus valsts likumu pārkāpumus.

6. pants

1. Ja tiek īstenotas 5. panta pirmajā daļā minētās ierosinātās darbības, šādas ziņas, pilnīgas vai daļējas, var tikt iegūtas un nosūtītas datu piegādātājdalībvalstij:

i) to, ka atrasta konkrēta prece, transportlīdzeklis, uzņēmums vai persona;

ii) kontroles vieta, laiks un iemesls;

iii) ceļojuma maršruts un mērķis;

iv) personas, kas ir kopā ar attiecīgo personu, vai personas attiecīgajā transportlīdzeklī;

v) izmantotais transportlīdzeklis;

vi) objekti, kas tiek transportēti;

vii) apstākļi, kādos tika atklāta prece, transportlīdzeklis, uzņēmums vai persona.

Gadījumā, kad šāda informācija ir iegūta, veicot diskrētu novērošanu, ir jāveic pasākumi, kas nodrošina, ka netiek apdraudēta novērošanas slepenība.

2. Sakarā ar īpašo kontroli, kas minēta 5. panta pirmajā daļā, personas, transportlīdzekļus un objektus var pārmeklēt, ciktāl to atļauj likumi, noteikumi un procedūras dalībvalstī, kur notiek pārmeklēšana. Ja kādas dalībvalsts likumi nepieļauj īpašo kontroli, minētā dalībvalsts to automātiski pārveido novērošanā un ziņošanā.

7. pants

1. Tieša pieeja muitu informācijas sistēmas datiem ir vienīgi katras dalībvalsts izraudzītajām valsts iestādēm. Šīs valsts iestādes ir muitu pārvaldes, bet var būt arī citas iestādes, kas saskaņā ar attiecīgās dalībvalsts likumiem, noteikumiem un procedūrām ir kompetentas rīkoties, lai sasniegtu mērķi, kas paredzēts 2. panta otrajā daļā.

2. Katra dalībvalsts nosūta pārējām dalībvalstīm un komitejai, kas minēta 16. pantā, saskaņā ar pirmo daļu izraudzīto kompetento iestāžu sarakstu, kam ir atļauts tieši piekļūt muitu informācijas sistēmas datiem, attiecībā uz katru iestādi norādot, kuriem datiem tai var būt pieeja un kādiem nolūkiem.

3. Atkāpjoties no noteikumiem pirmajā un otrajā daļā, dalībvalstis ar vienprātīgu nolīgumu var atļaut starptautiskām vai reģionālām organizācijām pieeju muitu informācijas sistēmai. Šāds nolīgums īstenojams kā protokols, ko pievieno šai konvencijai. Pieņemot savu lēmumu, dalībvalstis ņem vērā visus spēkā esošus divpusējus nolīgumus un atzinumus, ko sniegusi kopīgā pārraudzības iestāde, kas minēta 18. pantā, par datu aizsardzības pasākumu pietiekamību.

8. pants

1. Dalībvalstis var izmantot muitu informācijas sistēmas datus vienīgi tam, lai sasniegtu mērķi, kas paredzēts 2. panta otrajā daļā; tomēr ar iepriekšēju atļauju un ievērojot nosacījumus, ko paredz dalībvalsts, kas attiecīgos datus ievadījusi sistēmā, tās var izmantot tos administratīviem un citiem nolūkiem. Šāds cits izmantojums saskan ar likumiem, noteikumiem un procedūrām dalībvalstī, kura vēlas tos izmantot, un atbilst 5.5. principam Eiropas Padomes Ministru komitejas 1987. gada 17. septembra Ieteikumā R (87)15.

2. Neskarot šā panta pirmo un ceturto daļu un 7. panta trešo daļu, katrā dalībvalstī muitu informācijas sistēmas datus var izmantot tikai attiecīgās dalībvalsts izraudzītās valsts iestādes, kuras saskaņā ar likumiem, noteikumiem un procedūrām minētajā dalībvalstī ir kompetentas rīkoties, lai sasniegtu mērķus, kas paredzēti 2. panta otrajā daļā.

3. Katra dalībvalsts nosūta pārējām dalībvalstīm un komitejai, kas minēta 16. pantā, to iestāžu sarakstu, kuras tā ir izraudzījusi saskaņā ar otro daļu.

4. Muitu informācijas sistēmas datus, ar iepriekšēju atļauju un ievērojot nosacījumus, ko noteikusi dalībvalsts, kas šos datus ievadījusi sistēmā, var nosūtīt iestādēm, kas nav tās iestādes, kas izraudzītas saskaņā ar otro daļu, valstīm ārpus Kopienas, starptautiskām vai reģionālām organizācijām, kas vēlas tos izmantot. Katra dalībvalsts veic īpašus pasākumus, lai nodrošinātu šo datu drošību, kad tos pārraida vai piegādā dienestiem, kas atrodas ārpus to teritorijas. Šo pasākumu aprakstu nosūta kopīgajai pārraudzības iestādei, kas minēta 18. pantā.

