Amendment N° 1

to FINANCING MEMORANDUM

of Agreed between the Republic of Latvia and the European Commission Concerning the grant of assistance from the Instrument for Structural Policies for Pre-accession to the following measure Technical Assistance of the environmental projects located in Latvia

Whereas the Financing Memorandum “Technical Assistance of the environmental projects” located in Latvia was signed respectively by the European Commission on 12 September 2001 and by the Government of Latvia on 29 November 2001;

Whereas the Government of Latvia sent to the European Commission on 8August 2003 a request for modification aiming at changing of scope of work and extension of the end date of the measure;

Whereas the European Commission accepts said modification,

The European Commission, hereinafter referred to as “the Commission”, acting for and on behalf of the European Community, hereinafter referred to as “the Community” represented by Mr Graham Meadows, Acting Director General for Regional Policy.

on the one part, and

The Government of the Republic of Latvia, hereinafter referred to as “the beneficiary”

on the other part,

have agreed as follows:

The Financing Memorandum concerning the ISPA grant to the measure “Technical Assistance of the environmental projects” located in Latvia” (N° 2000/LV/16/P/PA/001) is hereby amended as follows:

“Article 2

Identification of the measure

Annex I appended to the Financing Memorandum is modified by the modifications mentioned in the attached Annex I.

Duration: End date now reads: 31 December 2007

Location: Location now reads: Daugava, Gauja and Salaca river basins, city of Rezekne, Maliena region, Kuldiga/Riga/Jekabpils districts, East and South Latgale.

Article 4

Payments

Paragraph 7, now reads:

The measure described in Annex I and payments by the body responsible for the implementation of the measure shall be completed no later than 31st December 2007”.

2. The authentic text of this Amendment n°1 to the financing memorandum is the present document as signed hereunder to which a new description of the measure is appended as Annex I and the amended financing plan as Annex II. All other provisions in the original financing memorandum remain unchanged.