9. pants

1. Datu iekļaušanu muitu informācijas sistēmā regulē datu piegādātājdalībvalsts likumi, noteikumi un procedūras, ja vien šī konvencija neparedz stingrākus noteikumus.

2. To, kā izmanto no muitu informācijas sistēmas iegūtus datus, tostarp to, kā veic kādu darbību saskaņā ar 5. pantu, kuru ierosinājusi datu piegādātājdalībvalsts, regulē likumi, noteikumi un procedūras dalībvalstī, kas izmanto šos datus, ja vien šī konvencija neparedz stingrākus noteikumus.

10. pants

1. Katra dalībvalsts izrauga kompetentu muitas pārvaldi, kas valstī atbild par muitu informācijas sistēmu.

2. Šī pārvalde atbild par to, lai attiecīgajā dalībvalstī muitu informācijas sistēmu izmantotu pareizi, un veic pasākumus, kas ir vajadzīgi, lai nodrošinātu atbilstību šīs konvencijas noteikumiem.

3. Dalībvalstis cita citai dara zināmu kompetento pārvaldi, kas paredzēta pirmajā daļā.

IV nodaļa

DATU GROZĪŠANA

11. pants

1. Tikai datu piegādātājdalībvalsts ir tiesīga grozīt, papildināt, labot vai dzēst datus, kurus tā ievadījusi muitu informācijas sistēmā.

2. Ja datu piegādātājdalībvalsts konstatē vai uzzina, ka dati, kurus tā ievadījusi, ir faktiski kļūdaini vai ka tie ievadīti un glabāti pretēji šai konvencijai, tā pēc vajadzības tos groza, papildina, labo vai dzēš un par to brīdina pārējās dalībvalstis.

3. Ja kādai no dalībvalstīm ir pierādījumi, kas liek domāt, ka dati daļēji tiešām ir kļūdaini vai tika iekļauti un tiek glabāti pretrunā ar šo konvenciju, cik drīz vien tas ir iespējams, tā par to brīdina datu piegādātājdalībvalsti. Pēdējā minētā valsts pārbauda attiecīgos datus un vajadzības gadījumā tūlīt labo vai dzēš konkrēto datu daļu. Datu piegādātājdalībvalsts brīdina pārējās dalībvalstis par visiem labojumiem un likvidācijām, ko tā veikusi.

4. Ja, ievadot datus muitu informācijas sistēmā, kāda dalībvalsts konstatē, ka tās ziņojums satura ziņā vai attiecībā uz ierosināto darbību ir pretrunā ar iepriekšējo ziņojumu, tā tūlīt brīdina dalībvalsti, kas veica iepriekšējo ziņojumu. Tad abas dalībvalstis mēģina jautājumu atrisināt. Gadījumā, ja nevar panākt vienošanos, pirmo ziņojumu saglabā, bet tās jaunā ziņojuma daļas, kas nav pretrunā ar pirmo ziņojumu, iekļauj sistēmā.

5. Ievērojot šīs konvencijas noteikumus, gadījumā, kad kādā dalībvalstī tiesa vai cita šīs dalībvalsts kompetenta iestāde pieņem galīgo lēmumu grozīt, papildināt, labot vai dzēst datus muitu informācijas sistēmā, attiecīgās dalībvalstis abpusēji uzņemas piemērot šādu lēmumu. Gadījumā, kad šādi lēmumi, kurus pieņēmušas tiesas vai citas kompetentas iestādes dažādās dalībvalstīs, tostarp 15. panta ceturtajā daļā paredzētie lēmumi attiecībā uz labojumu vai likvidāciju, ir pretrunīgi, dalībvalsts, kas ievadījusi konkrētos datus sistēmā, tos izdzēš.

V nodaļa

DATU GLABĀŠANA

12. pants

1. Muitu informācijas sistēmā iekļautus datus glabā tikai tik ilgi, cik tas ir vajadzīgs, lai sasniegtu mērķi, kura dēļ tie tika iekļauti. Datu piegādātājdalībvalsts vismaz reizi gadā pārbauda vajadzību tos saglabāt.

2. Datu piegādātājdalībvalsts pārbaudes laikā var izlemt saglabāt šos datus līdz nākošajai pārbaudei, ja tas ir vajadzīgs, lai sasniegtu mērķus, kuru dēļ šie dati tika iekļauti sistēmā. Neskarot 15. pantu, ja lēmums saglabāt datus netiek pieņemts, tos automātiski pārvieto uz to muitu informācijas sistēmas daļu, kurai pieeja ir ierobežota saskaņā ar ceturto daļu.

3. Kad saskaņā ar otro daļu ir paredzēta muitu informācijas sistēmā glabātu datu pārvietošana, par to muitu informācijas sistēma automātiski vienu mēnesi iepriekš informē datu piegādātājdalībvalsti.

4. Saskaņā ar otro daļu pārvietotus datus vienu gadu turpina glabāt muitu informācijas sistēmā, bet, neskarot 15. pantu, tie ir pieejami tikai 16. pantā minētās komitejas pārstāvim vai pārraudzības iestādēm, kas minētas 17. panta pirmajā daļā vai 18. panta pirmajā daļā. Šajā laikā tos var aplūkot vienīgi, lai pārbaudītu to precizitāti un likumību, pēc tam tie ir jāizdzēš.

VI nodaļa

PERSONAS DATU AIZSARDZĪBA

13. pants

1. Katra dalībvalsts, kas plāno iegūt personas datus no muitu informācijas sistēmas vai tos ievadīt muitu informācijas sistēmā, ne vēlāk par brīdi, kad stājas spēkā šī konvencija, pieņem attiecīgus valsts tiesību aktus, kas nodrošina tādu personas datu aizsardzības līmeni, kas ir vismaz līdzvērtīgs tam, ko paredz 1981. gada Strasbūras konvencijas principi.

2. Dalībvalsts var iegūt personas datus no muitu informācijas sistēmas vai tos tur ievadīt, kad šīs dalībvalsts teritorijā stājusies spēkā kārtība, kas paredzēta, lai aizsargātu pirmajā daļā minētos datus. Dalībvalsts arī iepriekš izrauga vienu vai vairākas valsts pārraudzības iestādes saskaņā ar 17. pantu.

3. Lai nodrošinātu to, ka pareizi piemēro šīs konvencijas datu aizsardzības noteikumus, katrā dalībvalstī muitu informācijas sistēmu uzskata par datu krātuvi, uz ko attiecas valsts noteikumi, kas minēti pirmajā daļā, un visi stingrāki noteikumi šajā konvencijā.

14. pants

1. Ievērojot 8. panta pirmo daļu, katra dalībvalsts gādā par to, lai tādu personas datu izmantojums, kas iegūti no muitu informācijas sistēmas, nolūkā, kas atšķiras no 2. panta otrajā daļā paredzētā mērķa, būtu pretrunā ar tās likumiem, noteikumiem un procedūrām.

2. Datus var pavairot vienīgi tehniskām vajadzībām ar nosacījumu, ka šāda kopija ir vajadzīga 7. pantā minēto iestāžu informācijas meklējumiem. Ievērojot 8. panta pirmo daļu, personas datus, ko ievadījusi cita dalībvalsts, nevar kopēt no muitu informācijas sistēmas citā valsts datu krātuvē.

15. pants

1. Personu tiesības attiecībā uz personas datiem muitu informācijas sistēmā, jo īpaši to piekļuves tiesības, tiek īstenotas saskaņā ar likumiem, noteikumiem un procedūrām dalībvalstī, kur šādas tiesības izmanto.

Ja attiecīgās dalībvalsts likumi, noteikumi un procedūras to paredz, 17. pantā paredzētā valsts pārraudzības iestāde lemj, vai ziņas ir jāsniedz un pēc kādas procedūras.

Dalībvalsts, kas nav piegādājusi attiecīgos datus, var nosūtīt datus vienīgi tad, ja tā vispirms devusi datu piegādātājdalībvalstij iespēju pieņemt savu nostāju.

2. Dalībvalsts, kam iesniegts pieteikums par pieeju personas datiem, atsaka pieeju, ja tas var kaitēt 5. panta pirmajā daļā minētajā ziņojumā norādītās darbības īstenošanai vai apdraudēt citu tiesības un brīvības. Pieeju atsaka vienmēr laikā, kad tiek veikta diskrēta novērošana vai novērošana un ziņošana.

3. Katrā dalībvalstī jebkura persona saskaņā ar attiecīgās dalībvalsts likumiem, noteikumiem un procedūrām var uzdot, lai tiktu izlaboti vai dzēsti personas dati, kas attiecas uz to, ja šie dati ir faktiski kļūdaini vai iekļauti un tiek glabāti muitu informācijas sistēmā pretēji mērķim, kas noteikts šīs konvencijas 2. panta otrajā daļā, vai noteikumiem 1981. gada Strasbūras konvencijas 5. pantā.

4. Katrā dalībvalstī jebkura persona saskaņā ar attiecīgās dalībvalsts likumiem, noteikumiem un procedūrām var iesniegt prasību vai, vajadzības gadījumā, sūdzību tiesā vai iestādē, kas ir kompetenta saskaņā ar šīs dalībvalsts likumiem, noteikumiem un procedūrām, sakarā ar personas datiem, kas attiecībā uz to iekļauti muitu informācijas sistēmā, lai

i) tiktu izlaboti vai dzēsti faktiski kļūdaini personas dati;

ii) lai tiktu izlaboti vai dzēsti personas dati, kas iekļauti vai tiek glabāti muitu informācijas sistēmā pretēji šai konvencijai;

iii) lai iegūtu pieeju personas datiem;

iv) lai iegūtu kompensāciju saskaņā ar 21. panta otro daļu.

Attiecīgās dalībvalstis uzņemas savstarpēji īstenot galīgos lēmumus, kurus pieņēmusi tiesa vai cita kompetenta iestāde saskaņā ar i), ii) un iii) punktu.

5. Norāde šajā pantā un 11. panta piektajā daļā uz "galīgu lēmumu" nenozīmē, ka dalībvalstij ir jāpārsūdz lēmums, ko pieņēmusi tiesa vai cita kompetenta iestāde.

VII nodaļa

IESTĀŽU SISTĒMA

16. pants

1. Izveido komiteju, ko veido dalībvalstu muitu pārvalžu pārstāvji. Savus lēmumus attiecībā uz otrās daļas pirmā ievilkuma noteikumiem komiteja pieņem vienprātīgi, bet lēmumus attiecībā uz otrās daļas otrā ievilkuma noteikumiem — ar divu trešdaļu balsu vairākumu. Komiteja apstiprina savu reglamentu ar vienprātīgu lēmumu.

2. Komiteja atbild

— par šīs konvencijas noteikumu izpildi un pareizu piemērojumu, neskarot 17. panta pirmajā daļā un 18. panta pirmajā daļā minēto iestāžu pilnvaras;

— par to, lai muitu informācijas sistēma tehniski un funkcionāli darbotos pareizi. Komiteja veic visus vajadzīgos pasākumus, lai nodrošinātu 12. un 19. pantā paredzēto pasākumu pareizu piemērojumu attiecībā uz muitu informācijas sistēmu. Šā panta piemērošanas nolūkā komitejai var būt tieša pieeja muitu informācijas sistēmā ievadītajiem datiem un tiesības tos izmantot.

3. Saskaņā ar Līguma par Eiropas Savienību VI sadaļu komiteja reizi gadā ziņo Padomei par to, cik efektīva ir muitu informācijas sistēma, un, vai tā darbojas pareizi, vajadzības gadījumā izvirzot priekšlikumus.

4. Komisija piedalās komitejas darbā.

VIII nodaļa

PERSONAS DATU AIZSARDZĪBAS PĀRRAUDZĪBA

17. pants

1. Katra dalībvalsts izrauga vienu vai vairākas valsts pārraudzības iestādes, kas atbild par personas datu aizsardzību, lai tās neatkarīgi pārraudzītu šāda tipa muitu informācijas sistēmā ievadītus datus.

Pārraudzības iestādes saskaņā ar attiecīgiem savas valsts likumiem veic neatkarīgu pārraudzību un pārbaudes, lai nodrošinātu, ka muitu informācijas sistēmā glabāto datu apstrāde un izmantojums nebūtu pretrunā ar attiecīgās personas tiesībām. Šai nolūkā pārraudzības iestādēm ir pieeja muitu informācijas sistēmai.

2. Jebkura persona no jebkuras valsts pārraudzības iestādes var prasīt, lai tā pārbaudītu muitu informācijas sistēmā ievadītus personas datus, kas attiecas uz viņu, un to, kā minētie dati tiek izmantoti. Minētās tiesības regulē likumi, noteikumi un procedūras dalībvalstī, kur veikts attiecīgais pieprasījums. Ja šos datus ievadījusi cita dalībvalsts, pārbaudi veic ciešā sadarbībā ar šīs citas dalībvalsts pārraudzības iestādi.

18. pants

1. Izveido kopīgu pārraudzības iestādi. To veido divi pārstāvji no katras dalībvalsts, kuri nāk no vienas vai vairākām neatkarīgām valsts pārraudzības iestādēm katrā no šīm valstīm.

2. Kopīgā pārraudzības iestāde veic savu uzdevumu saskaņā ar šīs konvencijas noteikumiem un 1981. gada Strasbūras konvencijas noteikumiem, ņemot vērā Eiropas Padomes Ministru komitejas 1987. gada 17. septembra Ieteikumu R (87)15.

3. Kopīgā pārraudzības iestāde ir kompetenta pārraudzīt muitu informācijas sistēmas darbību, pārbaudīt visas piemērojuma vai iztulkošanas grūtības, kas var rasties sistēmas darbības laikā, izpētīt grūtības, kas var rasties sakarā ar neatkarīgo pārraudzību, ko īsteno dalībvalstu pārraudzības iestādes, vai īstenojot indivīdu sistēmpieejas tiesības, kā arī izstrādāt priekšlikumus, lai rastu kopīgus problēmu risinājumus.

4. Lai kopīgā pārraudzības iestāde varētu veikt savus uzdevumus, tai ir pieeja muitu informācijas sistēmai.

5. Kopīgās pārraudzības iestādes izstrādātos ziņojumus pārsūta iestādēm, kam valsts pārraudzības iestādes iesniedz savus ziņojumus.

IX nodaļa

MUITU INFORMĀCIJAS SISTĒMAS DROŠĪBA

19. pants

1. Visus nepieciešamos administratīvos drošības pasākumus

i) attiecībā uz muitu informācijas sistēmas termināļiem savās valstīs veic dalībvalstu kompetentās iestādes;

ii) attiecībā uz muitu informācijas sistēmu un termināļiem, kas atrodas tajās pašās telpās, kur atrodas sistēma un ko izmanto tehniskām vajadzībām un trešajā daļā paredzētajām pārbaudēm, veic komiteja, kas minēta 16. pantā.

2. Jo īpaši kompetentās iestāde un 16. pantā minētā komiteja veic pasākumus:

i) lai personas bez atļaujas nevarētu piekļūt iekārtām, ko izmanto datu apstrādei;

ii) lai personas bez atļaujas nevarētu lasīt, kopēt, grozīt vai likvidēt datus vai datu nesējus;

iii) lai nepieļautu, ka datus ievada, iegūst, groza vai dzēš neatļauti;

iv) lai personām bez atļaujas nebūtu pieejas muitu informācijas sistēmas datiem, izmantojot datu pārraides iekārtas;

v) lai attiecībā uz muitu informācijas sistēmas izmantojumu garantētu, ka personām ar atļaujām būtu pieejas tiesības, kas ļauj piekļūt tikai tiem datiem, kas atbilst to kompetencei;

vi) lai garantētu, ka to, kurām iestādēm var pārraidīt datus ar datu pārraides iekārtām, var pārbaudīt un konstatēt;

vii) lai garantētu, ka pēc datu ievadīšanas var pārbaudīt un konstatēt, kādi dati ievadīti muitu informācijas sistēmā, kad un kas to ir veicis, kā arī pārraudzīt šo datu apskati;

viii) lai novērstu to, ka laikā, kad pārraida datus vai transportē datu nesējus, var neatļauti nolasīt, nokopēt, grozīt vai dzēst datus.

3. Komiteja, kas minēta 16. pantā, pārrauga muitu informācijas sistēmas datu apskatu, lai pārbaudītu, vai veiktie meklējumi bija atļauti un vai tos veikuši lietotāji ar atļaujām. Pārbauda vismaz 1% veikto meklējumu. Šo meklējumu un šo pārbaužu pārskatu ievada sistēmā, un tas kalpo vienīgi iepriekš minētajām pārbaudēm, ko veic 16. pantā paredzētā komiteja un 17. un 18. pantā paredzētās pārraudzības iestādes, un to dzēš pēc sešiem mēnešiem.

20. pants

Kompetentās muitas pārvaldes, kas minētas šīs konvencijas 10. panta pirmajā daļā, atbild par 19. pantā paredzētajiem drošības pasākumiem attiecībā uz termināļiem, kas atrodas attiecīgās dalībvalsts teritorijā, pārbaudēm, kas paredzētas 12. panta pirmajā un otrajā daļā, kā arī par šīs konvencijas pareizu piemērojumu, ciktāl tas ir vajadzīgs saskaņā ar attiecīgās dalībvalsts likumiem, noteikumiem un procedūrām.

X nodaļa

ATBILDĪBA UN PIENĀKUMI

21. pants

1. Katra dalībvalsts atbild par to, lai dati, ko tā ievadījusi muitu informācijas sistēmā, būtu precīzi, aktuāli un saskaņā ar likumu. Katra dalībvalsts atbild arī par to, lai būtu izpildīti 1981. gada Strasbūras konvencijas 5. panta noteikumi.

2. Katra dalībvalsts saskaņā ar saviem likumiem, noteikumiem un procedūrām atbild par kaitējumu, kas nodarīts kādai personai sakarā ar muitu informācijas sistēmas izmantojumu attiecīgajā dalībvalstī.

Tas pats attiecas uz gadījumiem, kad kaitējums nodarīts sakarā ar to, ka datu piegādātājdalībvalsts ievadījusi kļūdainus datus vai ievadījusi tos pretēji šai konvencijai.

3. Ja dalībvalsts, pret kuru izvirzīta prasība sakarā ar kļūdainiem datiem, nav dalībvalsts, kas sniegusi šos datus, konkrētās dalībvalstis mēģina vienoties par kompensācijas summu varbūtējo proporciju, ko dalībvalsts, kas piegādājusi šos datus, atmaksā šai citai dalībvalstij. Šādi apstiprinātas summas atmaksā pēc pieprasījuma.

22. pants

1. Katra dalībvalsts sedz izdevumus sakarā ar muitu informācijas sistēmas darbību, kas rodas, dalībvalstīm izmantojot muitu informācijas sistēmu savās teritorijās.

2. Dalībvalstis sedz pārējos izdevumus, kas radušies, īstenojot šo konvenciju, izņemot tos, kurus nevar nošķirt no muitu informācijas sistēmas darbības Kopienas muitas un lauksaimniecības noteikumu piemērošanas nolūkiem. Katras dalībvalsts iemaksas daļu nosaka saskaņā ar nacionālā kopprodukta attiecību pret dalībvalstu nacionālo kopproduktu kopsummu par gadu pirms gada, kurā radušies izdevumi.

Šajā daļā "nacionālais kopprodukts" ir nacionālais kopprodukts, ko nosaka saskaņā ar Padomes 1989. gada 13. februāra Direktīvu 89/130/EEK, Euratom par to, kā saskaņojama nacionālā kopprodukta apkopošana tirgus cenās 1, vai visiem citiem Kopienas instrumentiem, kas to groza vai aizstāj.

XI nodaļa

PIEMĒROJUMS UN NOBEIGUMA NOTEIKUMI

23. pants

Dalībvalstu iestādes tieši apmainās ar informāciju, ko sniedz saskaņā ar konvenciju.

24. pants

1. Šo konvenciju pieņem dalībvalstis saskaņā ar to attiecīgajām konstitucionālajām prasībām.

2. Dalībvalstis informē Eiropas Savienības Padomes ģenerālsekretāru par konstitucionālo prasību izpildi šīs konvencijas pieņemšanai.

3. Šī konvencija stājas spēkā deviņdesmit dienas pēc tam, kad pēdējā dalībvalsts ir iesniegusi otrajā daļā norādīto paziņojumu par šīs formalitātes izpildi.

25. pants

1. Šai konvencijai var pievienoties jebkura valsts, kas kļuvusi par Eiropas Savienības dalībvalsti.

2. Šīs konvencijas tekstam, ko sagatavojusi Eiropas Savienības Padome, ir jābūt autentiskam tās valsts valodā, kas pievienojusies.

3. Pievienošanās dokumenti glabājas depozitārijā.

4. Šī konvencija stājas spēkā attiecībā uz jebkuru tai pievienojušos valsti deviņdesmit dienas pēc datuma, kad deponēts pievienošanās dokuments vai konvencijas spēkā stāšanās datumā, ja tā vēl nav stājusies spēkā minētā deviņdesmit dienu perioda izbeigšanās laikā.

26. pants

1. Eiropas Savienības Padomes ģenerālsekretārs darbojas kā šīs konvencijas depozitārijs.

2. Depozitārijs publicē "Eiropas Kopienu Oficiālajā Vēstnesī" informāciju par dokumentu pieņemšanas un pievienošanās gaitu, deklarācijām un atrunām, kā arī visus citus paziņojumus attiecībā uz šo konvenciju.

27. pants

1. Visi dalībvalstu strīdi par šīs konvencijas iztulkošanu vai piemērošanu sākotnēji ir jāizskata Padomē saskaņā ar Līguma par Eiropas Savienību VI sadaļā noteikto kārtību nolūkā panākt risinājumu.

Ja sešu mēnešu laikā risinājums nav atrasts, viena no strīdā iesaistītajām pusēm šajā jautājumā var vērsties Eiropas Kopienu Tiesā.

2. Sakarā ar jebkuru strīdu, kas radies starp vienu vai vairākām dalībvalstīm un Eiropas Kopienu Komisiju, par šīs konvencijas piemērojumu, ko nevar atrisināt sarunu ceļā, var vērsties Tiesā.

Eiropas Savienības dalībvalstis un 1995. gada 26. jūlija Konvencijas par informācijas tehnoloģiju izmantošanu muitas vajadzībām, kas izstrādāta, pamatojoties uz Līguma par Eiropas Savienību K 3.pantu, (turpmāk — "Konvencija") parakstītāji,

ŅEMOT VĒRĀ Konvencijas iepriekšējas piemērošanas svarīgumu;

IEVĒROJOT to, ka Līguma par Eiropas Savienību K 7. pants, šī līguma VI daļas noteikumi neliedz ciešākas sadarbības veidošanu vai attīstību starp divām vai vairākām dalībvalstīm tiktāl, cik šāda sadarbība nav pretrunā ar minētā līguma VI daļu vai neierobežo to;

IEVĒROJOT to, ka Konvencijas pagaidu piemērošana starp noteiktām Eiropas Savienības dalībvalstīm nebūs pretrunā ar Līguma par Eiropas Savienību VI daļā paredzēto sadarbību vai neierobežos to,

IR VIENOJUŠĀS PAR SEKOJOŠO:

1.pants

Šajā līgumā:

— "Konvencija" ir konvencija par informācijas tehnoloģiju izmantošanu muitas vajadzībām, kas izstrādāta, pamatojoties uz Līguma par Eiropas Savienību K 3.pantu,

— "Augstās līgumslēdzējas puses" ir Eiropas Savienības dalībvalstis, Konvencijas dalībnieces,

— "Puses" ir Eiropas Savienības dalībvalstis, šī līguma dalībnieces.

2.pants

Konvenciju starp Augstajām līgumslēdzējām pusēm — šī līguma dalībniecēm, jāpiemēro pagaidām ar trešā mēneša pirmo dienu pēc tam, kad astoņas Augstākās līgumslēdzējas puses ir nodevušas glabāšanā dokumentu par šī Līguma apstiprināšanu, akceptēšanu vai ratificēšanu.

3.pants

Pārejas noteikumus, kas nepieciešami Konvencijas pagaidu piemērošanai, pieņem pēc to Augsto līgumslēdzēju pušu kopējās vienošanās, attiecībā uz kurām Konvencija tiek piemērota pagaidām, un konsultējoties ar citām Augstajām līgumslēdzējām pusēm. Pagaidu piemērošanas laikā Augstās līgumslēdzējas puses, kas darbojas pēc kopējas vienošanās ciešā saiknē ar Eiropas Savienības Komisiju, realizē Komitejas funkcijas, kas paredzētas Konvencijas 16.pantā. Konvencijas 7.panta trešajai daļai un 16.pantam šī perioda laikā nav jābūt izpildītam.

4.pants

1. Šis līgums ir atvērts to dalībvalstu parakstīšanai, kuras ir parakstījušas Konvenciju. Tas ir apstiprināšanas, akceptēšanas vai ratifikācijas objekts. Tas stājas spēkā trešā mēneša pirmajā dienā pēc tam, kad astoņas Augstās līgumslēdzējas puses ir nodevušas glabāšanā dokumentu par apstiprināšanu, akceptēšanu vai ratificēšanu.

2. Attiecībā uz katru Augsto līgumslēdzēju pusi, kura ir nodevusi glabāšanā dokumentu par apstiprināšanu, akceptēšanu vai ratificēšanu vēlāk par šo datumu, šis līgums stājas spēkā trešā mēneša pirmajā dienā pēc šādas nodošanas.

3. Dokumenti par apstiprināšanu, akceptēšanu vai ratifikāciju jānodod glabāšanā Eiropas Savienības Padomes Ģenerālsekretāram, kurš darbojas kā depozitārijs.

5.pants

Šo līgumu, kas vienā eksemplārā izstrādāts dāņu, holandiešu, angļu, somu, franču, vācu, grieķu, īru, itāļu, portugāļu, spāņu un zviedru valodā, kuru teksts ir vienādi autentisks, nodod glabāšanā Eiropas Savienības Padomes Ģenerālsekretāram, kurš nosūta apstiprinātu kopiju katrai no pusēm.

6.pants

Ar Konvencijas stāšanos spēkā šis Līgums zaudē spēku.

To apliecinot, attiecīgi pilnvarotas personas ir parakstījušas šo līgumu.

Parakstīts Briselē tūkstoš deviņsimt deviņdesmit piektā gada divdesmit sestajā jūlijā vienā eksemplārā dāņu, holandiešu, angļu, somu, franču, vācu, grieķu, īru, itāļu, portugāļu, spāņu un zviedru valodā, kuru teksts ir vienādi autentisks, nododot šo oriģinālu glabāšanā Eiropas Savienības Padomes Ģenerālsekretāra arhīvos.

PROTOKOLS par Eiropas Kopienu Tiesas sniegto Konvencijas par informācijas tehnoloģiju izmantošanu muitas vajadzībām iztulkošanu, pieņemot prejudiciālus nolēmumus, kas izstrādāts, pamatojoties uz Līguma par Eiropas Savienību K 3.pantu,

AUGSTĀS LĪGUMSLĒDZĒJAS PUSES,

IR VIENOJUŠĀS par šādiem noteikumiem, kurus jāpievieno Konvencijai:

1.pants

Eiropas Kopienu Tiesai tiek piešķirta jurisdikcija saskaņā ar noteikumiem, kas paredzēti šajā Protokolā, pieņemt prejudiciālus nolēmumus attiecībā uz Konvencijas par informācijas tehnoloģiju izmantošanu muitas vajadzībām iztulkošanu.

2.pants

1. Ar deklarācijas sniegšanu šī Protokola parakstīšanas laikā vai jebkurā laikā pēc tam, katrai dalībvalstij jāakceptē Eiropas Kopienu Tiesas jurisdikcija pieņemt prejudiciālus nolēmumus attiecībā uz Konvencijas par informācijas tehnoloģiju izmantošanu muitas vajadzībām iztulkošanu saskaņā ar otrās daļas "a" vai "b" punktā minētajiem noteikumiem.

2. Dalībvalsts, sniedzot deklarāciju saskaņā ar pirmo daļu, var norādīt, ka:

a) šīs valsts jebkura tiesa vai tribunāls, pret kuru nolēmumiem saskaņā ar nacionālo likumdošanu nav atbilstošu tiesas līdzekļu, var pieprasīt Eiropas Kopienu Tiesai pieņemt prejudiciālu nolēmumu attiecībā uz jautājumu, kas radies izskatāmā lietā pirms tās iztiesāšanas, un saistībā ar Konvencijas par informācijas tehnoloģiju izmantošanu muitas vajadzībām iztulkošanu, ja šī tiesa vai tribunāls nolemj, ka nolēmums par šo jautājumu ir nepieciešams, lai varētu pieņemt spriedumu, vai

b) šīs valsts jebkura tiesa vai tribunāls var pieprasīt Eiropas Kopienu Tiesai sniegt prejudiciālu nolēmumu par jautājumu, kas radies izskatāmā lietā pirms tās iztiesāšanas un saistībā ar Konvencijas par informācijas tehnoloģiju izmantošanu muitas vajadzībām iztulkošanu, ja šī tiesa vai tribunāls nolemj, ka nolēmums par šo jautājumu ir nepieciešams, lai varētu pieņemt spriedumu.

3.pants

1. Tiek piemērots Protokols par Eiropas Kopienu Tiesas statūtiem un šīs tiesas procesuālajiem noteikumiem.

2. Saskaņā ar Eiropas Kopienu Tiesas statūtiem katra dalībvalsts, neatkarīgi no tā, vai tā ir sniegusi deklarāciju saskaņā ar 2.pantu vai nav, ir tiesīga Eiropas Kopienu Tiesai iesniegt lietas pārskatu vai rakstiskas piezīmes gadījumos, kas izriet no 1.panta.

4.pants

1. Šo Protokolu pieņem dalībvalstis saskaņā ar to attiecīgajām konstitucionālajām prasībām.

2. Dalībvalstis informē depozitāriju par to attiecīgo konstitucionālo prasību izpildi šī Protokola pieņemšanai un tam pievieno katru deklarāciju, kas sniegta saskaņā ar 2.pantu.

3. Šis protokols stājas spēkā 90 dienas pēc tam, kad pēdējā dalībvalsts, kura ir Eiropas Savienības dalībvalsts laikā, kad Padome pieņēmusi Aktu, ar ko izstrādā šo Protokolu, ir iesniegusi otrajā daļā norādīto deklarāciju par šīs formalitātes izpildi. Tomēr, tas visātrāk var stāties spēkā tajā pašā laikā, kad stājas spēkā Konvencija par informācijas tehnoloģiju izmantošanu muitas vajadzībām.

5.pants

1. Protokolam var pievienoties jebkura valsts, kura ir kļuvusi par Eiropas Savienības dalībvalsti.

2. Pievienošanās dokumenti glabājas depozitārijā.

3. Šī Protokola tekstam, ko sagatavojusi Eiropas Savienības Padome, ir jābūt autentiskam tās valsts valodā, kura pievienojas.

4. Šis Protokols stājas spēkā attiecībā uz jebkuru tai pievienojušos valsti deviņdesmit dienas pēc datuma, kad deponēts pievienošanās instruments vai šī Protokola spēkā stāšanās datumā, ja tas vēl nav stājies spēkā minētā deviņdesmit dienu perioda izbeigšanās laikā.

6.pants

Katra valsts, kura kļūst par Eiropas Savienības dalībvalsti un pievienojas Konvencijai par informācijas tehnoloģiju izmantošanu muitas vajadzībām saskaņā ar 25.pantu, akceptē šī Protokola noteikumus.

7.pants

1. Grozījumus šajā Protokolā var ierosināt jebkura dalībvalsts, kura ir Augstā līgumslēdzēja puse. Katru ierosinājumu grozīt Protokolu nosūta depozitārijam, kurš to nosūta Padomei.

2. Grozījumus pieņem Padome, kura ierosina, ka dalībvalstīm tos jāpieņem saskaņā ar viņu attiecīgajām konstitucionālajām prasībām.

3. Pieņemtie grozījumi stājas spēkā saskaņā ar 4.panta noteikumiem.

8.pants

1. Eiropas Savienības Padomes Ģenerālsekretārs darbojas kā šī Protokola depozitārijs.

2. Depozitārijs publicē Eiropas Kopienu Oficiālajā Vēstnesī ar šo Protokolu saistītos paziņojumus vai instrumentus.

To apliecinot, attiecīgi pilnvarotas personas ir parakstījušas šo protokolu.

Atzīstot gatavību atbilstoši rīkoties, lai nodrošinātu, ka nacionālās procedūras Konvencijas par informācijas tehnoloģiju izmantošanu muitas vajadzībām un Protokola, kas attiecas uz tās iztulkošanu, pieņemšanai ir vienlaicīgi izpildītas, cik ātri vien iespējams.

Deklarācija, kas sniegta saskaņā ar Protokola 2.pantu

Šī Protokola parakstīšanas laikā zemāk minētās valstis deklarē, ka tās akceptē Eiropas Kopienu Tiesas jurisdikciju saskaņā ar Protokola 2.pantā minēto kārtību:

Īrija un Portugāles Republika saskaņā ar kārtību, kas minēta Protokola 2.panta otrās daļas "a" punktā;

Vācijas Federatīvā Republika, Grieķijas Republika, Francijas Republika, Nīderlandes Karaliste, Austrijas Republika, Somijas Republika un Zviedrijas Karaliste saskaņā ar kārtību, kas minēta Protokola 2.panta otrās daļas "b" punktā.

DEKLARĀCIJA

Vācijas Federatīvā Republika, Grieķijas Republika, Nīderlandes Karaliste un Austrijas Republika saglabā tiesības paredzēt savā nacionālajā likumdošanā, ka, ja lietā, kuru nav iztiesājusi nacionālā tiesa vai tribunāls, kuru nolēmumiem saskaņā ar nacionālo likumdošanu nav atbilstošu tiesas līdzekļu, rodas jautājums saistībā ar Konvencijas par informācijas tehnoloģiju izmantošanu muitas vajadzībām iztulkošanu, šī tiesa vai tribunāls prasīs nodot lietu Eiropas Kopienu Tiesai.

Dānijas Karaliste un Spānijas Karaliste sniegs deklarāciju pieņemšanas laikā.
